R. 2494</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date>May 18, 2023</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To make the assault of a law enforcement officer a deportable offense, and for other purposes.</official-title></form><legis-body id="HACD1E1AEF7C9458DA7E751F511AAF899" style="OLC"><section id="HD02E98811275446FA4D0116F253894E9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect Our Law enforcement with Immigration Control and Enforcement Act of 2023</short-title></quote> or the <quote><short-title>POLICE Act of 2023</short-title></quote>.</text></section><section id="H86FDF90D6EA44E8FA1500ED4FBD085B9"><enum>2.</enum><header>Assault of law enforcement officer</header><text display-inline="no-display-inline">Section 237(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H39AC76FF7E1441BB8F2E34FC53D8681A" display-inline="no-display-inline"><subparagraph id="HB58D6381D31F48C3AD16BD940B411AC5"><enum>(G)</enum><header>Assault of law enforcement officer</header><clause id="H84768DE5CCC4457886AA657630E5FC17"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Any alien who has been convicted of, who admits having committed, or who admits committing acts which constitute the essential elements of, any offense involving assault of a law enforcement officer is deportable. </text></clause><clause id="HA8A62081B8EF4069B679E0840D83ED87"><enum>(ii)</enum><header>Circumstances</header><text>The circumstances referred to in clause (i) are that the law enforcement officer was assaulted—</text><subclause id="H92D65B9FF1BA46A1AF95FA3F1B2064C4"><enum>(I)</enum><text>while he or she was engaged in the performance of his or her official duties;</text></subclause><subclause id="HF821AD4D540347E0B3764BCB2C47D76A"><enum>(II)</enum><text>because of the performance of his or her official duties; or</text></subclause><subclause id="HFDADD7D1423F45FD8DC7BAC062F26D85"><enum>(III)</enum><text>because of his or her status as a law enforcement officer.</text></subclause></clause><clause id="H34BD192C4C3E442F94E20AF1F928BB27"><enum>(iii)</enum><header>Definitions</header><text>In this subparagraph—</text><subclause id="H7C41A56F44D24CD3829D84278F11AD0B"><enum>(I)</enum><text>the term <quote>assault</quote> has the meaning given that term in the jurisdiction where the act occurred; and</text></subclause><subclause id="HBC280820A13A4A68B021BB4C2ED5AA4B"><enum>(II)</enum><text>the term <quote>law enforcement officer</quote> is a person authorized by law—</text><item id="HDDDCEE66A28D4F149225B26602821904"><enum>(aa)</enum><text>to apprehend, arrest, or prosecute an individual for any criminal violation of law; or</text></item><item id="HAED5DF8384374E89A7C7EACFE9FD0E55"><enum>(bb)</enum><text>to be a firefighter or other first responder.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HB081048521BC4E30983155A6E8757921"><enum>3.</enum><header>Report on aliens deported for assaulting a law enforcement officer</header><text display-inline="no-display-inline">On an annual basis, the Secretary of Homeland Security shall submit to Congress and make publicly available on the website of the Department of Homeland Security a report on the number of aliens who were deported during <pagebreak></pagebreak>the previous year under section 237(a)(2)(G) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(2)(G)</external-xref>). </text></section></legis-body><attestation><attestation-group><attestation-date date="20230517" chamber="House">Passed the House of Representatives May 17, 2023.</attestation-date><attestor display="yes">Cheryl L.
