<official-title display="yes">To amend the Help America Vote Act of 2002 to prohibit States from using in the administration of an election for Federal office proprietary voting system hardware or software which prevents the system from meeting the voluntary voting system guidelines for interoperability and auditability issued by the Election Assistance Commission under such Act, a voting system whose hardware and software components are manufactured, maintained, or serviced outside the United States, or a voting system which is connected to the internet.</official-title>

<section id="HDFC50C84464B4AA4820FB7F9390F6293" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Election Integrity Act of 2023</short-title></quote>. </text></section> <section id="HF26EF5B80FBB4E3F8C608CC71CB9C82A" section-type="subsequent-section"><enum>2.</enum><header>Prohibiting use of proprietary voting system hardware or software not enabling audits</header> <subsection id="HD582DDDE5D3746D18C97870247FB8609"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Section 301(a) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081(a)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="HBF50E616DA944C74B33C3E8458FAD588"><enum>(7)</enum><header>Prohibiting use of proprietary hardware or software not meeting voluntary guidance for interoperability and auditability</header><text display-inline="yes-display-inline">The voting system may not use any proprietary hardware or software unless the manufacturer of the hardware or software provides the appropriate election official with such information and assistance as the official may require to enable the voting system to be interoperable and auditable in accordance with the most recent voluntary voting system guidelines issued by the Commission under this title.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H7F10B1C1F7AD4F758407FDEE5F0C5193"><enum>(b)</enum><header>Effective date</header><text>Section 301(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081(d)</external-xref>) is amended by striking the period at the end and inserting the following: <quote>, or, in the case of the requirements of paragraph (7) of subsection (a), on and after January 1, 2024.</quote>. </text></subsection></section> 
<section id="H5579F58787EF42B5A0ECED07F1A9A3D3" section-type="subsequent-section"><enum>3.</enum><header>Prohibiting use of voting system produced by foreign entity in elections for Federal office</header> 
<subsection id="HBFF1237EAF8B4BF182E1BB0C1E9FCCA5"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Section 301(a) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081(a)</external-xref>), as amended by section 2(a), is further amended by adding at the end the following new paragraphs:</text> <quoted-block style="OLC" id="HEAC622A5DDC44D93A7B0F86A9DA42558" display-inline="no-display-inline"> <paragraph id="H5FF38939643C413CB477DB46F2AC5283"><enum>(8)</enum><header>System hardware and software manufactured and maintained in United States</header><text>All of the hardware components and all of the software components of the system shall be manufactured in the United States and shall be maintained and serviced only by persons who are in the United States.</text></paragraph> 
<paragraph id="HF4C04619580D4CBAA82FA0F5D25936BE"><enum>(9)</enum><header>System not produced by foreign entity</header> 
<subparagraph id="H0D91C18589EB496A86C5CF3018F6EC46"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The voting system may not be produced by a foreign entity.</text></subparagraph> <subparagraph id="H75E19835878A49FF9DFE9B20F45C5F84"><enum>(B)</enum><header>Foreign entity defined</header><text display-inline="yes-display-inline">In subparagraph (A), the term <term>foreign entity</term> means any of the following:</text> 
<clause id="HE173905597AB47028039F0A784AC32B5"><enum>(i)</enum><text>A foreign national.</text></clause> <clause id="H253F10F33F8A4106B8936CC5A09E0CF8"><enum>(ii)</enum><text>Any corporation which is not a foreign national and in which a foreign national or an alien directly or indirectly owns or controls any voting share.</text></clause> 
<clause id="H0EFFB0411B11416AA78A277D76866833"><enum>(iii)</enum><text display-inline="yes-display-inline">Any corporation which is not a foreign national and with respect to which any of the members of the board of directors are foreign nationals or aliens.</text></clause> <clause id="HC7402F77DE2A44E28876890653EE9F83"><enum>(iv)</enum><text display-inline="yes-display-inline">Any corporation which is not a foreign national and over which one or more foreign nationals or aliens has the power to direct, dictate, or control the decision-making process of the corporation with respect to its interests in the United States.</text></clause></subparagraph> 
<subparagraph id="HFEF75FEF4F454F13AE4C94AAE15F3629"><enum>(C)</enum><header>Foreign national defined</header><text>In this paragraph, the term <term>foreign national</term> has the meaning given such term in section 1(b) of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611(b)</external-xref>), except that such term shall not include any individual who is a citizen of the United States.</text></subparagraph> <subparagraph id="HC262DDDBF39948EFA8F23A527BF47B44"><enum>(D)</enum><header>Alien defined</header><text>In this paragraph, the term <term>alien</term> means an individual who is not a citizen of the United States or a national of the United States (as defined in section 101(a)(22) of the Immigration and Nationality Act), and who is not lawfully admitted for permanent residence (as defined in section 101(a)(20) of such Act).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA5252147E4914A52AA4FDD6F04007B39"><enum>(b)</enum><header>Effective date</header><text>Section 301(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081(d)</external-xref>), as amended by section 2(b), is further amended to read as follows:</text> <quoted-block style="OLC" id="H54A006E824254635A6CA474315607BC6" display-inline="no-display-inline"> <subsection id="H0FB7AF8FA0444586BDB0BC9F56252FAE"><enum>(d)</enum><header>Effective date</header> <paragraph id="HCD2873B0078342949A0D263302CAFDCD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), each State and jurisdiction shall be required to comply with the requirements of this section on and after January 1, 2006, or, in the case of the requirements of paragraph (7) of subsection (a), on and after January 1, 2024.</text></paragraph> 
<paragraph id="HC5D9AC90FC8A44638C869ACB41EEDB36"><enum>(2)</enum><header>Special rule for requirements relating to foreign entities</header><text display-inline="yes-display-inline">In the case of the requirements of paragraphs (8) and (9) of subsection (a), each State and jurisdiction shall be required to comply with such requirements on and after the date of the enactment of the Election Integrity Act of 2023.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H2AD205DB9999419A8B1EA93BDFAAB99C" section-type="subsequent-section"><enum>4.</enum><header>Prohibiting connection of voting systems to internet</header> <subsection id="H3924CE4538434E66AA7BD01894F0236D"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Section 301(a) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081(a)</external-xref>), as amended by section 2(a) and section 3(a), is further amended by adding at the end the following new paragraph:</text>

<paragraph id="H6076098DF2E04B84B6F41FA260322417"><enum>(10)</enum><header>Prohibiting connection of system to the internet</header> 
<subparagraph id="H398FB6F7959F41A7AACC23228CED5DFA"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">No system or device upon which ballots are programmed or votes are cast or tabulated shall be connected to the internet at any time.</text></subparagraph> <subparagraph id="H570F8E7E348B40999DA49ADB50FAD94E"><enum>(B)</enum><header>Prohibiting acceptance of ballots transmitted online</header><text display-inline="yes-display-inline">The voting system may not directly tabulate any voted ballot which is transmitted to an election official online.</text></subparagraph> 
<subparagraph id="H3E2830D83E5043FBB23FC8FA25D82902"><enum>(C)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing contained in this paragraph shall be deemed to prohibit the Commission from conducting the studies under section 242 or to conduct other similar studies under any other provision of law in a manner consistent with this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H91A23029F0034E4583D15C96B2C20FBC"><enum>(b)</enum><header>Effective date</header><text>Section 301(d)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081(d)(1)</external-xref>), as amended by section 2(b) and section 3(b), is further amended by striking <quote>paragraph (7) of subsection (a)</quote> and inserting <quote>paragraphs (7) and (10) of subsection (a)</quote>.</text></subsection></section>
