which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the National Defense Authorization Act for Fiscal Year 2017 to address sexual harassment involving National Oceanic and Atmospheric Administration personnel, and for other purposes.</official-title></form><legis-body id="HAD5C31668F614152AF8862766C7E1BD4" style="OLC"><section id="HEC94F699E9D24AECB8376D99DF43808A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Oceanic and Atmospheric Administration Sexual Harassment and Assault Prevention Improvements Act of 2023</short-title></quote>.</text></section><section id="H7D4746847D1A486D8492B8270CBBEE83"><enum>2.</enum><header>References</header><text display-inline="no-display-inline">Except as otherwise specifically provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a provision, the reference shall be considered to be made to a provision of subtitle C of title XXXV of <external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/33/894">33 U.S.C. 894 et seq.</external-xref>).</text></section><section id="H7867D30DD5164BEB8C2EDB70CE8A13F9"><enum>3.</enum><header>Policy on the prevention of and response to sexual harassment involving National Oceanic and Atmospheric Administration personnel</header><text display-inline="no-display-inline">Section 3541(f) (<external-xref legal-doc="usc" parsable-cite="usc/33/894">33 U.S.C. 894(f)</external-xref>) is amended—</text><paragraph id="H71088125D6174375A95A3B028F66305A"><enum>(1)</enum><text>by inserting <quote>and equal employment</quote> after <quote>sexual harassment</quote> each place it appears; and</text></paragraph><paragraph id="HA416FB4FBD96400E81BC70DBE16E520E"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="H4E66CC4C491A4CA588CB1693A6F663F5"><enum>(A)</enum><text>by redesignating subparagraphs (C) and (D) as subparagraphs (D) and (E), respectively; and</text></subparagraph><subparagraph id="HEAF574BD441846AEB00EDF55985BE489"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (B) the following:</text><quoted-block style="OLC" id="HC58EBB87D0EC4B2A8227A0D1EA7DDAB5" display-inline="no-display-inline" committee-id="HII00"><subparagraph id="H635A13DCB16F448D8A83F667186FDC9C"><enum>(C)</enum><text display-inline="yes-display-inline">A synopsis of each case and the disciplinary action taken, if any, in each case.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="HFB1B2B24BFAF4AA087BD365558C960D6"><enum>4.</enum><header>Annual report on sexual assaults, sexual harassment, and equal employment</header><text display-inline="no-display-inline">Section 3548 (<external-xref legal-doc="usc" parsable-cite="usc/33/894e">33 U.S.C. 894e</external-xref>) is amended—</text><paragraph id="H97774B87A74041838C0E5377EDB80CAF"><enum>(1)</enum><text>by striking the section heading and inserting the following: <quote><header-in-text level="section" style="OLC">Annual report on sexual assaults, sexual harassment, and equal employment in the National Oceanic and Atmospheric Administration.</header-in-text></quote>;</text></paragraph><paragraph id="H5B3FAE47302E4C5BB57C1D07B4863C5E"><enum>(2)</enum><text>in subsection (a), by striking <quote>the sexual assaults involving</quote> and inserting <quote>sexual assault and sexual harassment involving and the equal employment of</quote>; and</text></paragraph><paragraph id="H7ADB24FB933D48E6857BA748EDB1C42A"><enum>(3)</enum><text>in subsection (b)—</text><subparagraph id="H91EB283AAF2E4E3BB21A727BFB8F5D5C"><enum>(A)</enum><text>in paragraph (4), by inserting <quote>, including a synopsis of each case and the disciplinary action taken, if any, in each case</quote> before the period at the end; and</text></subparagraph><subparagraph id="H8A6FAB166BE841E9BAE15CBBE71CEE67"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H7B1C7BDB235747AE9CCE0D1942B14252" display-inline="no-display-inline" committee-id="HII00"><paragraph id="H3737207CCB374558B5094C7A6FDE7157"><enum>(5)</enum><text display-inline="yes-display-inline">A summary of the number of change of station, unit transfer, and change of work location requests submitted to the Under Secretary under section 3544(a), including the number of such requests that were denied.</text></paragraph><paragraph id="HB69F784BEB74450D88E2FC14FE953C6A" commented="no"><enum>(6)</enum><text display-inline="yes-display-inline">A summary of the number of cases referred to the Coast Guard under this section.</text></paragraph><paragraph id="H8B2811AD9BED415380059065F857FE28"><enum>(7)</enum><text display-inline="yes-display-inline">The number of alleged sexual assaults and sexual harassment cases involving fisheries observers, protected species observers, and endangered species observers, including—</text><subparagraph id="H2D1FF5BE469F452E81548DD10802378A"><enum>(A)</enum><text>a synopsis of each case and the status of such case;</text></subparagraph><subparagraph id="H9BABFC27E8334EE697C3A9C3B72CB6A6"><enum>(B)</enum><text>the disposition of any investigation; and</text></subparagraph><subparagraph id="H5053EBB2DDCC418DA449C26038347CC0"><enum>(C)</enum><text>a description of the fishery management region and fishery or the geographic region and type of permitted operation in which the sexual assault or sexual harassment is alleged to have occurred, as appropriate.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="HF67857277F2A41788CBC40CBBD3E50F7"><enum>5.</enum><header>Investigation and criminal referral requirements</header><subsection id="HDF86028273C844F18C3DC6D7FD1D15F4"><enum>(a)</enum><header>Technical amendment</header><text display-inline="yes-display-inline">Sections 3548 and 3549 (33 U.S.C. 894e and 894f) are redesignated as sections 3551 and 3552, respectively.</text></subsection><subsection id="HA5A3D34A9AB54DEEA1BE7C73348ED297"><enum>(b)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle C of title XXXV (<external-xref legal-doc="usc" parsable-cite="usc/33/894">33 U.S.C. 894 et seq.</external-xref>) is amended by inserting after section 3547 (<external-xref legal-doc="usc" parsable-cite="usc/33/894d-2">33 U.S.C. 894d–2</external-xref>) the following:</text><quoted-block style="OLC" id="HE9E44008EF5A499B9257A65B998FD0AB" display-inline="no-display-inline" committee-id="HII00"><section id="H4C8DF836E0F4414980D4765EAC8B39A2"><enum>3548.</enum><header>Exceptions regarding anonymity of survivors in certain cases</header><subsection id="H0AC050BCF4A040DEB4D3B90B95F0AC5D"><enum>(a)</enum><header>In general</header><text>In any case in which an employee, member of the commissioned officer corps of the Administration, or covered personnel elects restricted or unrestricted reporting under section 3541(b)(3)(B) or 3542(b)(5)(B), disclosure of the personally identifying information of such individual is authorized to the following persons or organizations when disclosure would be for the following reasons:</text><paragraph id="HC400C491365F438C988F6CE3303B1CB5"><enum>(1)</enum><text>To Administration staff or law enforcement personnel, if authorized by the survivor in writing.</text></paragraph><paragraph id="HA68FFF7A28AD4417A4928132884F483F"><enum>(2)</enum><text>To Administration staff or law enforcement personnel to prevent or lessen a serious or imminent threat to the health or safety of the survivor or another person.</text></paragraph><paragraph id="H0F86A4B48D5D4FDBBCF4A6A87FB9EF5F"><enum>(3)</enum><text>To a survivor advocate or healthcare provider, if required for the provision of survivor services.</text></paragraph><paragraph id="H9F9AFC1FE10C495F9661F8E07225B49D"><enum>(4)</enum><text>To a State or Federal court, if pursuant to a court order or if disclosure is required by Federal or State statute.</text></paragraph></subsection><subsection id="H2CFE7654C8CF406D9DE49646252AB35C"><enum>(b)</enum><header>Notice of disclosure and privacy protection</header><text>In any case in which information is disclosed under subsection (a), the Secretary shall—</text><paragraph id="H1A133469748F4C558B53E70CB53ADBB5"><enum>(1)</enum><text>make reasonable attempts to provide notice to the individual whose personally identifying information is disclosed; and</text></paragraph><paragraph id="HF8E86622C3A540C3B02EE3B632B67CFD"><enum>(2)</enum><text>take such action as is necessary to protect the privacy and safety of the individual.</text></paragraph></subsection></section><section id="H89F1432EB57F4026AD71D7A850B3F4E5"><enum>3549.</enum><header>Restricted reporting</header><subsection id="H75AB821D352843BDB8CEAAA432A0176E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of the enactment of the <short-title>National Oceanic and Atmospheric Administration Sexual Harassment and Assault Prevention Improvements Act of 2023</short-title>, the Secretary of Commerce, acting through the Under Secretary for Oceans and Atmosphere, shall develop a mechanism to provide a system of restricted reporting.</text></subsection><subsection id="H8E5AF3A94ED242E5B01E0820207D66FB"><enum>(b)</enum><header>Restricted reporting defined</header><text>In this section the term <term>restricted reporting</term> means a system of reporting that allows employees of the Administration, members of the commissioned officer corps of the Administration, and covered personnel who allege that they have been sexually harassed or sexually assaulted to confidentially disclose the details of such sexual harassment or sexual assault to specified individuals and receive the services outlined in this subtitle—</text><paragraph id="H83B520571309454F954CDC4B72E8F7EE"><enum>(1)</enum><text display-inline="yes-display-inline">without the dissemination of the personally identifying information of such individual except as necessary for the provision of such services and as provided by section 3548(a); and</text></paragraph><paragraph id="H3C0D03BDECA7415EBFCC06CA3530A952"><enum>(2)</enum><text>without automatically triggering an investigative process.</text></paragraph></subsection></section><section id="H5411E5C0D92A4742B06D719463BC3BD9" display-inline="no-display-inline" section-type="subsequent-section"><enum>3550.</enum><header>Mariner referral</header><text display-inline="no-display-inline">The Under Secretary of Commerce for Oceans and Atmosphere, acting through the Director of the Office of Marine and Aviation Operations and in consultation with the Commandant of the Coast Guard, shall, not later than 180 days after the date of the enactment of the <short-title>National Oceanic and Atmospheric Administration Sexual Harassment and Assault Prevention Improvements Act of 2023</short-title>, develop and implement a policy to report to the Commandant of the Coast Guard, in accordance with section 10104 of title 46, United States Code, the names of personnel of the Administration who—</text><paragraph id="H8205F54A04A04DCDA47036F8641227C3"><enum>(1)</enum><text display-inline="yes-display-inline">are the subject of a claim of an act or offense detrimental to good discipline and safety at sea, such as sexual harassment or sexual assault that is substantiated by an investigation under section 3546, or any other substantiated claim of an act or offense for which suspension or revocation of a credential is either mandatory or sought pursuant to part 5 of title 46, Code of Federal Regulations; and</text></paragraph><paragraph id="HB5406E6EF491411EA603DA8B0BD02FCE"><enum>(2)</enum><text>are—</text><subparagraph id="H69994C3E878545128AF600498A818E3F"><enum>(A)</enum><text>employees or contractors of the Administration required to hold a valid merchant mariner credential as a condition of employment; or</text></subparagraph><subparagraph id="H51F376BFFB9442E39E697CAB22B52154"><enum>(B)</enum><text>crew of a vessel that, at the time of such act or offense, was operating under a contract with the Administration.</text></subparagraph></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H9F6894BB01414476A92D70AFAB48B383"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 3552 is amended to read as follows:</text><quoted-block style="OLC" id="HBF486845A76A4FB391E2C38A04511170" display-inline="no-display-inline"><section id="HDD500CDACDF34C958C2C81920142B665"><enum>3552.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph id="H8BF5F6582E77413DAA02CBF185C26F4E"><enum>(1)</enum><header>Administration</header><text>The term <term>Administration</term> means the National Oceanic and Atmospheric Administration.</text></paragraph><paragraph id="HA6C889D12130434791C44344CC93A64D"><enum>(2)</enum><header>Covered personnel</header><text>The term <term>covered personnel</term> means an individual who works with or conducts business on behalf of the Administration and includes—</text><subparagraph id="H9BDF8E062E4742518FAFCC96B30E3C0A"><enum>(A)</enum><text display-inline="yes-display-inline">observers, at-sea monitors, and catch monitors required by the National Marine Fisheries Service to operate on or in commercial fishing vessels, other privately owned vessels, barges, or platforms, and shoreside processing facilities for—</text><clause id="HFF5FCC1F99164C47A086455144451911"><enum>(i)</enum><text>commercial fisheries observation required by the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801 et seq.</external-xref>);</text></clause><clause id="HCECEBAFFD8404C768ADC0706A1270568"><enum>(ii)</enum><text display-inline="yes-display-inline">protected species or endangered species observation required by the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1361">16 U.S.C. 1361 et seq.</external-xref>) or the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1351">16 U.S.C. 1351 et seq.</external-xref>); or </text></clause><clause id="H857DCDC24F4343989F6D9162499B0C22"><enum>(iii)</enum><text>platform removal observation; and</text></clause></subparagraph><subparagraph id="H287C161CB89E4166AE90FA0BF2FEEF6E" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">voting members and executive and administrative staff of regional fishery management councils established by section 302 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852</external-xref>).</text></subparagraph></paragraph><paragraph id="H68D35D16AC1048EAB9DE9ADFCE077283"><enum>(3)</enum><header>Sexual assault</header><text>The term <term>sexual assault</term> has the meaning given the term in section 40002(a) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13925">42 U.S.C. 13925(a)</external-xref>).</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H8A75D861E38948E7874105B190ED5C51"><enum>7.</enum><header>Conforming and clerical amendments</header><subsection id="H85D31000C09C4AE1BEFFB22BB48DE067"><enum>(a)</enum><header>Conforming amendments</header><text>Subtitle C of title XXXV (<external-xref legal-doc="usc" parsable-cite="usc/33/894">33 U.S.C. 894 et seq.</external-xref>) is amended—</text><paragraph id="HDA08E3D720CE4363A5F1417D39E6A293"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>individuals who work with or conduct business on behalf of the Administration</quote> each place it appears and inserting <quote>covered personnel</quote>;</text></paragraph><paragraph id="HC3C0F6CF5C224367BFBA8464CF18652C"><enum>(2)</enum><text>by striking <quote>National Oceanic and Atmospheric</quote> each place it appears, except—</text><subparagraph id="HF5CC195E17D44347880132E5F4F0370B"><enum>(A)</enum><text>when it appears as <quote><short-title>National Oceanic and Atmospheric Administration Sexual Harassment and Assault Prevention Improvements Act of 2023</short-title></quote>;</text></subparagraph><subparagraph id="HC064FCF03D554F8C8204D75C74545CE9"><enum>(B)</enum><text>in section 3551, in the section heading; and</text></subparagraph><subparagraph id="H4F9F1B5929D14C44845EF53E0CA2F581"><enum>(C)</enum><text>in section 3552(1);</text></subparagraph></paragraph><paragraph id="HDB58CA9D9AD241FFAC0AA40AFF16E920"><enum>(3)</enum><text>by striking the term <term>victims</term> each place it appears and inserting <quote>survivors</quote>;</text></paragraph><paragraph id="H87EFD61DE06B4A6290CB76404644F78B"><enum>(4)</enum><text>in section 3541(b)(2)(B), by striking <quote>victim</quote> and inserting <quote>target of sexual harassment</quote>;</text></paragraph><paragraph id="H23BE2F8867CE49D4AADD97F95EAA00C0"><enum>(5)</enum><text>in section 3542—</text><subparagraph id="HCE423FED9FF94308B391B4984B5138E2"><enum>(A)</enum><text>in subsection (b)(9)—</text><clause id="H9DFE5950C4FB4206B7481C22E5D3E2A5"><enum>(i)</enum><text>by striking <quote>Victim</quote> and inserting <quote>Survivor</quote>; Definitions.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HBAC79FB18DDA4684A35061FA4FC0AAA1"><enum>8.</enum><header>Prohibited acts</header><text display-inline="no-display-inline">Section 307(1)(L) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1857">16 U.S.C. 1857(1)(L)</external-xref>) is amended—</text><paragraph id="H0009BB632E4040B88AD39D8F444904AF"><enum>(1)</enum><text>by striking <quote>forcibly</quote>; and</text></paragraph><paragraph id="H17C20F5E19574DCEAD443906F7C0E864"><enum>(2)</enum><text>by striking <quote>on a vessel</quote>.</text></paragraph></section><section id="H080B8A5859FA4ABA92BED43380FE98FA"><enum>9.</enum><header>Prohibition on service in the commissioned officer corps of the National Oceanic and Atmospheric Administration by individuals convicted of certain sexual offenses</header><text display-inline="no-display-inline">Section 261(a) of the National Oceanic and Atmospheric Administration Commissioned Officer Corps Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/33/3071">33 U.S.C. 3071(a)</external-xref>) is amended—</text><paragraph id="H8C22DCE4554745A383BEA822C4A454B3"><enum>(1)</enum><text>by redesignating paragraph (26) as paragraph (27); and</text></paragraph><paragraph id="H8F67B7B0B8B14A398FE45484F5CC7DE7"><enum>(2)</enum><text>by inserting after paragraph (25) the following:</text><quoted-block style="OLC" id="HE36B4DE459B347CE814CA9DC04E7DE0F" display-inline="no-display-inline" committee-id="HII00"><paragraph id="H9D351D81B8DC4994B78E2AAD1DB7E5D2"><enum>(26)</enum><text display-inline="yes-display-inline">Section 657, relating to prohibition on service by individuals convicted of certain sexual offenses.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H4D21DB4D18504472BF4E3D2AFC02F4F7"><enum>10.</enum><header>Definition of responsible entity of a vessel</header><text display-inline="no-display-inline">Section 10104(g) of title 46, United States Code, is amended—</text><paragraph id="HCFEA37BC21A64AA193591EF9BE1E81B4"><enum>(1)</enum><text>in paragraph (1), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="H12A85978434B487BA0FF153EF9C16310"><enum>(2)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H6BD836A9E28E4540A981F3F83A57553C"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H26CC1B25D7DB4AD2A2C98F7DFAA38F07" display-inline="no-display-inline"><paragraph id="HC9CEEB22D1C844A8ACBBD783C1EC8C02"><enum>(3)</enum><text display-inline="yes-display-inline">the Director of the Office of Marine and Aviation Operations, with respect to each vessel owned or operated by the National Oceanic and Atmospheric Administration.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
