which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to prohibit the sale or other disposition of any firearm or ammunition to any person who has been convicted of a violent misdemeanor, and for other purposes.</official-title></form><legis-body id="HB21AED342F3F42C7AD153887C4341125" style="OLC"><section id="H1C8196FDAC81487A8BBAB2F15891625D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be referred to as the <quote><short-title>End Gun Violence Act of 2023</short-title></quote>. </text></section><section id="HD9B6CC9A816B405ABD26D8D3C3E0D5C4"><enum>2.</enum><header>Prohibition on sale or other disposition of a firearm or ammunition to a person convicted of a violent misdemeanor</header><text display-inline="no-display-inline">Section 922(d) of title 18, United States Code, is amended in the 1st sentence—</text><paragraph id="H53E87BC6CD0B4C8ABBDD34B3F61C214B"><enum>(1)</enum><text>in paragraph (10), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="HA0E8436E58A24CEDA099662E4EF631BF"><enum>(2)</enum><text>in paragraph (11), by striking the period and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H198B7BBD90524DEC9D17F51908C78ED6"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H525C0530C2704D00AE11A5BDFEB87469" display-inline="no-display-inline"><paragraph id="HCD5FEEDB2CBA4F7A93F07FED8F57833F"><enum>(12)</enum><text display-inline="yes-display-inline">has been convicted in any court of a violent misdemeanor within the preceding 5 years.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H0D957A9626AC479FA7649280833A07EF"><enum>3.</enum><header>Definition of violent misdemeanor</header><text display-inline="no-display-inline">Section 921(a) of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HE9BF609435474C88A2D1752D9EF6B457" display-inline="no-display-inline"><paragraph id="H8AB4B70AB07E4832BF86B4FE066E4841" display-inline="no-display-inline" indent="up1"><enum>(38)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H33496CC823D5492586D1E1444CC1EB02"><enum>(A)</enum><text>The term <term>violent misdemeanor</term> means an offense that—</text><clause id="H3C0D0BB5AE764F708CF3D782DB34546C" indent="up1"><enum>(i)</enum><text>is a misdemeanor under Federal, State, tribal, or local law; and</text></clause><clause id="H2F7B73BCD33947008379C82615CD8504" indent="up1"><enum>(ii)</enum><text>has as an element—</text><subclause id="H6185B8C0E0574152B7D2C9E6D25062D5"><enum>(I)</enum><text>the use, attempted use, or threatened use of—</text><item id="H78ADF1D6DA3A4B23B753CDD64AFAEC5A"><enum>(aa)</enum><text>physical force; or</text></item><item id="H69F5966812024800BDB1990077E55CF9"><enum>(bb)</enum><text>a deadly weapon; </text></item></subclause><subclause id="H047F9808B94846E08E6229885B7466E5"><enum>(II)</enum><text>the intent to cause physical injury; or</text></subclause><subclause id="HBF9EB682AE274387AF8E7394A12734C2"><enum>(III)</enum><text>knowingly causing physical injury.</text></subclause></clause></subparagraph><subparagraph id="H3F6001F85F0D4A029F4D77C3814C39E8" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="HD42DD74F533E49FBB921BB73BF92F19F"><enum>(i)</enum><text>A person shall not be considered to have been convicted of such an offense for purposes of this chapter, unless—</text><subclause id="H32001A5736034C79939225B7FAF8528F" indent="up1"><enum>(I)</enum><text>the person was represented by counsel in the case, or knowingly and intelligently waived the right to counsel in the case; and</text></subclause><subclause id="HE3372BCC3A804D41BB0D0F393DBF9ADC" indent="up1"><enum>(II)</enum><text>in the case of a prosecution for an offense described in this paragraph for which a person was entitled to a jury trial in the jurisdiction in which the case was tried, either—</text><item id="HBC6F86F35EEC47A8ABA55003B25379E2"><enum>(aa)</enum><text>the case was tried by a jury, or</text></item><item id="H5A6815DD4A2842AFA54133E0691B823A"><enum>(bb)</enum><text>the person knowingly and intelligently waived the right to have the case tried by a jury, by guilty plea or otherwise.</text></item></subclause></clause><clause id="HE0023BE864EF46C5BFA8BEB566E652A3" indent="up1"><enum>(ii)</enum><text>A person shall not be considered to have been convicted of such an offense for purposes of this chapter if the conviction has been expunged or set aside, or is an offense for which the person has been pardoned or has had civil rights restored (if the law of the applicable jurisdiction provides for the loss of civil rights under such an offense) unless the pardon, expungement, or restoration of civil rights expressly provides that the person may not ship, transport, possess, or receive firearms.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HFD4DC20A39B141BC9E6DD277795F78F9"><enum>4.</enum><header>Conforming amendments</header><subsection id="HB025798C7D1D482E9B1013F1E52B4A20"><enum>(a)</enum><text display-inline="yes-display-inline">Paragraphs (1)(B)(ii), (2), (4), and (5) of section 922(t) of title 18, United States Code, are each amended by striking <quote>receipt</quote> and all that follows through <quote>subsection (g)</quote> and inserting <quote>knowing sale or disposition of a firearm by the licensee to such other person, or the receipt of a firearm by such other person would violate subsection (d), (g),</quote>.</text></subsection><subsection id="HDA13F06E24F4491D83048F82583D6189"><enum>(b)</enum><text display-inline="yes-display-inline">Section 923(d)(1)(B) of such title is amended by striking <quote>section 922(g) and (n) of this chapter</quote> and inserting <quote>subsection (g) or (n) of section 922, and is not a person to whom the knowing sale or disposition of a firearm or ammunition is prohibited by section 922(d)</quote>.</text></subsection><subsection id="H05F63ABC85E848A3A7C6FD0EA13BFCFD"><enum>(c)</enum><text display-inline="yes-display-inline">Section 925A of such title is amended in paragraph (2), by inserting <quote>and to whom the knowing sale or disposition of a firearm was not prohibited pursuant to subsection (d) of such section</quote> after <quote>section 922</quote>.</text></subsection><subsection id="H1A092A418FE34456AC5BE1FA91D2D30D"><enum>(d)</enum><text display-inline="yes-display-inline">Section 103 of the Brady Handgun Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/34/40901">34 U.S.C. 40901</external-xref>) is amended—</text><paragraph id="HC01FC3DBF6C84D3BBF660DABE393F046"><enum>(1)</enum><text>in subsection (e)(1)—</text><subparagraph id="H19EB2115E2D844B3BF534E1063CEE5ED"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>for whom</quote> and all that follows through <quote>subsection (g)</quote> and inserting <quote>to whom the knowing sale or disposition of a firearm, or for whom receipt of a firearm, would violate subsection (d), (g),</quote>; and</text></subparagraph><subparagraph id="HC45376BB65FA46F6BD653F9B4083EB07"><enum>(B)</enum><text display-inline="yes-display-inline">in each of subparagraphs (F)(iii)(I) and (G)(i), by striking <quote>(g)</quote> and inserting <quote>(d), (g),</quote>;</text></subparagraph></paragraph><paragraph id="HE8A4224328AA465BB839B4B76BDF35BB"><enum>(2)</enum><text>in subsection (g), by striking <quote>receipt of a firearm by a prospective transferee would violate subsection (g)</quote> and inserting <quote>the knowing sale or disposition of a firearm to, or the possession or receipt of a firearm by, a prospective transferee would violate subsection (d), (g),</quote>; and</text></paragraph><paragraph id="H98C54435397D4AAC923AF9422D42F066"><enum>(3)</enum><text>in subsection (i)(2), by striking <quote>prohibited by section 922 (g) or (n) of title 18, United States Code or State law, from receiving a firearm.</quote> and inserting <quote>to whom the knowing sale or disposition of, or for whom the possession or receipt of, a firearm is prohibited by subsection (d), (g), or (n) of section 922 of title 18, United States Code, or State law.</quote>.</text></paragraph></subsection><subsection id="HBC04A4C6CA2D4D1B93DECD50E8550CB0"><enum>(e)</enum><text>Section 101(b) of the NICS Improvement Amendments Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/34/40911">34 U.S.C. 40911(b)</external-xref>) is amended—</text><paragraph id="H620A7CA6C0784A7FA750847DA06AC09B"><enum>(1)</enum><text>in paragraph (1)(A), by striking <quote>a person is disqualified from possessing or receiving a firearm under subsection (g)</quote> and inserting <quote>the knowing sale or disposition of a firearm to, or the possession or receipt of a firearm by, a person is prohibited under subsection (d), (g),</quote>; and</text></paragraph><paragraph id="HA90A6555FB634158876DB4C582F87EE9"><enum>(2)</enum><text>in paragraph (2)(A), by striking <quote>a member of the Armed Forces involved in such proceeding is disqualified from possessing or receiving a firearm under subsection (g)</quote> and inserting <quote>the knowing sale or disposition of a firearm to, or the possession or receipt of a firearm by, a member of the Armed Forces is prohibited under subsection (d), (g),</quote>.</text></paragraph></subsection><subsection id="H4AE0556DD0524BC9A1DB7893E73B1072"><enum>(f)</enum><text display-inline="yes-display-inline">Section 102 of the NICS Improvement Amendments Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/34/40912">34 U.S.C. 40912</external-xref>) is amended—</text><paragraph id="H29C96DEF92794BF8941C6086BFA272B0"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(3)—</text><subparagraph id="H3E1040A8D7D143FFBD538941E13CA9A6"><enum>(A)</enum><text>by inserting <quote>, or to whom the knowing sale or disposition of a firearm is prohibited,</quote> after <quote>firearm</quote>; and</text></subparagraph><subparagraph id="H576ECDB7E496499EA8494D26EED5F2C8"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>subsection (g)</quote> and inserting <quote>subsection (d), (g),</quote>; and</text></subparagraph></paragraph><paragraph id="H076A9AB917DB4F958432CB69EB2D5C27"><enum>(2)</enum><text>in subsection (c)(1)(A), by inserting <quote>, or is a person to whom the knowing sale or disposition of a firearm is prohibited by subsection (d) of such section</quote> before the period.</text></paragraph></subsection></section><section id="H6485B3DA785A4E11A4412DCFCC15A2C2"><enum>5.</enum><header>Applicability</header><text display-inline="no-display-inline">The amendments made by this Act shall not apply with respect to convictions occurring before the date that is 6 months after the date of enactment of this Act.</text></section><section id="H1F568E405A5B4DA181CD7F48BDFDA9F5"><enum>6.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall—</text><paragraph id="HCA2E30733ECC453896AC933336AC8C38"><enum>(1)</enum><text>alter the requirements of subsections (d)(8) or (g)(8) of section 922 of title 18, United States Code; or</text></paragraph><paragraph id="H3F63224E525C43AD84D9A22D3A5D9122"><enum>(2)</enum><text display-inline="yes-display-inline">have a limiting effect on State, tribal, or local law.</text></paragraph></section></legis-body></bill>
