and </text></paragraph><paragraph id="H3146AB2955A2441691A435AFBFC8BEE6"><enum>(2)</enum><text>for each of fiscal years 2024 and 2025, $400,000,000 is authorized to fund maintenance, construction, and repairs for Coast Guard shoreside infrastructure.</text></paragraph></subsection><subsection id="H9BDF791D121F4E9CA81B52BEAA87CDE2"><enum>(b)</enum><header>Information technology set-asides</header><text>Of the amounts authorized under subsection (a)(1), $11,000,000 is authorized to fund the acquisition, development, and implementation of a new credentialing system for the merchant mariner credentialing program.</text></subsection><subsection id="H66454B0161704A35B30DF933BF780D19"><enum>(c)</enum><header>Shoreside infrastructure</header><text>Of the amounts authorized to be appropriated under section 4902(2)(A) of title 14, United States Code—</text><paragraph id="H42AF2EE3E4BD434DBBDC835D43FCBFE8"><enum>(1)</enum><text>for the purposes of improvements to facilities at the United States Coast Guard Training Center Cape May in Cape May, New Jersey—</text><subparagraph id="HDE15A1C9A0F64D96ADB66DE0C345FB92" commented="no"><enum>(A)</enum><text>for fiscal year 2024—</text><clause id="H8BF0934A432044AB958D9211BF72B912" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">$130,000,000 is authorized to fund the construction of a new indoor multipurpose recruit training facility; and </text></clause><clause id="H62637056652843CAA8E865E395449E7E" commented="no"><enum>(ii)</enum><text>$70,000,000 is authorized to fund Phase II of the barracks’ recapitalization; and </text></clause></subparagraph><subparagraph id="HDFB9B58E806046A2B3EA7FD1DC8F6303"><enum>(B)</enum><text>for fiscal year 2025, $70,000,000 is authorized to fund Phase III of the barracks’ recapitalization; </text></subparagraph></paragraph><paragraph id="H92BA907A2A944338A3822B9DDBC728C6"><enum>(2)</enum><text>for each of fiscal years 2024 and 2025, $30,000,000 is authorized to fund Phase I construction of a ship handling facility in the United States Coast Guard Yard in Baltimore, Maryland; and</text></paragraph><paragraph id="H1E394BC4A4F54CADAC6AD1AB62C40B4C"><enum>(3)</enum><text display-inline="yes-display-inline">for fiscal year 2024, $130,000,000 is authorized to fund Phase I of waterfront improvements of Coast Guard Base Seattle, including environmental remediation consisting of dredging and structural improvements to piers and wharfs necessary to complete the expansion of Base Seattle to homeport 3 Polar Security Cutters in Seattle, Washington.</text></paragraph></subsection></section><section id="H9C9356DCA6EA42D4BBF0AFD299FC2DB0"><enum>103.</enum><header>Availability of amounts for acquisition of additional vessels and aircraft</header><text display-inline="no-display-inline">Of the amounts authorized to be appropriated under section 4902(2)(A) of title 14, United States Code, for fiscal year 2024—</text><paragraph id="H0E1AD67C3F4A4193B1CA014FF75665C0"><enum>(1)</enum><text>$400,000,000 is authorized for the acquisition of 4 Fast Response Cutters;</text></paragraph><paragraph id="HA653763E2CED48D2B2A7AB6086ECE30A"><enum>(2)</enum><text>$125,000,000 is authorized for the acquisition or procurement of an available commercial icebreaker; </text></paragraph><paragraph id="HA148569DD04143ED9014117C18711F83"><enum>(3)</enum><text>$55,000,000 is authorized for the acquisition of a Great Lakes icebreaker at least as capable as Coast Guard Cutter Mackinaw (WLBB-30);</text></paragraph><paragraph id="H823612DCDF90463099C77D6E3875FA0F"><enum>(4)</enum><text>$20,000,000 is authorized to procure long lead time materials for a Great Lakes icebreaker at least as capable as Coast Guard Cutter Mackinaw (WLBB–30);</text></paragraph><paragraph id="HF8AC6DE3F97B480988FEE32CF2019210"><enum>(5)</enum><text>$30,500,000 is authorized for the program management, design, and acquisition of Pacific Northwest heavy weather boats that are at least as capable as the Coast Guard 52-foot motor surfboat;</text></paragraph><paragraph id="HBF169E59B4E04D7E93CF4B743CEE3820"><enum>(6)</enum><text>$138,500,000 is authorized for the acquisition or procurement of 1 missionized HC-130J aircraft; and</text></paragraph><paragraph id="H9748165962D5471AB137E654FE234BF7"><enum>(7)</enum><text>$113,000,000 is authorized to outfit and assemble 4 MH-60T Jayhawk aircraft.</text></paragraph></section><section id="HA5FD21770A4D4B2080E22A7DE945CFBA"><enum>104.</enum><header>Authorization for certain programs and services</header><text display-inline="no-display-inline">Of the amounts authorized to be appropriated under section 4902(1)(A) of title 14, United States Code, for each of fiscal years 2024 and 2025—</text><paragraph id="HC2AD8E81CB70436B87F8B608A1A03137"><enum>(1)</enum><text display-inline="yes-display-inline">$11,978,000 is authorized to fund additional recruiting personnel and offices for the Coast Guard Recruiting Command; and</text></paragraph><paragraph id="H76014F5681DB4AB2A6E39E4734155A1C"><enum>(2)</enum><text>$9,000,000 is authorized to enhance Coast Guard recruiting capabilities.</text></paragraph></section><section id="HC1EA6C5F9E4449F69B9E73302F72CBA1"><enum>105.</enum><header>Fishing vessel safety</header><text display-inline="no-display-inline">Section 4502 of title 46, United States Code, is amended—</text><paragraph id="H91F7DBF72E3A476F82355E0C293B977F"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (i) by striking paragraph (4) and inserting the following:</text><quoted-block style="USC" id="HE465B09DDDA54E8A93836C9593FB5535" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph id="HE7C78A206E1046068FE350D6346D5D12"><enum>(4)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">Out of funds made available under section 4902(1)(A) of title 14, $3,000,000 shall be available for each of fiscal years 2024 and 2025 for grants under this subsection. </text></paragraph><after-quoted-block>; and</quote>; and</text></paragraph><paragraph id="H51BEA8220A034CBFA0C23BA3D4821AC1"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H56B915B7C21F46BD9CDFDF8564D85E7C" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph id="H128BE754256646B3913E34B48BDDFA77"><enum>(5)</enum><text display-inline="yes-display-inline">prohibiting a representative of a government of country that the Secretary of State has determined has repeatedly provided support for acts of international terrorism under section 620A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>) from visiting a facility for which a facility security plan is required under section 70103(c).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H2CBC8967FBFD4D36AD618647B1ACF0AF"><enum>203.</enum><header>Minor construction increase</header><text display-inline="no-display-inline">Section 903(d)(1) of title 14, United States Code, is amended by striking <quote>$1,500,000</quote> and inserting <quote>$2,000,000</quote>.</text></section><section id="H8DEC215586CF43D7809BB7C75781B5D4" section-type="subsequent-section"><enum>204.</enum><header>Tsunami evacuation plans</header><subsection id="H354289A614E64A409E879222A9AAD8A3"><enum>(a)</enum><header>Tsunami evacuation plans</header><paragraph id="HBDEF69E119164920A4B08C8CE4F2EC15"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Commandant, in consultation with the Administrator of the National Oceanic and Atmospheric Administration and the Administrator of the Federal Emergency Management Agency, shall establish location specific tsunami evacuation plans for each unit and sector of the Coast Guard that has facilities, personnel, or assets located within areas—</text><subparagraph id="H444580A743F04CD987B21804CAD450C3"><enum>(A)</enum><text>designated by the Administrator of the National Oceanic and Atmospheric Administration as high risk or very high risk of a United States tsunami hazard; and</text></subparagraph><subparagraph id="HF39AACB4314943CDBAA92EAABB5F455E"><enum>(B)</enum><text>that are located inside a tsunami inundation zone.</text></subparagraph></paragraph><paragraph id="H126C661420FA45009B237390CED302E1"><enum>(2)</enum><header>Evacuation plans</header><text>In establishing the evacuation plans under paragraph (1), the Commandant shall ensure that such plans—</text><subparagraph id="H0DD5C56090E3404BBA7B9FE5C8A72FD2"><enum>(A)</enum><text>are included in the emergency action plans for each unit or sector located inside of a tsunami inundation zone;</text></subparagraph><subparagraph id="H2A6D3FB4E128466887444EB13102984E"><enum>(B)</enum><text>designate an evacuation route to an assembly area located outside of a tsunami inundation zone;</text></subparagraph><subparagraph id="HD57A4AA70D654D429069ACA31ABDADBD"><enum>(C)</enum><text display-inline="yes-display-inline">include a map or diagram of all tsunami inundation zone evacuation routes;</text></subparagraph><subparagraph id="HB02A0F2C4CD74175AA094AA4139A5CA4"><enum>(D)</enum><text display-inline="yes-display-inline">include evacuation routes for all Coast Guard personnel and dependents of such personnel living in Coast Guard housing;</text></subparagraph><subparagraph id="H8C8933E9BA2B4CF79C8F88C4F179963F"><enum>(E)</enum><text display-inline="yes-display-inline">are feasible for all servicemembers and dependents of such servicemembers present on Coast Guard property or living in Coast Guard provided housing; </text></subparagraph><subparagraph id="H51980DC6B2CF4FB6A8D2105F2C423C71"><enum>(F)</enum><text>include procedures to begin evacuations once a major seismic event is detected;</text></subparagraph><subparagraph id="H526430D96F1E431F9A452336B0415D15"><enum>(G)</enum><text display-inline="yes-display-inline">include evacuation plans for air and water assets that do not impinge on the safety of human life;</text></subparagraph><subparagraph id="H5F36EB744EAC413DB641B9430C8D7B62"><enum>(H)</enum><text>are able to be completely executed within 15 minutes of detection of a seismic event or, if not possible within 15 minutes, within a reasonable timeframe;</text></subparagraph><subparagraph id="HEDC96C74D11C4096B2FD6BFA18D42B4B"><enum>(I)</enum><text>are able to be completely executed by servicemembers on foot from any location within the tsunami inundation zone;</text></subparagraph><subparagraph id="H90485848351242268242F2905E2826E5"><enum>(J)</enum><text>are exercised biennially by each unit and sector located in a tsunami inundation zone; and</text></subparagraph><subparagraph id="HD75DDEA695E44C82B58BE23EAAA73043"><enum>(K)</enum><text display-inline="yes-display-inline">are evaluated by leadership at each unit and sector located in a tsunami inundation zone annually.</text></subparagraph></paragraph><paragraph id="HBC91472BC68A4D339F34F43FD8764DD9"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">In establishing the evacuation plans under paragraph (1), the Commandant shall consult local governments. </text></paragraph></subsection><subsection id="HDE167494547D426194386B2DD15FD2DD"><enum>(b)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, the Commandant shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate, and provide a briefing to each such Committee on, a report on—</text><paragraph id="HDB91DEBC47EE4544A11EAAC3EBDA0842"><enum>(1)</enum><text>the status of the implementation and feasibility of the plans established under subsection (a)(1);</text></paragraph><paragraph id="H3E1257C942B5413DA0CBED6726ADCA2A"><enum>(2)</enum><text>a risk evaluation and vulnerability assessment of the infrastructure and assets located within tsunami inundation zones;</text></paragraph><paragraph id="HE8035234DAE14EE58189BE0107776F8D"><enum>(3)</enum><text>the need for vertical evacuation structures for units and sectors in which an evacuation of a tsunami inundation zone cannot be completed on foot within 15 minutes of the detection of a seismic event; and </text></paragraph><paragraph id="H0C3CD260782D455FA93CC3A0A0718CBB"><enum>(4)</enum><text>whether the plans established under subsection (a)(1) achieve the purpose to protect human life and ensure the ability for the Coast Guard to provide search and rescue operations following a tsunami event in the area. </text></paragraph></subsection><subsection id="HD229AB2E6ABA4FD0A2631841D9A2510D"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H69A32D0996104149BB1991CDE5583C14"><enum>(1)</enum><header>Seismic event</header><text>The term <quote>seismic event</quote> means an earthquake, volcanic eruption, submarine landslide, coastal rockfall, or other event with the magnitude to cause a tsunami. </text></paragraph><paragraph id="HD6A38584F86B4AF3A3C97BAA2BBADED2"><enum>(2)</enum><header>Tsunami inundation zone</header><text display-inline="yes-display-inline">The term <quote>tsunami inundation zone</quote> means an area of inland flooding modeled, predicted, or forecasted as a potential result of a tsunami or seismic event.</text></paragraph><paragraph id="H8566000927604D918BE0BB9C783EF7CD"><enum>(3)</enum><header>Vertical evacuation structure</header><text>The term <quote>vertical evacuation structure</quote> means an elevated structure above the tsunami inundation zone designated as a place of refuge from flood waters.</text></paragraph></subsection></section><section id="HC4350C0E20A9486492F52451FEF2E825"><enum>205.</enum><header>Study on Bering Strait vessel traffic projections and emergency response posture at the Port of Point Spencer, Alaska</header><subsection id="H138A49A52BDB4DF5A18C4A011C4F097F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Commandant shall seek to enter into an agreement with the National Academies of Science, Engineering, and Medicine, under which the Marine Board of the Transportation Research Board (in this section referred to as the <quote>Board</quote>) shall conduct a study to—</text><paragraph id="H98E238D5F0C546B7A5942E23ED9686DD"><enum>(1)</enum><text>analyze commercial vessel traffic that transits through the Bering Strait and projections for the growth of such traffic during the 10-year period beginning after such date of enactment; and</text></paragraph><paragraph id="H30D87B75CD4544CCB5BA1B73A7A9460D"><enum>(2)</enum><text>assess the adequacy of emergency response capabilities and infrastructure at the Port of Point Spencer, Alaska, to address navigation safety risks and geographic challenges necessary to conduct emergency maritime response operations in the Arctic environment.</text></paragraph></subsection><subsection id="H03D14FDC34FE4296AE72FF8BB312E7EA"><enum>(b)</enum><header>Elements</header><text>The study required under subsection (a) shall include the following:</text><paragraph id="HE0B5DD0BD4694CAB8C6D5C51C882BAD5" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">An analysis of the volume and types of domestic and international commercial vessel traffic through the Bering Strait and the projected growth of such traffic, including a summary of—</text><subparagraph id="H5852FD1C2878442696AB60EB3A780E22" commented="no"><enum>(A)</enum><text>the sizes, ages, and flag states of vessels; and</text></subparagraph><subparagraph id="H90BF5F9EFFDD4161B1A65962CE7D8030" commented="no"><enum>(B)</enum><text>the oil and product tankers that are—</text><clause id="H7EE627DC9A854042BADC68717702055F" commented="no"><enum>(i)</enum><text>in transit to or from Russia or China; or</text></clause><clause id="H50223DB47E634C7DA1B089A45FE58233" commented="no"><enum>(ii)</enum><text>owned or operated by a Russian or Chinese entity.</text></clause></subparagraph></paragraph><paragraph id="HAABA111795D94731AD0CA432746988A4"><enum>(2)</enum><text>An assessment of the state and adequacy of vessel traffic services and oil spill and emergency response capabilities in the vicinity of the Bering Strait, including its approaches.</text></paragraph><paragraph id="H020F699D0B0845B5891C3B6EE5636260"><enum>(3)</enum><text>A risk assessment of the projected growth in commercial vessel traffic in the Bering Strait and higher probability of increased frequency in the number of maritime accidents, including spill events, and the potential impacts to the Arctic maritime environment and Native Alaskan village communities in the vicinity of the Bering Strait.</text></paragraph><paragraph id="HFB703CB80CD34FC3BA489854707EC35D"><enum>(4)</enum><text>An evaluation of the ability of the Port of Point Spencer, Alaska to serve as a port of refuge and as a staging, logistics, and operations center to conduct and support maritime emergency and spill response activities.</text></paragraph><paragraph id="H8FDFD1EEB6F944A492C4A6363DEA8570"><enum>(5)</enum><text>Recommendations for practical actions that can be taken by the Congress, Federal agencies, the State of Alaska, vessel carriers and operators, the marine salvage and emergency response industry, and other relevant stakeholders to mitigate risks, upgrade infrastructure, and improve the posture of the Port of Point Spencer, Alaska, to function as a strategic staging and logistics center for maritime emergency and spill response operations in the Bering Strait region.</text></paragraph></subsection><subsection id="HC1AB55BDCFDE49A58101677D8241A7EC"><enum>(c)</enum><header>Consultation</header><text>In conducting the study required under subsection (a), the Board shall consult with—</text><paragraph id="H48B7E59F8F0044268F53D83B3780B660"><enum>(1)</enum><text>the Department of Transportation;</text></paragraph><paragraph id="H74698AD6EA8245C2A4D4FA1B8221EBFC"><enum>(2)</enum><text display-inline="yes-display-inline">the Corps of Engineers; </text></paragraph><paragraph id="H989CD9C2F0A742D8B68CBACA2F678769"><enum>(3)</enum><text>the National Transportation Safety Board; </text></paragraph><paragraph id="H32471B79C1DF4ABCB2E2D4138612B566"><enum>(4)</enum><text>relevant ministries of the government of Canada; </text></paragraph><paragraph id="HFBCAF43798EB4D98951B3EE5363E2698"><enum>(5)</enum><text>the Port Coordination Council for the Port of Point Spencer; and</text></paragraph><paragraph id="H9AC2DD177B5646948018E3381B261C4A"><enum>(6)</enum><text>non-government entities with relevant expertise in monitoring and characterizing vessel traffic in the Arctic.</text></paragraph></subsection><subsection id="H09183C9045404CE99565991F8083C534"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after initiating the study under subsection (a), the Board shall submit to the appropriate committees of Congress a report containing the findings and recommendations of the study.</text></subsection><subsection id="HD255F9FEA4374850B47FE65515428752"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H276F5D5AEF6B4B5B9D2819789B880018"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <quote>appropriate committees of Congress</quote> means—</text><subparagraph id="H4EC5D6D18EB74B438C9459F78D40F628"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Commerce, Science, and Transportation of the Senate; and</text></subparagraph><subparagraph id="H0C30B567BCBF437CB3A8E11ADD8FC8F3"><enum>(B)</enum><text display-inline="yes-display-inline">Committee on Transportation and Infrastructure of the House of Representatives.</text></subparagraph></paragraph><paragraph id="H35F6AF5E0B7A4DBF8C8EC4478AAD9FD1"><enum>(2)</enum><header>Arctic</header><text display-inline="yes-display-inline">The term <quote>Arctic</quote> has the meaning given such term in section 112 of the Arctic Research and Policy Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/15/4111">15 U.S.C. 4111</external-xref>).</text></paragraph><paragraph id="H0A49815B31FA4E2FB58D64645D1945F1"><enum>(3)</enum><header>Port Coordination Council for the Port of Point Spencer</header><text display-inline="yes-display-inline">The term <quote>Port Coordination Council for the Port of Point Spencer</quote> means the Council established under section 541 of the Coast Guard Authorization Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/120">Public Law 114–120</external-xref>).</text></paragraph></subsection></section><section id="H65CCF76E83A04ED8943E0B7E38984A92"><enum>206.</enum><header>Service life extension programs</header><subsection id="HD30F5D93523E434C8A48918E79329687"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/11">chapter 11</external-xref> of title 14, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H95066CDC8DFF44CF9E5CBD35B84B3362" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><section id="HF1593B5A8CFD4CD78FAD3CA4C5716A69"><enum>1138.</enum><header>Service life extension programs</header><subsection id="H6B1D361F196E4F7CA26E969B16C963E1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Requirements for a Level 1 or Level 2 acquisition project or program under sections 1131 through 1134 shall not apply to an acquisition by the Coast Guard that is a service life extension program.</text></subsection><subsection id="H1F7F3C30D0044CA7B92601BB264D078F"><enum>(b)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <quote>service life extension program</quote> means a capital investment that is solely intended to extend the service life and address obsolescence of components or systems of a particular capability or asset.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H12770D46EFEE4CEE86CE9C5C2194D570"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis for chapter 11 of such title is amended by inserting after the item relating to section 1137 the following:</text><quoted-block style="USC" id="H6381CAF540FA4E43AB781AE952C552D2" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><toc regeneration="no-regeneration" changed="added" reported-display-style="italic" committee-id="HPW00"><toc-entry level="section">1138. Service life extension programs.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H32F72EFE213A484E8CE65494CC792915"><enum>207.</enum><header>Underwater inspections brief</header><text display-inline="no-display-inline">Not later than 30 days after the date of enactment of this Act, the Commandant, or a designated individual, shall brief the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on the underwater inspection in lieu of drydock program established under section 176.615 of title 46, Code of Federal Regulations (as in effect on the date of enactment of this Act). </text></section><section id="HDDE524B3EF014264BBA31989B3B953FB"><enum>208.</enum><header>St. Lucie River railroad bridge</header><text display-inline="no-display-inline">Regarding Docket Number USCG-2022-0222, before adopting a final rule, the Commandant of the Coast Guard shall conduct an independent boat traffic study at mile 7.4 of the St. Lucie River.</text></section><section id="HAFA85876CCA64E1EADFE6A0720CF45A5"><enum>209.</enum><header>Online incident reporting system</header><subsection id="H8E98D4A7C6934D12BD74F0F4F6E68188"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the National Response Center shall—</text><paragraph id="H504F441784804A32B4F772E4B7E84CBE"><enum>(1)</enum><text>develop an online capacity through a web-based application to receive a notification of an oil discharge or release of a hazardous substance; and</text></paragraph><paragraph id="H721767C3429645D89DBE3039EC9F6145"><enum>(2)</enum><text>allow any such notification to the National Response Center that is required under Federal law or regulation to be made online using the application.</text></paragraph></subsection><subsection id="H6CB5F60B693B41D49E1CD7E536EE316B"><enum>(b)</enum><header>Use of application</header><text>In carrying out subsection (a), the National Response Center may not require the notification of an oil discharge or release of a hazardous substance to be made using the application developed under such subsection. </text></subsection></section><section id="HE8298BE701144866BA89B5CA2D2EBFB8" display-inline="no-display-inline" section-type="subsequent-section"><enum>210.</enum><header>Maritime Domain Awareness in Coast Guard Sector for Puerto Rico and Virgin Islands</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Commandant shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report containing—</text><paragraph id="H5CCC878FE4D447879EF311E44C3466E7"><enum>(1)</enum><text display-inline="yes-display-inline">an overview of the maritime domain awareness in the area of responsibility of the Coast Guard sector responsible for Puerto Rico and the United States Virgin Islands, including—</text><subparagraph id="HED3527DD32AA4ED79A1761553D13F9DC"><enum>(A)</enum><text>the average volume of known maritime traffic that transited the area during fiscal years 2020 through 2023;</text></subparagraph><subparagraph id="H1229EDC3DC054A0EB52C7B0C80DA44D4"><enum>(B)</enum><text>current sensor platforms deployed by such sector to monitor illicit activity occurring at sea in such area;</text></subparagraph><subparagraph id="H688D93FFF2DE49AEBA75EFD0F058BD52"><enum>(C)</enum><text>the number of illicit activity incidents at sea in such area that the sector responded to during fiscal years 2020 through 2023;</text></subparagraph><subparagraph id="HA8385EB806AC4714A1936A97A840BE0B"><enum>(D)</enum><text>an estimate of the volume of traffic engaged in illicit activity at sea in such area and the type and description of any vessels used to carry out illicit activities that such sector responded to during fiscal years 2020 through 2023; and</text></subparagraph><subparagraph id="H6F6CC9C8C08846279DDC052C5FD14579"><enum>(E)</enum><text>the maritime domain awareness requirements to effectively meet the mission of such sector;</text></subparagraph></paragraph><paragraph id="HB553E2A0B2CA4D1D99195D32331F3D6E"><enum>(2)</enum><text>a description of current actions taken by the Coast Guard to partner with Federal, regional, State, and local entities to meet the maritime domain awareness needs of such area;</text></paragraph><paragraph id="HE4334EB92C8D4729808781A0ED3F8615"><enum>(3)</enum><text display-inline="yes-display-inline">a description of any gaps in maritime domain awareness within the area of responsibility of such sector resulting from an inability to meet the enduring maritime domain awareness requirements of the sector or adequately respond to maritime disorder, including illicit drug and migrant activity; </text></paragraph><paragraph id="H0BE12AEC497B45A68BECEF7CD75FD99C"><enum>(4)</enum><text>an identification of current technology and assets the Coast Guard has to mitigate the gaps identified in paragraph (3);</text></paragraph><paragraph id="H36FB54FA16464416AD07DC51631A5905"><enum>(5)</enum><text>an identification of capabilities needed to mitigate such gaps, including any capabilities the Coast Guard currently possesses that can be deployed to the sector;</text></paragraph><paragraph id="HCC2A6D19703F43B18F997311F8F63B15"><enum>(6)</enum><text>an identification of technology and assets the Coast Guard does not currently possess and are needed to acquire in order to address such gaps; and </text></subparagraph><subparagraph id="H5310203E4E5147E4823D747436CBFB1C"><enum>(B)</enum><text>pursue expanded research, development, testing, and evaluation opportunities and funding to expand and accelerate identification and transition of unmanned system and counter-unmanned system technologies.</text></subparagraph></paragraph><paragraph id="HA3A8ED9C99544D309054BA5338AE9332"><enum>(3)</enum><text>The identification of contracting and acquisition authorities needed to expedite the development and deployment of unmanned system and counter-unmanned system technologies.</text></paragraph><paragraph id="H4A685E6D761E453790B5E43EDEFBE3CB"><enum>(4)</enum><text>A detailed list of commercially available unmanned system and counter-unmanned system technologies with capabilities determined to be useful for the Coast Guard.</text></paragraph><paragraph id="HE91DE9C7CA904A5DB4038690A087EF31"><enum>(5)</enum><text>A cross-agency collaboration plan to engage with the Department of Homeland Security, the Department of Defense, and other relevant agencies to identify common requirements and opportunities to partner in acquiring, contracting, and sustaining unmanned system and counter-unmanned system capabilities.</text></paragraph><paragraph id="H7B60880B4AB444FA92661CB00167902B"><enum>(6)</enum><text>Opportunities to obtain and share unmanned system data from government and commercial sources to improve maritime domain awareness.</text></paragraph><paragraph id="H4D0CB331553543D58D626560AB572A76"><enum>(7)</enum><text>The development of a concept of operations for a data ecosystem that supports and integrates unmanned system and counter-unmanned system technologies with key enablers, including enterprise communications networks, data storage and management, artificial intelligence and machine learning tools, and information sharing and dissemination capabilities.</text></paragraph></subsection><subsection id="HD72E9B7D021146B0BFB0DD4B262C1DA1"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HABBEA31ABB184DFFABB1208ABCF71F13"><enum>(1)</enum><header>Counter-unmanned system</header><text display-inline="yes-display-inline">The term <quote>counter-unmanned system</quote> means a system or device capable of lawfully and safely disabling, disrupting, or seizing control of an unmanned system, including a counter-UAS system (as defined in section 44801 of title 49, United States Code).</text></paragraph><paragraph id="HC6194ED1F76E4E7795ABBCE6DE0F4F38"><enum>(2)</enum><header>Unmanned system</header><text display-inline="yes-display-inline">The term <quote>unmanned system</quote> means an unmanned surface, undersea, or aircraft and associated elements (including communication links and the components that control the unmanned system) that are required for the operator to operate the system safely and efficiently, including an unmanned aircraft system (as defined in section 44801 of title 49, United States Code).</text></paragraph></subsection></section><section id="HFCF1546BD21748BFA97B5142DBE62F81"><enum>213.</enum><header>Rulemaking regarding port access routes</header><text display-inline="no-display-inline">Not later than December 31, 2023, the Secretary of the department in which the Coast Guard is operating shall issue a final rule for the Atlantic Coast Port Route Access Study for which an Advanced Notice of Proposed Rulemaking title <quote>Shipping Safety Fairways Along the Atlantic Coast</quote> was issued on June 19, 2020. </text></section><section id="H33C025277B40491EBB160D07BBEE62B6"><enum>214.</enum><header>Great Lakes icebreaker</header><text display-inline="no-display-inline">Not later than 30 days after the date of enactment of this Act, the Commandant shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a strategy detailing how the Coast Guard will complete design and construction of the Great Lakes icebreaker at least as capable as the Coast Guard Cutter Mackinaw (WLBB–30) in not more than 3 years after funding is provided for such icebreaker.</text></section></title><title id="H0F5276D3E961482C841FDFC877C21936" style="OLC"><enum>III</enum><header> Maritime</header><subtitle id="H10197B39AEFE44309B34696B881EF15C"><enum>A</enum><header> American Samoa Mariners Act of 2023</header><section id="H7631E1991E0449C9BE843C18F57133C5" commented="no"><enum>301.</enum><header>Merchant seamen licenses, certificates, and documents; Secretary shall publish a notification under subsection (a) in the Customs Bulletin and Decisions within 14 days of receipt of such notification.</text></paragraph><paragraph id="HECF96D78C955414EBF97F9A54A462DAB"><enum>(2)</enum><header>Confidential information</header><text>The Secretary shall redact any information exempt from disclosure under section 552 of title 5, fines and penalties</header><subsection id="H320ED56006E244CA81825FCF6A4A7D33"><enum>(a)</enum><header>In general</header><text>Section 55102 of title 46, United States Code, is amended by adding at id="H22A94685D81A495F93E3E66E19A58E86"><enum>(d)</enum><header>Publication of penalty</header><paragraph id="H6A38386CA62F40B6BDD16CDBBE466AB1"><enum>(1)</enum><header>In general</header><text>Not later than 14 days after the issuance of a pre-penalty notice or a penalty, including a settlement, under subsection (c), the Secretary of Homeland Security shall publish such pre-penalty notice or a notification of such penalty in the Customs Bulletin and Decisions to the party impacted by the penalty.</text></paragraph><paragraph penalty;</text></subparagraph><subparagraph id="H3CBA41C0611D4ACC8C6FC5BA0D3FF887"><enum>(C)</enum><text>the amount of the fine or value of merchandise seized; and</text></subparagraph><subparagraph id="H750FE9350BBA4754A19288E401707EAB"><enum>(D)</enum><text>a summary of the alleged misconduct and justification for imposing a penalty.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE0B029C041404B9C80FFD13C5985251A"><enum>(b)</enum><header>Rulemaking</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall issue such regulations as vessels;</text></paragraph><paragraph id="H17C938ADAC08413D9B9F94390A34616E"><enum>(2)</enum><text>the waters on which vessels are to be operated; or</text></paragraph><paragraph id="H94B1304A6B5843D08B716A7E00031515"><enum>(3)</enum><text>other appropriate standards.</text></paragraph></subsection><subsection id="H7F6FA493C1504D18AE48915684C08D54"><enum>(c)</enum><header>Considerations</header><text display-inline="yes-display-inline">In issuing the credential under subsection (a), the Secretary may consider the following qualifications of the merchant mariner:</text><paragraph id="H688FF76175E741CDB92BBE98200CD6E7"><enum>(1)</enum><text>Age.</text></paragraph><paragraph id="HA4485D35374A4BBAB3E03A68F212AC64"><enum>(2)</enum><text>Character.</text></paragraph><paragraph id="H5D92838C04244F27957BC7A969C15CF0"><enum>(3)</enum><text>Habits of life.</text></paragraph><paragraph id="H693B8A898F154BC4B4F0EC6D34572305"><enum>(4)</enum><text>Experience.</text></paragraph><paragraph id="HC5C12BAC78FC475E9297597940E06E01"><enum>(5)</enum><text display-inline="yes-display-inline">Professional qualifications demonstrated by satisfactory completion of applicable examinations or other educational requirements.</text></paragraph><paragraph id="H05E67535B99649E2AB8F21FFE56D16A2"><enum>(6)</enum><text>Physical condition, including sight and hearing.</text></paragraph><paragraph id="HD15E5F2DF9034438B073C8FC1AA01FDB"><enum>(7)</enum><text display-inline="yes-display-inline">Other requirements established by the Secretary, including career patterns and service appropriate to the particular service, industry, or job functions the display-inline="yes-display-inline">A person operating a vessel in a grossly negligent manner that results in serious bodily injury, as defined in section 1365(h)(3) of title 18—</text><subparagraph id="H1A27809FE78D4CAFA5FDDFB9CEDBEA5D"><enum>(A)</enum><text>commits a class E felony; and</text></subparagraph><subparagraph id="H7D0E8630119E4410A826DAE8D2A02935"><enum>(B)</enum><text>may be (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>);</text></subparagraph><subparagraph id="H2CDA30E82ECE4C95B62AEB7FB3F0EE93"><enum>(B)</enum><text display-inline="yes-display-inline">conducted the assessment recommended in the Government Accountability Office report submitted under section 8254(a) of such Act;</text></subparagraph><subparagraph id="H140166DE8DAB4E0CA50F96954994A65E"><enum>(C)</enum><text display-inline="yes-display-inline">concluded through such assessment that a risk-based examination schedule provides not less than the level of safety provided by the annual examinations required under subsection (a)(1); and</text></subparagraph><subparagraph id="H560D129B14F44987BBFEA7F01B22D1EE"><enum>(D)</enum><text display-inline="yes-display-inline">provided the results of such assessment to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate. </text></subparagraph></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section></subtitle><subtitle Information on type approval certificates.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HFA949DB5D84046CB991323489C7F2995" section-type="subsequent-section" display-inline="no-display-inline"><enum>346.</enum><header>Manning and crewing requirements for certain vessels, vehicles, and structures</header><subsection id="H40FB69C7F22847999A12CFB92E6227FF"><enum>(a)</enum><header>Authorization of limited exemptions from manning and crew requirement</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/81">Chapter 81</external-xref> of title 46, United States Code, is amended by adding at the end the following: </text><quoted-block id="HF350F1F9C7AC4441BD422BB3454634E1" style="USC" changed="added" reported-display-style="italic" committee-id="HPW00"><section id="HC4CDEE38417242828F7D640232F44868"><enum>8109.</enum><header>Exemptions from manning and crew requirements </header><subsection id="HBA28CE42F1264E938D5D11AFCE02296D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may provide an exemption described in subsection (b) to the owner or operator of a covered facility if each individual who is manning or crewing the covered facility is—</text><paragraph id="H5FFC8C66B7184FBCB5D2337911BFFC96"><enum>(1)</enum><text>a citizen of the United States;</text></paragraph><paragraph id="H17FA9DB6FCCC4F2DB4518AA3FF958E5A"><enum>(2)</enum><text>an alien lawfully admitted to the United States for permanent residence; or</text></paragraph><paragraph id="H93FF32F947514A1BBD2A814676EE2E36"><enum>(3)</enum><text>a citizen of the nation under the laws of which the vessel is documented.</text></paragraph></subsection><subsection id="HB6F00396CC504C669629C186B018F801"><enum>(b)</enum><header>Requirements for eligibility for exemption</header><text display-inline="yes-display-inline">An exemption under this subsection is an exemption from the regulations established pursuant to section 302(a)(3) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1356">43 U.S.C. 1356(a)(3)</external-xref>).</text></subsection><subsection id="H5212223B1B16483190ADB01AF99D2301"><enum>(c)</enum><header>Limitations</header><text>An exemption under this section— </text><paragraph id="HB3042205D02547BAACC2B659B2F2C7B8"><enum>(1)</enum><text>shall provide that the number of individuals manning or crewing the covered facility who are described in paragraphs (2) and (3) of subsection (a) may not exceed two and one- half times the number of individuals required to man or crew the covered facility under the laws of the nation under the laws of which the covered facility is documented; and</text></paragraph><paragraph id="HC83FB700C67B40AE88876D855441B9DB"><enum>(2)</enum><text>shall be effective for not more than 12 months, but may be renewed by application to and approval by the Secretary.</text></paragraph></subsection><subsection id="H19B5F0B0ED7D4EB3B5DF9E34ACC564AA"><enum>(d)</enum><header>Application</header><text>To be eligible for an exemption or a renewal of an exemption under this section, the owner or operator of a covered facility shall apply to the Secretary with an application that includes a sworn statement by the applicant of all information required for the issuance of the exemption.</text></subsection><subsection id="HB60DE1658370475E838D9C2705454E93"><enum>(e)</enum><header>Revocation</header><paragraph id="HD5ACEE48E57A4E20A08810EAE4238738"><enum>(1)</enum><header>In general</header><text>The Secretary—</text><subparagraph id="H899280F2CB13474182E2A7B3C674CA95"><enum>(A)</enum><text>may revoke an exemption for a covered facility under this section if the Secretary determines that information provided in the application for the exemption was false or incomplete, or is no longer true or complete; and</text></subparagraph><subparagraph id="H376F27984F8348CCBA6AED59C14E9DA0"><enum>(B)</enum><text display-inline="yes-display-inline">shall immediately revoke such an exemption if the Secretary determines that the covered facility, in the effective period of the exemption, was manned or crewed in a manner not authorized by the exemption.</text></subparagraph></paragraph><paragraph id="H14232D92F7A04D8B9AC96CAADE2E9499"><enum>(2)</enum><header>Notice required</header><text>The Secretary shall provides notice of a determination under subparagraph (A) or (B) of paragraph (1) to the owner or operator of the covered facility.</text></paragraph></subsection><subsection id="H15664F6D40CA4ED188DA5995B67D6F6E"><enum>(f)</enum><header>Review of compliance</header><text display-inline="yes-display-inline">The Secretary shall periodically, but not less than once annually, inspect each covered facility that operates under an exemption under this section to verify the owner or operator of the covered facility’s compliance with the exemption. During an inspection under this subsection, the Secretary shall require all crew members serving under the exemption to hold a valid transportation security card issued under section 70105.</text></subsection><subsection id="H5C00DCC425B14AAABC508E759BE3BA56"><enum>(g)</enum><header>Penalty</header><text>In addition to revocation under subsection (e), the Secretary may impose on the owner or operator of a covered facility a civil penalty of $10,000 per day for each day the covered facility—</text><paragraph id="HF5861852603540CBB2A1E3F61F227280"><enum>(1)</enum><text>is manned or crewed in violation of an exemption under this subsection; or</text></paragraph><paragraph id="H30F2BE33348E4476B94A0B74BF8A547E"><enum>(2)</enum><text>operated under an exemption under this subsection that the Secretary determines was not validly obtained.</text></paragraph></subsection><subsection id="H96C566EF41BA4AE79A57E17931C73023"><enum>(h)</enum><header>Notification of Secretary of State</header><text>The Secretary shall notify the Secretary of State of each exemption issued under this section, including the effective period of the exemption.</text></subsection><subsection id="H2A48D28A18124D7BB855C1F876B4346E"><enum>(i)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H37B83EDFB9FB4A348ED7F0939C316A2E"><enum>(1)</enum><header>Covered facility</header><text display-inline="yes-display-inline">The term <quote>covered facility</quote> means any vessel, rig, platform, or other vehicle or structure, over 50 percent of which is owned by citizens of a foreign nation or with respect to which the citizens of a foreign nation have the right effectively to control, except to the extent and to the degree that the President determines that the government of such foreign nation or any of its political subdivisions has implemented, by statute, regulation, policy, or practice, a national manning requirement for equipment engaged in the exploring for, developing, or producing resources, including non-mineral energy resources in its offshore areas.</text></paragraph><paragraph id="H1B256FE5B3CF4CDF9286368E731C27F9"><enum>(2)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the Secretary of the department in which the Coast Guard is operating.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H408A254A140A4F86A8ED7EB1A865B1AD" display-inline="no-display-inline"><enum>(b)</enum><header>Annual report</header><paragraph id="H6CE5AB02EAF34ADA82D8D183302E0E3A"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary shall submit to Congress a report containing information on each letter of nonapplicability of section 8109 of title 46, United States Code, with respect to a covered facility that was issued by the Secretary during the preceding year.</text></paragraph><paragraph id="HEEA4CC48917548678F636C743569660C"><enum>(2)</enum><header>Contents</header><text>The report under paragraph (1) shall include, for each covered facility—</text><subparagraph id="H2AC9C8D4C8E44340A6184D26B4010E9B"><enum>(A)</enum><text>the name and International Maritime Organization number;</text></subparagraph><subparagraph id="H33B2192A78EF4CD483C347FAD1A42342"><enum>(B)</enum><text display-inline="yes-display-inline">the nation in which the covered facility is documented;</text></subparagraph><subparagraph id="H0D8A4EBAA9C34AE2ADEDA79267824B94"><enum>(C)</enum><text>the nationality of owner or owners; and</text></subparagraph><subparagraph id="H20B21A5A4CA64A158789484DCCE4002D"><enum>(D)</enum><text display-inline="yes-display-inline">for any covered facility that was previously issued a letter of nonapplicability in a prior year, any changes in the information described in subparagraphs (A) through (C).</text></subparagraph></paragraph></subsection><subsection id="H0A3C2EE210A3470EB9259984EECC803A"><enum>(c)</enum><header>Regulations</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary shall promulgate regulations that specify the documentary and other requirements for the issuance of an exemption under the amendment made by this section.</text></subsection><subsection id="H49107D6FE9254E4682EFAE761A08C259"><enum>(d)</enum><header>Existing exemptions</header><paragraph id="H95E92A0714EA41A1BF76892EB94B47BD"><enum>(1)</enum><header>Effect of amendments; termination</header><text>Each exemption under section 30(c)(2) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1356">43 U.S.C. 1356(c)(2)</external-xref>) issued before the date of the enactment of this Act—</text><subparagraph id="H235F15B306A747BBB0E116AA61330CC4"><enum>(A)</enum><text>shall not be affected by the amendments made by this section during the 120-day period beginning on the date of the enactment of this Act; and</text></subparagraph><subparagraph id="H9F391290592C44E29E14443534B252F8"><enum>(B)</enum><text>shall not be effective after such period.</text></subparagraph></paragraph><paragraph id="H77D066CBDAA5431389A5A8288A652A54"><enum>(2)</enum><header>Notification of holders</header><text>Not later than 60 days after the date of the enactment of this Act, the Secretary shall notify all persons that hold such an exemption that it will expire as provided in paragraph (1).</text></paragraph></subsection><subsection id="H7A138258D0C24C5E80D1A68917939926"><enum>(e)</enum><header>Clerical amendment</header><text>The analysis for chapter 81 of the title 46, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="H53AFAD3AB43247C9869A4AF2D003426D" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><toc regeneration="no-regeneration" changed="added" reported-display-style="italic" committee-id="HPW00"><toc-entry level="section">8109. Exemptions from manning and crew requirements.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HBB0603EEC37E4F59A7EFD92D81B6E95B" display-inline="no-display-inline" section-type="subsequent-section"><enum>347.</enum><header>Classification societies</header><text display-inline="no-display-inline">Section 3316(d) of title 46, United States Code, is amended—</text><paragraph id="HC5A08E9576904776B9D863934CA24279"><enum>(1)</enum><text>by amending paragraph (2)(B)(i) to read as follows:</text><quoted-block style="USC" id="H78EBDD5084174F708363265A33B1F1AD" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><clause id="HA7AF3644633745EA8FD32A35F4790CB6" display-inline="no-display-inline" indent="up2"><enum>(i)</enum><text display-inline="yes-display-inline">the government of the foreign country in which the foreign society is headquartered—</text><subclause id="H91FAF725786E417687813D4B2D83806C"><enum>(I)</enum><text>delegates that authority to the American Bureau of Shipping; or</text></subclause><subclause id="H9B6E494720DA45C6AFFD448C50EA8EE4"><enum>(II)</enum><text>does not delegate that authority to any classification society; or</text></subclause></clause><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="H9F13E2D99B3146D581B2BD44A6F17391"><enum>(2)</enum><text>by adding at the end the following: </text><quoted-block style="USC" id="H28AE5759E5DC45889E5DADA8DDDCF935" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph id="H559D1B22A79D4A2BA9954369FC666770"><enum>(5)</enum><header>Clarification on authority</header><text display-inline="yes-display-inline">Nothing in this subsection authorizes the Secretary to make a delegation under paragraph (2) to a classification society from the People’s Republic of China.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></subtitle></title><title id="H9E3CB15BC16448379BBDD4DEF19B3CD1"><enum>IV</enum><header>Oil Pollution Incident Liability</header><section id="HCA389E85BAD744B6A048282FAF0D0C9D"><enum>401.</enum><header>Vessel response plans</header><text display-inline="no-display-inline">Section 311(j)(6) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1321">33 U.S.C. 1321(j)(6)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H7504F0C6DC0E4096A69A5992F812A25C" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph id="H32DF4D32575F4AB999F15A61FBF54779"><enum>(6)</enum><header>Equipment requirements, verification, and inspection</header><text display-inline="yes-display-inline">The President may require—</text><subparagraph id="H5DDFAF9AD2E7436C92A70928CD874F79"><enum>(A)</enum><text>periodic inspection of containment booms, skimmers, vessels, and other major equipment used to remove discharges;</text></subparagraph><subparagraph id="H94EC887E08A04BB7B2EDCA77E5B752E3"><enum>(B)</enum><text display-inline="yes-display-inline">periodic inspection of vessels, salvage and marine firefighting equipment, and other major equipment used to respond to vessel casualties and prevent discharges;</text></subparagraph><subparagraph id="H5D77E43A6AA7489DB21B1ED72580BE66"><enum>(C)</enum><text display-inline="yes-display-inline">periodic verification of capabilities to appropriately, and in a timely manner, respond to a worst case discharge, or a substantial threat of a discharge, including—</text><clause id="HCF70E447A93842FC88770897D7363619"><enum>(i)</enum><text>drills, with or without prior notice;</text></clause><clause id="HC11D652BE37D44DA8744688845D9D419"><enum>(ii)</enum><text>review of contracts and relevant third-party agreements;</text></clause><clause id="H4540111901D244D5A74BA2F0018A42D8"><enum>(iii)</enum><text>testing of equipment;</text></clause><clause id="H9D403779FB494097808CE36BF85BBA84"><enum>(iv)</enum><text>review of training; and</text></clause><clause id="HD96641B9A91E459C8C6BCFB4E0459DC2"><enum>(v)</enum><text>other evaluations of response capabilities, as determined appropriate by the President; and</text></clause></subparagraph><subparagraph id="HDC9CAD7D06AB41248E31EF24B9E60261"><enum>(D)</enum><text>vessels operating on navigable waters and carrying oil or a hazardous substance in bulk as cargo, and nontank vessels carrying oil of any kind as fuel for main propulsion, to carry appropriate removal equipment that employs the best technology economically feasible and that is compatible with the safe operation of the vessel.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H080954B1A4A3463C85856A3AD283B7BB"><enum>402.</enum><header>Use of marine casualty investigations</header><text display-inline="no-display-inline">Section 6308 of title 46, United States Code, is amended—</text><paragraph id="H1FBBABE58CFC4293BDFB44A1640DA892"><enum>(1)</enum><text>in subsection (a) by striking <quote>initiated</quote> and inserting <quote>conducted</quote>; and</text></paragraph><paragraph id="H733F1E439B744ED896464A2112A112D2"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="H2B092F6132C14B12800143CCC81A01EB" style="OLC" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="HD35A6055968A4A398C68128CC3ED5597"><enum>(e)</enum><text>For purposes of this section, an administrative proceeding conducted by the United States includes proceedings under section 7701 and claims adjudicated under section 1013 of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2713">33 U.S.C. 2713</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H689B3DE6529342F4A8FD2BCF2FD9EA89"><enum>403.</enum><header>Timing of review</header><text display-inline="no-display-inline">Section 1017 of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2717">33 U.S.C. 2717</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H549ED19113564B52A3F396D754674960" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="HD4EF1BFFBFA74343964A8576028FA443"><enum>(g)</enum><header>Timing of review</header><text display-inline="yes-display-inline">Before the date of completion of a removal action, no person may bring an action under this Act, section 311 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1321">33 U.S.C. 1321</external-xref>), or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5, United States Code, challenging any decision relating to such removal action that is made by an on-scene coordinator appointed under the National Contingency Plan.</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block></section></title><title id="H5BFFB23112DA4DD9BBEA140E47158A8E"><enum>V</enum><header>Technical, Conforming, and Clarifying Amendments</header><section id="HBA2E31055B5F43C795E9B46348C9ECE9"><enum>501.</enum><header>Technical and conforming amendments</header><subsection id="H41D0A459DD7C4194B7721E6130BB0FA4"><enum>(a)</enum><header>Prohibition on entry and operation</header><text>Section 70022(b)(1) of title 46, United States Code, is amended by striking <quote>Federal Register</quote> and inserting <quote>the Federal Register</quote>.</text></subsection><subsection id="H89E9A89CDD764515BE9E8726102DF18C"><enum>(b)</enum><header>Port, harbor, and coastal facility security</header><text>Section 70116(b) of title 46, United States Code, is amended—</text><paragraph id="H1A66E857EA1240DE8C87A3FE31B03ECC"><enum>(1)</enum><text>in paragraph (1) by striking <quote>terrorism cyber</quote> and inserting <quote>terrorism, cyber</quote>;
