committed to the Committee of the Whole House on the State of the Union and ordered to be printed<pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Homeland Security Act of 2002 to establish a process to review applications for certain grants to purchase equipment or systems that do not meet or exceed any applicable national voluntary consensus standards, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body id="H3F5F4A289EC0401EA36CF24F459A8904" style="OLC"><section id="HFEAB92CB9E324016A95FF7D071340545" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>First Responder Access to Innovative Technologies Act</short-title></quote>.</text></section><section id="H61A08C6C77D64D049E6A2C90CB3F9C9F"><enum>2.</enum><header>Approval of certain equipment</header><subsection id="H412833A74CC24EB4A94CAB7E5EE3B05D"><enum>(a)</enum><header>In general</header><text>Section 2008 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/609">6 U.S.C. 609</external-xref>) is amended—</text><paragraph id="H3B9995B4AAA24EDCA08DD5F6AA8BEDD8"><enum>(1)</enum><text>in subsection (f)—</text><subparagraph id="H86E0F139C543451BAED38B7AADA515BF"><enum>(A)</enum><text>by striking <quote>If an applicant</quote> and inserting the following:</text><quoted-block id="H1BE234060E324A51B0260E71DB63F5FC" style="OLC"><paragraph id="HC91EE85604B34B64B68F2F32A9835079"><enum>(1)</enum><header>Application requirement</header><text>If an applicant</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H313F4AF28EDF436F8B217FCFABE3D83B"><enum>(B)</enum><text>by adding at the end the following new paragraphs:</text><quoted-block id="H1B06D680012B4840AE8A36BEE9F05627" style="OLC"><paragraph id="H6989A931B1BF4E9B91D2F43782442355"><enum>(2)</enum><header>Review process</header><text>The Administrator shall implement a uniform process for reviewing applications that, in accordance with paragraph (1), contain explanations to use grants provided under section 2003 or 2004 to purchase equipment or systems that do not meet or exceed any applicable national voluntary consensus standards developed under section 647 of the Post-Katrina Emergency Management Reform Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/6/747">6 U.S.C. 747</external-xref>).</text></paragraph><paragraph id="H268D5FC3A5B444BBA369246271196721"><enum>(3)</enum><header>Factors</header><text>In carrying out the review process under paragraph (2), the Administrator shall consider the following:</text><subparagraph id="HC07C3117A798403696569B44AA6492B3"><enum>(A)</enum><text>Current or past use of proposed equipment or systems by Federal agencies or the Armed Forces.</text></subparagraph><subparagraph id="HA877C4A096204468813030421C115325"><enum>(B)</enum><text>The absence of a national voluntary consensus standard for such equipment or systems.</text></subparagraph><subparagraph id="H8D2DE6EE73D3426A911FEF9533A745EC"><enum>(C)</enum><text>The existence of an international consensus standard for such equipment or systems, and whether such equipment or systems meets such standard.</text></subparagraph><subparagraph id="H453E824D008240C1A9D67E8D435678A8"><enum>(D)</enum><text>The nature of the capability gap identified by the applicant and how such equipment or systems will address such gap.</text></subparagraph><subparagraph id="HCD008607B27840F383F5D7DEA418174B"><enum>(E)</enum><text>The degree to which such equipment or systems will serve the needs of the applicant better than equipment or systems that meet or exceed existing consensus standards.</text></subparagraph><subparagraph id="H486BFF1187E146658B2DB9379AC26916"><enum>(F)</enum><text>Any other factor determined appropriate by the Administrator.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H53512B2A1E474D86907EC6D8FF4A84D2"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block id="HD554B9E265FC4AC8AC0BAEFDAD5F13A9" style="OLC"><subsection id="HC17DCBFE6D0E43C19829CD0DD9BE3C6A"><enum>(g)</enum><header>Review process</header><text>The Administrator shall implement a uniform process for reviewing applications to use grants provided under section 2003 or 2004 to purchase equipment or systems not included on the Authorized Equipment List maintained by the Administrator.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HEEEA031FAC354BECB8962C3D837E5748"><enum>(b)</enum><header>Inspector General report</header><text>Not later than three years after the date of the enactment of this Act, the Inspector General of the Department of Homeland Security shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report assessing the implementation of the review process established under paragraph (2) of subsection (f) of section 2008 of the Homeland Security Act of 2002 (as added by subsection (a) of this section), including information on the following:</text><paragraph id="H7B4E053C0B2B43989FD2069FC6F19792"><enum>(1)</enum><text>The number of requests to purchase equipment or systems that do not meet or exceed any applicable consensus standard evaluated under such review process.</text></paragraph><paragraph id="H1422CEDA11484F20A816BF3E2879AD3A"><enum>(2)</enum><text>The capability gaps identified by applicants and the number of such requests granted or denied.</text></paragraph><paragraph id="HAF6087773EA74333B35BA873F20570CD"><enum>(3)</enum><text>The processing time for the review of such requests.</text></paragraph></subsection></section></legis-body><endorsement display="yes"><action-date date="20230719">July 19, 2023</action-date><action-desc> Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
