which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of the Interior and the Secretary of Agriculture to develop a plan for providing the staffing necessary to ensure timely review of communications use authorizations, and for other purposes.</official-title></form><legis-body id="HA323B1D3333C422B8A83D3C813F1FD93" style="OLC"><section id="HF9284F73590F4570A0EA184E3698F908" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enhancing Administrative Reviews for Broadband Deployment Act</short-title></quote>.</text></section><section id="H911647B42C194F939FBF15E483B3551C"><enum>2.</enum><header>Ensuring timely review of communications use authorizations</header><subsection id="H86FBAA4DB24A4260B7C01B29923B0369"><enum>(a)</enum><header>Study and report</header><paragraph id="HE4ADCCCF71B14870BEE3832FFA1D9C8F"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretaries concerned shall each conduct, with respect to the relevant covered department, a study to determine—</text><subparagraph id="H15EFD6E8367E4F58AD62260BB6E4F8A3"><enum>(A)</enum><text display-inline="yes-display-inline">if there are programmatic or administrative barriers to the timely review of requests for communications use authorizations;</text></subparagraph><subparagraph id="HB6AC41B2FC47479AAD090F1D7040E51D"><enum>(B)</enum><text display-inline="yes-display-inline">if there are revisions to rules or regulations that could be implemented to improve efficiency with respect to reviewing requests for communications use authorizations; and</text></subparagraph><subparagraph id="HEAC1478EBFBE493BA60F274FD5595238"><enum>(C)</enum><text display-inline="yes-display-inline">if there are processes for prioritizing the review of requests for communications use authorizations.</text></subparagraph></paragraph><paragraph id="H538E32D2D668467AA138FFF0AE195F15"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretaries concerned shall jointly submit to the appropriate congressional committees a report that—</text><subparagraph id="H3A9F1B509BF847D0829A171B3088E5B9"><enum>(A)</enum><text>describes the results of the studies conducted under paragraph (1), including any barriers, revisions, or processes identified under subparagraphs (A) through (C) of such paragraph; and</text></subparagraph><subparagraph id="HDEF740D90CD2431B98704AF70322FF8B"><enum>(B)</enum><text display-inline="yes-display-inline">includes a plan for providing, with respect to the organizational units of the relevant covered departments, the staffing necessary to ensure timely review of communications use authorizations.</text></subparagraph></paragraph></subsection><subsection id="HB8CDA4CDB5A84FCD8AB0940724E7577A"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HE1F650A629044E28AA0AB9C1EAEAE546"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="H93E7A965BF374903BB6DE42D4B080FF2"><enum>(A)</enum><text>the Committee on Energy and Commerce of the House of Representatives;</text></subparagraph><subparagraph id="H6FB5D38AF4D548A990DC63228ED71954"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives;</text></subparagraph><subparagraph id="H17204700D30D459BBB6F944D198F28B6"><enum>(C)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate; and</text></subparagraph><subparagraph id="H3DCCB6148571407EB733F3DEB4262416"><enum>(D)</enum><text>the Committee on Environment and Public Works of the Senate.</text></subparagraph></paragraph><paragraph id="HA6634E9CEFFD4B3D989ED5FAC880895F"><enum>(2)</enum><header>Communications facility</header><text display-inline="yes-display-inline">The term <term>communications facility</term> has the meaning given the term <term>communications facility installation</term> in section 6409(d) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(d)</external-xref>).</text></paragraph><paragraph id="H0576FA0C705C452C86107216D9A3F2DF"><enum>(3)</enum><header>Communications use</header><text>The term <term>communications use</term> means the placement and operation of a communications facility.</text></paragraph><paragraph id="HD3EF2111B53C45A4A421F2D46817AF78"><enum>(4)</enum><header>Communications use authorization</header><text display-inline="yes-display-inline">The term <term>communications use authorization</term> means an easement, right-of-way, lease, license, or other authorization—</text><subparagraph id="H95609AF9F208437DB3952641CB2AF578"><enum>(A)</enum><text>provided by the Secretary of the Interior or the Secretary of Agriculture;</text></subparagraph><subparagraph id="H9D30C54B158647D4A1B0FCDE1C6F39A8"><enum>(B)</enum><text>to locate or modify a communications facility on covered land; and</text></subparagraph><subparagraph id="H89C1D2EB4F124AB9A02A9FA3E5C25FEF"><enum>(C)</enum><text>for the primary purpose of authorizing the occupancy and use of such covered land for communications use.</text></subparagraph></paragraph><paragraph id="H3A91E05608B14B8C9391FFA236E232BF"><enum>(5)</enum><header>Covered land</header><text>The term <term>covered land</term> means—</text><subparagraph id="H38CEF3B7C654433694EDC12D1AA6AADB"><enum>(A)</enum><text>public lands; and</text></subparagraph><subparagraph id="H30C70618709E45A59536C798DEDA4945"><enum>(B)</enum><text>National Forest System land.</text></subparagraph></paragraph><paragraph id="H762D1BAC198A4FC2ADF64C30FBFB8939"><enum>(6)</enum><header>National Forest System</header><text>The term <term>National Forest System</term> has the meaning given that term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>).</text></paragraph><paragraph id="H23DD68DC7AAD4211B0C5C5866095B898" commented="no"><enum>(7)</enum><header>Organizational unit</header><text>The term <term>organizational unit</term> means—</text><subparagraph id="HFCBAC453AF0047FEAD7046C012D3FDD0" commented="no"><enum>(A)</enum><text>with respect to the Department of the Interior—</text><clause id="HE89FA9E2D4264F5985D0DC38A5CD6521" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">a State office of the Bureau of Land Management;</text></clause><clause id="H1CF757940D004CC8AD3D6FEC3E469F3C" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">a regional office of the Bureau of Land Management;</text></clause><clause id="H2A2A165B36D44F22B41DC147840CE460" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">a district office of the Bureau of Land Management; or</text></clause><clause id="H83B13416003840738E72E44A22E25F95" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">a field office of the Bureau of Land Management; and</text></clause></subparagraph><subparagraph id="H22A9E2EB7D784571B3A95E2BB64148FD" commented="no"><enum>(B)</enum><text>with respect to the Department of Agriculture—</text><clause id="H2AC3FA2E0C0F4E238B3561693CC62990" commented="no"><enum>(i)</enum><text>a regional office of the Forest Service;</text></clause><clause id="H8707BE90B4034C04B28615DBA937011D" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">a management unit of the Forest Service; or</text></clause><clause id="H818B925A088B44C5AB97A224F18150C2" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">a ranger district office of the Forest Service.</text></clause></subparagraph></paragraph><paragraph id="H3C9254F1183B452EB2E5BB35A994B271"><enum>(8)</enum><header>Public lands</header><text>The term <term>public lands</term> has the meaning given that term in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>).</text></paragraph><paragraph id="HA01F3FC44AC94B7DABA7F00E6D3860C9"><enum>(9)</enum><header>Relevant covered department</header><text>The term <term>relevant covered department</term> means—</text><subparagraph id="H19F9AEFA021C4A6FBCAEFCFF49511EF9"><enum>(A)</enum><text>with respect to the Secretary of the Interior, the Department of the Interior; and</text></subparagraph><subparagraph id="H5ECBBDBC528C429B8A01027068146941"><enum>(B)</enum><text>with respect to the Secretary of Agriculture, the Department of Agriculture.</text></subparagraph></paragraph><paragraph id="H7720182650FF42B2AC9A3F8F1905A4BF"><enum>(10)</enum><header>Secretaries concerned</header><text>The term <term>Secretaries concerned</term> means—</text><subparagraph id="H9B0E53F286784CA0BB6AB3D6943F756A"><enum>(A)</enum><text>the Secretary of the Interior; and</text></subparagraph><subparagraph id="HC77351EE02114DBA97B755F6FDA32920"><enum>(B)</enum><text>the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
