R. 3292</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230515">May 15, 2023</action-date><action-desc><sponsor name-id="W000798">Mr. Walberg</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide that a project for the deployment or modification of a communications facility entirely within a brownfield site is not subject to requirements to prepare certain environmental or historical preservation reviews.</official-title></form><legis-body id="H4489B61E49D94E39BFC17B957A002E98" style="OLC"><section id="HB79840EC41F64D5FA2E5DA6B75C5DA27" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Brownfields Broadband Deployment Act</short-title></quote>.</text></section><section id="HAF192A40BB3940C99726C271AF8C4788"><enum>2.</enum><header>Application of NEPA and NHPA to brownfields</header><subsection id="HBFF496103D144B87BEA9F76F85BE2AA9"><enum>(a)</enum><header>NEPA exemption</header><text display-inline="yes-display-inline">A Federal authorization with respect to a covered project may not be considered a major Federal action under section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>).</text></subsection><subsection id="H92893CA7C02845BE9B57EEF970B45537"><enum>(b)</enum><header>National Historic Preservation Act exemption</header><text display-inline="yes-display-inline">A covered project may not be considered an undertaking under section 300320 of title 54, United States Code.</text></subsection><subsection id="HE0AC738F2FCF48DE978625209D8FAE45"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H6ED9692457D247C197B9738117082450"><enum>(1)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Federal Communications Commission. </text></paragraph><paragraph id="H49F2E71A3F8A4425969B41E41CC353A6"><enum>(2)</enum><header>Communications facility</header><text>The term <term>communications facility</term> has the meaning given the term <quote>communications facility installation</quote> in section 6409(d) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(d)</external-xref>).</text></paragraph><paragraph id="H78CC177E165449118983FBBC77D19CAD"><enum>(3)</enum><header>Covered project</header><text display-inline="yes-display-inline">The term <term>covered project</term> means a project—</text><subparagraph id="HCBA0ED395A2143AE9374BFB931C8A617"><enum>(A)</enum><text>for the deployment or modification of a communications facility that is to be carried out entirely within a brownfield site (as defined in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>)); and</text></subparagraph><subparagraph id="H7092E233E22C4C92A6D287F9AADB57E0"><enum>(B)</enum><text display-inline="yes-display-inline">for which a permit, license, or approval from the Commission is required or that is otherwise subject to the jurisdiction of the Commission.</text></subparagraph></paragraph><paragraph id="H2CD991C7CEC54BB6B944705074F50493"><enum>(4)</enum><header>Federal authorization</header><text>The term <quote>Federal authorization</quote>—</text><subparagraph id="H320878A0D79741EC908554F0664B245B"><enum>(A)</enum><text>means any authorization required under Federal law with respect to a covered project; and</text></subparagraph><subparagraph id="H7BCB1FD66C3946AE978F0F8DCA149476"><enum>(B)</enum><text>includes any permits, special use authorizations, certifications, opinions, or other approvals as may be required under Federal law with respect to a covered project.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
