which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name>, and in addition to the Committees on <committee-name committee-id="HGO00">Oversight and Accountability</committee-name>, and <committee-name committee-id="HAP00">Appropriations</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to provide for the continuing operation of national cemeteries during periods of certain funding restrictions, and for other purposes.</official-title></form><legis-body id="H65CA3A66D8164D8799A168399D42D47B" style="OLC"><section id="H18B4BE2B805F466687618F84AA9FB3AE" section-type="section-one"><enum>1.</enum><header>Continuing operation of national cemeteries</header><subsection id="H43CF99F086FA4A5391287C75ADCD502E"><enum>(a)</enum><header>Continuing operations</header><text display-inline="yes-display-inline">Section 2404 of title 38, United States Code, as most recently amended by section 3 of the National Cemeteries Preservation and Protection Act of 2022 (<external-xref legal-doc="public-law" parsable-cite="pl/117/355">Public Law 117–355</external-xref>), is further amended by adding at the end the following:</text><quoted-block style="USC" id="HC0D8879E9FC54D868B703803BEA8427D" display-inline="no-display-inline"><subsection id="H53506F7ECFA04DF6A59ACA315C8B99B3"><enum>(j)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H1D4B1A0E9CEF490FB3FF16F0452AFA6C"><enum>(1)</enum><text>The Secretary shall ensure that all national cemeteries remain open, and shall continue to maintain such cemeteries, during any—</text><subparagraph id="H5ED380A6CF1C4D4CB3D2950C7EE668EF" indent="up1"><enum>(A)</enum><text>period that obligations may not be issued without exceeding the debt subject to limit under section 3101 of title 31; or </text></subparagraph><subparagraph id="HBC52B9D4914D431994360E47452735C6" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">lapse in discretionary appropriations for the Department on or after the date of enactment of this subsection.</text></subparagraph></paragraph><paragraph id="HDA683420C01F45E789A635FE62214669" indent="up1"><enum>(2)</enum><text>The Secretary may transfer any amounts as the Secretary determines necessary from any discretionary or direct spending account of the Department for the purpose of carrying out paragraph (1).</text></paragraph><paragraph id="HD975D4645DDF4464805E1E2B64074047" indent="up1"><enum>(3)</enum><text>If a national cemetery closes for any period of time during a period referred to in paragraph (1), the Secretary shall submit to Congress and to the Secretary of the Treasury a report that identifies any national cemetery that was closed and the number of days such cemetery was closed.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9656134D051248F191F94F85CAF5F2BE"><enum>(b)</enum><header>TSP G-Fund reduction</header><paragraph id="H41187C63B75047D79D3CB9E636643E53"><enum>(1)</enum><header>CSRS</header><text display-inline="yes-display-inline">Section 8348(j)(5)(B) of title 5, United States Code, is amended to read as follows:</text><quoted-block style="USC" id="HF9E19BCC11B549DD8CDC4FCBDD2900C0" display-inline="no-display-inline"><subparagraph id="H1C3C957982A34B3BBA3869615EC3EA7B"><enum>(B)</enum><text display-inline="yes-display-inline">the term <quote>debt issuance suspension period</quote> means any period of days equal to—</text><clause id="H52E8EA4D2ED04C6CB72367C84206EC60"><enum>(i)</enum><text>the period for which the Secretary of the Treasury determines for purposes of this subsection that the issuance of obligations of the United States may not be made without exceeding the public debt limit, minus</text></clause><clause id="H1C9DF577BEAD400C97D1E96E22235E46"><enum>(ii)</enum><text>the number of days any national cemetery was closed, as determined under section 2404(j)(3) of title 38.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H7A15C1FAF9704BD98C4EFA67356552AB"><enum>(2)</enum><header>FERS</header><text>Section 8438(g)(6)(B) of such title is amended to read as follows:</text><quoted-block style="USC" id="HEFF38243BE33401B8389D61712F0BC98" display-inline="no-display-inline"><subparagraph id="H296B56D2D40745FB95B9758B5CC51A65"><enum>(B)</enum><text display-inline="yes-display-inline">the term <quote>debt issuance suspension period</quote> means any period of days equal to—</text><clause id="H3F896CDA6A0A4BDD80720243A5978CA5"><enum>(i)</enum><text>the period for which the Secretary of the Treasury determines for purposes of this subsection that the issuance of obligations of the United States may not be made without exceeding the public debt limit, minus</text></clause><clause id="HB69A3BEAD89244118E4F9717197FCB67"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of days any national cemetery was closed, as determined under section 2404(j)(3) of title 38.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
