<section id="HC439B763812D4495B917463A5D7189A9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Lighthouse Museum Act</short-title></quote>.</text></section> <section id="H7AEBB923922E4FA8A5A86EB7F9A7BC4D"><enum>2.</enum><header>National lighthouse museum</header><text display-inline="no-display-inline">Part B of subtitle II of title 36, United States Code, is amended by inserting after chapter 1519 the following new chapter:</text>

<section id="HE516ED3C8CF24FFE89FAAC4E3108EE61"><enum>152001.</enum><header>Organization</header>
<subsection id="H496C36FCBF224AC3AEF2C13E1E02AD52"><enum>(a)</enum><header>Federal charter</header><text>The National Lighthouse Museum, incorporated in New York, is a federally chartered corporation.</text></subsection> <subsection id="HCD95848836F94F9A89D9DF482EC0AF8E"><enum>(b)</enum><header>Expiration of charter</header><text>If the corporation does not comply with any provision of this chapter, the charter granted by this chapter expires.</text></subsection></section>
<section id="H626CB8593BEE4082BFDF59D5135C8EA9"><enum>152002.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of the corporation are as provided in its constitution and bylaws and include the following purposes:</text> <paragraph id="HC77A6F8448954CEFB24DFD6A93E4E47B"><enum>(1)</enum><text display-inline="yes-display-inline">To collect, preserve, and interpret objects related to the history and technology of lighthouses and lightships located, in the past or present, at sites throughout the United States.</text></paragraph>
<paragraph id="H00D85557F1954236878D35184582EDC2"><enum>(2)</enum><text>To research, document, and disseminate information on the history and technology of American lighthouses.</text></paragraph> <paragraph id="HE77FEBEAE6DD4F29B7F2EE685334248E"><enum>(3)</enum><text>To create and maintain an archive of artifacts and materials related to American lighthouses.</text></paragraph>
<paragraph id="HC99473DC066E47A6AA7B983F20C4878A"><enum>(4)</enum><text>To foster research of American lighthouse history.</text></paragraph> <paragraph id="H8082DCCC51964FFC847CFC73D964DB4C"><enum>(5)</enum><text>To serve as a contact point for public inquiry and assistance with respect to American lighthouse history, research, education, collections, and programs.</text></paragraph>
<paragraph id="H5B0AF8EC62E24A8A8C2386F8D33F8D93"><enum>(6)</enum><text>To celebrate America’s lighthouse heritage through educational programs, publications, films, festivals, living history, lighthouse trails, conferences, and other such offerings.</text></paragraph> <paragraph id="H10F9374FFEAF44AD85368F095315E05D"><enum>(7)</enum><text>To support other existing and future lighthouse museums, organizations, and sites.</text></paragraph>
<paragraph id="H68B1BA368766434ABD3FE7EC4A34EB98"><enum>(8)</enum><text>To establish partnerships with other organizations to attain the above goals.</text></paragraph> <paragraph id="H9062335F01BA4F2291FCFA1F2A4DD0EA"><enum>(9)</enum><text>To engage in any lawful act or activity necessary to further the purposes of the corporation under this section.</text></paragraph></section>
<section id="H34239D596EBD480C9C9931EAE2C4D6F8"><enum>152003.</enum><header>Operation of museum</header>
<subsection id="H97672B9E772A441B8A0202928230E898"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The corporation shall operate a museum to be known as the National Lighthouse Museum at the site of the former United States Lighthouse Service General Depot located at what is now known as St. George, Staten Island, New York.</text></subsection> <subsection id="HADC6A519856440729AAEF920CA8DE5F2"><enum>(b)</enum><header>Storage facility</header><text>The corporation shall operate a storage facility located at or near the site described in subsection (a) for the care, conservation, and maintenance of artifacts in the collection of the corporation.</text></subsection>
<subsection id="H9A8D283648744DF0B76EE0C0B1772EE4"><enum>(c)</enum><header>Support to other museums</header><text>The corporation shall provide support to other museums that interpret the history of aids to navigation in the United States.</text></subsection> <subsection id="H97819CB93E7B4253AD53B3A0F63E4E3B"><enum>(d)</enum><header>Designation of collection</header><text>The collection of artifacts of the National Lighthouse Museum shall be known as the National Lighthouse Collection.</text></subsection>
<subsection id="H3E89EEA274D44B87AF96B9300C7DF2C2"><enum>(e)</enum><header>Exclusive right</header><text>The corporation shall have the sole and exclusive right to use, in carrying out its purposes, the name <quote>National Lighthouse Museum</quote> and the sole and exclusive right to the use of its corporate seal, emblems, and badges as adopted by the corporation.</text></subsection></section> <section id="HE5E319B32FAD40D49040329B4DDAB2CA"><enum>152004.</enum><header>Membership</header><text display-inline="no-display-inline">Eligibility for membership in the corporation and the rights and privileges of members are as provided in the constitution and bylaws of the corporation.</text></section>
<section id="H34A5CCE7FFC74507A78D719DBF1ABEE6"><enum>152005.</enum><header>Governing body</header>
<subsection id="H14C4B4FF1F0B458E9BD0F6E4DC524150"><enum>(a)</enum><header>Board of trustees</header><text>The board of trustees of the corporation and the responsibilities of the board are as provided in the constitution and bylaws of the corporation.</text></subsection> <subsection id="HD11FD1FAC2514630B40672052AD5601C"><enum>(b)</enum><header>Officers</header><text>The officers and the election of officers of the corporation are as provided in the bylaws of the corporation.</text></subsection></section>
<section id="H331FC53F32024502B607F213F67B22C4"><enum>152006.</enum><header>Powers</header><text display-inline="no-display-inline">The corporation has only the powers provided in its constitution, bylaws, and charter as granted by the Board of Regents of the State of New York and in the certificate of authority in any other State in which the corporation is, or shall be, qualified to do business.</text></section> <section id="H20E4D633E21D4117B249E5A678EF0188"><enum>152007.</enum><header>Restrictions</header> <subsection id="H55C58A65F5234F2BACF3646DADB6B35D"><enum>(a)</enum><header>Stock and dividends</header><text>The corporation may not issue stock or declare or pay a dividend.</text></subsection>
<subsection id="HA50ADE2BF80E4F0A8E4A28827F9E900C"><enum>(b)</enum><header>Political activities</header><text>The corporation or a trustee or officer, acting as such trustee or officer, may not contribute to, support, or participate in any political activity or in any manner attempt to influence legislation.</text></subsection> <subsection id="H099B0EC1827B42DC8F6BE93EF082C48A"><enum>(c)</enum><header>Distribution of income or assets</header><text>The income or assets of the corporation may not inure to the benefit of, or be distributed to, a trustee, officer, or member during the life of the charter granted by this chapter. This subsection does not prevent the payment of reasonable compensation to an officer or reimbursement for actual necessary expenses in amounts approved by the board of trustees.</text></subsection>
<subsection id="H970491EF77F741C7858F1E135EFC33AB"><enum>(d)</enum><header>Loans</header><text>The corporation may not make a loan to a trustee, officer, or employee.</text></subsection> <subsection id="HE13325E52B0E476084E42D1C8515A2A6"><enum>(e)</enum><header>Claim of governmental Approval or authorization</header><text>The corporation may not claim congressional approval or the authority of the United States Government for any of its activities.</text></subsection></section>
<section id="HBEA41E061BF049C1BD79893289330AD5"><enum>152008.</enum><header>Duty to maintain corporate and tax-exempt status</header>
<subsection id="H6B2F55778AE74F9CBE88A2877FC392EC"><enum>(a)</enum><header>Corporate status</header><text>The corporation shall maintain its corporate status as a corporation incorporated under the laws of the State of New York.</text></subsection> <subsection id="H8F4ED85266D14584B1C2F378BED78949"><enum>(b)</enum><header>Tax-Exempt status</header><text>The corporation shall maintain its status as an organization exempt from taxation under the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/1">26 U.S.C. 1 et seq.</external-xref>).</text></subsection></section>
<section id="HA4DEB553F6F54004BF434910D8BC8D20"><enum>152009.</enum><header>Records and inspection</header>
<subsection id="H15E144F0DA7F4FC7BC1D435DFD6F1915"><enum>(a)</enum><header>Records</header><text>The corporation shall keep—</text> <paragraph id="H8D850A7FA582410CBC3091BF67686C3A"><enum>(1)</enum><text>correct and complete records of account;</text></paragraph>
<paragraph id="H59EF56560579412C9BC258A7A0605D51"><enum>(2)</enum><text>minutes of the proceedings of its members, board of trustees, and committees; and</text></paragraph> <paragraph id="H5E85B882784B4F68B72A97DB3D731C85"><enum>(3)</enum><text>at its principal office, a record of the names and addresses of its members entitled to vote, if any.</text></paragraph></subsection>
<subsection id="H030134AC9DF04AA8A05662809AD899CC"><enum>(b)</enum><header>Inspection</header><text>Any officer or trustee, or any member entitled to vote (if any), or an agent or attorney of such officer, trustee, or member, may inspect the records of the corporation for any proper purpose at any reasonable time.</text></subsection></section> <section id="HD972446D66654694BBEA1565F4C1FF38"><enum>152010.</enum><header>Service of process</header><text display-inline="no-display-inline">The corporation shall comply with the law on service of process of the State of New York and in each State in which it carries on activities.</text></section>
<section id="HB7907F4A31EF4B6785022421DD0FF865"><enum>152011.</enum><header>Liability for acts of officers and agents</header><text display-inline="no-display-inline">The corporation is liable for the acts of its officers and agents acting within the scope of their authority.</text></section> <section id="H8C0D5E8907924F8A899BE8E33073621F"><enum>152012.</enum><header>Annual report</header><text display-inline="no-display-inline">The corporation shall submit an annual report to Congress on the activities of the corporation during the prior fiscal year. The report shall be submitted at the same time as the report of the audit required by section 10101 of this title. The report may not be printed as a public document.</text></section>
<section id="H41F37B8917E94C2085D94DD42BD614EB"><enum>152013.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this chapter—</text> <paragraph id="HF4A90DA58F8243239D3F3FB100FC05E9"><enum>(1)</enum><text>the term <quote>corporation</quote> means the National Lighthouse Museum, Inc., incorporated in New York; and</text></paragraph>
<paragraph id="HE1175DE1C4E2491A9DCF4AF0333CACA8"><enum>(2)</enum><text>the term <quote>State</quote> includes the District of Columbia and the territories and possessions of the United States.</text></paragraph></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HAF2B8B0E31E5468FB60AAD995AB91BB2"><enum>3.</enum><header>Clerical amendment</header><text display-inline="no-display-inline">The table of chapters at the beginning of subtitle II of title 36, United States Code, is amended by inserting after the item relating to chapter 1519 the following new item:</text>
