<section id="HD166BCDBFDA442CF8680D41EA5687155" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Inaction Has Consequences Act</short-title></quote>.</text></section> <section id="H4CF71704B544406EAF9275FED997DBC2"><enum>2.</enum><header>Holding salaries of Members of Congress in escrow upon failure to pass regular appropriation bills</header> <subsection id="H53E8E9E98C5F4E1493025C67F59CD24F"><enum>(a)</enum><header>Holding Salaries in Escrow</header><text display-inline="yes-display-inline">If by the first day of a fiscal year (beginning with fiscal year 2024), a House of Congress has not passed each of the regular appropriation bills for such fiscal year, during the period described in subsection (b) the payroll administrator of that House of Congress shall deposit in an escrow account all payments otherwise required to be made during such period for the compensation of Members of Congress who serve in that House of Congress, and shall release such payments to such Members only upon the expiration of such period.</text></subsection>
<subsection id="H72658FEC7F184B01B97DAB5F3E40AB9C"><enum>(b)</enum><header>Period Described</header><text>With respect to a House of Congress and a fiscal year, the period described in this paragraph is the period which begins on the first day of the fiscal year and ends on the earlier of—</text> <paragraph id="HF269C722BCC34D40A50ADB9E22AE6AD7"><enum>(1)</enum><text display-inline="yes-display-inline">the first day by which the House of Congress has passed each of the regular appropriation bills for such fiscal year; or</text></paragraph>
<paragraph id="HF644845E3B1F479F9F2793719FDF5645"><enum>(2)</enum><text>the last day of the Congress during which that fiscal year begins.</text></paragraph></subsection> <subsection display-inline="no-display-inline" id="HF11F1A62E84C41298454E3E7FCEFE062"><enum>(c)</enum><header>Regular Appropriation Bill Defined</header><text>The term <term>regular appropriation bill</term> means any annual appropriation bill which, with respect to the Congress involved, is under the jurisdiction of a single subcommittee of the Committee on Appropriations of the House of Representatives (pursuant to the Rules of the House of Representatives for that Congress) and a single subcommittee of the Committee on Appropriations of the Senate (pursuant to the Standing Rules of the Senate).</text></subsection></section>
<section id="H1213AEA34AF94E7E8933D607537B7215"><enum>3.</enum><header>Administration of escrow</header>
<subsection id="H29D2FE6D51A94B4AB90D7271DD60448C"><enum>(a)</enum><header>Withholding and Remittance of Amounts From Payments Held in Escrow</header><text>The payroll administrator shall provide for the same withholding and remittance with respect to a payment deposited in an escrow account under section 2 that would apply to the payment if the payment were not subject to such section.</text></subsection> <subsection id="HACA58D65AAC94C6AA3781AB81B10AEA9"><enum>(b)</enum><header>Role of Secretary of the Treasury</header><text>The Secretary of the Treasury shall provide the payroll administrators of the Houses of Congress with such assistance as may be necessary to enable the payroll administrators to carry out this Act.</text></subsection></section>
<section id="H17D27418D70248B6A4C01A2414D782A7"><enum>4.</enum><header>Release of amounts at end of a Congress</header><text display-inline="no-display-inline">In order to ensure that this Act is carried out in a manner consistent with the twenty-seventh article of amendment to the Constitution of the United States, the payroll administrator of a House of Congress shall release for payments to Members of that House of Congress any amounts remaining in any escrow account under section 2 on the last day of the Congress during which the amounts were deposited in such account.</text></section> <section id="HA69A892B11464FF487446C500983C55A"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
<paragraph id="H72A86D941A844DBBA7650307AA0F69DD"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Member</term> includes a Delegate or Resident Commissioner to the Congress; and</text></paragraph> <paragraph id="HFCB3BCDC2474432081B6D8A286D4CA88"><enum>(2)</enum><text>the <quote>payroll administrator</quote> of a House of Congress means—</text>
<subparagraph id="HCD784B232C6248EB8BC2F2ABADB2E063"><enum>(A)</enum><text>in the case of the House of Representatives, the Chief Administrative Officer of the House of Representatives, or an employee of the Office of the Chief Administrative Officer who is designated by the Chief Administrative Officer to carry out this Act; and</text></subparagraph> <subparagraph id="H62AEDB6A26E84D63889434C363A3674E"><enum>(B)</enum><text>in the case of the Senate, the Secretary of the Senate, or an employee of the Office of the Secretary of the Senate who is designated by the Secretary to carry out this Act.</text></subparagraph></paragraph></section>
