BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to exclude employer-reimbursed travel expenses for abortion-related care from taxation, and for other purposes.</official-title></form><legis-body id="H6374CE4C9D604DE59886E3437773EBE4" style="OLC"><section id="H05A6B012B976408FBCFF26AAA0A457F8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Travel for Care Act</short-title></quote>. </text></section><section id="H8D5163B59D1E4A65B02F84FE285376AE" commented="no"><enum>2.</enum><header>Tax treatment of abortion-related travel arrangements</header><subsection id="HFC7E0E6F0DAF478EBD26E2B0441495FA"><enum>(a)</enum><header>Amendments to the Internal Revenue Code of 1986</header><paragraph id="H9475580D8A3B40D7B43064B44F748E53"><enum>(1)</enum><header>Exception from group health plan requirements for abortion-related travel arrangements</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/9831">Section 9831</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF21184F9A3E043A38227D5A344025F13"><subsection id="HD8F05EB3ED644B7CB3C9C31DEE34AA77"><enum>(e)</enum><header>Exception for abortion-Related travel arrangements</header><paragraph id="HAD9C5045D4704FCC8A29FA2361180B86"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this title (and notwithstanding any other provision of this title), the term <quote>group health plan</quote> shall not include any abortion-related travel arrangement.</text></paragraph><paragraph id="HBF90AE96927E43BEB9D50D1AE8A8EE92"><enum>(2)</enum><header>Abortion-related travel arrangement</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>abortion-related travel arrangement</quote> means an arrangement which—</text><subparagraph id="HD6E509EFABCF40E6B4FFD3D222A999E2"><enum>(A)</enum><text>is funded by an employer, and </text></subparagraph><subparagraph id="H69C36D06DE794874B254C79869E0DA39"><enum>(B)</enum><text display-inline="yes-display-inline">provides for the payment of, or reimbursement of, an employee for expenses incurred by the employee or the family members of such employee (as determined under the terms of the arrangement) for travel, including meals and lodging, to receive an abortion or follow-up care related to such abortion.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HC819D4F5E7CE47729B9CE0182799A94D"><enum>(2)</enum><header>Meals and lodging related to travel for abortion-related medical care included as amounts paid for medical care; Increased limitation for such amounts</header><text>Section 213(d) of such Code is amended—</text><subparagraph id="HB40DA09DDE4243A9ABDF43CB1E988BD3"><enum>(A)</enum><text>in paragraph (1), by striking <quote>or</quote> at the end of subparagraph (C), by striking the period at the end of subparagraph (D) and inserting <quote>, or</quote>, and by adding at the end the following new subparagraph: </text><quoted-block style="OLC" id="HEBBF40EDE0154AA4958524B8D58033DB" display-inline="no-display-inline"><subparagraph id="H280DE14577B741C6929BEDC54A452619"><enum>(E)</enum><text display-inline="yes-display-inline">in the case of an abortion or follow-up care related to an abortion, for meals and lodging while away from home primarily for and essential to such care if there is no significant element of personal pleasure, recreation, or vacation in the travel away from home.</text></subparagraph><after-quoted-block>, and </after-quoted-block></quoted-block></subparagraph><subparagraph id="H4F3963BB08A140F5B93B4D05F1BC507A"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="H6A88E732F4454B86978566FA1F7F912D" display-inline="no-display-inline"><enum>(i)</enum><text>in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">Amounts paid for certain lodging away from home treated as paid for medical care</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Special rules for lodging and meals</header-in-text></quote>, </text></clause><clause id="H4D8E9E3BBE514C6A81075CEF61D4C78E"><enum>(ii)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively,</text></clause><clause id="H1BE9B83888C34A7FA032763A6F88B3F3"><enum>(iii)</enum><text>by striking <quote>Amounts paid for lodging</quote> and inserting:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA80F09C2734F4ECAB564A7ADAC34284C"><subparagraph id="HC3E6539F84C14D75B4AE6152EAE682D7"><enum>(A)</enum><header>Amounts paid for certain lodging away from home treated as paid for medical care</header><text display-inline="yes-display-inline">Amounts paid for lodging other than lodging described in paragraph (1)(E)</text></subparagraph><after-quoted-block>, and</after-quoted-block></quoted-block></clause><clause id="HD5CFB3FD081B4D5EB0FD008A0463A802"><enum>(iv)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="HD5C69B919EBA465FAE4BD8127403C5DE" display-inline="no-display-inline"><subparagraph id="H9A55165943FA4DC98330B5F276F00235"><enum>(B)</enum><header>Limitation on amounts taken into account for meals and lodging related to abortion-related medical care</header><text display-inline="yes-display-inline">In the case of amounts paid for meals and lodging as described in subparagraph (E) of paragraph (1), the amount taken into account under such subparagraph shall not exceed, with respect to each night and each individual, the maximum per diem rates for official Federal Government travel published annually by the General Services Administration, the Department of State, and the Department of Defense.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H26CD413F3E224145961577F99D33CAD1"><enum>(3)</enum><header>Abortion-related travel arrangements disregarded for purposes of health savings account eligibility</header><text display-inline="yes-display-inline">Section 223(c)(1)(B)(ii) of such Code is amended by striking <quote>or</quote> after <quote>long-term care,</quote> and by inserting <quote>or coverage under an abortion-related travel arrangement (as defined in section 9831(e)(2)),</quote> after <quote>other remote care,</quote>. </text></paragraph><paragraph id="H68C920F0DA19494587609F7840B930B4"><enum>(4)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply to amounts paid or incurred after June 23, 2022.</text></paragraph></subsection><subsection id="H62FAA6DBD39C4297A1020B0C8F91C460"><enum>(b)</enum><header>Amendments to the Employee Retirement Income Security Act of 1974</header><paragraph id="H087D08668E8046258256ACFC041FDDB4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 733(a)(1) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1191b">29 U.S.C. 1191b(a)(1)</external-xref>) is amended by inserting <quote>or any abortion-related travel arrangement (as defined in section 9831(e)(2) of such Code)</quote> before the period at the end.</text></paragraph><paragraph id="HD8FDAF513DD040FC86FE1547544C7B0F"><enum>(2)</enum><header>Exception from continuation coverage requirements, etc</header><text display-inline="yes-display-inline">Section 607(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1167">29 U.S.C. 1167(1)</external-xref>) is amended by inserting <quote>or any abortion-related travel arrangement (as defined in section 9831(e)(2) of such Code)</quote> before the period at the end.</text></paragraph><paragraph id="HAC772DF899EF4AAAB11A6CD227C31B31"><enum>(3)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this subsection shall apply to plan years beginning after June 23, 2022.</text></paragraph></subsection><subsection id="H3F94DECCA3004C7F942B525E99B259BB"><enum>(c)</enum><header>Amendments to the Public Health Service Act</header><paragraph id="H7740FDAF5A3E428FB98B7FCF8CEAAD9D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2791(a)(1) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-91">42 U.S.C. 300gg–91(a)(1)</external-xref>) is amended by inserting <quote>or any abortion-related travel arrangement (as defined in section 9831(e)(2) of such Code)</quote> before the period at the end.</text></paragraph><paragraph id="H2F4F6D9B5EDE4D0F9ACB4E49773C1F08"><enum>(2)</enum><header>Exception from continuation coverage requirements</header><text display-inline="yes-display-inline">Section 2208(1) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300bb-8">42 U.S.C. 300bb–8(1)</external-xref>) is amended by inserting <quote>or any abortion-related travel arrangement (as defined in section 9831(e)(2) of such Code)</quote> before the period at the end.</text></paragraph><paragraph id="H59797676506142CE9DE1B59CC598838F"><enum>(3)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this subsection shall apply to plan years beginning after June 23, 2022.</text></paragraph></subsection></section><section id="HC47E9AF085724735AC7C14A0DCE08586"><enum>3.</enum><header>Safe harbor for absence of deductible for contraception, abortion, and abortion-related expenses</header><subsection id="H067EE85FAAFB4E7CA54B38D885F44040"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/223">Section 223(c)(2)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H605CA1976E9F4175BA011A8F59C5CBCA"><subparagraph id="H1DC85EFCB4C94D3F906FB81F3854F55B"><enum>(H)</enum><header>Safe harbor for absence of deductible for contraception, abortion, and abortion-related expenses</header><text display-inline="yes-display-inline">A plan shall not fail to be treated as a high deductible health plan by reason of failing to have a deductible for contraception, abortion, or abortion-related travel expenses described in section 9831(e)(2).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H37FE99C2FD9D4C848967F81DD5502852"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this subsection shall apply to plan years beginning after June 23, 2022.</text></subsection></section></legis-body></bill>
