which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide that a project for the collocation of a telecommunications service facility is not subject to requirements to prepare certain environmental or historical preservation reviews.</official-title></form><legis-body id="H69BF3539BAEC4F7BBC33BDB7D6F7883A" style="OLC"><section id="H4018969927CA43E4B170AD2B4C3939DF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Broadband Competition and Efficient Deployment Act</short-title></quote>.</text></section><section id="H67BB22A03A134B3BAEA9EAE32F3DD326"><enum>2.</enum><header>Application of NEPA and NHPA to collocation of telecommunications service facilities</header><subsection id="HFBDEDBBE5FD343C78D085A1E7689BCE4"><enum>(a)</enum><header>NEPA exemption</header><text display-inline="yes-display-inline">A Federal authorization with respect to a covered project may not be considered a major Federal action under section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>).</text></subsection><subsection id="H71BF382052974316B8495A235FF4D8AE"><enum>(b)</enum><header>National Historic Preservation Act exemption</header><text display-inline="yes-display-inline">A covered project may not be considered an undertaking under section 300320 of title 54, United States Code.</text></subsection><subsection id="H2704FA4067634B2DB569C1B26A2D7106"><enum>(c)</enum><header>Definitions</header><text>In this section: </text><paragraph id="HAA45649FB4F74193B1CF5DEA6BF07437"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission. </text></paragraph><paragraph id="HA9E754784CBA44D6BE637CB53AC0291D" commented="no"><enum>(2)</enum><header>Covered project</header><text display-inline="yes-display-inline">The term <term>covered project</term> means a project—</text><subparagraph id="H1F52BF88937B49238316612E6A1D6945" commented="no"><enum>(A)</enum><text>for the placement, construction, or modification of a telecommunications service facility in or on eligible support infrastructure; and</text></subparagraph><subparagraph id="H8D43F88A156F4B4A9191A11D614FB786"><enum>(B)</enum><text display-inline="yes-display-inline">for which a permit, license, or approval from the Commission is required or that is otherwise subject to the jurisdiction of the Commission.</text></subparagraph></paragraph><paragraph id="HC92E85DBA1764806B233C34F01D4FE63"><enum>(3)</enum><header>Eligible support infrastructure</header><text display-inline="yes-display-inline">The term <term>eligible support infrastructure</term> means infrastructure that supports or houses a facility for communication by wire (or is designed to or capable of supporting or housing such a facility) at the time when a complete request to a State or local government or instrumentality thereof, or to an Indian Tribe, for authorization to place, construct, or modify a telecommunications service facility in or on the infrastructure is received by the government, instrumentality, or Indian Tribe.</text></paragraph><paragraph id="H4235F311C17D47769D64EE9DE8FFA6C2"><enum>(4)</enum><header>Federal authorization</header><text>The term <quote>Federal authorization</quote>—</text><subparagraph id="H71924BB089B4462B9A0CC51640020E5F"><enum>(A)</enum><text>means any authorization required under Federal law with respect to a covered project; and</text></subparagraph><subparagraph id="H90F9017FB4AC4267A6EA41604C993DE0"><enum>(B)</enum><text>includes any permits, special use authorizations, certifications, opinions, or other approvals as may be required under Federal law with respect to a covered project.</text></subparagraph></paragraph><paragraph id="HFF1AB6C210654EC1A4EB76E1AE26C3F6"><enum>(5)</enum><header>Indian Tribe</header><text display-inline="yes-display-inline">The term <quote>Indian Tribe</quote> has the meaning given the term <quote>Indian tribe</quote> under section 102 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5130">25 U.S.C. 5130</external-xref>).</text></paragraph><paragraph id="HFAA419142197469F9ACBD2CD3260D0CD" commented="no"><enum>(6)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each State of the United States, the District of Columbia, and each territory or possession of the United States.</text></paragraph><paragraph id="H11BBB42CC40C4713A322B2CC75E693D1"><enum>(7)</enum><header>Telecommunications service</header><text>The term <term>telecommunications service</term> has the meaning given such term in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>).</text></paragraph><paragraph id="H58550979902043F2924FDD3EFE1972F0"><enum>(8)</enum><header>Telecommunications service facility</header><text>The term <term>telecommunications service facility</term>—</text><subparagraph id="HA407895931874A469141494A9D25C720"><enum>(A)</enum><text display-inline="yes-display-inline">means a facility that is designed or used to provide or facilitate the provision of any interstate or intrastate telecommunications service; and</text></subparagraph><subparagraph id="H620045E2DB1E4C0AB0B8795FFFB30387"><enum>(B)</enum><text display-inline="yes-display-inline">includes a facility described in subparagraph (A) that is used to provide other services.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
