<section display-inline="no-display-inline" id="H4116D438205E40B18D27F1D7420870D4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disabled Veterans Tax Termination Act</short-title></quote>.</text></section> <section id="H5CE5800B7D8E49EE9561D3ADCC80C133"><enum>2.</enum><header>Concurrent receipt of both retired pay and veterans’ disability compensation for military retirees with compensable service-connected disabilities</header> <subsection id="HF5E767C7B0B849ABA4C3A34918E956A9"><enum>(a)</enum><header>Inclusion of Retirees With Service-Connected Disabilities Rated Less Than 50 Percent</header><text>Section 1414(a) of title 10, United States Code, is amended—</text>
<paragraph id="H21F95A40411D4A32B2BEE3BDC6638404"><enum>(1)</enum><text>by striking <quote><header-in-text level="subsection" style="OLC">Compensation</header-in-text></quote> in the subsection heading and all that follows through <quote>Subject</quote> and inserting <quote><header-in-text level="subsection" style="OLC">Compensation</header-in-text>.—Subject</quote>;</text></paragraph> <paragraph id="H5B8DCDEA35B7443BAAF4BF6F60B87563"><enum>(2)</enum><text>by striking <quote>qualifying service-connected disability</quote> and inserting <quote>service-connected disability</quote>; and</text></paragraph>
<paragraph id="H88E7D8D7254049729D9495A824E08C93"><enum>(3)</enum><text>by striking paragraph (2).</text></paragraph></subsection> <subsection id="HDC2E47E5A250400BA2ECFE06044014A8"><enum>(b)</enum><header>Inclusion of disability retirees with less than 20 years of service</header><text display-inline="yes-display-inline">Section 1414(b) of title 10, United States Code, is amended—</text>
<paragraph id="H39A7FE41586C434690E824B4B3C93780"><enum>(1)</enum><text>in paragraph (1), by striking <quote>member retired</quote> and inserting <quote>qualified retiree who is retired</quote>; and</text></paragraph> <paragraph id="HF42A2478BA0A4C698981EE2E07B191D8"><enum>(2)</enum><text>by striking paragraph (2) and inserting the following new paragraph:</text>

<paragraph id="H5057D45985D74929A31C97066253FB4B"><enum>(2)</enum><header>Disability retirees with less than 20 years of service</header><text display-inline="yes-display-inline">The retired pay of a qualified retiree who is retired under chapter 61 of this title with fewer than 20 years of creditable service is subject to reduction under sections 5304 and 5305 of title 38, but only by the amount (if any) by which the amount of the member’s retired pay under such chapter exceeds the amount equal to 2½ percent of the member’s years of creditable service multiplied by the member’s retired pay base under section 1406(b)(1) or 1407 of this title, whichever is applicable to the member.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H29803D63C501499E92EC709671536544"><enum>(c)</enum><header>Conforming amendments reflecting end of Concurrent Receipt phase-In period</header><text display-inline="yes-display-inline">Section 1414 of title 10, United States Code, is further amended—</text>
<paragraph id="H970F21BE158C482EB0DC99C82BE9FD6B"><enum>(1)</enum><text>in subsection (a), as amended by subsection (a) of this section, by striking the final sentence;</text></paragraph> <paragraph id="H2DDE360E60AC42D497513880987FDB0E"><enum>(2)</enum><text>by striking subsection (c) and redesignating subsections (d) and (e) as subsections (c) and (d), respectively; and</text></paragraph>
<paragraph id="H269164E77B99418E8B22B3B99BEFF581"><enum>(3)</enum><text>in subsection (d), as so redesignated, by striking paragraphs (3) and (4).</text></paragraph></subsection> <subsection id="H2B38C5D97AD142308E33AA856DBB6911"><enum>(d)</enum><header>Clerical Amendments</header> <paragraph id="H89FDDB359D2641A1968825BA97A5352F"><enum>(1)</enum><header>Section heading</header><text display-inline="yes-display-inline">The heading for section 1414 of title 10, United States Code, is amended to read as follows:</text>

<paragraph id="H20ABAB1A4A2D42F4A6EADDFA3720CE51"><enum>(2)</enum><header>Table of sections</header><text display-inline="yes-display-inline">The item relating to such section in the table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/71">chapter 71</external-xref> of title 10, United States Code, is amended to read as follows:</text> <quoted-block id="H5733795E8653482F9B50D971537F8CC9" style="OLC"> <toc regeneration="no-regeneration"> <toc-entry level="section">1414. Members eligible for retired pay who are also eligible for veterans’ disability compensation: concurrent payment of retired pay and disability compensation.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H7CC5AE96DA9D409D887C914F2ABC1108"><enum>(e)</enum><header>Conforming amendment reflecting subsection redesignation</header><text display-inline="yes-display-inline">Section 1413a(f) of title 10, United States Code, is amended by striking <quote>Subsection (d)</quote> and inserting <quote>Subsection (c)</quote>.</text></subsection>
<subsection id="H532178569F774230B653E00DD2C604E7"><enum>(f)</enum><header>Effective Date</header><text>The amendments made by this section shall take effect on the first day of the first month beginning after the date of the enactment of this Act and shall apply to payments for months beginning on or after that date.</text></subsection></section> </legis-body></bill>
