R. 322</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230112">January 12, 2023</action-date><action-desc><sponsor name-id="D000626">Mr. Davidson</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To modify the Federal TRIO programs.</official-title></form><legis-body id="HE12581896781466A83B6F52CDC056E73" style="OLC"><section section-type="section-one" id="H61C830814DA94E9E8D48C119B8F09A05"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Educational Opportunity and Success Act of 2023</short-title></quote>.</text></section><section id="HEACF2DB02E174C61A8F8D41B74ACC90F"><enum>2.</enum><header>Program authority and authorization of appropriations for Federal TRIO programs</header><subsection id="H7DB0658A2000483BBEC1278EEA7B280A"><enum>(a)</enum><header>Minimum grants</header><text>Section 402A(b)(3) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-11">20 U.S.C. 1070a–11(b)(3)</external-xref>) is amended—</text><paragraph id="H511820622EAD451ABD75A1CC357F1C4C"><enum>(1)</enum><text>by striking <quote>$200,000</quote> and inserting <quote>$220,000</quote>; and</text></paragraph><paragraph id="H11E70080DB49423DB17D6FF2AB9801F5"><enum>(2)</enum><text>by striking <quote>$170,000</quote> and inserting <quote>$190,000</quote>.</text></paragraph></subsection><subsection id="HD228363FA70540C09C95052EA87096A1"><enum>(b)</enum><header>Procedures for awarding grants and contracts</header><text display-inline="yes-display-inline">Section 402A(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-11">20 U.S.C. 1070a–11(c)</external-xref>) is amended—</text><paragraph id="HE2C91ABCF89345EFA36572354B9AFEB5"><enum>(1)</enum><text>in paragraph (2)(A)—</text><subparagraph id="HBA69CD34FB4240C49075501B5813EE50"><enum>(A)</enum><text>in the subparagraph heading, by striking <quote><header-in-text style="OLC" level="subparagraph">Prior experience</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subparagraph">Prior success</header-in-text></quote>;</text></subparagraph><subparagraph id="H7ED7C5B951BB43E994C85E78F0E2FDE1"><enum>(B)</enum><text>in the first sentence, by striking <quote>prior experience of high quality service delivery</quote> and inserting <quote>prior success in achieving high quality service delivery</quote>; and</text></subparagraph><subparagraph id="H4F6D2FD48940402DBEEDEAA37D7539CA"><enum>(C)</enum><text>in the second sentence—</text><clause id="H026B23087C3E4AEF93E99C1973380186"><enum>(i)</enum><text>by striking <quote>prior experience shall not</quote> and inserting <quote>prior success in achieving high quality service delivery shall not</quote>; and</text></clause><clause id="H34356477937F48F1911988C68D6316DC"><enum>(ii)</enum><text>by striking <quote>shall not be given prior experience consideration</quote> and inserting <quote>shall not be given such consideration</quote>; and</text></clause></subparagraph></paragraph><paragraph id="H87CB2FD9FE1640D5A4CFF07F738D3CFD"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (8) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2BB3B7AFD2294306AF83E7FDC12908DE"><paragraph id="H0747A83C16DE4788A1AC5F02564C893A"><enum>(8)</enum><header>Review and notification by the Secretary</header><subparagraph id="HC0BED2793334455FBD61DFB695A8AAB1"><enum>(A)</enum><header>Guidance</header><text>Not less than 90 days before the commencement of each competition for a grant under this chapter, the Secretary shall issue nonregulatory guidance regarding the rights and responsibilities of applicants with respect to the application and evaluation process for programs and projects assisted under this chapter, including applicant access to peer review comments. The guidance shall describe the procedures for the submission, processing, and scoring of applications for grants under this chapter, including the information described in subparagraph (B).</text></subparagraph><subparagraph id="H138DE53D174E4635A6DE4FAA27D42503"><enum>(B)</enum><header>Technical components of applications</header><clause id="H17BC8E5C0444476096298708D31E220D"><enum>(i)</enum><header>Establishment and treatment of nonsubstantive technical components of applications</header><text>With respect to any competition for a grant under this chapter, the Secretary may only establish voluntary page limit and formatting requirements for grant applications and may not reject grant applications that do not meet those voluntary requirements. The Secretary may suggest page limits and formatting standards (including with respect to font size, font style, font type, line spacing, paragraph justification, and page margins), but may not use noncompliance with these suggested requirements as a basis to reject or penalize grant applications.</text></clause><clause id="H049FEEB46F2143E785CA434B17DCE18A"><enum>(ii)</enum><header>Identification and treatment of technical budget errors in applications</header><subclause id="HA37128E1EE794EFF8974E610A32B9552"><enum>(I)</enum><header>In general</header><text>With respect to any competition for a grant under this chapter, the Secretary may not reject or penalize grant applications on the basis of a typographical or rounding error in a proposed budget until the Secretary has given the applicant an opportunity for correction in accordance with subclause (II).</text></subclause><subclause id="H21C8BDA9A3FA4DCF98302CFFBF24D588"><enum>(II)</enum><header>Notice and opportunity for correction</header><text>The Secretary shall provide notice and identification of an error described in subclause (I) by email and phone to the applicant before awarding grants for each competition. During a period of not fewer than 14 days, the Secretary shall allow the applicant to submit a revised application that corrects the identified error.</text></subclause><subclause id="HE3F22D91234945349E81541599168D6F"><enum>(III)</enum><header>Treatment of revised applications</header><text>The Secretary shall treat the revised application in the same manner as a timely submitted application.</text></subclause><subclause id="HB4CD950536B8489780D78ADE64F62DD8"><enum>(IV)</enum><header>Failure to correct</header><text>If an applicant has received a notice and opportunity for correction of a typographical or rounding error in a proposed budget in accordance with subclause (II) and the applicant fails to correct the error and submit a revised application before the deadline described in that subclause, the Secretary may reject or penalize that grant application.</text></subclause></clause></subparagraph><subparagraph id="HFAED1B41594E420FBB353258BEB7D1B6"><enum>(C)</enum><header>Review</header><clause id="H0F007234F84C4AC6AC8F861A4CB7AC55"><enum>(i)</enum><header>Request for review</header><text>With respect to any competition for a grant under this chapter, an applicant may request a review if the applicant—</text><subclause id="H99B97D7858F5402FB4423D6B44FD9AEC"><enum>(I)</enum><text>has evidence that a specific technical, administrative, or scoring error was made by the Department, an agent of the Department, or a peer reviewer, with respect to the scoring or processing of a submitted application; and</text></subclause><subclause id="H39C790B5D3A94551A3D133913745CCD8"><enum>(II)</enum><text>has otherwise met all of the requirements for submission of the application.</text></subclause></clause><clause id="HB9CA046861004FA7B5124675F4430D09"><enum>(ii)</enum><header>Error made by the Department</header><text>In the case of evidence of error by the Department or an agent of the Department, other than a peer reviewer, the Secretary shall review any evidence submitted by the applicant and provide a timely response to the applicant. If the Secretary determines that an error was made by the Department or an agent of the Department, other than a peer reviewer, the Secretary shall correct the error and accordingly adjust the applicant score.</text></clause><clause id="H93CF0A3FA50D4FB28FAE2F8275023AF5"><enum>(iii)</enum><header>Error made by a peer reviewer</header><subclause id="H0DBF679B1DF64DE686BFCDEF3E13A174"><enum>(I)</enum><header>In general</header><text>In the case of evidence of error by a peer reviewer, a secondary review panel shall automatically and promptly evaluate the application for consideration in the applicable grant competition upon receipt of a request by any such applicant. Examples of errors warranting secondary review may include—</text><item id="H34BADDC2D42349DE9819FAACC62BCF01"><enum>(aa)</enum><text>points withheld for criteria not required in statute, regulation, or guidance governing a program under this chapter or the application for a grant for such program; or</text></item><item id="H7FCBCC00065540ADADC4F43DBDE2DDC3"><enum>(bb)</enum><text>information pertaining to selection criteria that was incorrectly determined to be missing from an application.</text></item></subclause><subclause id="HDD8C1FCD5EB94C52A4855785B324EB7B"><enum>(II)</enum><header>Timely review and replacement score</header><text>The secondary review panel described in subclause (I) shall conduct a secondary review in a timely fashion, and the score resulting from the secondary review shall replace the score from the initial peer review.</text></subclause><subclause id="H8A78B8B706174B43B23CBD2B3A4D79FD"><enum>(III)</enum><header>Composition of secondary review panel</header><text>The secondary review panel shall be composed of reviewers each of whom—</text><item id="H0034D950E9374A0B91719E6DDFEB1C9D"><enum>(aa)</enum><text>did not review the application in the original peer review;</text></item><item id="H5343DFC31AFD49089EE0C4F0F859723F"><enum>(bb)</enum><text>is a member of the cohort of peer reviewers for the grant program that is the subject of such secondary review; and</text></item><item id="H045EAFEED6184722B01F82E3777EA167"><enum>(cc)</enum><text>to the extent practicable, has conducted peer reviews in not less than 2 previous competitions for the grant program that is the subject of such secondary review.</text></item></subclause><subclause id="HDBD0F47B168A4B67A3C23C0BC0F12805"><enum>(IV)</enum><header>Final score</header><text>The final peer review score of an application subject to a secondary review under this clause shall promptly be adjusted appropriately using the score awarded by the secondary review panel, so as not to interfere with the timely awarding of grants for the applicable grant competition.</text></subclause></clause><clause id="H9F66ABCE9BA243F2B9BA087F0B164A6A"><enum>(iv)</enum><header>Finality</header><subclause id="H495BBA56C65B44018092E7819D967704"><enum>(I)</enum><header>In general</header><text>A determination by the Secretary under clause (ii) shall not be reviewable by any officer or employee of the Department other than the Secretary.</text></subclause><subclause id="H122751D2973A45BDB118013326524313"><enum>(II)</enum><header>Scoring</header><text>The score awarded by a secondary review panel under clause (iii) shall not be reviewable by any officer or employee of the Department other than the Secretary.</text></subclause></clause><clause id="H347B413019334EDA8F7A501141E50CFE"><enum>(v)</enum><header>Funding of applications with certain adjusted scores</header><text>Applications with scores that are adjusted upward under clause (ii) or (iii) that equal or exceed the minimum cut-off score for the applicable grant competition shall be funded by the Secretary using general or administrative funds available to the Secretary other than those funds appropriated or allocated for the programs authorized by this chapter.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1AE09EE1AEA14384B4E221B67A051E6A"><enum>(c)</enum><header>Outreach</header><text>Section 402A(d)(3) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-11">20 U.S.C. 1070a–11(d)(3)</external-xref>) is amended by adding at the end the following: <quote>The Secretary shall also host at least one virtual, interactive training using telecommunications technology to ensure that interested applicants have access to technical assistance.</quote>.</text></subsection><subsection id="H0D45A4A7067B4A569F471FC660A0E293"><enum>(d)</enum><header>Documentation of status as a low-Income individual</header><text>Section 402A(e) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-11">20 U.S.C. 1070a–11(e)</external-xref>) is amended—</text><paragraph id="H3E146348BE624C979FCEF6A41AC6AAD0"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="H773FDDD6A32E4784934C1427A47858EA"><enum>(A)</enum><text>in subparagraph (C), by striking <quote>or</quote> after the semicolon;</text></subparagraph><subparagraph id="H163AED3A025A4C9AAACEBF0284FE1E5D"><enum>(B)</enum><text>in subparagraph (D), by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="H400C3A2526304015B947ED7E070EBA17"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE8B8FCB857F64C9A8DBE26B62A6E1698"><subparagraph id="HFEEC1F6BDDA640408537B931FD5EE7BB" indent="up1"><enum>(E)</enum><text>documentation that the student has been determined to be eligible for a Federal Pell Grant under section 401; or</text></subparagraph><subparagraph id="H6CDF73AFF1CF4160933AC6905FC5F4E7" indent="up1"><enum>(F)</enum><text>for grants authorized under section 402B and 402F of this chapter, documentation that a student is attending a school that had a percentage of enrolled students who are identified students (as defined in section 11(a)(1)(F)(i) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1759a">42 U.S.C. 1759a(a)(1)(F)(i)</external-xref>)) that meets or exceeds the threshold described in section 11(a)(1)(F)(viii) of that Act during the school year prior to the first year of the period for which such grant is awarded.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H51B467E2BE48476CA609AFBA6C502BDC"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="H8EC5672491E643EF90616D02BF9F2314"><enum>(A)</enum><text>in subparagraph (C), by striking <quote>or</quote> after the semicolon;</text></subparagraph><subparagraph id="H2DC4BDAED4A442DFA9F40137BD19DC8A"><enum>(B)</enum><text>in subparagraph (D), by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="H070CC04C0FC447A6B2E50BE0A3DCD149"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8D21601C6A2B40FEBEEC70FECD621051"><subparagraph id="H91E8A3E287334F468520E7D051E6C80B" indent="up1"><enum>(E)</enum><text>documentation that the student has been determined to be eligible for a Federal Pell Grant under section 401; or</text></subparagraph><subparagraph id="HE9AFA1DBF3614634ACD741115A4B6316" indent="up1"><enum>(F)</enum><text>for grants authorized under section 402B and 402F of this chapter, documentation that a student is attending a school that had a percentage of enrolled students who are identified students (as defined in section 11(a)(1)(F)(i) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1759a">42 U.S.C. 1759a(a)(1)(F)(i)</external-xref>)) that meets or exceeds the threshold described in section 11(a)(1)(F)(viii) of that Act during the school year prior to the first year of the period for which such grant is awarded.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HCF780C9D9177478B81F378834A2105DD"><enum>(e)</enum><header>Outcome criteria</header><text>Section 402A(f) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-11">20 U.S.C. 1070a–11(g)</external-xref>) is amended—</text><paragraph id="H17CA13DAB70E41468600F2154DB4AD0E"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="H37DC0B28110C43078ECEA5158B71C9CA"><enum>(A)</enum><text>in the paragraph heading, by striking <quote><header-in-text style="OLC" level="paragraph">prior experience</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">prior success</header-in-text></quote>;</text></subparagraph><subparagraph id="H42CADC7CF0EE4EFB86947A84259A585D"><enum>(B)</enum><text>by striking <quote>January 1, 2009</quote> and inserting <quote>the date of enactment of the <short-title>Educational Opportunity and Success Act of 2023</short-title></quote>; and</text></subparagraph><subparagraph id="HF5DF19A9D3304312A457AB7F5147AA78"><enum>(C)</enum><text>by striking <quote>prior experience of</quote> and inserting <quote>prior success in achieving</quote>; and</text></subparagraph></paragraph><paragraph id="HFBD7B9337C2441C49FE25474D0991F77"><enum>(2)</enum><text>in paragraph (3)—</text><subparagraph id="HA729A7A697064B57A4C99B87E797ADBE"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="H18EAC19886CE46E88E625908797E0219"><enum>(i)</enum><text>in clause (iv), by striking <quote>that will make such students eligible for programs such as the Academic Competitiveness Grants Program</quote> and inserting <quote>that includes at least 4 years of mathematics, 3 years of science, and 2 years of a foreign language</quote>;</text></clause><clause id="H032496638D0F4806B61017B99864F2E7"><enum>(ii)</enum><text>by redesignating clauses (v) and (vi) as clauses (vi) and (vii), respectively; and</text></clause><clause id="HC4BA942FDC0F4E1B9CDAAC226D5D8906"><enum>(iii)</enum><text>by inserting after clause (iv), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD50033D3F6DA44E1B7B26A4097B76740"><clause id="HF127C31BD03E40B9A8B98E37B9F454CE"><enum>(v)</enum><text>the completion of financial aid applications, including the Free Application for Federal Student Aid described in section 483(a) and college admissions applications;</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H37AFF4B95B5E4442A8B22846CE280235"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="HB813CC4FC5C24E94B8BCFB748EC745D6"><enum>(i)</enum><text>in the matter preceding clause (i), by inserting <quote>except in the case of programs that are specifically designed for veterans,</quote> after <quote>402C</quote>;</text></clause><clause id="HC2FAD97B15A64EDF924A7BEE4F397C75"><enum>(ii)</enum><text>in clause (v), by striking <quote>that will make such students eligible for programs such as the Academic Competitiveness Grants Program</quote> and inserting <quote>that includes at least 4 years of mathematics, 3 years of science, and 2 years of a foreign language</quote>;</text></clause><clause id="HD326A3465ED847EDAE61F33315BAD838"><enum>(iii)</enum><text>by redesignating clauses (vi) and (vii) as clauses (vii) and (viii), respectively; and</text></clause><clause id="H2B66CB4859EA4C349AE9829FBF196A5A"><enum>(iv)</enum><text>by inserting after clause (v), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8D16BDFF90AA4E189657E86A9F6194BE"><clause id="H8C6269DF216849D7A98947E121B93C4E"><enum>(vi)</enum><text>the completion of financial aid applications, including the Free Application for Federal Student Aid described in section 483(a) and college admissions applications;</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HDB8A4EE226A2470A91155818467A38EA"><enum>(C)</enum><text>by redesignating subparagraphs (C) through (E) as subparagraphs (D) through (F), respectively;</text></subparagraph><subparagraph id="HDCD52A7EFCCC4A3C8205C85E0617AB11"><enum>(D)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H11149D88621D4ECDA093918B11293B4A"><subparagraph id="H08ECDC1955674D68A292A5D2957FFBB1"><enum>(C)</enum><text>For programs authorized under section 402C that are specifically designed for veterans, the extent to which the eligible entity met or exceeded the entity’s objectives for such program regarding—</text><clause id="H63594CD36D134A50A36F5199B05D5157"><enum>(i)</enum><text>the delivery of service to a total number of students served by the program, as agreed upon by the entity and the Secretary for the period of the program; </text></clause><clause id="HD922A015108D476C907ADE7248833BCE"><enum>(ii)</enum><text>such students’ academic performance as measured by standardized tests; </text></clause><clause id="H51B692FC463E42FD97DADCA4A8E1456E"><enum>(iii)</enum><text>the retention and completion of participants in the program; </text></clause><clause id="H2F9ECD74BD0C4072987170FDCB05E6FC"><enum>(iv)</enum><text>the provision of assistance to students served by the program in completing financial aid applications, including the Free Application for Federal Student Aid described in section 483(a) and college admission applications; </text></clause><clause id="H35F79153E5B64F60A288BF885CBB9575"><enum>(v)</enum><text>the enrollment of such students in an institution of higher education; and </text></clause><clause id="H9E8BDC3861D748F4A8C11CE1A976C416"><enum>(vi)</enum><text>to the extent practicable, the postsecondary completion of such students; </text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H073AF6DE920F4334A60AD857AD884FC3"><enum>(E)</enum><text>in subparagraph (D), as redesignated by subparagraph (C), by striking clause (ii) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8B74C289370C416B81413ECFF94835F4"><clause id="H204A78914CB04E19BD7993FED1DB46AB"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H5C1C761DFE174C37B917CD93A4EB8444"><enum>(I)</enum><text>in the case of an entity that is an institution of higher education offering a baccalaureate degree, the extent to which the entity met or exceeded the entity's objectives regarding the percentage of such students' completion of a baccalaureate degree at any baccalaureate granting institution within 6 years of initial enrollment in the project; or</text></subclause><subclause id="H6F32EBD608724C4E83B81A6AB15E5DE7" indent="up1"><enum>(II)</enum><text>in the case of an entity that is an institution of higher education that does not offer a baccalaureate degree, the extent to which such students met or exceeded—</text><item id="H90F53A85A843460FA535A63CF909A3B8"><enum>(aa)</enum><text>the entity’s objective regarding the transfer of such students to institutions of higher education that offer baccalaureate degrees, regardless of whether the transferring student completes a degree or certificate; and</text></item><item id="HB417AE56E95E47AA947EE82F7F435040"><enum>(bb)</enum><text>the entity’s objective regarding the completion of a degree or certificate by such students at the institution or any accredited institution within 4 years of initial enrollment in the project;</text></item></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H03DC0B74A8A045D098F23EA74DF15C7C"><enum>(F)</enum><text>by amending subparagraph (E), as redesignated by subparagraph (C), to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8964F697962B4175B3D96D1C92D53C6C"><subparagraph id="H788590D4563D4657BD99CA0AE9EB9198"><enum>(E)</enum><text>For programs authorized under section 402E, the extent to which the entity met or exceeded—</text><clause id="H55FEBBFC984C4FC88BAC835C5B55538E"><enum>(i)</enum><text>the entity’s objective regarding the delivery of service to a total number of students served by the program, as agreed upon by the entity and the Secretary for the period;</text></clause><clause id="H0DB0AF066BB8453A98888F2D633484D8"><enum>(ii)</enum><text>the entity’s objective regarding the provision of appropriate scholarly and research activities for the students served by the program;</text></clause><clause id="HB158A0FEECA24FDA80E57727CA08B88C"><enum>(iii)</enum><text>the entity’s objective regarding the acceptance and enrollment of such students in graduate programs within 2 years of receiving the baccalaureate degree; </text></clause><clause id="HE61B7A54747943EF85660E65DC8DA6BB"><enum>(iv)</enum><text>the entity’s objective regarding the continued enrollment of such students in graduate study; and</text></clause><clause id="HCE41688213F949C9A1176F507BB5B44A"><enum>(v)</enum><text>the entity’s objective regarding the attainment of doctoral degrees by former program participants within 10 years of receiving the baccalaureate degree. </text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H82EC48D5D5B249C9BB96D5578D457659"><enum>(G)</enum><text>in subparagraph (F), as redesignated by subparagraph (C)—</text><clause id="H0BB4D7F47FE143E09CF5BAD296C1A0D2"><enum>(i)</enum><text>in clause (i), by inserting <quote>within 2 years of participation in the program</quote> after <quote>such diploma or equivalent</quote>; and</text></clause><clause id="HA52740D0789849F3AB8136BF0FBBBBDE"><enum>(ii)</enum><text>in clause (ii), by inserting <quote>or re-enrollment</quote> after <quote>the enrollment</quote>.</text></clause></subparagraph></paragraph></subsection><subsection id="H2AC2D2F357A8436AB09837613FFAD4B4"><enum>(f)</enum><header>Authorization of appropriations</header><text>Section 402A(g) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-11">20 U.S.C. 1070a–11(g)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H01B446C749BA4CD78B041D9C2CF379CE"><subsection id="H328F56252A564B6EB2EDF827A81EC409"><enum>(g)</enum><header>Authorization of appropriations</header><text>For the purpose of making grants and contracts under this chapter, there are authorized to be appropriated $1,100,000,000 for fiscal year 2024 and such sums as may be necessary for each of the five succeeding fiscal years. Of the amount appropriated under this chapter, the Secretary may use no more than 1 percent of such amount to obtain additional qualified readers and additional staff to review applications, to increase the level of oversight monitoring, to support impact studies, program assessments, and reviews, and to provide technical assistance to potential applicants and current grantees.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9D48E6E875C64776B26D2EC9678385C2"><enum>(g)</enum><header>Definitions</header><text>Section 402A(h) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-11">20 U.S.C. 1070a–11(h)</external-xref>) is amended by striking paragraph (4) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H72A5A56DB2774EFEBF894D93ABE0D171"><paragraph id="H6A2359A4962D44F7B2A38CA9415BE07F"><enum>(4)</enum><header>Low-income individual</header><text>The term <term>low-income individual</term> means—</text><subparagraph id="H9474709F26B64773833AE8B22D7F6E6D"><enum>(A)</enum><text>an individual from a family whose adjustable gross income for the preceding year did not exceed 150 percent of an amount equal to the poverty level determined by using criteria of poverty established by the Bureau of the Census;</text></subparagraph><subparagraph id="H518597A2F07D4586AE009B78E8EA46D7"><enum>(B)</enum><text>an individual from a family whose adjustable gross income, as reported on the individual's most recently completed Free Application for Federal Student Aid, did not exceed 150 percent of an amount equal to the poverty level determined by using criteria of poverty established by the Bureau of the Census for that year;</text></subparagraph><subparagraph id="H4730CF443E1F4F5E89283EFDBEE4AECB"><enum>(C)</enum><text>an individual who has been determined to be eligible for a Federal Pell Grant under section 401; or</text></subparagraph><subparagraph id="H0793CDA455CE4087BE5F8C9169F41C7C"><enum>(D)</enum><text>for grants authorized under section 402B and 402F of this chapter, a student who is attending a school that had a percentage of enrolled students who are identified students (as defined in section 11(a)(1)(F)(i) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1759a">42 U.S.C. 1759a(a)(1)(F)(i)</external-xref>)) that meets or exceeds the threshold described in section 11(a)(1)(F)(viii) of that Act during the school year prior to the first year of the period for which such grant is awarded.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HEEA79CAE35ED4A74B69A394CC04D7AB6"><enum>3.</enum><header>Upward Bound</header><text display-inline="no-display-inline">Section 402C(f) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-13">20 U.S.C. 1070a–13(f)</external-xref>) is amended—</text><paragraph id="HDF8D3F05CCE541019C07B3516E7F6221"><enum>(1)</enum><text>by striking <quote>$60</quote> and inserting <quote>$90</quote>;</text></paragraph><paragraph id="H13ED61511AF34751BF14B204FA106EB0"><enum>(2)</enum><text>by striking <quote>$300</quote> and inserting <quote>$450</quote>; </text></paragraph><paragraph id="H6CBA03948F0A4ACC96A0AC7C53C304D1"><enum>(3)</enum><text>by striking <quote>$40</quote> and inserting <quote>$60</quote>; and</text></paragraph><paragraph id="HDA47CBC7567F4A50930245DB20A61C70"><enum>(4)</enum><text>by adding at the end the following: <quote>Adults participating in a project that is specifically designed for veterans under this section may be paid stipends not in excess of $100 per month during the year.</quote>.</text></paragraph></section><section id="HA201EB8836914256B1011AA9691C1726"><enum>4.</enum><header>Postbaccalaureate achievement program authority</header><text display-inline="no-display-inline">Section 402E of the Higher Education Act of 1965 (20 USC 1070a–15) is amended—</text><paragraph id="HE880427ABA414A13B270723F70F62C2F"><enum>(1)</enum><text>in subsection (b)(2), by striking <quote>summer internships</quote> and inserting <quote>internships or faculty-led research experiences</quote>;</text></paragraph><paragraph id="H3BE038E03AEB459BACF147521AB519D3"><enum>(2)</enum><text>in subsection (d)(4), by striking <quote>summer research internships</quote> and inserting <quote>research internships or faculty-led research experiences</quote>; and</text></paragraph><paragraph id="HB05176FDEC8B471EAD1DDCF92820B8D4"><enum>(3)</enum><text>in subsection (f)(1), by striking <quote>$2,800</quote> and inserting <quote>$4,000</quote>.</text></paragraph></section></legis-body></bill>
