which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><action display="yes"><action-date date="20240130">January 30, 2024</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on April 28, 2023</action-instruction></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of the Interior to convey to Mesa County, Colorado, certain Federal land in Colorado, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HII00" reported-display-style="italic" id="HEDE0902878344C9D90EF2ED8926CA021"><section id="H11A5479C83604F078FE9A0F4F87F83F5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clifton Opportunities Now for Vibrant Economic Yields Act</short-title></quote> or as the <quote><short-title>CONVEY Act</short-title></quote>.</text></section><section id="H5771657E39B647C293A321DE9F9DD539" section-type="subsequent-section"><enum>2.</enum><header>Conveyance of Federal land to Mesa County, Colorado</header><subsection id="H7F9EC7B3255A4C678863D1609677587F"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H35EA1245F2F84D1C85F1A5D77127B4BB"><enum>(1)</enum><header>Clifton parcel</header><text>The term <term>Clifton parcel</term> means the approximately 31.1 acres of Federal land depicted as <quote>31.1 Acres to be Conveyed to Mesa County</quote> on the map titled <quote>Clifton Opportunities Now for Vibrant Economic Yields (CONVEY) Act</quote> and dated April 19, 2023.</text></paragraph><paragraph id="HE854413C5C3241D682CBA1F6B874C4B6"><enum>(2)</enum><header>County</header><text>The term <term>County</term> means Mesa County, Colorado.</text></paragraph><paragraph id="H1AF9CDD8E1E0420EB47B624E6FDD95A6"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the Bureau of Land Management.</text></paragraph></subsection><subsection id="HC7B176E131D74E10AA91ED8EE7A9FC8E"><enum>(b)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding the Secretarial Order dated August 26, 1902, and the Secretarial Order dated July 25, 1908, the Secretary shall convey to the County, as soon as practicable, all rights, title, and interest of the United States in and to the Clifton parcel.</text></subsection><subsection id="H6FDD337B8C534BDC98CE1F06960C9AFF"><enum>(c)</enum><header>Requirements</header><text>The conveyance under this section shall be—</text><paragraph id="H21834E3DBBBD4EC187D613B924CEE5A0"><enum>(1)</enum><text>subject to valid existing rights; and</text></paragraph><paragraph id="HF2C7A351A9E74279B2A861488C0D0733"><enum>(2)</enum><text>for not less than fair market value, as determined in accordance with subsection (d).</text></paragraph></subsection><subsection id="HCA6AA3DFF4E745D9BDCE8BE319E02218"><enum>(d)</enum><header>Appraisal</header><paragraph id="HA2871B8787404D9D810CCCC63A70763A"><enum>(1)</enum><header>In general</header><text>The fair market value of the Clifton parcel shall be determined by an independent appraisal obtained by the Secretary.</text></paragraph><paragraph id="H4415C8CF0D544CCBB498B0B5215F1D64"><enum>(2)</enum><header>Appraisal standards</header><text>The appraisal required by paragraph (1) shall be conducted in accordance with the—</text><subparagraph id="HA4C5D18A863B48D4A00B8217060EE8B8"><enum>(A)</enum><text>Uniform Appraisal Standards for Federal Land Acquisitions; and</text></subparagraph><subparagraph id="HC4099B582A3C4ADBB0460F4A04757FA5"><enum>(B)</enum><text>Uniform Standards of Professional Appraisal Practice.</text></subparagraph></paragraph></subsection><subsection id="H4F029ABECE144A3896D71318EE2B95ED"><enum>(e)</enum><header>Costs of conveyance</header><text display-inline="yes-display-inline">The County shall pay all costs associated with the conveyance required under subsection (b), including all costs associated with any survey conducted for the purpose of accomplishing such conveyance.</text></subsection><subsection id="H981925B7341348CD87B40FE04374CA16"><enum>(f)</enum><header>Proceeds from conveyance</header><text display-inline="yes-display-inline">The proceeds from the conveyance required under subsection (b) shall be—</text><paragraph id="HCE0545D8B145438390AEDDEE173E1575"><enum>(1)</enum><text>deposited into the Federal Land Disposal Account established by the Federal Land Transaction Facilitation Act (<external-xref legal-doc="usc" parsable-cite="usc/43/2301">43 U.S.C. 2301 et seq.</external-xref>); and</text></paragraph><paragraph id="HB182DBF856A74C9181188314DF9A33A8"><enum>(2)</enum><text>available for expenditure under that Act.</text></paragraph></subsection><subsection id="H9D30FB9A693A43ECA297DE16BB07F9ED"><enum>(g)</enum><header>Map and legal description</header><paragraph id="H0AA3532CB31F49CD9DB739434C29CCCB"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of the enactment of this Act, the Secretary shall finalize a map and a legal description of all land to be conveyed under this Act.</text></paragraph><paragraph id="HB584886CF7DA4E759B9D6B9F13366E82"><enum>(2)</enum><header>Controlling document</header><text>In the case of a discrepancy between the map and the legal description created under paragraph (1), the map shall control.</text></paragraph><paragraph id="H063F9292BBFD449A87450955069F2D10"><enum>(3)</enum><header>Corrections</header><text>The Secretary and the County, by mutual agreement, may correct any minor errors in the map or the legal description created under paragraph (1).</text></paragraph><paragraph id="H474C75A2EEE64AD08486C1146B625973"><enum>(4)</enum><header>Map on file</header><text>The map and the legal description created under paragraph (1) shall be kept on file and available for public inspection in each appropriate office of the Bureau of Land Management.</text></paragraph></subsection></section></legis-body><endorsement display="yes"><action-date date="20240130">January 30, 2024</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
