which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Plant Protection Act for purposes of mitigating the threat of invasive species, and for other purposes.</official-title></form><legis-body id="H47489A7FE19C4F3FB9E3577D35CA6517" style="OLC"><section section-type="section-one" id="H9DD5813C08674932B388A2184ACF70C9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Invasive Species Prevention and Forest Restoration Act</short-title></quote>.</text></section><section id="HC204301E078145EAA3D7FAF26B5448B1"><enum>2.</enum><header>Emergency authority with respect to invasive species</header><text display-inline="no-display-inline">Section 442 of the Plant Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7772">7 U.S.C. 7772</external-xref>) is amended—</text><paragraph id="HEABD93E7B8D24F3FBF64C83FA81D2E7F"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by inserting <quote>directly or indirectly</quote> before <quote>threatens</quote>;</text></paragraph><paragraph id="H204789E16CA346F8A726BD7F2C293B97"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="HFE57FDDB819043519752741ABAF843DD"><enum>(A)</enum><text>by striking <quote>shall remain</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="HC99B70F04FB34C6AB7E0598F3A744B39"><text>shall—</text><paragraph id="H61BB1A7A117B4ED3A90152A65DF9C603"><enum>(1)</enum><text>remain</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="HFABF9E2BC866496BACEC9217693A5D40"><enum>(B)</enum><text>in paragraph (1) (as so designated), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H9F41452E0FB34EDD9ECE3476E99E7423"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H109234F8BA8B47F38878CF757696F525"><paragraph id="H22048EA267964013819F88D5C10AAD50"><enum>(2)</enum><text>be transferred not later than 60 days after the date on which the Secretary determines that there is an emergency described in subsection (a).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H7A13E85179FA4B9FA708730B6DEDC823"><enum>(3)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph><paragraph id="HC80F52ED11594C35AF67FA34DF17BD43"><enum>(4)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5E96DE4DA512435DB0E7257C38FD15C9"><subsection id="H45B5E7FACB53405B8F4C0A22C5D5C97F"><enum>(c)</enum><header>Emergency determination</header><text>In determining whether there is an emergency described in subsection (a), the Secretary shall consider, but shall not treat as a dispositive factor, whether there are sufficient Federal funds available to timely achieve the arrest, control, eradication, or prevention of the spread of the applicable plant pest or noxious weed.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HDBB36486E7D6439A9B227B0023A21F64"><enum>3.</enum><header>Forest reclamation grants</header><text display-inline="no-display-inline">Subtitle K of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3310">7 U.S.C. 3310 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9E364952D043428CB170CE0A4179D61C"><section id="H4B9EF60AEBDE419DB138D4D9714C1DE2"><enum>1473I.</enum><header>Forest reclamation grants</header><subsection commented="no" display-inline="no-display-inline" id="H01CE37AEB7BC48598AD8FE418A572BC2"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="H91F88853B3E64046B4ABC63AB86F43DE"><enum>(1)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means any of the following:</text><subparagraph id="HBE6C4547C6C64B7A90573C35A14FD4CB"><enum>(A)</enum><text>A Federal agency.</text></subparagraph><subparagraph id="H6954A2CA46324114BAFED2348A614C51"><enum>(B)</enum><text>A State cooperative institution.</text></subparagraph><subparagraph id="H592862BA24B849C2BB028E9270DCEC60"><enum>(C)</enum><text display-inline="yes-display-inline">A college or university offering a baccalaureate or higher degree in the study of food, forestry, and agricultural sciences.</text></subparagraph><subparagraph id="H06237CA3214F48ACA42CF06FAAC170D0"><enum>(D)</enum><text display-inline="yes-display-inline">An organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of that Code. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF98051A70AD0438B8D36B28053DC0A20"><enum>(2)</enum><header>Noxious weed; plant pest</header><text display-inline="yes-display-inline">The terms <term>noxious weed</term> and <term>plant pest</term> have the meanings given those terms in section 403 of the Plant Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7702">7 U.S.C. 7702</external-xref>).</text></paragraph></subsection><subsection id="HBDC3A9E0AC8B4179BABF6A9EE3B7D6B4"><enum>(b)</enum><header>Grant awards</header><text>For purposes of addressing the critical threat to numerous tree species posed by nonnative plant pests and noxious weeds, the Secretary shall award competitive grants to eligible entities under which the eligible entities shall—</text><paragraph id="HB983701FED56492FAD4E156E8B104D8C"><enum>(1)</enum><text>conduct research to promote the restoration of affected tree species, including research on—</text><subparagraph id="HF24738C3092647909F81F1E305990BD2"><enum>(A)</enum><text>biological control of nonnative plant pests or noxious weeds threatening or heavily damaging native tree species; </text></subparagraph><subparagraph id="HF37B1C90CC3C403BB18DAEAB81D391EE"><enum>(B)</enum><text>exploration of genetic manipulation of plant pests or noxious weeds;</text></subparagraph><subparagraph id="H55B4F4954CBD4B7EA9E5C3A746FCAE5C"><enum>(C)</enum><text>enhancement of pest-resistance mechanisms of hosts; and</text></subparagraph><subparagraph id="H122099B6C6554A0C83DB6185579F1ED0"><enum>(D)</enum><text>development of other strategies for restoring individual tree species; and</text></subparagraph></paragraph><paragraph id="HE295165E8D544BBAB95B741EA5D2F26F"><enum>(2)</enum><text>develop, and disseminate to the public, tools and information based on the research conducted under paragraph (1).</text></paragraph></subsection><subsection id="HEDF3117ABA904493AACC190AFE911D33"><enum>(c)</enum><header>Applications</header><text display-inline="yes-display-inline">An eligible entity seeking to receive a grant under this section shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including a description of a comprehensive forest restoration research program to be carried out by the eligible entity using the funds received through the grant.</text></subsection><subsection id="HD34C1D1BBA334A4EA45213354E39017B"><enum>(d)</enum><header>Use of funds</header><paragraph id="H98518100D7B04284A85EDBAF6E70B743"><enum>(1)</enum><header>In general</header><text>An eligible entity receiving a grant under this section shall use the funds received through the grant to conduct research intended to address specific questions relating to the recovery of tree species that are native to the United States and suffering severe levels of mortality caused by nonnative plant pests or noxious weeds.</text></paragraph><paragraph id="H9ECEEA8FB1E24DF1AD92B2C01F08607D"><enum>(2)</enum><header>Matching requirement</header><subparagraph id="H53D4B664D4A34A03B8D0A399097EC0A9"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under this section shall provide matching funds from non-Federal sources in an amount equal to not less than 20 percent of the grant. </text></subparagraph><subparagraph id="H087D2A35414E4165821B360A5168BC7B"><enum>(B)</enum><header>Indirect costs</header><clause commented="no" display-inline="no-display-inline" id="HAE81969F496949E4A191551956AF33EE"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Indirect costs charged against a grant awarded under this section shall not exceed 30 percent of the total Federal funds provided under the grant award.</text></clause><clause commented="no" display-inline="no-display-inline" id="H9A2250C346FB4002AFFCC34C604581F8"><enum>(ii)</enum><header>Inclusions</header><text>Indirect costs described in clause (i) shall include—</text><subclause commented="no" display-inline="no-display-inline" id="H4652B9ED1161405A80C2B7D44393D45B"><enum>(I)</enum><text display-inline="yes-display-inline">equipment used in relation to the grant;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H2F512E95AABA4EBFA83CFBF1AE7F7614"><enum>(II)</enum><text>capital improvements of facilities that are necessary to carry out the grant;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H117C25FF403B4CB393F21EB9D636FE26"><enum>(III)</enum><text>accounting costs, personnel costs, and administrative costs incurred by an eligible entity necessary to carry out the grant; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H177BCAAA7EC9485DA2CF41327934308E"><enum>(IV)</enum><text display-inline="yes-display-inline">such other costs as the Secretary determines to be appropriate. </text></subclause></clause></subparagraph></paragraph><paragraph id="H8555979561FF45EABFD74D1D2C7838F8"><enum>(3)</enum><header>Maximum amount of grants</header><text display-inline="yes-display-inline">An eligible entity may not receive more than a total of $400,000 per year in grant funding under this section.</text></paragraph></subsection><subsection id="H76FD0CF5909542D9BC2CD086307815AB"><enum>(e)</enum><header>Cooperation among eligible entities</header><text>To the maximum extent practicable, the Secretary shall encourage eligible entities to cooperate in setting research priorities under this section.</text></subsection><subsection id="H291F55288ED34655A5D7138E68DDCC0B"><enum>(f)</enum><header>Committees</header><text>In carrying out this section, the Secretary shall—</text><paragraph id="H264FB7F94A674113A845919A363BE1B7"><enum>(1)</enum><text>establish a committee of experts composed of representatives of the Forest Service, the Animal and Plant Health Inspection Service, the Agricultural Research Service, and State forestry agencies to advise the Secretary on criteria appropriate for—</text><subparagraph id="HD663D97938B947D8960BCF24FCFC0935"><enum>(A)</enum><text>defining research topics eligible for funding under this section;</text></subparagraph><subparagraph id="H009EBFA0D24C4F5197DBCB3E7056DBC7"><enum>(B)</enum><text>reviewing the adherence of grant proposals to the purposes described in subsection (b)(1); and</text></subparagraph><subparagraph id="HF07F1820350C466DA3B6B6F02E90C08C"><enum>(C)</enum><text>membership in scientific peer review panels to review grant applications under this section; and</text></subparagraph></paragraph><paragraph id="HB490B6F033D84BC782FA95E254DA6222"><enum>(2)</enum><text>establish an advisory committee composed of representatives of land-grant colleges and universities and affiliated State agricultural experiment stations, the forest products industry, recreationists, and professional forester, conservation, and conservation scientist organizations to assist the committee of experts established under paragraph (1) with respect to the responsibilities of that committee described in subparagraphs (A), (B), and (C) of that paragraph.</text></paragraph></subsection><subsection id="H9A7B19D0A2F544D0A7C43273D3CF7F8A"><enum>(g)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the first grant is awarded under this section, and annually thereafter, the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report describing the use of funds under this section in the previous year.</text></subsection><subsection id="H0BAD047E7D0F4094BF7A0D9860FCE3B5"><enum>(h)</enum><header>Funding</header><text>Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this section—</text><paragraph id="H775E9C98A4724048ACB4E82B5AFD08F3"><enum>(1)</enum><text>$3,000,000 for fiscal year 2023;</text></paragraph><paragraph id="HBDE44D517F804F5CAD38D9038C506AD8"><enum>(2)</enum><text>$5,000,000 for fiscal year 2024;</text></paragraph><paragraph id="HAD68B54D05CC4C84A3D65E26B2D62981"><enum>(3)</enum><text>$8,000,000 for fiscal year 2025; and</text></paragraph><paragraph id="HA781402CCB8A42989B3C7A29696EEED3"><enum>(4)</enum><text>$10,000,000 for fiscal year 2026.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H51AEB8ABFC2545A6AE3F1A2A18021D9C"><enum>4.</enum><header>Forest restoration implementation grants</header><text display-inline="no-display-inline">Subtitle K of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3310">7 U.S.C. 3310 et seq.</external-xref>) (as amended by section 3) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6483F1B4D9E0417C84C09FEDFAED70ED"><section id="H67556BF0A01544CFB6D1BDAEC925CF81"><enum>1473J.</enum><header>Forest restoration implementation grants</header><subsection commented="no" display-inline="no-display-inline" id="HEEAE157253F0418DA9A207F82FE10C2B"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="H0487941318074BE295511AF8CA628F98"><enum>(1)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means any of the following:</text><subparagraph id="HFAFD6849B4724BC287E0B35A7D61B517"><enum>(A)</enum><text>A cooperating forestry school.</text></subparagraph><subparagraph id="H80843A826FEE4D93A4598B7BC17E231B"><enum>(B)</enum><text>A land-grant college or university.</text></subparagraph><subparagraph id="H7209C0D28A9A4F1486EBFC378E90C636"><enum>(C)</enum><text>A State agricultural experimental station.</text></subparagraph><subparagraph id="H830F503246A54E3BA5D4367EBB4DD841"><enum>(D)</enum><text>An organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of that Code.</text></subparagraph><subparagraph id="H03F0883824DE48C98A94CAF9D7FED80B"><enum>(E)</enum><text>A Federal agency.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9223B0427E54416681F16F32302CA841"><enum>(2)</enum><header>Noxious weed; plant pest</header><text display-inline="yes-display-inline">The terms <term>noxious weed</term> and <term>plant pest</term> have the meanings given those terms in section 403 of the Plant Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7702">7 U.S.C. 7702</external-xref>).</text></paragraph></subsection><subsection id="HBCE8F105C2634AA991D77B953DF4CC09"><enum>(b)</enum><header>Grant awards</header><text display-inline="yes-display-inline">The Secretary may award grants on a competitive basis under this section to eligible entities to support—</text><paragraph id="HE92F8DEBB3494333981913AA80D0BB04"><enum>(1)</enum><text>the implementation of research conducted under section 1473I; or</text></paragraph><paragraph id="HA72928521FFE4C1EA6001391D37C6AB9"><enum>(2)</enum><text>any other solution that the committee established under subsection (f)(1) of that section determines to be effective in restoring forest tree species native to forests in the United States that have suffered severe levels of mortality caused by nonnative plant pests or noxious weeds.</text></paragraph></subsection><subsection id="H531D59CDAF8E434F8D025B90971FEDD1"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity seeking to receive a grant under this section shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including a demonstration that the eligible entity has a program in effect with a forest restoration strategy that incorporates a majority of the following components:</text><paragraph id="HE45FFA2D5E90427C887C3705AA9B1ABC"><enum>(1)</enum><text display-inline="yes-display-inline">Collection and conservation of native tree genetic material.</text></paragraph><paragraph id="H0410F80808C14F71B180523172FD208A"><enum>(2)</enum><text>Production of propagules of native trees in numbers large enough for landscape-scale restoration.</text></paragraph><paragraph id="HDA3FD1BC1A84452A9A821826EBC28E33"><enum>(3)</enum><text display-inline="yes-display-inline">Preparation of planting sites in former habitats of the native tree species that are the subjects of the application.</text></paragraph><paragraph id="HCD4F5EF3B72F4715B815B885032CC4DC"><enum>(4)</enum><text>Planting of native tree seedlings.</text></paragraph><paragraph id="H6A685FA3EA2E44BF904BB60575EAB0EE"><enum>(5)</enum><text>Post-planting maintenance of native trees.</text></paragraph></subsection><subsection id="H3E6D4614B5744ADC89D3AF8E56185D30"><enum>(d)</enum><header>Selection criteria</header><text display-inline="yes-display-inline">The Secretary shall select an eligible entity to receive a grant under this section based on the degree to which the application submitted by the eligible entity under subsection (c) addresses the following criteria:</text><paragraph id="H96D3FB80ABC749E39EF67F54EC0994B6"><enum>(1)</enum><text>The risk posed to the forests of the State in which the work is to be conducted using funding received through the grant by nonnative plant pest or noxious weed species present in the State.</text></paragraph><paragraph id="HCCAD85F343354F22B8DB830DD6F1C9DE"><enum>(2)</enum><text>The proportion of the forest land of the State composed of species vulnerable to nonnative plant pests or noxious weeds present in the United States.</text></paragraph><paragraph id="HF2460E3CB8FD4935916D5BB24341B22D"><enum>(3)</enum><text>The rate of spread in the State, through natural or human-assisted means, of nonnative plant pests or noxious weeds.</text></paragraph><paragraph id="H00DF7A065AD14737A529C6E7C1F33056"><enum>(4)</enum><text display-inline="yes-display-inline">The environmental and public health safety of the project proposed to be conducted using funding received through the grant, as demonstrated by supporting research.</text></paragraph></subsection><subsection id="H14D2A3050CC04815A51C6078AC84D03E"><enum>(e)</enum><header>Matching requirement</header><paragraph id="H12A6556D06B24BCF9C04263C9D5CD81B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under this section shall provide matching funds from non-Federal sources in an amount equal to not less than 10 percent of the grant. </text></paragraph><paragraph id="HF8BDE35FD9554D63AF54CE7EEB58E900"><enum>(2)</enum><header>Indirect costs</header><subparagraph commented="no" display-inline="no-display-inline" id="H01EA16D3C27641AC86BE9CA9269FE47D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Indirect costs charged against a grant awarded under this section shall not exceed 30 percent of the total Federal funds provided under the grant award.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA5DCC7E8E05B4C69B109FC20D643FFF1"><enum>(B)</enum><header>Inclusions</header><text>Indirect costs described in subparagraph (A) shall include—</text><clause commented="no" display-inline="no-display-inline" id="HAB3B42A2E0034688BFA90F747039EF21"><enum>(i)</enum><text display-inline="yes-display-inline">equipment used in relation to the grant;</text></clause><clause commented="no" display-inline="no-display-inline" id="HAFEE8166AFFA4B4EA530579481688748"><enum>(ii)</enum><text>capital improvements of facilities that are necessary to carry out the grant;</text></clause><clause commented="no" display-inline="no-display-inline" id="HEB9D468A623B46AABD106172DB4F5CEF"><enum>(iii)</enum><text>accounting costs, personnel costs, and administrative costs incurred by an eligible entity necessary to carry out the grant; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H5FC6FC74B6F946C0A1ED838A8498D500"><enum>(iv)</enum><text display-inline="yes-display-inline">such other costs as the Secretary determines to be appropriate.</text></clause></subparagraph></paragraph></subsection><subsection id="H066E9EF0879D403998DB39F2459D624E"><enum>(f)</enum><header>Funding</header><paragraph id="HF03286F036B54B7DAC8942A09B0CF302"><enum>(1)</enum><header>In general</header><text>Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this section $25,000,000 for each of fiscal years 2023 through 2026.</text></paragraph><paragraph id="HD5AE94A0EAF84749AA042F15FD4E1DF7"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">Of the funds made available under paragraph (1) for a fiscal year, not more than 5 percent may be used by the Secretary for expenses relating to the administration of this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H462EA394A3A54A798C067F19154986F9"><enum>5.</enum><header>Study on protection of forests from nonnative plant pests and pathogens</header><subsection id="HD20C9BC0262F48C2BA97D63C24910CB1"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text><paragraph id="H6F389B8EE8024A81AAD9F754C9E113C0"><enum>(1)</enum><text display-inline="yes-display-inline">many Federal agencies have important roles to play in addressing nonnative plant pests and pathogens in the stewardship and management of forests by those Federal agencies;</text></paragraph><paragraph id="HCF7A5F7911A44624B84D4CD444AA580E"><enum>(2)</enum><text display-inline="yes-display-inline">because of a lack of national policy, nonnative plant pests and pathogens of forests are a low priority for all Federal agencies; and</text></paragraph><paragraph id="HEF7C0D07805A4B899AEB4C3314991480"><enum>(3)</enum><text>efforts to prevent the introduction and spread of nonnative plant pests and pathogens, and especially to reduce the resulting damage and restore tree species to forests, lack coordination and action.</text></paragraph></subsection><subsection id="H273BD2A6A22940A2A883713ED81F9377"><enum>(b)</enum><header>Study</header><paragraph id="H84B3F7DCA31246FEBE67DF7EE6D86E81"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Agriculture (referred to in this section as the <quote>Secretary</quote>) shall seek to enter into an agreement (referred to in this section as the <quote>Agreement</quote>) with the National Academy of Sciences, or another nongovernmental entity that the Secretary determines to be most appropriate, under which the National Academy of Sciences or other entity, as applicable, not later than 1 year after the date of enactment of this Act, shall conduct, and submit to Congress a report describing the results of, a study to analyze the available resources that Federal agencies have to research, and find solutions to, nonnative plant pests and pathogens. </text></paragraph><paragraph id="H09B66C8F45E34AB89A778DBB712EE378"><enum>(2)</enum><header>Recommendations</header><text display-inline="yes-display-inline">The report submitted pursuant to paragraph (1) shall include recommendations—</text><subparagraph id="HBAF220B1683B4645B2AE427D61F4EEA5"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to—</text><clause id="HB4414330E92F4D129BA25FE6617C3ECD"><enum>(i)</enum><text display-inline="yes-display-inline">establishing a national policy to effectively counter the threat posed by nonnative pests and disease pathogens to tree species, including preventing the introduction and spread of those pests and pathogens, minimizing the damage caused by those pests and pathogens, and restoring affected tree species to the forest;</text></clause><clause id="HF5E5C2F78AE44D1B880EAC23343BC1D8"><enum>(ii)</enum><text display-inline="yes-display-inline">improving coordination and cooperation among Federal agencies with responsibility for management and repair of the decimation of tree species affected by nonnative pests and disease pathogens and associated ecological destruction; </text></clause><clause id="H078FD8D743654481A90FFE4F857649EA"><enum>(iii)</enum><text>addressing the low prioritization by the Federal agencies described in clause (ii) of nonnative plant pests and pathogens affecting forests and trees;</text></clause><clause id="HA233CDEC10184339B1F14C13A9652182"><enum>(iv)</enum><subclause commented="no" display-inline="yes-display-inline" id="H46F7F3C786A04D7C800FAAFF435CFDA4"><enum>(I)</enum><text display-inline="yes-display-inline">identifying expertise and site and facility resources within the Federal agencies described in clause (ii); and </text></subclause><subclause id="H0792CADE64F743C0BBE4FC9F79CDEB02" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">improving coordination among those agencies with respect to the management and repair described in clause (ii), including coordination with academic institutions and other appropriate nonprofit organizations; </text></subclause></clause><clause id="H8475083CB64D4A3C9E3F2EE14EFD4851"><enum>(v)</enum><text display-inline="yes-display-inline">the establishment of a center for nonnative forest pest control, prevention, and species restoration within the Department of Agriculture, including potential organizational structures of such a center, with an emphasis on including representation of a wide variety of appropriate agencies within the center, including the Animal and Plant Health Inspection Service, the Agriculture Research Service, the National Institute of Food and Agriculture, the Natural Resources Conservation Service, the Forest Service, and any other agency that the Secretary determines is appropriate; and</text></clause><clause id="HF7C3A5E5562E4735B7C937D08094EC34"><enum>(vi)</enum><subclause commented="no" display-inline="yes-display-inline" id="HA725BFCF254946E099FE2A0DB45EC90D"><enum>(I)</enum><text>giving priority to the emergency response of the Department of Agriculture to an emergency relating to nonnative pests and disease pathogens;</text></subclause><subclause id="H22D5049B967245F68133A6537B84F8DC" indent="up1"><enum>(II)</enum><text>clarifying the coordination of the Department of Agriculture with other Federal agencies in responding to those emergencies; and </text></subclause><subclause indent="up1" id="H81E885BB63984B958D7E397479B22168"><enum>(III)</enum><text>identifying funding levels sufficient to carry out responses to those emergencies; and </text></subclause></clause></subparagraph><subparagraph id="H1EBB1B372A7A441C98AA5DE6C519933C"><enum>(B)</enum><text>that—</text><clause id="H0AF7E3CD1DAC437CBB2A8CABA43C0EA5"><enum>(i)</enum><text>take into account existing Federal resources; and</text></clause><clause id="H794E142A87854CCE892B7C106C5E4EDB"><enum>(ii)</enum><text>may be implemented through further legislative and administrative action.</text></clause></subparagraph></paragraph><paragraph id="H4FCEE45C55C340FEA8E1A540BE16DBF2" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Agreement shall require the National Academy of Sciences or other entity, as applicable, to consult with specialists in entomology, genetics, forest pathology, tree breeding, forest and urban ecology, and invasive species management.</text></paragraph></subsection></section></legis-body></bill>
