Definitions.</toc-entry></toc></subsection></section><title id="H424B2C365E264032B3AD04E684859938"><enum>I</enum><header>Tuition-Free Community College</header><section id="H0FBD22B182AB41FD8B3F0F31BFE1CB3F" section-type="subsequent-section"><enum>101.</enum><header>Tuition-free community college grant program</header><subsection id="H221C1655D03F414E8D26D20CEFA56A6B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a program to provide grants to each State that submits a complete application to facilitate tuition-free community college for all eligible students.</text></subsection><subsection id="H1DF103F2160C4B18AD10B7E266BDB015"><enum>(b)</enum><header>Grant amounts</header><text>The Secretary shall determine grant amounts under subsection (a) with respect to each State based on the following:</text><paragraph id="HF16D48B5F665464C9D4F674CCB50F880"><enum>(1)</enum><text>Statewide unemployment and underemployment rates that are 1 percentage point above the national average.</text></paragraph><paragraph id="H53129073C7484E6DB3E0451DBDE2443D" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The number of local educational agencies in a State that elect to receive special assistance payments under section 11(a)(1)(F) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1759a">42 U.S.C. 1759a(a)(1)(F)</external-xref>).</text></paragraph><paragraph id="HF1C17A2E449547989B0F36F9F2E04639"><enum>(3)</enum><text>A statewide official poverty rate that is 1 percentage point above the national average.</text></paragraph></subsection><subsection id="H780D29DD73AA4CECBFA12A6A343C17E2"><enum>(c)</enum><header>Funds</header><paragraph id="H9B7B6A6B26F042358DEB46D4B53F8B06"><enum>(1)</enum><header>Timing</header><text>A grant under this title shall be awarded for a period of 5 years, of which—</text><subparagraph id="H2FD8CE84FCA149DCAD9C0474791BE170"><enum>(A)</enum><text>a maximum of 1 year may be used for planning; and</text></subparagraph><subparagraph id="HCF0A54A1515C4F6EA4CDE96D86BF0974"><enum>(B)</enum><text display-inline="yes-display-inline">a minimum of 4 years shall be used for implementation.</text></subparagraph></paragraph><paragraph id="HB25B238FAD1E40D1978D8C44CCAD1F2B"><enum>(2)</enum><header>Federal cost share</header><text>The Federal cost share of an activity carried out with a grant under subparagraph (a) shall not be less than 100 percent for costs incurred during the 5-year grant period described in paragraph (1).</text></paragraph></subsection></section><section id="H6ABE1CE1CF434B24B56F7600D1A71EB7"><enum>102.</enum><header>Applications</header><text display-inline="no-display-inline">To be eligible for a grant under this title, a State shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines appropriate, including a State plan describing the following:</text><paragraph id="H76C4CC56DBF745CAA97B6B98D4C4A5BF"><enum>(1)</enum><header>Interagency committee</header><subparagraph id="HCCCCBFE5097641129287CBF871624618"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A plan to formalize an interagency committee within such State to—</text><clause id="HAB4C731BC86E45C4B9A70C34E5BC788E"><enum>(i)</enum><text>evaluate gaps and opportunities in the State workforce, higher education, childcare, and human services systems; and</text></clause><clause id="H7C148BFF4BD64587999539E0ED277129"><enum>(ii)</enum><text>maximize Federal and State resources to support pathway development that increases economic mobility and recognized postsecondary credential attainment.</text></clause></subparagraph><subparagraph id="H8B9CDE848293425298E0A74F8A72FCC8"><enum>(B)</enum><header>Membership</header><text>An assurance that such committee shall consist of members from the following entities:</text><clause id="HAC6C8E8D46DD443C8C77BE0081C59CF4"><enum>(i)</enum><text>State board.</text></clause><clause id="H72BBB57F2758490CB8D0E5CA771759F3"><enum>(ii)</enum><text>State unemployment insurance agency.</text></clause><clause id="H725210F84A8C4380BBB7F405AC816C5D"><enum>(iii)</enum><text>Office of the State higher education executive officer and public college boards.</text></clause><clause id="H80F6C9D169EF4C419F4EAA9A0C36725C"><enum>(iv)</enum><text>State community college system.</text></clause><clause id="HE9C3475763574FFE9FB2DE21D4E1921A"><enum>(v)</enum><text>State departments of health and human services.</text></clause><clause id="HC428B61E5B864686BCB45515F524B865"><enum>(vi)</enum><text>State departments of economic development.</text></clause><clause id="HCB6775FF5E86473989A9A8DA09237A0D"><enum>(vii)</enum><text>Workforce development agencies.</text></clause><clause id="HBD085BBBD79F4175A8F7FB84351F3278"><enum>(viii)</enum><text>State or local housing authorities.</text></clause><clause id="H9F53E54195644B8F9C85EC77A445C2E5"><enum>(ix)</enum><text>Other relevant State agencies as determined by the Governor of such State.</text></clause></subparagraph></paragraph><paragraph id="HB76336DF99BA4C55AABD82B4E7705B0A" commented="no"><enum>(2)</enum><header>Education alignment</header><text>A plan to—</text><subparagraph id="HAF421D09B29C4EC68842FD16FBE9AF4E"><enum>(A)</enum><text>with respect to eligible individuals without a secondary school diploma or its recognized equivalent, facilitate the completion of such diploma or recognized equivalent at a community college;</text></subparagraph><subparagraph id="H3C720DD14F02471A8C143730E57A7A0C"><enum>(B)</enum><text display-inline="yes-display-inline">ensure that credits received for Advanced Placement or International Baccalaureate classes are applied to an equivalent community college course; and</text></subparagraph><subparagraph id="H3A38E5C1C27C4A0D8C5CF2FC05CB3EB9"><enum>(C)</enum><text display-inline="yes-display-inline">otherwise align the requirements between secondary schools and community colleges in order to increase the accessibility of community college for eligible individuals.</text></subparagraph></paragraph><paragraph id="HF381E2613C004F498C4ED29213E02D9B"><enum>(3)</enum><header>Development</header><text display-inline="yes-display-inline">A plan to—</text><subparagraph id="H68E0A1D125DB496DBD72B1007570803E"><enum>(A)</enum><text>improve career pathway development, with special attention to career pathways related to in-demand industry sectors or occupations described in paragraph (9);</text></subparagraph><subparagraph id="H92E74EE2370144599107317491760B7D"><enum>(B)</enum><text>increase economic mobility of State residents; and</text></subparagraph><subparagraph id="H6538C199DC72459FA5ACD4394990F9B2"><enum>(C)</enum><text display-inline="yes-display-inline">provide access to affordable postsecondary education for State residents through a network of coordinated State and Federal support systems designed and implemented by State agencies in partnership with public institutions of higher education and public higher education systems.</text></subparagraph></paragraph><paragraph id="H816259110B7D4F7EA2FDE217F929141D"><enum>(4)</enum><header>Credential attainment</header><text display-inline="yes-display-inline">A plan to prioritize secondary and recognized postsecondary credential attainment through—</text><subparagraph id="HB630DA1FC9C443CD8BAADC8B8971D53E"><enum>(A)</enum><text>integrated education and training models; </text></subparagraph><subparagraph id="HA945F298A830436992A020FCA54E95A2"><enum>(B)</enum><text>dual enrollment programs; and</text></subparagraph><subparagraph id="HBEC547F202A94CA6BAC5F764AEE2E077"><enum>(C)</enum><text>an increased number of navigators.</text></subparagraph></paragraph><paragraph id="H7D44E71CD6E54EB5957544653D28A7FF"><enum>(5)</enum><header>Priority</header><text display-inline="yes-display-inline">A plan to prioritize assistance to individuals—</text><subparagraph id="HBC725CC8A22E453B8E4F72A8F3F81AC0"><enum>(A)</enum><text>with a barrier to employment; or</text></subparagraph><subparagraph id="HED2AFC06CB4D44B7A9605AC51B1FACEC"><enum>(B)</enum><text>with incomes below 200 percent of the poverty level.</text></subparagraph></paragraph><paragraph id="H035191E628074EEA8A36CEE5A961CC3E"><enum>(6)</enum><header>Public resources</header><text display-inline="yes-display-inline">A plan to maximize public resources to support the attainment of a recognized postsecondary credential, including with respect to—</text><subparagraph id="HF7E0F50777AD41C398FDC714B6D1E44C"><enum>(A)</enum><text>transportation;</text></subparagraph><subparagraph id="HA2812ECFAEB24DD581C21D18C72C0DF5"><enum>(B)</enum><text>on-campus or off-campus housing; </text></subparagraph><subparagraph id="HD550159F739A4E91B7F0AD6D15A0EA5B"><enum>(C)</enum><text>childcare; and</text></subparagraph><subparagraph id="H700CE291AE734706B4C03AA097BA5F68"><enum>(D)</enum><text>food assistance.</text></subparagraph></paragraph><paragraph id="HEF81328280004470A4351F45FFF5041E"><enum>(7)</enum><header>Outreach</header><text display-inline="yes-display-inline">A plan to reach eligible individuals without a recognized postsecondary credential, including with respect to individuals who—</text><subparagraph id="H79F44F04F3964FACAEC21D7E97064632" display-inline="no-display-inline"><enum>(A)</enum><text>live in high-poverty areas;</text></subparagraph><subparagraph id="HF07FF195C0F745A58AE52CED14BC3B30"><enum>(B)</enum><text>are first-generation students;</text></subparagraph><subparagraph id="H61F222C8B05243A6A0A77B2DA8FFFE11"><enum>(C)</enum><text>are low-income students; and</text></subparagraph><subparagraph id="H6276554EBC184183BDE254C55E0C30EC"><enum>(D)</enum><text display-inline="yes-display-inline">identify as belonging to other underrepresented student groups.</text></subparagraph></paragraph><paragraph id="H7D8633A71562423DA5711C936E6A48E7"><enum>(8)</enum><header>Recognized postsecondary credential retention and completion</header><text>A plan to increase retention and credential completion by—</text><subparagraph id="HF5B198C2AAEB4F42999CF5A359054292"><enum>(A)</enum><text>developing new, or expanding existing, degree and credential programs based on the needs of in-demand industry sectors or occupations described in paragraph (9); and</text></subparagraph><subparagraph id="H1EB6960363804BCF913AC262DF1AE709"><enum>(B)</enum><text>increasing the number of career counselors and navigators.</text></subparagraph></paragraph><paragraph id="H4F40BAF77E8F419D8BCB65EE668085C9"><enum>(9)</enum><header>In-demand industry sectors or occupations</header><text>A plan to—</text><subparagraph id="HA582E8E02D3549FEAD0D280588D70398"><enum>(A)</enum><text>identify in-demand industry sectors or occupations in such State; and</text></subparagraph><subparagraph id="HE44A118115C64B24A78E52B2E6FC53CD"><enum>(B)</enum><text>develop and provide access to pathways to credential and degree programs for jobs in such industries, giving priority to credential and degree programs that correspond to high-quality jobs in consultation with—</text><clause id="H3F8D91AD28554F76A95B8A2C195752FB"><enum>(i)</enum><text>the State board;</text></clause><clause id="HEF17EB86D36E4D46BBC53FE86DAAB48C"><enum>(ii)</enum><text>the State health and human services agency;</text></clause><clause id="H10B2CF216B634731BD6E47EA5D73AAB9"><enum>(iii)</enum><text>the State board of higher education; and</text></clause><clause id="H1C6D0391178E4DA58555AD8A9D177D95"><enum>(iv)</enum><text>business industry groups within the State.</text></clause></subparagraph></paragraph><paragraph id="HCC73BE618EC6449BB057615B460B3BED" commented="no"><enum>(10)</enum><header>Federal programs</header><subparagraph id="H436762EE10334985A87218012A6C5E7A"><enum>(A)</enum><header>In general</header><text>A description of how the State will use amounts under covered programs, to the extent otherwise permitted by law, to reduce eligibility and participation requirement barriers in such programs in order to—</text><clause id="HAC30C1DAF9D04A34861B0C8F33DCDC5F"><enum>(i)</enum><text>treat the pursuit of a recognized postsecondary credential as meeting any compliance, work participation, and core activity requirements for each such program; and</text></clause><clause id="H0674488D13D0451A8F833F0886CEC342"><enum>(ii)</enum><text>increase access to and completion of recognized postsecondary credential programs.</text></clause></subparagraph><subparagraph id="H59AD1F3F24604FE6B1CB51759F992B95"><enum>(B)</enum><header>Covered programs defined</header><text>In this paragraph, the term <term>covered programs</term> means—</text><clause id="H3C4F049BE6904FF5AB953FA91E1E11A3"><enum>(i)</enum><text>the temporary assistance for needy families program under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601</external-xref>);</text></clause><clause id="H5497D8F2AEBB4345A7C8B03B8950C4C9"><enum>(ii)</enum><text>the supplemental nutrition assistance program employment and training program under section 6 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015</external-xref>);</text></clause><clause id="HD6EF1EF7370E4A078F541CDA1C99B415"><enum>(iii)</enum><text display-inline="yes-display-inline">the child care development fund under the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858">42 U.S.C. 9858 et seq.</external-xref>); and</text></clause><clause id="H7CDEFAC0F6294B5695D7811978ECC990" commented="no"><enum>(iv)</enum><text>housing assistance programs carried out by the Secretary of Housing and Urban Development.</text></clause></subparagraph></paragraph><paragraph id="H4D23964096D54F42A93C27841488F0B6"><enum>(11)</enum><header>Cost analyses</header><text display-inline="yes-display-inline">Cost analyses for—</text><subparagraph id="HE467F7195D5C44DF964F4EF9A3E04259"><enum>(A)</enum><text>providing tuition-free community and technical college pathways to individuals who have not attained—</text><clause id="H81FF64BEF02E4F93AFBF04C081BC624C"><enum>(i)</enum><text>a secondary school diploma or its recognized equivalent; or</text></clause><clause id="H0BD22F89A500443DB493D9F640A3C8BC" commented="no"><enum>(ii)</enum><text>a recognized postsecondary credential, up to and including a bachelor’s degree; and</text></clause></subparagraph><subparagraph id="HF63609245B274DFB9FF66086A6C40DDE"><enum>(B)</enum><text>expanding institutional capacity to meet an increased demand for recognized postsecondary credentials by expanding supportive services, including with respect to hiring additional—</text><clause id="H89AFFCD452C443FE8F8EDF5AB383ED79"><enum>(i)</enum><text>career counselors;</text></clause><clause id="HEA6DB665EBEE472E8A8BC7C1C7162764"><enum>(ii)</enum><text>navigators; and</text></clause><clause id="H7C07FFC28AFF498CB8C6F3D51281A75E"><enum>(iii)</enum><text>other support staff.</text></clause></subparagraph></paragraph><paragraph id="HEE629BC5801E4D17922D463A8179353B"><enum>(12)</enum><header>Data collection</header><text display-inline="yes-display-inline">A plan for data collection efforts to measure program outcomes and evaluate program success, including by leveraging existing administrative data to track any change in participation in recognized postsecondary credential programs at community colleges.</text></paragraph><paragraph id="H9AF63A74B5724190B8AC9090D70DB31C"><enum>(13)</enum><header>Data sharing</header><text>A State shall—</text><subparagraph id="H20E3494F864C4039B86C0173D4FA59DC"><enum>(A)</enum><text>provide an interagency data-sharing agreement that facilitates statewide data collection efforts between—</text><clause id="H1E80C31A57734DEE9C7530C7C92D2C45"><enum>(i)</enum><text display-inline="yes-display-inline">State agencies that oversee the dispersal of State and Federal benefits;</text></clause><clause id="H16E21D7E1ABA49C4972D0510CAFD618B"><enum>(ii)</enum><text>the State educational agency;</text></clause><clause id="H906123CF3D7747F6A1FED6528FB71D61"><enum>(iii)</enum><text>the State higher education system; </text></clause><clause id="H623039BB2F2B40E0A63C248B02D2ECAB"><enum>(iv)</enum><text>the State board; and</text></clause><clause id="H1A3A38B18B1B4DBFB02B7F68C347FB89"><enum>(v)</enum><text>other agencies determined by the Secretary to be necessary; and</text></clause></subparagraph><subparagraph id="H503ED88E0F844495B38843E28D4430D5"><enum>(B)</enum><text>detail how such agreement will promote cross-agency collaboration and improve recognized postsecondary credential completion.</text></subparagraph></paragraph><paragraph id="HF61756206E4542BA939DB0D8EC425EBD"><enum>(14)</enum><header>Transfer agreements</header><subparagraph id="H4482F9E15D1D48BCBA5574ED20631416"><enum>(A)</enum><header>In general</header><text>A description of—</text><clause id="H84F79A2826314C7E87E08DD1B470BD73"><enum>(i)</enum><text>transfer agreements between 2-year and 4-year public institutions of higher education in such State; and</text></clause><clause id="H46047CE9AEDF41B2B8EBFA136487323D"><enum>(ii)</enum><text>the ways in which the State will expand the number of transfer agreements, including with respect to the facilitation and improvement of credit transfers between institutions.</text></clause></subparagraph><subparagraph id="H98AD0BC589D04FFB9B50C1D1F678BE1E"><enum>(B)</enum><header>Transfer agreement</header><text>An assurance that the transfer agreement required under subparagraph (A)(i) shall include, at a minimum—</text><clause id="HA264B60C09E94C4E9A66E1BF746E9E01"><enum>(i)</enum><text>a general education curriculum that consists of not fewer than 30 credit hours that are transferrable to any public institution of higher education in such State;</text></clause><clause id="H8235BAC26EF946BBAA3E9FDE8A7552B4"><enum>(ii)</enum><text>common course numbering for substantively similar courses in such general education curriculum; and</text></clause><clause id="H9180C428092B49E6AEBF40855C7530E9"><enum>(iii)</enum><text>assurance that an eligible associate’s degree shall be fully transferrable to, and credited as, the first 2 years of a related baccalaureate program at a public institution of higher education in such State.</text></clause></subparagraph></paragraph></section><section id="HEF3D4A746F654F718D365DC0356A9592"><enum>103.</enum><header>Grant uses</header><text display-inline="no-display-inline">A State shall use grant funds awarded under this title for the following:</text><paragraph id="H82DEACE6B2944C349CBAD2FF0A1EFBCB"><enum>(1)</enum><text>Implementing the State plan submitted under section 102.</text></paragraph><paragraph id="HBC0B24ADA681496FBAC21F3FF9679D3D"><enum>(2)</enum><text>Ensuring that eligible students enrolled in community colleges—</text><subparagraph id="H6439634335CE4C33BA9D028D34EC76D5"><enum>(A)</enum><text>are not charged tuition or fees; and</text></subparagraph><subparagraph id="HCB443F8234004624A95335C1042921E0"><enum>(B)</enum><text>are not required to apply Federal, State, or private financial assistance (including scholarships) to tuition or fees.</text></subparagraph></paragraph></section><section id="H47E90223FAF14344BBCBBBD0D64498E4"><enum>104.</enum><header>Reports</header><subsection id="H3121597CDB1B4D838DBEF0D5F8352D61"><enum>(a)</enum><header>Annual report</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which a grant is made under this title, and annually thereafter, a State shall submit to the Secretary a report describing—</text><paragraph id="H6088191B3A7C44F0B9ED7E4A78995451"><enum>(1)</enum><text>the uses of funds;</text></paragraph><paragraph id="H33C49A08BBDF4DF2835C4E25296DE97A"><enum>(2)</enum><text>progress made in fulfilling the requirements under section 103;</text></paragraph><paragraph id="H9B74908A1A144885BF7152F8D0703A4C"><enum>(3)</enum><text>rates of—</text><subparagraph id="HDEF872A39CEF4C4C8360E934D2AD5E55"><enum>(A)</enum><text>graduation and attainment of recognized postsecondary credentials at participating community colleges; and</text></subparagraph><subparagraph id="H95341B01A26441BA9B753F94727A60C7"><enum>(B)</enum><text display-inline="yes-display-inline">transfer to 4-year institutions at participating community colleges; and </text></subparagraph></paragraph><paragraph id="H1943EDCDD0DA4847AF502DC6EC5859BD"><enum>(4)</enum><text>other information determined by the Secretary to be necessary.</text></paragraph></subsection><subsection id="H596BDA0470AD441F807F75904F85481C"><enum>(b)</enum><header>Certification</header><paragraph id="H7AE3FFF75C6B41BCBE4972387B288752"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date on which a State receives a grant under this title, such State shall provide certification of implementation of the—</text><subparagraph id="H30AE4E08535044E68F7D44B230508521"><enum>(A)</enum><text>education alignment plan required under section 102(2); and</text></subparagraph><subparagraph id="HA6216645BADF4444BD4DDB3817041AAF"><enum>(B)</enum><text>transfer agreements required under section 102(14).</text></subparagraph></paragraph><paragraph id="H95120832C28447E38F52FFFD7D6BD028"><enum>(2)</enum><header>Failure to certify</header><text>If a State does not provide the certification required under paragraph (1), such State shall submit to the Secretary—</text><subparagraph id="HB3E0DDEF268A4E748D0320690D843A65"><enum>(A)</enum><text>a report describing the reasons for the failure of such State to provide certification; and</text></subparagraph><subparagraph id="HF3454A14ADB247BC8A3CB9F91F42017C"><enum>(B)</enum><text>a plan to ensure that, not later than 5 years after the date on which the State received a grant under this title, such State will provide such certification.</text></subparagraph></paragraph></subsection><subsection id="HAE296F4FD60E4B3EA33B706E4499581D"><enum>(c)</enum><header>Sustaining funds</header><text display-inline="yes-display-inline">Not later than 180 days after the date that is the conclusion of the 5-year grant period described in section 101(c), a State shall submit a report to the Secretary describing—</text><paragraph id="H6E7B70295A4949A1818A963ED1AD7945"><enum>(1)</enum><text display-inline="yes-display-inline">the ways in which such State will sustain a tuition-free community college model; and</text></paragraph><paragraph id="H9C8C7E8B77CD4840BB5123618D696CFD"><enum>(2)</enum><text>the amount of Federal assistance needed to sustain the model described in paragraph (1).</text></paragraph></subsection></section><section id="H7AAFDF1D0E8B429EBB995B768DA4272C"><enum>105.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as are necessary to carry out this title for fiscal year 2023 and each of the 4 succeeding fiscal years.</text></section><section id="H449FC443214947CBBE6B67BDD2427BD5"><enum>106.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H5C20B372D6814320B47EA86612284526" commented="no"><enum>(1)</enum><header>Business industry group</header><text>The term <term>business industry group</term> means an organization that represents businesses (including small businesses), individual employers, industry clusters, and individuals from—</text><subparagraph id="H61A0F537F4D740C3B51C310F7C387775" commented="no"><enum>(A)</enum><text>business or trade organizations;</text></subparagraph><subparagraph id="H84F8FF9C92554C0E81EDF37FD6901AEA" commented="no"><enum>(B)</enum><text>economic development organizations;</text></subparagraph><subparagraph id="H0EF02BC0439F470598F8EABBB4AD0266" commented="no"><enum>(C)</enum><text>nonprofit organizations, community-based organizations, or intermediaries;</text></subparagraph><subparagraph id="HBA4A0D8E4830402D8B46D04D183C99B1" commented="no"><enum>(D)</enum><text>philanthropic organizations; </text></subparagraph><subparagraph id="H42A9FB33DB904EAD89DD8D6FA85B1E9A" commented="no"><enum>(E)</enum><text>industry associations; or</text></subparagraph><subparagraph id="HBB75C82D678A4A73A7B8EE3E561DEAC0" commented="no"><enum>(F)</enum><text>other organizations determined necessary by the State.</text></subparagraph></paragraph><paragraph id="H2B76723FA2AD4D0CB4EB2323C57E8D7F"><enum>(2)</enum><header>Eligible associate’s degree</header><text>The term <term>eligible associate’s degree</term> means an associate’s degree that—</text><subparagraph id="H5688B4C3162F4E5084859D4F78F47D66"><enum>(A)</enum><text display-inline="yes-display-inline">is in an academic major in the arts or sciences;</text></subparagraph><subparagraph id="HBD71C34CD3C6442182C5A9BB211CD56C"><enum>(B)</enum><text display-inline="yes-display-inline">is awarded by a public institution of higher education in a State; and</text></subparagraph><subparagraph id="H015D4BC1620D4F23BF809C9E6626227A"><enum>(C)</enum><text display-inline="yes-display-inline">is awarded on or after the date that is not later than 3 years after the date on which the State first received a grant under this Act.</text></subparagraph></paragraph><paragraph id="HD954C2C771BD4543AA3F22852A0D5E4F"><enum>(3)</enum><header>High-quality job</header><text>The term <term>high-quality job</term> means a job with—</text><subparagraph id="H9A0ACA6DE33A4928A7627DD6E2F98175"><enum>(A)</enum><text>wages and benefits in the top 20 percent for the relevant industry or occupation;</text></subparagraph><subparagraph id="HB552ED736344489A879EF7F3FA080274"><enum>(B)</enum><text>access to training and advancement opportunities;</text></subparagraph><subparagraph id="HB3D83832E6D54C2A999DEE3EC78AB796"><enum>(C)</enum><text>paid sick leave;</text></subparagraph><subparagraph id="HB7440A849F2E4A629C914E06A91DF868"><enum>(D)</enum><text>paid family leave; and</text></subparagraph><subparagraph id="H4F5D6FC279AE4703BFCAE20F997D1093"><enum>(E)</enum><text>paid medical leave or short-term disability leave.</text></subparagraph></paragraph><paragraph id="H79FA5974895642C8AC1A8307C9BAE6BA" commented="no"><enum>(4)</enum><header>Navigator</header><text>The term <term>navigator</term> means an individual who is integrated into the existing community college operation and who works with students to—</text><subparagraph id="H6763D4E71A304638901905556D2EB37E" commented="no"><enum>(A)</enum><text>understand the eligibility of such students for Federal, State, and local financial aid and benefit options;</text></subparagraph><subparagraph id="H83E43B53E1E2434287887A2043DF437F" commented="no"><enum>(B)</enum><text>assist such students with the application process for such options; and</text></subparagraph><subparagraph id="H1A4A969EC4434A889C84AA4E88D4C435" commented="no"><enum>(C)</enum><text>connect students with resources on campus and in the community.</text></subparagraph></paragraph></section></title><title id="H82D5BAA244384E5BB7CAC6575381E5F9"><enum>II</enum><header>Institutional Capacity</header><section id="H6FD5156F303547AE9DBC042F5B5BF3DC"><enum>201.</enum><header>Institutional capacity and wraparound service support grant program</header><subsection id="H4B31D6CFCF624E2C99C74E891153762C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a program to award grants to each eligible State that submits a complete application under section 202 to provide institutional capacity and wraparound service support with respect to the implementation of tuition-free community college under title I.</text></subsection><subsection id="H6B2E773223A1408191EF2D67C84894F6"><enum>(b)</enum><header>Grant amounts</header><text display-inline="yes-display-inline">The Secretary shall determine grant amounts under subsection (a) with respect to each eligible State based on the following:</text><paragraph id="H878633DB180B441CB71B5B7F4C63EEB0" commented="no"><enum>(1)</enum><text>The cost analysis required under section 202(1). </text></paragraph><paragraph id="HF06A9B4100E0476AB49EB700AC978833"><enum>(2)</enum><text>The number of adults in such State without a secondary credential or recognized postsecondary credential.</text></paragraph><paragraph id="H91639A405F1543FBB9AA1983770C0609"><enum>(3)</enum><text display-inline="yes-display-inline">The number of adults in such State with a recognized postsecondary credential that is not an associate or baccalaureate degree.</text></paragraph><paragraph id="H06F1759CBCA44C20A87A5D67C69A25CB"><enum>(4)</enum><text>The unemployment rate in such State.</text></paragraph></subsection></section><section id="H1663411A613244A1A8CB107D425A81FA"><enum>202.</enum><header>Application</header><text display-inline="no-display-inline">To be eligible for a grant under this title, an eligible State shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines appropriate, including—</text><paragraph id="H8932EB85265C497085D3E810B9818359"><enum>(1)</enum><text>a cost analysis for, with respect to community colleges—</text><subparagraph id="H5B3970A7FD384FDBB12F50D445B9F696"><enum>(A)</enum><text>the expansion of institutional capacity; and</text></subparagraph><subparagraph id="H9FF12624873447A68A55C91F4B4B3C69"><enum>(B)</enum><text>the provision of wraparound services for students; and</text></subparagraph></paragraph><paragraph id="HAD8F31BFAE6F46EFB30BAAC29FBD4575"><enum>(2)</enum><text>a plan detailing how the State will award subgrants in accordance with section 204(b) among—</text><subparagraph id="HF92B3433F05D447DBC92564DE09B1E64"><enum>(A)</enum><text>community colleges that are located in geographic areas that serve local educational agencies that participate, through the community eligibility provision authorized by the Healthy, Hunger-free Kids Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758</external-xref> note et seq.) in—</text><clause id="HAAB029911C444AB39E07259C8FF5019D"><enum>(i)</enum><text>the national school lunch program under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>); and</text></clause><clause id="HFA95A631A478416794896232BF2E7CD9"><enum>(ii)</enum><text>the school breakfast program under the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771 et seq.</external-xref>);</text></clause></subparagraph><subparagraph id="HC63A99A88DB74C53B8A03B6BA7492AE0" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">community colleges that are located in geographic areas with 40 percent of the population at or below the Federal poverty line; </text></subparagraph><subparagraph id="H95FCEFA9F7C2458A945EFC845E3FF810" commented="no"><enum>(C)</enum><text>institutions of higher education with admissions rates of 50 percent or higher; and</text></subparagraph><subparagraph id="HDD710F78ABBF4B10A888DBB996083D14" commented="no"><enum>(D)</enum><text>institutions that are eligible to receive a grant under part A or B of title III or title V of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>), including—</text><clause id="HEC4AC2334CCE48569FCEBB94E1584579" commented="no"><enum>(i)</enum><text>historically Black colleges or universities;</text></clause><clause id="H6D31AA7F57F347EB9DFB22F874A18881" commented="no"><enum>(ii)</enum><text>Hispanic-serving institutions;</text></clause><clause id="H334E82666E4447B89BB43CC43F8FD3D6" commented="no"><enum>(iii)</enum><text>Tribal colleges or universities;</text></clause><clause id="H1B15281C660D47EF80E50F9FEC1DCC9B" commented="no"><enum>(iv)</enum><text>minority-serving institutions; and</text></clause><clause id="HF6BA0FE76A5C49DA890CCBFEFB04A37E" commented="no"><enum>(v)</enum><text>rural-serving institutions of higher education.</text></clause></subparagraph></paragraph></section><section id="H7D885BE1C3B342DAB508E028B8CF674D"><enum>203.</enum><header>Selection committee</header><subsection id="H0CB0E3297FAC401FA4A90B1C1B7DD420"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a selection committee to review each application and award grants under this title.</text></subsection><subsection id="H229E1A648CDF4331966C72B0FCA0C712"><enum>(b)</enum><header>Membership</header><paragraph id="H4D722EC4FC2C4393B74823DA1A08F098"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall determine the number of members, of whom not less than 50 percent—</text><subparagraph id="HF3C78A3975564C278E769391E721CBC3"><enum>(A)</enum><text>may not be employed by the Federal government;</text></subparagraph><subparagraph id="HF3B0FF8C47A94034AFE3FB1E4D383D8B"><enum>(B)</enum><text>shall have relevant research or practical experience with respect to student support programs;</text></subparagraph><subparagraph id="H3B94A514C31C4268A194C92165D7931F"><enum>(C)</enum><text>shall have relevant research or practical experience with respect to designing and implementing tuition-free community college programs; and</text></subparagraph><subparagraph id="HB0B7892718014011904ED9D29DB6FEA0"><enum>(D)</enum><text>shall identify as belonging to an underrepresented group in higher education, including—</text><clause id="H154E829A96EA4D708692BD4FBCD513D5"><enum>(i)</enum><text>African Americans;</text></clause><clause id="HD8261451998B4D87BC175142D2585F8D"><enum>(ii)</enum><text>Hispanics;</text></clause><clause id="HE964568B589144FB830A9089428FD10F"><enum>(iii)</enum><text>Native Americans;</text></clause><clause id="H7399E02172A94F6B9B13D6DB5B2DFC70"><enum>(iv)</enum><text>Alaska Natives;</text></clause><clause id="HB4E0C6FAB2CD4938BA22EE654730161B"><enum>(v)</enum><text>Asian Americans; and</text></clause><clause id="H1ED1B6CF901D4701ADCC99DA22F94125"><enum>(vi)</enum><text>Native American Pacific Islanders, including Native Hawaiians.</text></clause></subparagraph></paragraph><paragraph id="H468A387656A3400BB2AD92FF6DFC88B5" commented="no"><enum>(2)</enum><header>Conflicts of interest</header><text>With respect to each application, a member having a conflict of interest may not review such application.</text></paragraph></subsection></section><section id="HBE53D897472647FEA2E3DBC213BD96C3"><enum>204.</enum><header>Grant uses</header><subsection id="H9C3056E95F3B4023B92FEE336568B92F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible State shall use grant funds awarded under this title to award subgrants to eligible institutions in accordance with subsection (b).</text></subsection><subsection id="H372DF702DCF942A7A6207B8E5A511195"><enum>(b)</enum><header>Subgrants</header><paragraph id="H84DD6AA3C9E241C48CABE5347379C9CE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible State shall award subgrants to eligible institutions.</text></paragraph><paragraph id="H2E1DC62C896A455EA1F7AEEAB83CB834"><enum>(2)</enum><header>Eligible institution defined</header><text>In this subsection, the term <term>eligible institution</term> means an institution—</text><subparagraph id="H5211899FB6EB4737905303BC9FF50DFC"><enum>(A)</enum><text>listed in subparagraphs (A) through (D) of section 202(2); and</text></subparagraph><subparagraph id="H820C79D4AE3C4262B56FF90850993FB0"><enum>(B)</enum><text>located in the eligible State.</text></subparagraph></paragraph><paragraph id="HAD05AA302FA44953B2C47F27B028072C"><enum>(3)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible institution seeking a subgrant under this subsection shall submit to the eligible State an application in such form, at such time, and containing such information as the State may require.</text></paragraph><paragraph id="HB52FCE6ACAC94B54A21B1DEFC8E289CF"><enum>(4)</enum><header>Subgrant uses</header><text display-inline="yes-display-inline">An eligible institution that receives a subgrant under this subsection shall use such subgrant funds for implementing activities and services that improve retention and completion of recognized postsecondary credentials, including—</text><subparagraph id="H4E4C45C828784ADAB55B5BDECE411CD7" display-inline="no-display-inline"><enum>(A)</enum><text>identifying and addressing the needs of students, including affordable housing, childcare, transportation, and food;</text></subparagraph><subparagraph id="H7F2E6F1D521A46A0BE2E853889BA0F45"><enum>(B)</enum><text>supporting the work of navigators, including—</text><clause id="HB2B042625A634821A3CDC835B6DB366D"><enum>(i)</enum><text>providing information to students with respect to eligibility for assistance under other Federal, State, and institutional assistance programs; and</text></clause><clause id="H6460E1A104C04C4BA8F9CBCDB83153B3"><enum>(ii)</enum><text>connecting students with on-campus and off-campus supportive services; </text></clause></subparagraph><subparagraph id="H144EF4E4A3624D7493CA99CE27B6501B"><enum>(C)</enum><text>hiring additional staff;</text></subparagraph><subparagraph id="H3F0D6DF61680424BBB2418F71ACD48F5"><enum>(D)</enum><text>increasing access to supportive services by centralizing such services on-campus;</text></subparagraph><subparagraph id="H633CC87427CF42F392A24930A39BEFD8"><enum>(E)</enum><text display-inline="yes-display-inline">offering additional scheduling options for classes with respect to the day, time, and location of such classes;</text></subparagraph><subparagraph id="H2C61FE0597EA49D0BB9000B7D807DC71" commented="no"><enum>(F)</enum><text>improving the transfer of credits between institutions of higher education, including community colleges;</text></subparagraph><subparagraph id="HA8742705CB5A4DE1A9F482498741CF55" commented="no"><enum>(G)</enum><text>expanding pathways related to in-demand industry sectors or occupations; and </text></subparagraph><subparagraph id="HB39BC6630F284D5FBD2899D26E64C046"><enum>(H)</enum><text>providing access to technology, including—</text><clause id="H743E1118D4E44CC8B0F6791C28D45FC8"><enum>(i)</enum><text display-inline="yes-display-inline">digital literacy courses;</text></clause><clause id="H8494037230144E3EA50E66D022365203"><enum>(ii)</enum><text>computers;</text></clause><clause id="H4F000A44D7764A2CA2C2FE3B0222EF44"><enum>(iii)</enum><text>software; and</text></clause><clause id="H76EACDF03794456B9C6944B097920655"><enum>(iv)</enum><text>other equipment necessary to attain a recognized postsecondary credential.</text></clause></subparagraph></paragraph></subsection></section><section id="HB7FB543B588546C88F28CAB613FB346D" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>205.</enum><header>Committee on student food and housing</header><subsection id="H8AB5DD7FA87044FCB65C6D362FDE336F" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish, with respect to each eligible institution that receives a subgrant under section 204(b), a Committee on Student Food and Housing (in this section referred to as the <quote>Committee</quote>).</text></subsection><subsection id="HFF4CDBAD13B54199901847A5DCB027B6" commented="no"><enum>(b)</enum><header>Duties</header><text>The Committee shall assist such eligible institution in carrying out the activities required under section 204(b)(4).</text></subsection><subsection id="HA6B6AA61B6074E21A8B25F656A6DF593" commented="no"><enum>(c)</enum><header>Membership</header><text>The Committee shall be composed of a number of members determined by the Secretary as follows:</text><paragraph id="H68153F3250374750942FECE228F7F386" commented="no"><enum>(1)</enum><text>Students enrolled at the institution who have experienced food or housing insecurity.</text></paragraph><paragraph id="H1619B249858A4D578AF72E5415A655B0" commented="no"><enum>(2)</enum><text>Student government representatives from the institution.</text></paragraph><paragraph id="HACB206E525454EE7A46DFA21DDB53F20" commented="no"><enum>(3)</enum><text>Individuals employed by or working for the institution, including such individuals from the following departments:</text><subparagraph id="HE07735E133214F2B82CBBABEF103AA5F" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">Financial aid.</text></subparagraph><subparagraph id="HD1BE2652410C4CDCA1F7DE9DB83D9A1B" commented="no"><enum>(B)</enum><text>Housing.</text></subparagraph><subparagraph id="HF186B0D35FD7479AA0EE1F6FBD2AE8D6" commented="no"><enum>(C)</enum><text>Dining.</text></subparagraph><subparagraph id="HDA96CB3887E1458182E0C763A1E86E33" commented="no"><enum>(D)</enum><text>Student affairs.</text></subparagraph><subparagraph id="H567A6E38FD46421FB71BDACA9811472A" commented="no"><enum>(E)</enum><text>Other well-being services on campus.</text></subparagraph></paragraph></subsection></section><section id="HA101EA15ADAB4EBD85966E9AF400AA5C"><enum>206.</enum><header>Reports</header><subsection id="HC4FB46CC2F424F589A9BE83B90A9DE75"><enum>(a)</enum><header>Annual report</header><paragraph id="H32AE2C74493D4C72A58125F03A80DEE3"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date on which a grant is made under this title, and annually thereafter, an eligible State shall submit to the Secretary a report describing—</text><subparagraph id="H7768E44B7CF0423E8F36522B7491CB0F"><enum>(C)</enum><text>with respect to participating community colleges, rates of—</text><clause id="H541D355939C44C3C90EB4ECC6CB45B02"><enum>(i)</enum><text>graduation;</text></clause><clause id="H9594A6F30AC641D49E69840FCAC36E5B"><enum>(ii)</enum><text>transfer; and</text></clause><clause id="H14F4AEAEA9A94BC799C90021D801BC42"><enum>(iii)</enum><text>attainment of recognized postsecondary credentials;</text></clause></subparagraph><subparagraph id="H759190D929784B1CA03FF5F61C798A4D"><enum>(D)</enum><text display-inline="yes-display-inline">the institutional reports submitted under subsection (b);</text></subparagraph><subparagraph id="HBF9E7E1235FB4CF98FF648A5CA8AF1B2"><enum>(E)</enum><text>the ways in which the State is communicating with institutions to—</text><clause id="HB15558EC1F32447D9031831C1BC2DF3C"><enum>(i)</enum><text>understand the barriers of students, with respect to eligibility and access, to public supports; and</text></clause><clause id="H212FB913580C4BE590AB52C9583FFAC7"><enum>(ii)</enum><text>use the information described in subparagraph (A) to inform any changes;</text></clause></subparagraph><subparagraph id="HF3D8F30DF9B24E4EA374B191154DEF03"><enum>(F)</enum><text>the ways in which the State human services agency and State board are aligning the policy goals of such agencies with the policy goals of the State higher education agency;</text></subparagraph><subparagraph id="HAAB05352959047A58C09E1EE3AEC828E"><enum>(G)</enum><text>changes in completion of secondary and postsecondary degrees for target eligible students;</text></subparagraph><subparagraph id="H2DEBD97B357643739DC53162A87FA50B"><enum>(H)</enum><text>changes in access to, and use of, public benefits;</text></subparagraph><subparagraph id="HAA6110E02021499598CC3A73DB08DCA1"><enum>(I)</enum><text>changes in employment with respect to in-demand industry sectors and high-quality jobs;</text></subparagraph><subparagraph id="H2C5767A25E8D481D8FB043786D1AD8C5"><enum>(J)</enum><text>changes in rates of unemployment and underemployment;</text></subparagraph><subparagraph id="H5575050711324D1580EFF904911471D5"><enum>(K)</enum><text>other data as provided by the State; and</text></subparagraph><subparagraph id="H745E8BE1454948048967B8CD306762FA"><enum>(L)</enum><text>other data as required by the Secretary.</text></subparagraph></paragraph><paragraph id="H5AC4E1216D034D54BA3C6DDAE2A6C879"><enum>(2)</enum><header>Disaggregation</header><text>The information described in subparagraphs (G) through (K) shall be disaggregated, where possible, by—</text><subparagraph id="H58BD4A25F497472E80DC51C541904398"><enum>(A)</enum><text>race;</text></subparagraph><subparagraph id="HB74B892B68A243BAA176D11AB4C539DB"><enum>(B)</enum><text display-inline="yes-display-inline">ethnicity; and</text></subparagraph><subparagraph id="HA3A64099A06145F689CA2D584A17B426"><enum>(C)</enum><text>income level.</text></subparagraph></paragraph></subsection><subsection id="HECE10C98547D48049D2056FA0F704392"><enum>(b)</enum><header>Institution report</header><text>Not later than 1 year after receiving a subgrant under section 204(b), and on an annual basis thereafter, an institution shall submit to the State a report describing—</text><paragraph id="H03E2EC2A408C4FF4A8C03A20AD1F2297"><enum>(1)</enum><text>the uses of funds;</text></paragraph><paragraph id="H83E9C1EFBF304BDFA2B1BB9B82591ED8"><enum>(2)</enum><text>with respect to the period beginning on the date on which a subgrant was received and ending on the date on which the report is submitted, changes in rates of—</text><subparagraph id="H3B770AD2439D4DEA9E2CDF466DF6B167"><enum>(A)</enum><text>retention; and</text></subparagraph><subparagraph id="H20A0E3092B3D43669EF412134D9AC090"><enum>(B)</enum><text>graduation;</text></subparagraph></paragraph><paragraph id="H3658927F4B3E4A518D7AEC32D7CF5E3D"><enum>(3)</enum><text>the ways in which such institution increased awareness of, and access to, public supports made available through State agencies; and</text></paragraph><paragraph id="HBF4E9DABDC0847B78D1B2DC25B6BA4F3"><enum>(4)</enum><text>the ways in which such institution made improvements to tracking data with respect to—</text><subparagraph id="H4A281D3835CF49EA822094CAB6CFD31E"><enum>(A)</enum><text>the basic needs of students;</text></subparagraph><subparagraph id="HECCBE43B99FD4856B20C8E4419076EB8"><enum>(B)</enum><text>the financial barriers of students; and</text></subparagraph><subparagraph id="H3EE383EE99BA4386A1DE945F4DD58D4C"><enum>(C)</enum><text>the connection of students to public supports.</text></subparagraph></paragraph></subsection></section><section id="HD264EDCFC84B4AC6968E67943D2D96A6"><enum>207.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as are necessary to carry out this title for fiscal year 2023 and each of the 4 succeeding fiscal years.</text></section><section id="HBB82424580DA4028AD6D53C7D1D0098D"><enum>208.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H6588B4B2991E4C428B800BA09436114E"><enum>(1)</enum><header>Eligible State</header><text display-inline="yes-display-inline">The term <term>eligible State</term> means a State that is a recipient of a grant under title I.</text></paragraph><paragraph id="HAF6F593231854FFB8A8CC2936F2F2CE0"><enum>(2)</enum><header>HEA terms</header><subparagraph id="H5BB58056880B4B5EA1EA47E875D4743A"><enum>(A)</enum><header>Hispanic-serving institution</header><text>The term <term>Hispanic-serving institution</term> has the meaning given such term in section 502 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1101a">20 U.S.C. 1101a</external-xref>).</text></subparagraph><subparagraph id="H2DD1223916AF4584B214D4BC6AAB28A9"><enum>(B)</enum><header>Historically Black college or university</header><text>The term <term>historically Black college or university</term> has the meaning given the term <term>part B institution</term> in section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>).</text></subparagraph><subparagraph id="H2D4E815CC3DE4281A55FFB63C3118658"><enum>(C)</enum><header>Minority-serving institution</header><text display-inline="yes-display-inline">The term <term>minority-serving institution</term> includes the entities described in paragraphs (1) through (7) of section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>).</text></subparagraph><subparagraph id="HE699B361709F410292333928476DDD6C"><enum>(D)</enum><header>Tribal college or university</header><text>The term <term>Tribal college or university</term> has the meaning given such term in section 316(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)</external-xref>).</text></subparagraph><subparagraph id="H90AC9C64935A4463ACFF4570BE157A73"><enum>(E)</enum><header>Rural-serving institution of higher education</header><text>The term <term>rural-serving institution of higher education</term> has the meaning given such term in section 861(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1161q">20 U.S.C. 1161q(b)</external-xref>).</text></subparagraph></paragraph></section></title><title id="H1ED9CBBA167345F081BAFD529FF72E9A"><enum>III</enum><header>Emergency Funds for Students</header><section id="HE6CCDE2A0DFD4F2A941626A7D9C6093F"><enum>301.</enum><header>Emergency grant fund program</header><subsection id="H237E4BAEB62441B29B3DECE190F37DB8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a program to provide grants to each State that submits a complete application to provide emergency aid subgrants to eligible students enrolled at a public institution of higher education.</text></subsection><subsection id="HF86F881B63E1479AAD73879C36F5843D"><enum>(b)</enum><header>Funds</header><paragraph id="H437A5C8E2C2B4E2E9D5922DDA23423E5"><enum>(1)</enum><header>Timing</header><text display-inline="yes-display-inline">A grant under this title shall be awarded for a period of 5 years.</text></paragraph><paragraph id="H364840AA6BE64B1AAB9DA8C769F4773A"><enum>(2)</enum><header>Administration</header><text>Not more than 20 percent of funds awarded under this title may be used for the administration of emergency aid at institutions of higher education.</text></paragraph><paragraph id="H0B505B8FBA354CB1B1DC6C82A7E97C05"><enum>(3)</enum><header>Direct aid</header><text>Not less than 80 percent of funds awarded under this title shall be used to award emergency aid subgrants to eligible students.</text></paragraph></subsection><subsection id="H2A00A9B1DD764FE88E9A7671ECD0AF00"><enum>(c)</enum><header>Eligible student defined</header><text display-inline="yes-display-inline">In this title, the term <term>eligible student</term> means a student enrolled at a public institution of higher education, without regard to whether such student submits an application under section 483 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090</external-xref>), experiencing financial challenges that may affect the ability of such student to remain enrolled at such institution, including—</text><paragraph id="HD802B9E4D04C4A8E82E6B37FE08A7C33"><enum>(1)</enum><text>loss of—</text><subparagraph id="HAFAD9EBFC48A4EF7BB30BDE96212E051"><enum>(A)</enum><text>employment (including a temporary loss of employment);</text></subparagraph><subparagraph id="H876477B008514AD395A50A8A95F1B769"><enum>(B)</enum><text>transportation;</text></subparagraph><subparagraph id="H2BB7AD9A51454D988061BAAE7A6B4543"><enum>(C)</enum><text>child care;</text></subparagraph><subparagraph id="H15CA8531624440DCBAB2BE91BDF05BDB"><enum>(D)</enum><text>utilities (including water and electricity); or</text></subparagraph><subparagraph id="H0C91C3D4996144B9A3042946ECB00852"><enum>(E)</enum><text>housing;</text></subparagraph></paragraph><paragraph id="HCF1DF052CDA5459886A16F2B8241B105"><enum>(2)</enum><text>food insecurity;</text></paragraph><paragraph id="H3301F3213CD54D389F65FFFC62558944"><enum>(3)</enum><text>with respect to a student or the dependent of such student, a medical condition or need, including—</text><subparagraph id="H7B03BF31542D4595AC770F9CAD5937BE"><enum>(A)</enum><text>pregnancy; and</text></subparagraph><subparagraph id="HCA5A178A7F954BB291F8B3A752F6C880"><enum>(B)</enum><text>mental health conditions; and</text></subparagraph></paragraph><paragraph id="HDBE89FF21D40431185CF640D248E7C12"><enum>(4)</enum><text>with respect to a student who is a dependent—</text><subparagraph id="HAEBFB1081E6F421A8B9F41218360A475"><enum>(A)</enum><text>the death of a parent or guardian; or</text></subparagraph><subparagraph id="H4BF72C94295F4ECEBB5BEC4AE6194E54"><enum>(B)</enum><text>a parent or guardian with a medical condition that results in temporary or permanent loss of employment of such parent or guardian.</text></subparagraph></paragraph></subsection></section><section id="H91E99E2FF3E14F2E83C3E8400AA8181C"><enum>302.</enum><header>Application</header><text display-inline="no-display-inline">To be eligible for a grant under this title, a State shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines appropriate, including—</text><paragraph id="H8FC5F9850813459799C12072E8B2D114"><enum>(1)</enum><text>a data-sharing agreement between the State agency administering the program and the institutions of higher education in such State;</text></paragraph><paragraph id="H40A4CFF89BBA46A292A8FA1AE9E94A2A"><enum>(2)</enum><text>the ways in which such State will ensure publicity and availability of emergency aid on campuses of participating institutions of higher education;</text></paragraph><paragraph id="H389B449EFA274B0DAA7D0301119075A7"><enum>(3)</enum><text display-inline="yes-display-inline">the estimated amount of funding needed, based on, with respect to such State—</text><subparagraph id="HC91C9E2348DD4B3D83DCC119D7547345"><enum>(A)</enum><text>income distribution of eligible students;</text></subparagraph><subparagraph id="HE25AC95B8C3A467C9DF36B75013D2026"><enum>(B)</enum><text>the number of open-access and rural institutions; and</text></subparagraph><subparagraph id="H8F28D931304240A283411D0900B6C59B"><enum>(C)</enum><text>poverty rates;</text></subparagraph></paragraph><paragraph id="H7D829AC03ED6409D996378F44E9EB6FF"><enum>(4)</enum><text>the populations of students such State will prioritize in awarding subgrants;</text></paragraph><paragraph id="H4EE4CA87C9ED4D0FB7666D9A9877F935"><enum>(5)</enum><text>a description of the ways in which such State will administer subgrants, including with respect to—</text><subparagraph id="HCED5273DD1AF4A44AD79EBC233B596FA"><enum>(A)</enum><text>responding to applications;</text></subparagraph><subparagraph id="HBDA92813D48A45F3B4026D3FCAC4C967"><enum>(B)</enum><text>approving applications; and</text></subparagraph><subparagraph id="H2963E04E42824E5AB7184C4B0B993091"><enum>(C)</enum><text>disbursing emergency aid subgrants outside of business hours; and</text></subparagraph></paragraph><paragraph id="H6ED9329820214642B939DD7A8C42B73A"><enum>(6)</enum><text>an assurance that such State will notify students enrolled in institutions of higher education in such State if such students, or dependents of such students, become eligible for assistance under—</text><subparagraph id="H616AFBBCF9C244299BA7F594A5EFEA61"><enum>(A)</enum><text>the special supplemental nutrition program for women, infants, and children under section 17 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>);</text></subparagraph><subparagraph id="H3C1A75B4A59E4E2BA6EF90E11A555164"><enum>(B)</enum><text>the supplemental nutrition assistance program under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>);</text></subparagraph><subparagraph id="H555EDFB99F434B24A96A00EED755651B"><enum>(C)</enum><text>the free and reduced price school lunch program under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>);</text></subparagraph><subparagraph id="H0390468582E544DE8772D77E30A0335B"><enum>(D)</enum><text>the temporary assistance for needy families program under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601</external-xref>);</text></subparagraph><subparagraph id="HFE1DB67EAD054231AA896C820B9D65D3"><enum>(E)</enum><text>the supplemental security income program under title XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>);</text></subparagraph><subparagraph id="H3B9F4DD9936143C88E0C52B64032D788"><enum>(F)</enum><text>Medicaid under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>);</text></subparagraph><subparagraph id="H50EB31079FFA4A4BBA9838A8F97D835C"><enum>(G)</enum><text>Federal housing assistance programs under the United States Housing Act of 1937, including—</text><clause id="H9E184D1ACB3640D4B3B3A4636FD8D9F3"><enum>(i)</enum><text>public housing as defined in section 3(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>); and</text></clause><clause id="H18A1EE0AA7AA4C9AB536D2266F687DFE"><enum>(ii)</enum><text>tenant-based assistance under section 8(o) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>); and</text></clause></subparagraph><subparagraph id="HF26CA238261A419D9E0A22E1F55953AF"><enum>(H)</enum><text>any other means-tested program determined by the Secretary to be appropriate.</text></subparagraph></paragraph></section><section id="H60CFA545501E449B928E26C7DDC4C1AC"><enum>303.</enum><header>Grant uses</header><subsection id="HBBC65575440E46F38E898128F99BD9A5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A State shall use grant funds awarded under this title to award subgrants to eligible students for emergency aid.</text></subsection><subsection id="HE5E0C6A774FF4A618943946EB4B11C01"><enum>(b)</enum><header>Subgrants</header><paragraph id="HD51AAB65CD10455B89C7382A1C9E7C8E"><enum>(1)</enum><header>Administration</header><text>In awarding subgrants under this subsection, a State may award a contract to a scholarship-granting organization for purposes of—</text><subparagraph id="HA75320DF411C4A27AC1A776F153C53C0"><enum>(A)</enum><text>accepting applications from eligible students; and</text></subparagraph><subparagraph id="H14C36C54AD684FEB91774E221108A5E5"><enum>(B)</enum><text>disbursing subgrant funds to eligible students.</text></subparagraph></paragraph><paragraph id="H779AA77102EE48F8B1ED67F5147519F9"><enum>(2)</enum><header>Applications</header><subparagraph id="H7AEF90B3024345AE8724218BFB6601A4"><enum>(A)</enum><header>In general</header><text>To be eligible for a subgrant under this title, an eligible student shall submit to the State an application in such form, at such time, and containing such information as the State determines appropriate.</text></subparagraph><subparagraph id="HEDB34CF816DA4C17945716010D5E9D50"><enum>(B)</enum><header>Appeal</header><text>If an application for an emergency aid subgrant submitted by an eligible student under subparagraph (A) is denied by the State, such student may appeal such denial in a manner to be determined by the State.</text></subparagraph></paragraph><paragraph id="HCB00F5F6E8AC4418A6A31DD1AE2636EE"><enum>(3)</enum><header>Notification</header><text>Upon receipt of an application from an eligible student under paragraph (2), the State shall notify such student of such receipt in a manner to be determined by the State.</text></paragraph><paragraph id="H7E068256B2C9470CA1FA002A82965487"><enum>(4)</enum><header>Funds</header><subparagraph id="H801964C9606148CE9EDFA17153901010"><enum>(A)</enum><header>Subgrant amounts</header><clause id="H9B868BF6065B474A852FD542BEB884BA"><enum>(i)</enum><header>Eligible students without dependents</header><text>With respect to an academic year, a subgrant awarded to an eligible student that does not have a dependent may not exceed $1,500. </text></clause><clause id="HE897EC889C114248A81FC0C4FA0F5B90"><enum>(ii)</enum><header>Eligible students with dependents</header><text>With respect to an academic year, a subgrant awarded to an eligible student with a dependent may not exceed $2,500.</text></clause></subparagraph><subparagraph id="H6580A305C05F46FABAC9B954253336E3"><enum>(B)</enum><header>Disbursement of funds</header><text>A State shall disburse funds to eligible students in a timely manner, as determined by the State.</text></subparagraph><subparagraph id="HBFCC599D12A64A8CB192F94BE6313421"><enum>(C)</enum><header>Federal taxes</header><text display-inline="yes-display-inline">A subgrant under this title may not be considered income for purposes of the Internal Revenue Code of 1986.</text></subparagraph></paragraph></subsection></section><section id="HE2865EC9286C45F4B3B8E8CD46BEA534"><enum>304.</enum><header>Data collection</header><text display-inline="no-display-inline">A State that awards subgrants under this title shall collect the following data:</text><paragraph id="HA07826267D134B5BBFB871D88A5725CE"><enum>(1)</enum><text>With respect to each public institution of higher education—</text><subparagraph id="H4DED76EFA9E543C98D2E15DF4E6AB3FA"><enum>(A)</enum><text>the number and percentage of students receiving emergency aid; and</text></subparagraph><subparagraph id="HC10D5E4C4B5246DF93421E6ACBA87449"><enum>(B)</enum><text>the average grant amount for each student.</text></subparagraph></paragraph><paragraph id="H0E9E0E3C498443A58FAB68CD90A31D8D"><enum>(2)</enum><text>With respect to each semester or quarter at a public institution of higher education—</text><subparagraph id="H0C2351FF5AAC4992AD77B801C94A2720"><enum>(A)</enum><text>rate of retention; and</text></subparagraph><subparagraph id="H9D920F8FA18F4A9B81411A2AA542A173"><enum>(B)</enum><text>rate of completion of a recognized secondary credential.</text></subparagraph></paragraph><paragraph id="H6383A6B05E2540DB957CCE5D1DF27F4E"><enum>(3)</enum><text>The grade point averages of students receiving emergency aid subgrants. </text></paragraph><paragraph id="H31AF1A2E6FC7430A98C26C15761DDEA3"><enum>(4)</enum><text>Other data reported by the State.</text></paragraph><paragraph id="H1521AE3A7E6F4453BD7FD0D9E4D03366"><enum>(5)</enum><text>Other data required by the Secretary.</text></paragraph></section><section id="H4EBCBDAE8CF44090B3A4F504771C38E9"><enum>305.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as are necessary to carry out this title for fiscal year 2023 and each of the 4 succeeding fiscal years.</text></section></title><title id="H1875FC9071304B529A198E8E0718D331"><enum>IV</enum><header>Technical Assistance</header><section id="HF2CBDD4055A6448D9B381E28C34A675F" commented="no"><enum>401.</enum><header>Technical assistance grant program</header><subsection id="H488149C61DA6497A86A1934D5EAD78AC" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a program to provide grants to eligible entities to provide technical assistance to States applying for grants under title I, II, or III of this Act.</text></subsection><subsection id="HA66274ACBDF04479817C19B3603A88B7" commented="no"><enum>(b)</enum><header>Eligible entity defined</header><text>In this title, the term <term>eligible entity</term> means an entity—</text><paragraph id="HF2FF410C0BFA456AB3F837D94F691FB1" commented="no"><enum>(1)</enum><text>that is—</text><subparagraph id="HA4D24AA9E604477F877E4F60F01C8715" commented="no"><enum>(A)</enum><text>a nonprofit organization;</text></subparagraph><subparagraph id="HCA028499C4314BA188D6DA5DEF6D8FD3" commented="no"><enum>(B)</enum><text>a think tank;</text></subparagraph><subparagraph id="H57A0E04580A0485CBF8DD7C5AF01534A" commented="no"><enum>(C)</enum><text>a State board of education;</text></subparagraph><subparagraph id="H785FAF67108B447996FD6CB9B32C20A8" commented="no"><enum>(D)</enum><text>a research center at an institution of higher education; or</text></subparagraph><subparagraph id="HAD1AFF7935C04807B18BAF8F1673126A" commented="no"><enum>(E)</enum><text>an other entity as determined by the Secretary;</text></subparagraph></paragraph><paragraph id="HF6BEA916A2F84FBC975ABA5A9C87909C" commented="no"><enum>(2)</enum><text>that has expertise with respect to—</text><subparagraph id="H6CA1A44CC09E456EAB4A5052789DEE13" commented="no"><enum>(A)</enum><text>developing, designing, researching, or evaluating—</text><clause id="H98051E0E45DA4A01B2B063EB2F2996D7" commented="no"><enum>(i)</enum><text>tuition-free community college programs; </text></clause><clause id="H7BFF11878DAD4807B4B59CBAC0D96039" commented="no"><enum>(ii)</enum><text>emergency aid programs; or</text></clause><clause id="HB93101FC87BA43E0B57EF59E6D67C941" commented="no"><enum>(iii)</enum><text>initiatives addressing the basic needs of students; or</text></clause></subparagraph><subparagraph id="HF3011B20630C4326811A12D528E86455" commented="no"><enum>(B)</enum><text>implementing supportive services programs for students; and</text></subparagraph></paragraph><paragraph id="H25A73340DB2B43A18A699FCF076F656A" commented="no"><enum>(3)</enum><text>that has a demonstrated record of supporting institutions of higher education or States with respect to—</text><subparagraph id="HF1A88AE9CAC748FF9059D2EA8B286237" commented="no"><enum>(A)</enum><text>the activities described in paragraph (2); and</text></subparagraph><subparagraph id="H7426D27404E84F3B99E57C6CE2E651CA" commented="no"><enum>(B)</enum><text>connecting students to public benefits.</text></subparagraph></paragraph></subsection></section><section id="H42825999E4344671A31BCC396662D8FF"><enum>402 </enum><header>Application</header><text display-inline="no-display-inline">To be eligible for a grant under this title, an eligible entity shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines appropriate.</text></section><section id="H8E6BA8381CC742AE9B2EB58CA2467A66"><enum>403.</enum><header>Grant uses</header><text display-inline="no-display-inline">An eligible entity shall use grant funds awarded under this title for the following:</text><paragraph id="H57068E56868A49249FCBD94821639900"><enum>(1)</enum><text>Assisting States with respect to—</text><subparagraph id="HDF2CFC33D97F405BA785D2337E7BBB86"><enum>(A)</enum><text>the application process for a grant under title I, II, or III of this Act; and</text></subparagraph><subparagraph id="H4270FAAAD2E5422FA02C714E82FA2469"><enum>(B)</enum><text>the development or new, or expansion or improvement of existing, tuition-free community college models.</text></subparagraph></paragraph><paragraph id="HD8B4F9F5B4F54D90BBDE72B3AFACF3F0"><enum>(2)</enum><text>Assisting the Secretary with respect to—</text><subparagraph id="H1EAE29D292C74569A058BDD1CF0793E7"><enum>(A)</enum><text display-inline="yes-display-inline">evaluating applications from States for grants under title I, II, or III of this Act; and</text></subparagraph><subparagraph id="H56A0B0AEF51D45FDA0FA0A4811493325"><enum>(B)</enum><text>providing feedback to such States.</text></subparagraph></paragraph></section><section id="HC41E4E0FBB5A4DECA3C1939FA84631A4"><enum>404.</enum><header>Reports</header><subsection id="H9CE9573C8C8841089F919CA51878E1D7"><enum>(a)</enum><header>Annual report</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which a grant is made under this title, and on an annual basis thereafter, a State receiving assistance from an eligible entity that received a grant under this title shall submit to the Secretary a report on—</text><paragraph id="H6158A16593A541439578BB2C6D006E06"><enum>(1)</enum><text display-inline="yes-display-inline">the effectiveness of such assistance, including, as applicable, progress with respect to applying for a grant under this Act; and</text></paragraph><paragraph id="HF1EA80751334433C98702F19F693F2DD"><enum>(2)</enum><text display-inline="yes-display-inline">as of the date of the submission of the report, any outcomes of programs funded by a grant under this Act and carried out by such State, describing—</text><subparagraph id="H42352926B87F4369B39E484E1DC9C0B2"><enum>(A)</enum><text>any Federal policies that prevent successful implementation of such programs; and</text></subparagraph><subparagraph id="HE8A1373EC3904E9D8138175710D6AFC8"><enum>(B)</enum><text>any recommendations for changes with respect to Federal policies described in paragraph (1).</text></subparagraph></paragraph></subsection><subsection id="HE8AEF8670D584AAD87A40941416A5F25"><enum>(b)</enum><header>GAO report</header><text>Not later than 1 year after the date on which each report is submitted under subsection (a), the Comptroller General shall submit to Congress a report on the policy barriers described in subsection (a)(2), including policy recommendations based on such barriers. </text></subsection></section><section id="H42B642E9CB104F688660F4FB896D78D9"><enum>405.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as are necessary to carry out this title for fiscal year 2023 and each of the 4 succeeding fiscal years.</text></section></title><title id="H384A12FB072448B3BE621FD4041F6626"><enum>V</enum><header>Definitions</header><section id="HE974BB97851742EFB499D1DA69BE2B9E"><enum>501.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H8A530D04904546B9B1D8CABE5C353ADB"><enum>(1)</enum><header>Community college</header><text display-inline="yes-display-inline">The term <term>community college</term> has the meaning given the term <term>junior or community college</term> in Section 312 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1058">20 U.S.C. 1058</external-xref>).</text></paragraph><paragraph id="H17D155DEFEA84D378491D81FFFC3054C"><enum>(2)</enum><header>Eligible student</header><text>The term <term>eligible student</term> means an individual who—</text><subparagraph id="H7D329DC74EAD4CE8A7EF799ACA2F78D0"><enum>(A)</enum><text display-inline="yes-display-inline">is at least 18 years of age;</text></subparagraph><subparagraph id="H5D782A6C82284950945277BFA75A06CD"><enum>(B)</enum><text>a resident of the State; and</text></subparagraph><subparagraph id="HD0093C7BFEA04F3C969C80E26BAF4ACB"><enum>(C)</enum><text>does not have a postsecondary credential that is less than a bachelor’s degree.</text></subparagraph></paragraph><paragraph id="H13125930E6D14E9FB9FBFBF75A276D76"><enum>(3)</enum><header>ESEA terms</header><text>The terms <term>secondary school</term> and <term>Secretary</term> have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="H073626B1AAD94CA684860D263FC7A1CA"><enum>(4)</enum><header>Institution of higher education</header><text display-inline="yes-display-inline">The term <term>institution of higher education</term> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><paragraph id="HE2462466220F4803920E0553C0D0F91E"><enum>(5)</enum><header>WIOA terms</header><subparagraph id="H708C1B273ECD4EF794BF65C5092E54A4"><enum>(A)</enum><text display-inline="yes-display-inline">The terms <term>in-demand industry sector or occupation</term>, <term>individual with a barrier to employment</term>, <term>recognized postsecondary credential</term>, <term>State board</term>, and <term>supportive services</term> have the meanings given such terms in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></subparagraph><subparagraph id="H7683B862FD0A4CEE8F87AB4B7A6DEBDF"><enum>(B)</enum><text display-inline="yes-display-inline">The term <term>integrated education and training</term> has the meaning given such term in section 203 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3272">29 U.S.C. 3272</external-xref>).</text></subparagraph></paragraph></section></title></legis-body></bill>
