<section id="H8103AB96CE8E4475979042EA9B167EC2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Unjust Red Flag Laws Act of 2023</short-title></quote>.</text></section> <section id="H65D671FC5DA345C4B98D8219F26E325C"><enum>2.</enum><header>Prohibition on funding for implementation and enforcement of red flag laws or rules</header> <subsection id="H24D8C4E254C54FB78A895AD8EBB76632"><enum>(a)</enum><header>Prohibition on funding</header><text>None of the funds made available for any Federal department or agency may be used to—</text> 
<paragraph id="HB4E0C96D311E4FD594CF837678ECE7E1"><enum>(1)</enum><text>implement or enforce Federal red flag laws; or</text></paragraph> <paragraph id="HD63AA927FA3647E6A54892F18D21939A"><enum>(2)</enum><text>provide assistance to States, local, tribal, or territorial government departments or agencies for the implementation or enforcement of red flag laws. </text></paragraph></subsection> 
<subsection id="HEAE20B4C7E0A4B56839889401FCF8778"><enum>(b)</enum><header>Red flag law defined</header><text display-inline="yes-display-inline">In this section, the term <term>red flag law</term> means a risk-based, temporary, and preemptive protective order that authorizes the removal of a firearm without due process. </text> </subsection></section> </legis-body></bill>
