which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Agricultural Act of 2014 and the Consolidated Farm and Rural Development Act to require producers to establish disaster preparedness plans to be eligible for certain disaster assistance programs, and for other purposes.</official-title></form><legis-body id="HB02F4B2019C541A8908228CEA3AD0B8E" style="OLC"><section id="H1241DDCB7E9C46EE9E35BF8290B93FFD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emergency and Disaster Preparedness for Farm Animals Act</short-title></quote>.</text></section><section id="H48C5D704E6854275B1D30D293C4E9216"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H02A3EB5F0F084361B2DB06F671A71E93"><enum>(1)</enum><text display-inline="yes-display-inline">American farms continue to experience devastating impacts from extreme weather events that have resulted in the death of millions of livestock and poultry in recent years.</text></paragraph><paragraph id="H454FDEFC3E9E49E4846C226957C41E56"><enum>(2)</enum><text>During 2020 and 2021, the United States experienced a record-breaking hurricane season, record-breaking heat waves and the hottest month on record, a record-breaking wildfire season, and record-breaking droughts across the county.</text></paragraph><paragraph id="H30E1456889EA453C99C8F826FFFC8386"><enum>(3)</enum><text>Extreme weather events continue to become more frequent and severe, putting the country’s agriculture operations and livestock herds at increased risk.</text></paragraph><paragraph id="H33029122F67E4F8BA06A9DDED4B23243"><enum>(4)</enum><text>To help producers recover from weather-related losses, numerous Federal disaster assistance programs have been established that provide significant funding to compensate producers each year, but do not require emergency planning.</text></paragraph><paragraph id="HD984C0F5A62743679EA8D6A5C45C9736"><enum>(5)</enum><text>Leading agricultural and animal health entities, including the Department of Agriculture, the American Veterinary Medical Association, and the World Organisation for Animal Health, as well as the Federal Emergency Management Agency, all recognize the importance of emergency planning and recommend the development of disaster preparedness plans on farms to help mitigate the impacts of extreme weather.</text></paragraph><paragraph id="HFFC39131EE0D4A2CB6F9D04692001E68"><enum>(6)</enum><text>As we continue to adapt to a rapidly changing climate, emergency planning requirements are necessary to help ensure farmers are prepared, financial losses are reduced, and farm animals are protected.</text></paragraph></section><section id="H828EEC0688154F68A12B2D032D86EC9D"><enum>3.</enum><header>Disaster preparedness plans required under certain disaster assistance programs</header><subsection id="HB31081108C2A486282D02BC00AD6BFEB"><enum>(a)</enum><header>Livestock indemnity payments</header><text display-inline="yes-display-inline">Section 1501(b) of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/7/9081">7 U.S.C. 9081(b)</external-xref>) is amended—</text><paragraph id="HBEF2524BDBF948DD87235646B3BCB37A"><enum>(1)</enum><text>in paragraph (1)(B), by inserting <quote>(other than a disaster preparedness plan under paragraph (5))</quote> after <quote>management practice</quote>; and </text></paragraph><paragraph id="H696B7314C11846FD95D4492FAC66C3D3"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H2FB6727239CB49F19387B6E4A1D5F537" display-inline="no-display-inline"><paragraph id="HADBDC58FABEC4996808114893A8423CD"><enum>(5)</enum><header>Special rule for payments due to adverse weather</header><subparagraph id="H31D2A04DCE8C44E1B1BB57FB76C98449" commented="no"><enum>(A)</enum><header>In general</header><text>An eligible producer may only receive a payment under this subsection for a loss described in paragraph (1)(B) if—</text><clause id="H7EA0271099754EED8B035D7B43416E17" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">on a date before the 180-day period preceding such loss, the eligible producer submitted to the Secretary, acting through the Administrator of the Farm Service Agency, an initial disaster preparedness plan; </text></clause><clause id="HB5AD265E80E24804A73BF960FEC549F2"><enum>(ii)</enum><text>in the case of a disaster preparedness plan that was submitted to the Secretary on a date before the 2-year period preceding such loss, the producer submitted a renewal of such plan during such 2-year period; and </text></clause><clause id="H90E8B1E3ACE84C89A38669EC8DED0065" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">not later than 30 days after such loss is incurred, the eligible producer provides to the Secretary a description of how the most recently submitted disaster preparedness plan was implemented on the farm to attempt to prevent such loss.</text></clause></subparagraph><subparagraph id="H68D76292C86441C5856CF2084A1A86C5"><enum>(B)</enum><header>Elements</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), a disaster preparedness plan shall include—</text><clause id="H465A60CE381F4F72AFFA9975BB75BDF3"><enum>(i)</enum><text>an adverse weather plan for each potential adverse weather event (based on the region the applicable farm is located and size of the farm) for each species of livestock on the farm; and</text></clause><clause id="H1D02CD9CA2EC4A12A4C90705C965E4BF"><enum>(ii)</enum><text>such other information as the Secretary may require.</text></clause></subparagraph><subparagraph id="H6B290E82142B4FA39EEDE9CDF5CCC42D"><enum>(C)</enum><header>Publication</header><text>The Secretary shall make the plans received by the Secretary under subparagraph (A)(i) available to State or local agencies upon request. </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H57E84847805C49008B79E7F38656A367"><enum>(b)</enum><header>Consolidated Farm and Rural Development Act</header><text>Section 333 of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1983">7 U.S.C. 1983</external-xref>) is amended—</text><paragraph id="HC0A5F31FB2FA48D2A538ADAEE604E1A9"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (6);</text></paragraph><paragraph id="HA36B7A42AEEE412BB589A678FB9649FC"><enum>(2)</enum><text>by striking the period at the end of paragraph (7) and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H2F21268EC23C488C83BC9FC2630AA5DD"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="HB081C1857ABB47489421096C4745C87F" display-inline="no-display-inline"><paragraph id="H6A512B0855AF4E779E82FA50B4104D4C"><enum>(8)</enum><text display-inline="yes-display-inline">in the case of an emergency loan to replace livestock lost due to a natural disaster or major disaster or emergency designated by the President under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>), require the applicant to develop a disaster preparedness plan that includes an adverse weather plan for each potential adverse weather event (based on the region the applicable farm is located and size of the farm) for each species of livestock on the farm.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H4FDD838AC51047F0A73B4246C02A3903"><enum>(c)</enum><header>Effective date</header><text>This section, and the amendments made by this section, shall take effect on the date that is 1 year after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
