establish a Border Enforcement Security Task Force unit to investigate transnational criminal organization arms smuggling across the international border between the United States and Mexico, and for other purposes.</official-title></form><legis-body id="H32897F9E9D014F0DA9A73F8830FB87C0" style="OLC"><section id="HE2E35EAFCC034A11A2C8DECBA037E0D7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Illicit Arms Trafficking Security Enforcement Act</short-title></quote>.</text></section><section id="H9867FC403DE7414B82386BB300645893"><enum>2.</enum><header>Border Enforcement Security Task Force unit for arms smuggling</header><subsection id="H24F44C0D3B224949AC0E95FBE332D0D6"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security shall, pursuant to section 432 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/240">6 U.S.C. 240</external-xref>), establish, in consultation with the National Targeting Center of U.S. Customs and Border Protection and the Bureau of Alcohol, Tobacco, Firearms and Explosives of the Department of Justice, a Border Enforcement Security Task Force unit to investigate transnational criminal organization arms smuggling across the international border between the United States and Mexico.</text></subsection><subsection id="H7BD2EE2199BE4618B62B8C57D79A8B12"><enum>(b)</enum><header>Purposes</header><text>The Border Enforcement Security Task Force unit established in accordance with subsection (a) shall focus on the following:</text><paragraph id="H2F67BC23EC604146A067455DD3C2DAF4"><enum>(1)</enum><text>Reducing arms smuggling of weapons, weapon parts, munitions, explosives, and related items from the United States to Mexico.</text></paragraph><paragraph id="H0F789D48CCE24B62B23D0509D637CBB0"><enum>(2)</enum><text>Apprehending, or working with relevant law enforcement to apprehend, arms smugglers within the United States or crossing from the United States to Mexico.</text></paragraph><paragraph id="H249A2A9A3D9A4C5C89439F5BB5571D6D"><enum>(3)</enum><text display-inline="yes-display-inline">Ensuring coordination with the Bureau of Alcohol, Tobacco, Firearms, and Explosives to receive comprehensive data on seized firearms in Mexico through an electronic tracing system or a successor system.</text></paragraph><paragraph id="H627DD73CE3FE4BE49516CFD52E450C27"><enum>(4)</enum><text display-inline="yes-display-inline">Deconflicting arms trafficking investigations between the Department of Homeland Security and the Department of Justice.</text></paragraph></subsection><subsection id="HB06877ED91C64359B8E806423C7C338D"><enum>(c)</enum><header>Composition</header><text display-inline="yes-display-inline">The Border Enforcement Security Task Force unit established in accordance with subsection (a) shall be composed of the following:</text><paragraph id="HA874AE24D53349E69667957FA16842F5"><enum>(1)</enum><text display-inline="yes-display-inline">U.S. Customs and Border Protection.</text></paragraph><paragraph id="H85D961BFD0F74C2B8C2D48C10804987D"><enum>(2)</enum><text>U.S. Immigration and Customs Enforcement, led by Homeland Security Investigations.</text></paragraph><paragraph id="H097CB259E88D4410B0C7DB74B4D33330"><enum>(3)</enum><text>Other Department of Homeland Security personnel, as appropriate.</text></paragraph><paragraph id="HF605B7F034C9450BBA7B3DA07CD75A7F"><enum>(4)</enum><text>The Bureau of Alcohol, Tobacco, Firearms, and Explosives, with the approval of the Attorney General.</text></paragraph><paragraph id="HA03AC936013B4FD5A3AA363B1054F6AE"><enum>(5)</enum><text>Other Federal, State, local, Tribal, and foreign law enforcement agencies, including Mexican law enforcement agencies, as appropriate.</text></paragraph></subsection><subsection id="HCA4D920C3C634EA6A06EF906B55A2906" commented="no"><enum>(d)</enum><header>Resources</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security, in coordination with the Attorney General, shall submit to Congress a report that identifies technology, dedicated personnel, and other resources required for the following purposes relating to the establishment of the Border Enforcement Security Task Force unit in accordance with subsection (a): </text><paragraph id="H665414EBDBB74D6C87D8C54A243ED193" commented="no"><enum>(1)</enum><text>Continuation of Operation Without a Trace and related Bureau of Alcohol, Tobacco, Firearms, and Explosives agency strategy.</text></paragraph><paragraph id="HFBF70DF3DBF64F9FBD863AD95768842B" commented="no"><enum>(2)</enum><text>Conducting pilot programs and operations. </text></paragraph><paragraph id="HE27F348C7FA54AC3B9C01EE7BFC88BCD" commented="no"><enum>(3)</enum><text>Joint training operations.</text></paragraph></subsection><subsection id="H56CC1CBDC13B41CE9B3C87F0E71736FA" commented="no"><enum>(e)</enum><header>Memorandum of understanding</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security and the Attorney General shall update the 2009 memorandum of understanding between Homeland Security Investigations and the Bureau of Alcohol, Tobacco, Firearms, and Explosives relating to improving coordination on efforts to combat illegal arms trafficking.</text></subsection></section></legis-body></bill>
