R. 3208</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240925">September 25, 2024</action-date><action-desc> Received; read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend the Homeland Security Act of 2002 to establish a DHS Cybersecurity On-the-Job Training Program, and for other purposes.</official-title></form><legis-body id="H09A4E5DA2BF54DF08AF476A737F5A049" style="OLC"><section id="HCCA8A4FA51C34FD7995EBD5AC720946E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DHS Cybersecurity On-the-Job Training Program Act</short-title></quote>.</text></section><section id="H3484DBECBEBE4DADACE745CF827295A5"><enum>2.</enum><header>DHS Cybersecurity On-the-Job Training Program</header><subsection id="HFC2E81986B7548A08BE5B2EE9E5BF705"><enum>(a)</enum><header>In general</header><text>Subtitle A of title XXII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/141">6 U.S.C. 141 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block id="H72064BA09E724919BAE8CEE85532143D" style="OLC"><section id="H2BAAEF8818AC489B993C87C97F704A7E"><enum>2220F.</enum><header>DHS Cybersecurity On-the-Job Training Program</header><subsection id="HBF588FCC026343C8BE44F5A4C2D27692"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is established within the Agency a <quote>DHS Cybersecurity On-the-Job Training Program</quote> (in this section referred to as the <quote>Program</quote>) to voluntarily train Department employees who are not currently in a cybersecurity position for work in matters relating to cybersecurity at the Department. The Program shall be led by the Director, in consultation with the Under Secretary for Management.</text></subsection><subsection id="HD7E1BBEE78584546BCBCDEABF1D68E09"><enum>(b)</enum><header>Duties of the Director</header><text>In carrying out the Program under subsection (a), the Director—</text><paragraph id="HB4578495BA4D41B685ED83FAF5E9F346"><enum>(1)</enum><text display-inline="yes-display-inline">shall develop a curriculum for the Program, incorporating any existing curricula as appropriate, and consistent with the National Initiative for Cybersecurity Education Framework or any successor framework, which may include distance learning instruction, in-classroom instruction within a work location, on-the-job instruction under the supervision of experienced cybersecurity staff, or other means of training and education as determined appropriate by the Director;</text></paragraph><paragraph id="HC3219197A57248E4AFB00133713C1B33"><enum>(2)</enum><text display-inline="yes-display-inline">shall develop criteria for participation in the Program;</text></paragraph><paragraph id="H9B9645405E8F4579ADEF4AD7C20145C2"><enum>(3)</enum><text>in accordance with paragraph (1), shall provide cybersecurity training to employees of the Department and may, as appropriate, provide cybersecurity training to other Federal employees; and</text></paragraph><paragraph id="H01D902E3D9B745238144CF22F140CA2A"><enum>(4)</enum><text>shall annually for seven years submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report that includes—</text><subparagraph id="H08FBCC239953425A9E7AAE8F8F5D8406"><enum>(A)</enum><text display-inline="yes-display-inline">information relating to the number of employees who participated in the Program in the preceding year;</text></subparagraph><subparagraph id="H6FD03F9D2862403FA95A79B17D80FE00"><enum>(B)</enum><text>an identification of the positions into which employees trained through the Program were hired after such training;</text></subparagraph><subparagraph id="H42DAAD4BADAC422DAEAF77E13A31E361"><enum>(C)</enum><text>a description of metrics used to measure the success of the Program;</text></subparagraph><subparagraph id="H070D1074EF934D8483A573866AC96A7B"><enum>(D)</enum><text>copies of the reports submitted pursuant to (c)(1); and</text></subparagraph><subparagraph id="H59AB2403320A47699FF583DE941476FA"><enum>(E)</enum><text>any additional information relating to the duties specified in this subsection.</text></subparagraph></paragraph></subsection><subsection id="H58F299CC57194F3B8AC3719895A56AB3"><enum>(c)</enum><header>Duties of the Under Secretary for Management</header><text>In carrying out the Program under subsection (a), the Under Secretary for Management shall—</text><paragraph id="HD4EE4C9C8F7F40AE9429B615CBF9F240"><enum>(1)</enum><text>submit to the Secretary an annual report on the status of vacancies in cybersecurity positions throughout the Department;</text></paragraph><paragraph id="HEF260423674C473AA72B0F8D31EEF568"><enum>(2)</enum><text>support efforts by the Director to identify and recruit individuals employed by the Department to participate in the Program;</text></paragraph><paragraph id="HBA818D0D2B154560ADD0F273A6007D46"><enum>(3)</enum><text display-inline="yes-display-inline">implement policies, including continuing service agreements, to encourage participation in the Program by employees throughout the Department; and</text></paragraph><paragraph id="H0FBB52B317824E0A9E789B148188E2F4"><enum>(4)</enum><text>conduct outreach to employees who complete the Program regarding cybersecurity job opportunities within the Department.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H4796C171C3AE4987A1D8C5EDFE775D7D"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of the Homeland Security Act of 2002 is amended by inserting after the item relating to section 2220E the following new item:</text><quoted-block style="OLC" id="H6046F28DA3E44A138E56A7AFB968C3E0" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 2220F.
