which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require research facilities that use companion dogs, cats, or rabbits for research purposes and receive funding from the National Institutes of Health to offer such animals for adoption after completion of such research, and for other purposes.</official-title></form><legis-body id="HBC3D64CCE27846C6987D891D77832ED8" style="OLC"><section id="H3BE7726F933F4718AB9B3B909F61F209" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Companion Animal Release from Experiments Act of 2023</short-title></quote> or the <quote><short-title>CARE Act of 2023</short-title></quote>.</text></section><section id="HFC0322D7C53E4D8DBEA0FBC2C7B969E4"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress the finds the following:</text><paragraph id="HA761EFFD814A4820B15178107EAC835A"><enum>(1)</enum><text display-inline="yes-display-inline">The use of animals in research has been an issue of public concern since the mid-20th century, because animals used in research will, in most cases, experience fear, pain, confinement, and premature death.</text></paragraph><paragraph id="HEA05FBB3BC824CFE8AE60A04BA0EE095"><enum>(2)</enum><text display-inline="yes-display-inline">Section 495 of the Health Research Extension Act is the statutory basis for the public health service policy of the Federal Government with respect to humane care and use of laboratory animals.</text></paragraph><paragraph id="H617351D58FF84D15B6E686A886440571"><enum>(3)</enum><text display-inline="yes-display-inline">Currently, the public health service policy of the Surgeon General does not cover the post research treatment of such animals.</text></paragraph><paragraph id="H42B1E53DECCF430799C457B28E672C34"><enum>(4)</enum><text display-inline="yes-display-inline">Animals used in research include animals commonly kept as companion animals by the public.</text></paragraph><paragraph id="H3DFA0BBCF05346AAB9B0BE5C9701BF43"><enum>(5)</enum><text display-inline="yes-display-inline">More than 64,000 dogs, 18,000 cats, and 145,000 rabbits are used in experiments in the United States each year and much of the research is conducted at facilities that receive public funding through the National Institutes of Health.</text></paragraph><paragraph id="H6F012365D4E244BE9D39A888354F0C8C"><enum>(6)</enum><text display-inline="yes-display-inline">Due to an absence of Federal requirements, 15 States have enacted laws governing the post research placement for dogs and cats used in publicly funded research institutions.</text></paragraph><paragraph id="H82EE852C80864002887DAA9B45EC4595"><enum>(7)</enum><text display-inline="yes-display-inline">A national requirement is needed to ensure that research institutions that receive tax payer funding establish adoption policies for companion animals that are no longer used for research, including finding such animals a home and adopting transparent policies concerning the success of such requirement.</text></paragraph></section><section id="HD8DD1DA43818404D89A76923F098FF54" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Offering dogs, cats, or rabbits used in research facilities for adoption</header><subsection id="H8CB4ED5ED4AA42F1A168DC3576E7F526"><enum>(a)</enum><header>Adoption guidelines for research facilities</header><text>Section 495(b)(3) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/289d">42 U.S.C. 289d(b)(3)</external-xref>) is amended—</text><paragraph id="H690A04352D26492DB66850CE5B5D241C"><enum>(1)</enum><text>by striking the <quote>and</quote> at the end of subparagraph (B); </text></paragraph><paragraph id="HEB42DB470B2447768ABC6CBBBE8A3085"><enum>(2)</enum><text>by striking the period at the end of subparagraph (C) and inserting a semicolon; and</text></paragraph><paragraph id="H25FDBA5E5CA24FADA452540E04C425DB"><enum>(3)</enum><text>by inserting after subparagraph (C) the following:</text><quoted-block style="OLC" id="H9DA3A6C5D94644E7B470FD4DA08E2F32" display-inline="no-display-inline"><subparagraph id="HFCB0DD91C84A4AA08EE796FAE596907B" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">develop and implement policies for the adoption of dogs, cats, or rabbits no longer needed for biomedical and behavioral research, including—</text><clause id="H32BE681BAAAD47DE9BE2E49DDA240A73" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">developing and making publicly available on the website of such research entity a policy for offering for adoption a dog, cat, or rabbit no longer needed for biomedical and behavioral research;</text></clause><clause id="HD1A95B4F1AC840A48B08552950A758A2"><enum>(ii)</enum><text>assessing the health of such dog, cat, or rabbit to determine whether such animal is suitable for adoption; and</text></clause><clause id="H382754A151044B308443A833DC86E1F2"><enum>(iii)</enum><text display-inline="yes-display-inline">making reasonable efforts to offer for adoption any dog, cat, or rabbit deemed suitable for adoption, either through—</text><subclause id="H981CF09105824CBCABF8BFC9D45AAB37"><enum>(I)</enum><text>private placement;</text></subclause><subclause id="H7D113BB864D649179B0BCABB8998C6B8"><enum>(II)</enum><text>an animal shelter; or</text></subclause><subclause id="H464D6BA2E2014A95BAEF0AB892962663"><enum>(III)</enum><text>an animal adoption organization; and</text></subclause></clause></subparagraph><subparagraph id="HF5764137F8C74B8396FAD1B9C1692D5B" indent="up1"><enum>(E)</enum><text>maintain records on dogs, cats, or rabbits used by the research entity and make such records publicly available on the website of such research entity, including records on—</text><clause id="H8BCE1A511E9442D4AEC1D518E7ED4658"><enum>(i)</enum><text display-inline="yes-display-inline">the number of dogs, cats, or rabbits used for research;</text></clause><clause id="H815616D110A14DA78E3F26D449D2B251"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of dogs, cats, or rabbits placed for adoption through private placement, animal shelter, or through an animal adoption organization; and</text></clause><clause id="H8A2F3F2588954B51A2DDBF1056D9832C"><enum>(iii)</enum><text display-inline="yes-display-inline">the number of dogs, cats, or rabbits destroyed.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H25A5CBA4E8644BE3915EDC794A9737E7"><enum>(b)</enum><header>Immunity and animal adoption organization defined</header><text display-inline="yes-display-inline">Section 495 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/289d">42 U.S.C. 289d</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HFF915F723ECF427FB2CF642FD06FD5AA" display-inline="no-display-inline"><subsection id="H6720CAA7891947F2BFFDA0225D90CBC6"><enum>(f)</enum><header>Immunity</header><text display-inline="yes-display-inline">A research facility that places a dog, cat, or rabbit for adoption consistent with the policies under subsection (b)(3)(D) is immune from any civil liability in any Federal or State judicial or administrative proceeding arising out of any act or omission with respect to such dog, cat, or rabbit following the adoption of such dog, cat, or rabbit, except for willful or wanton misconduct.</text></subsection><subsection id="H8A5BA3E156BC45CAAF44EEC1A06F44F0"><enum>(g)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section, the following terms apply:</text><paragraph id="HD95BD8292C9F4354A45AF0F619E50BE1"><enum>(1)</enum><header>Animal adoption organization</header><text>The term <term>animal adoption organization</term> means an organization that—</text><subparagraph id="HC8BDA86B9C8241F2A9DAAFD070A1DC0D"><enum>(A)</enum><text>rescues animals in need and finds permanent, adoptive homes for such animals;</text></subparagraph><subparagraph id="H7F52547232074E28B5ADD1644259BCF8"><enum>(B)</enum><text>is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986; and</text></subparagraph><subparagraph id="H561828CE54C44983BD6C79A92F721339"><enum>(C)</enum><text>is exempt from tax under section 501(a) of such Code.</text></subparagraph></paragraph><paragraph id="H35BF5F88B3134353A130A48E09F40856"><enum>(2)</enum><header>Animal shelter</header><text display-inline="yes-display-inline">The term <term>animal shelter</term> means a facility that—</text><subparagraph id="HD628EF36232C4A3FBF05ADA2D541F76F"><enum>(A)</enum><text>accepts or seizes animals to care for such animals; and</text></subparagraph><subparagraph id="HDF6EE2ABCDC94B1AB22977768DD2D3F6"><enum>(B)</enum><text>places such animals in a permanent adoptive home.</text></subparagraph></paragraph><paragraph id="H11F8BA3BA237436F8B8F9405FA58897B"><enum>(3)</enum><header>Private placement</header><text display-inline="yes-display-inline">The term <term>private placement</term> means an arrangement between the research entity and an individual seeking to provide a permanent adoptive home for the animal pursuant to the adoption policy of such entity. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA39BBDD2D57C480C81AA97A82CB11F3A"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this Act shall take effect 1 year after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
