R. 3347</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230515">May 15, 2023</action-date><action-desc><sponsor name-id="S001157">Mr. David Scott of Georgia</sponsor> (for himself, <cosponsor name-id="T000463">Mr. Turner</cosponsor>, <cosponsor name-id="G000597">Mr. Garbarino</cosponsor>, and <cosponsor name-id="C001067">Ms. Clarke of New York</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the Secretary of Veterans Affairs from replacing physician anesthesiologists with certified registered nurse anesthetists under the health care system of the Department of Veterans Affairs, and for other purposes.</official-title></form><legis-body id="H4A5B928DBA304A2CB33BD076DB65F3F7" style="OLC"><section id="H58833280861E4F649B700BC330D0A29D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect Lifesaving Anesthesia Care for Veterans Act of 2023</short-title></quote>.</text></section><section id="H72F0EA868B9945F494FD7ED0F24351FD"><enum>2.</enum><header>Prohibition on replacement of physician anesthesiologists under health care system of Department of Veterans Affairs</header><subsection id="H5C549D5086AE414B8193FFA5BA5428A3"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs may not—</text><paragraph id="H485E0EA62C6949B7B5DFBE41047DAFDB"><enum>(1)</enum><text display-inline="yes-display-inline">modify the policy of the Department of Veterans Affairs relating to anesthesia care in a manner that would provide any medical professional other than a physician anesthesiologist with full practice authority for the furnishment of anesthesia care to veterans under the laws administered by the Secretary (including by providing certified registered nurse anesthetists with such full practice authority); or</text></paragraph><paragraph id="HC3FC4FF14C004297968FC275FC525125"><enum>(2)</enum><text display-inline="yes-display-inline">finalize, implement, or enforce the provisions relating to anesthesia care of the proposed rule titled <quote>Advanced Practice Registered Nurses</quote> and published in the Federal Register on May 25, 2016 (81 Fed. Reg. 33155), or any substantially similar rule.</text></paragraph></subsection><subsection id="HFF6EF78C15CA4BCDA2EDFA809030F5E5"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to limit the authority of the Secretary of Veterans Affairs to issue any short-term emergency order relating to the safety, care, or well-being of veterans during surgical procedures.</text></subsection></section></legis-body></bill>
