which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide that a project for the collocation of a personal wireless service facility is not subject to requirements to prepare certain environmental or historical preservation reviews.</official-title></form><legis-body id="H37DA1BF3C3D44D34BD1FA4ACD5A7ABF8" style="OLC"><section id="H2F739F549D6C4F23AFC50D3E92E3D754" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wireless Broadband Competition and Efficient Deployment Act</short-title></quote>.</text></section><section id="H9719605802A84198AC732D07BF415AAE"><enum>2.</enum><header>Application of NEPA and NHPA to collocation of certain personal wireless service facilities</header><subsection id="HA797DE32114044C0BF4E4CA402748E8A"><enum>(a)</enum><header>NEPA exemption</header><text display-inline="yes-display-inline">A Federal authorization with respect to a covered project may not be considered a major Federal action under section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>).</text></subsection><subsection id="HC13803AC8BA84E568BC5DA01C820247C"><enum>(b)</enum><header>National Historic Preservation Act exemption</header><text display-inline="yes-display-inline">A covered project may not be considered an undertaking under section 300320 of title 54, United States Code.</text></subsection><subsection id="H3B3DF57961F243978CEEB4FEDEDF2E15"><enum>(c)</enum><header>Definitions</header><text>In this section: </text><paragraph id="H4A116F71B1014D6E9C895F7588F0060B"><enum>(1)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Federal Communications Commission. </text></paragraph><paragraph id="H332DAB030F904DFABDEF685C28CBF118" commented="no"><enum>(2)</enum><header>Covered project</header><text display-inline="yes-display-inline">The term <term>covered project</term> means a project—</text><subparagraph id="H34C713FCA5784F979FD5E13E5B058F7C" commented="no"><enum>(A)</enum><text>for—</text><clause id="H85287E1BAA7F4F18899687FF31A8720F"><enum>(i)</enum><text display-inline="yes-display-inline">the mounting or installation of an eligible personal wireless service facility with another eligible personal wireless service facility that exists at the time at which a complete request for authorization of such mounting or installation is filed with a State or local government or instrumentality thereof or with an Indian Tribe; or</text></clause><clause id="HD8757968162C48528B3929609E660636" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the modification of an eligible personal wireless service facility; and</text></clause></subparagraph><subparagraph id="H8F2693DFFD4B4D379F26AD919F7F1033"><enum>(B)</enum><text display-inline="yes-display-inline">for which a permit, license, or approval from the Commission is required or that is otherwise subject to the jurisdiction of the Commission.</text></subparagraph></paragraph><paragraph id="H5F6176D15F6446B5AAF012A15D0257D2" commented="no"><enum>(3)</enum><header>Eligible personal wireless service facility</header><text display-inline="yes-display-inline">The term <term>eligible personal wireless service facility</term> means any antenna, apparatus, or transmitting device, and any equipment, switches, wiring, cabling, power sources, shelters, or cabinets, for the provision of a personal wireless service.</text></paragraph><paragraph id="H1CBCC40E63544787A6B31C6488F06D69"><enum>(4)</enum><header>Federal authorization</header><text>The term <quote>Federal authorization</quote>—</text><subparagraph id="H6143FCF196A546CC948D40061A3392D2"><enum>(A)</enum><text>means any authorization required under Federal law with respect to a covered project; and</text></subparagraph><subparagraph id="H45073B8B328A4962915D677156B73470"><enum>(B)</enum><text>includes any permits, special use authorizations, certifications, opinions, or other approvals as may be required under Federal law with respect to a covered project.</text></subparagraph></paragraph><paragraph id="H9FF8FC94F05C4E23900E8306287980EF"><enum>(5)</enum><header>Indian Tribe</header><text display-inline="yes-display-inline">The term <quote>Indian Tribe</quote> has the meaning given the term <quote>Indian tribe</quote> under section 102 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5130">25 U.S.C. 5130</external-xref>).</text></paragraph><paragraph id="HF3024CEC91074D32A7601D32537E8DD4"><enum>(6)</enum><header>Personal wireless services</header><text>The term <term>personal wireless services</term>—</text><subparagraph id="H293D5410D5AD4C02A911D740DDDC6795"><enum>(A)</enum><text>has the meaning given such term in section 332(c)(7)(C) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332(c)(7)(C)</external-xref>); and</text></subparagraph><subparagraph id="H864EA2A29362469D974F6FD99575F817"><enum>(B)</enum><text>also includes commercial mobile data service (as defined in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>)).</text></subparagraph></paragraph><paragraph id="H942340B318A64352A0129730C6DCBCBE" commented="no"><enum>(7)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each State of the United States, the District of Columbia, and each territory or possession of the United States.</text></paragraph></subsection></section></legis-body></bill>
