R. 3001</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230428">April 28, 2023</action-date><action-desc><sponsor name-id="D000032">Mr. Donalds</sponsor> (for himself, <cosponsor name-id="W000814">Mr. Weber of Texas</cosponsor>, <cosponsor name-id="H001096">Ms. Hageman</cosponsor>, <cosponsor name-id="C001126">Mr. Carey</cosponsor>, <cosponsor name-id="J000304">Mr. Jackson of Texas</cosponsor>, and <cosponsor name-id="B000825">Mrs. Boebert</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Education to implement corrective measures for a local educational agency or institution of higher education that prohibits or constrains fossil fuel sector employment recruitment, and for other purposes.</official-title></form><legis-body id="HF50407044EF84FC0876919E72A1ED14C" style="OLC"><section id="H0C9A747931EE41F9BF60C0E361CCC3BE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Embrace Fossil Fuel Recruitment Act</short-title></quote>.</text></section><section id="H1630C68B175F493CA4F4BFD75AF6F0B1"><enum>2.</enum><header>Fossil fuel industry workforce recruiter access to students</header><subsection id="HF94C1492460E4F2FABBDF3B9930C9684"><enum>(a)</enum><header>Secondary schools</header><paragraph id="H6AD5DBF1BD784C828C877CA1C4DE20A0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each local educational agency (as defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)) receiving financial assistance under such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>) shall provide prospective employers doing business within the fossil fuel sector the same access to secondary school students for recruitment purposes as is provided to prospective employers doing business within other energy resource sectors. </text></paragraph><paragraph id="H26EF90AD983946A6BFD4C0B2867B781B" display-inline="no-display-inline"><enum>(2)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Paragraph (1) shall be subject to enforcement under part D of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1234">20 U.S.C. 1234 et seq.</external-xref>).</text></paragraph></subsection><subsection id="H02B309A8D4FC456D8E7582077135A392"><enum>(b)</enum><header>Institutions of higher education</header><paragraph id="HFFE85415F3D6411794D2EE57D42B26B6"><enum>(1)</enum><header>In general</header><text>Each institution of higher education (as defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>)) receiving financial assistance under such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>) shall provide prospective employers doing business within the fossil fuel sector the same access to students for recruitment purposes as is provided to prospective employers doing business within other energy resource sectors.</text></paragraph><paragraph id="HAE52848EA6774D75891F2DEB78F1A0DF"><enum>(2)</enum><header>Enforcement</header><text display-inline="yes-display-inline">For purposes of section 487(c)(3)(B)(i)(I) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(c)(3)(B)(i)(I)</external-xref>), a failure to comply with paragraph (1) shall be considered a failure to comply with a provision of title IV of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070 et seq.</external-xref>). In addition, the Secretary of Education shall have the authority to implement the same range of corrective measures for an institution that fails to comply with paragraph (1) as the Secretary has for an institution that fails to comply with a requirement in its program participation agreement under section 487 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094</external-xref>), including termination of the institution's participation under title IV of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070 et seq.</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
