<section id="H80268EF9174B43B4970E7B82ACEBC3E4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Empowering Patient Choice of Medical Care Act</short-title></quote>.</text></section> <section id="H5B40B4A9E3B54F129785CF698F916F8D"><enum>2.</enum><header>Elimination of inpatient-only service list</header><text display-inline="no-display-inline">Beginning January 1, 2024, the Secretary of Health and Human Services may not refuse to designate an outpatient hospital service pursuant to section 1833(t)(1)(B)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(t)(1)(B)(i)</external-xref>) based solely on a determination by the Secretary that such service may only be <inline-comment display="yes">safely</inline-comment> furnished in an inpatient setting.</text></section>
