which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HSY00">Science, Space, and Technology</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the Office of Advanced Aviation within the Administration of the Federal Aviation Administration, and for other purposes.</official-title></form><legis-body id="H7205DF50DAB8465FA86277E0CAE82AF8" style="OLC"><section id="H82C4B8B0A7C540AC8A7AF0D2FC08EE74" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advanced Aviation Act</short-title></quote>.</text></section><section id="H7C1AC6981DF74D42872B7EFC8B58B7DA"><enum>2.</enum><header>Office of Advanced Aviation; Associate Administrator for Advanced Aviation</header><subsection id="H443AD156E2E849468D0582AA2E5739E9"><enum>(a)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall redesignate the Office of NextGen as the Office of Advanced Aviation.</text></subsection><subsection id="H353D49CB9B8847299534C4C09D1E2E77"><enum>(b)</enum><header>Appointment</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall appoint an Associate Administrator for Advanced Aviation to head the Office of Advanced Aviation designated under subsection (a).</text></subsection><subsection id="H461AE723FFC2496C88AC08796615CDF7"><enum>(c)</enum><header>Responsibilities</header><text>The responsibilities of the Associate Administrator for Advanced Aviation shall include the following:</text><paragraph id="H601E42F47EBA44028D2BFBAFB8B75010" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Coordinate rulemaking and approval processes on matters relating to the standardization and certification of advanced aviation systems for use in the national airspace system.</text></paragraph><paragraph id="H70C358E28BB74E45BC26A0BC05B20E12"><enum>(2)</enum><text display-inline="yes-display-inline">Coordinate rulemaking and approval processes on matters relating to the safe operation and integration of advanced aviation systems in the national airspace system.</text></paragraph><paragraph id="HB1B2C30207FB45A597477A284BF5149B"><enum>(3)</enum><text display-inline="yes-display-inline">Coordinate activities and establish policies related to the integration of aeronautical radio frequency spectrum designated by the National Telecommunications and Information Administration of the Department of Commerce for use in the national airspace system. </text></paragraph><paragraph id="H282D6E0A03A144BD8C002BC59812EF3D"><enum>(4)</enum><text display-inline="yes-display-inline">Coordinate workforce planning across relevant offices of the Administration to—</text><subparagraph id="H60EDBC44957F409D86CC60642CEDD0B9"><enum>(A)</enum><text>hire and recruit personnel to—</text><clause id="HD30B17A9BE6B489F8E23C3FF2BDF8C18"><enum>(i)</enum><text>research, develop, test, and evaluate advanced aviation systems; and</text></clause><clause id="H7DBF1330664249E48106D14AC5F9B071"><enum>(ii)</enum><text>process applications related to advanced aviation systems in a timely manner;</text></clause></subparagraph><subparagraph id="H6BE9FC0892B64FBCA51690C8AA36D25E"><enum>(B)</enum><text>develop and submit a quarterly report to the Secretary and the Administrator, including—</text><clause id="HEAA7B8D0524C47B6A1449E25BFA33A24"><enum>(i)</enum><text>core workforce requirements related to the research, development, testing and evaluation of advanced aviation systems by the Administration;</text></clause><clause id="H12F6F3344C76471AB0E7AD039F76102B"><enum>(ii)</enum><text>core workforce requirements related to the safety, certification, and operational approval of advanced aviation systems by the Administration; and</text></clause><clause id="HA5EFC22F1D0A47A0B9A4F6FAE37B7C15"><enum>(iii)</enum><text>recommendations on staffing and budgetary resources needed to address areas of concern.</text></clause></subparagraph></paragraph><paragraph id="H2AFCA3CCEBBD459EA8D191A0AD2988F1"><enum>(5)</enum><text display-inline="yes-display-inline">Coordinate rulemaking related to the international standardization and environmental effects of advanced aviation systems.</text></paragraph><paragraph id="H5E7B0C662E8E49F389EA90A40845559B"><enum>(6)</enum><text>Advise the Administrator during internal and interagency coordination and rulemaking on counter-UAS systems and other matters related to advanced aviation systems.</text></paragraph><paragraph id="H095CCADD1A5D417FA34A8F3BFFED5B38"><enum>(7)</enum><text>Advise the Chief Technology Officer of the Administration on the development of enterprise architecture.</text></paragraph><paragraph id="H2EACAB6464614FC2800EF44916652A10"><enum>(8)</enum><text>Validate supporting system requirements proposed by the Chief Technology Officer.</text></paragraph><paragraph id="H1B16F2001BB94EF0922FC55A698C4A0B"><enum>(9)</enum><text display-inline="yes-display-inline">Consult with the Director of the William J. Hughes Technical Center for Advanced Aviation, as redesignated under section 5, to—</text><subparagraph id="H295438530010467DB88A31ABC7DAE9A1"><enum>(A)</enum><text>evaluate technologies related to advanced aviation systems;</text></subparagraph><subparagraph id="HD52D48663AEC40EA8F9565BF16FB5C0A"><enum>(B)</enum><text>inform processes and rulemaking related to advanced aviation systems;</text></subparagraph><subparagraph id="H7C9D9047F20949839BB6CB7313646A6E"><enum>(C)</enum><text>identify new technologies that qualify as viable advanced aviation systems; and</text></subparagraph><subparagraph id="H3F8A5DE3D4F04327BC3A175800F83E56"><enum>(D)</enum><text>coordinate referral of all technologies to the relevant office of the Administration.</text></subparagraph></paragraph><paragraph id="H57F694BA7E1340F29FE4F244B22468EF"><enum>(10)</enum><text>Lead aviation rulemaking committees relevant to advanced aviation systems.</text></paragraph><paragraph id="H414D209E427D4482BACCC1BBBC96FCEF"><enum>(11)</enum><text>Consult with and assign tasks to the Advanced Aviation Advisory Committee.</text></paragraph><paragraph id="H5DA024697D8F41A887150920E1504795"><enum>(12)</enum><text display-inline="yes-display-inline">Develop and implement a secure password-protected online portal that allows stakeholders with a new or pending certification or approval application to review the status of such application, receive notice of deadlines and major certification milestones, and identify the Administration office reviewing such application.</text></paragraph><paragraph id="HFA282F8741014BB8AED290877F80FEAB"><enum>(13)</enum><text>Implement pilot programs in partnership with advanced aviation stakeholders to provide data to support rulemaking and approval processes.</text></paragraph><paragraph id="H12ACD5FDE03E4FDFBC0599F38AC28EE5"><enum>(14)</enum><text>Serve as a representative of the Administration during interagency coordination of policies related to advanced aviation systems.</text></paragraph><paragraph id="H7B960307ADC8436CBE8D9CABDC25F95C"><enum>(15)</enum><text>Promote the safe and responsible integration of advanced aviation systems into the national airspace system.</text></paragraph></subsection><subsection id="H9E01728BC0404C839D1FEF5F822E5C77" commented="no"><enum>(d)</enum><header>Notice of objection</header><paragraph id="HD4AB9D1D7566423FBA4CEB87B470E4B2" commented="no"><enum>(1)</enum><header>In general</header><text>In carrying out the responsibilities described in subsection (c), the Associate Administrator for Advanced Aviation may submit to the Administrator a notice of objection with respect to—</text><subparagraph id="H177D9C6FCF294F31A051865E4092A361" commented="no"><enum>(A)</enum><text>a final rule of the Administration related to advanced aviation systems;</text></subparagraph><subparagraph id="H8621DDA971874AD2821FF58308999B79" commented="no"><enum>(B)</enum><text>a determination by the Chief Technology Officer related to the establishment of enterprise architecture or supporting system requirements;</text></subparagraph><subparagraph id="HA1815AC818CB4A52B3FF5FDB43176FAA" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">an airworthiness or type certification determination that relates to an advanced aviation system issued in accordance with section 44701 or 44704 of title 49, United States Code, or a modification or reversal of such determination; and</text></subparagraph><subparagraph id="H21EB3241A3F94EA49F105284DA7C3E89" commented="no"><enum>(D)</enum><text>an waiver determination that relates to the operation of an advanced aviation system in the national airspace system issued in accordance with section 44701 or 44807 of title 49, United States Code, or a modification or reversal of such determination.</text></subparagraph></paragraph><paragraph id="HDDA492FF00EF40C69630EFD1733F2279"><enum>(2)</enum><header>Contents of notice</header><text display-inline="yes-display-inline">In each notice of objection submitted under this subsection, the Associate Administrator shall include an explanation for the basis of each such objection.</text></paragraph><paragraph id="HC065D55DECC74D0ABB5FA402DFFB617C" commented="no"><enum>(3)</enum><header>Determination by Administrator</header><text display-inline="yes-display-inline">Not later than 30 days after receiving a notice of objection under this subsection, the Administrator shall—</text><subparagraph id="HAD9CDE2E9DFF465B87BB02A3FE16825D"><enum>(A)</enum><text>determine whether to agree with or overrule such objection; and</text></subparagraph><subparagraph id="H36DBFBCB04454887BF29502151373431"><enum>(B)</enum><text>if the Administrator determines that such objection should be overruled, submit to the Secretary a report explaining the reasons for overruling such objection.</text></subparagraph></paragraph><paragraph id="H1590A83A8DC64B35B5FD44528EF4F24F" commented="no"><enum>(4)</enum><header>Determination by Secretary</header><text display-inline="yes-display-inline">Not later than 30 days after receiving a report submitted under paragraph (3)(B), the Secretary may determine whether to allow the rule, determination, modification, or reversal to which the report relates to proceed. If the Secretary fails to make a determination under this paragraph, the determination made by the Administrator under paragraph (3) shall proceed.</text></paragraph><paragraph id="H92837E95C7114DCAAC68D14DEC66631E" commented="no"><enum>(5)</enum><header>Implementation of rule</header><text>Any rule or determination that is the subject of a notice of objection submitted under this subsection shall not take effect during the period beginning on the date on which such notice is submitted and ending on the last day of the 30-day period described in paragraph (4).</text></paragraph><paragraph id="HCB044C02917543DB8F5FF45598787037"><enum>(6)</enum><header>Submission to Congress</header><text>The Secretary shall—</text><subparagraph id="HE09D6D2E4B6E42F0999CFBFB80C502A2"><enum>(A)</enum><text display-inline="yes-display-inline">submit to Congress each notice of objection submitted under paragraph (1);</text></subparagraph><subparagraph id="H3FBD5BB9261447E489A376ACB8FBA8B8"><enum>(B)</enum><text display-inline="yes-display-inline">notify Congress of each determination of the Administrator under paragraph (3), and submit to Congress the report required under subparagraph (B) of such paragraph, if applicable; and</text></subparagraph><subparagraph id="H1BA8F99F7A124A8E905F8D2D1245D01D"><enum>(C)</enum><text>notify Congress of any determination made by the Secretary pursuant to paragraph (4).</text></subparagraph></paragraph></subsection></section><section id="H3DCE06170C6C41E681F83DCAF596D973"><enum>3.</enum><header>Office of Advanced Integration</header><subsection id="H5F256DD5FB564C12A7EB938F62CDC91B"><enum>(a)</enum><header>Establishment</header><text>The Associate Administrator for Advanced Aviation shall establish an Office of Advanced Integration within the Office of Advanced Aviation.</text></subsection><subsection id="H799379ED267E4DA8948416C47E242C79"><enum>(b)</enum><header>Designation</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Associate Administrator, in consultation with the Administrator and Secretary, shall appoint a Director of Advanced Integration to head the Office of Advanced Integration.</text></subsection><subsection id="HCDDA87AA4E96415C9EB7565C60D161C2"><enum>(c)</enum><header>Responsibilities</header><text>The Associate Administrator shall delegate to the Director of Advanced Integration the responsibilities described in paragraphs (1) through (5) of section 2(c).</text></subsection><subsection id="HB7C20267661D41259B1C2A6E09EC030E"><enum>(d)</enum><header>Collaboration</header><text display-inline="yes-display-inline">The Director of Advanced Integration shall collaborate with—</text><paragraph id="HBC9A30F65E1F4BAE84A646522A3F5C2C"><enum>(1)</enum><text display-inline="yes-display-inline">the Executive Director of the Aircraft Certification Service of the Administration and the Executive Director of the Flight Standards Service of the Administration to carry out the responsibilities described in section 2(c)(1);</text></paragraph><paragraph id="H9AF78459CC184E719599D7E4051C4BA1"><enum>(2)</enum><text display-inline="yes-display-inline">the Director for Air Traffic Services Operations Planning and Integration of the Administration to carry out the responsibilities described in section 2(c)(2);</text></paragraph><paragraph id="H3DF95A8418DA460EB1F19660126F1FF9"><enum>(3)</enum><text display-inline="yes-display-inline">the Vice President of Technical Operations of the Air Traffic Organization to carry out the responsibilities described in section 2(c)(3);</text></paragraph><paragraph id="H4682EACC832747C29D3FD4D7966139A8"><enum>(4)</enum><text display-inline="yes-display-inline">the Assistant Administrator for Finance and Management of the Administration to carry out the responsibilities described in section 2(c)(4); and</text></paragraph><paragraph id="H13740449CAE34AEF9FC7615516FBB0DA"><enum>(5)</enum><text display-inline="yes-display-inline">the Director of the Office of International Affairs of the Administration and the Director of the Office of Environment and Energy of the Administration to carry out the responsibilities described in section 2(c)(5).</text></paragraph></subsection></section><section id="HC495129DB794499DA79CFC5ED1AFC261"><enum>4.</enum><header>Advanced Aviation Coordination Unit</header><subsection id="HD8E3EBC7253A467C9BD9D2D17A1911AE"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a coordination unit within the Administration to carry out the responsibilities described in subsection (d), to be known as the Advanced Aviation Coordination Unit.</text></subsection><subsection id="H268208DC95874DBC8D55C644F92FE718"><enum>(b)</enum><header>Membership</header><text>The Advanced Aviation Coordination Unit shall consist of the head of each relevant office of the Administration, or an employee representing such office, including—</text><paragraph id="H54B5A065578A46559CC39A4D2A6E8B9C"><enum>(1)</enum><text>the Office of Advanced Integration established under section 3;</text></paragraph><paragraph id="HC9D6E9013AA44D4CADD218E044E698C0"><enum>(2)</enum><text display-inline="yes-display-inline">the William J. Hughes Technical Center for Advanced Aviation, as redesignated under section 5;</text></paragraph><paragraph id="H268502E533774D139EE786EDFFC80A02"><enum>(3)</enum><text>the Office of Aviation Safety;</text></paragraph><paragraph id="H574812D5894148BDB2500E79DF513D1A"><enum>(4)</enum><text>the Aircraft Certification Service;</text></paragraph><paragraph id="HE9333DBCB27A4778A425BD7004E935F7"><enum>(5)</enum><text>the Flight Standards Service;</text></paragraph><paragraph id="HE295EF0F3DD946898BEDE9D1F44ECDB7"><enum>(6)</enum><text>Air Traffic Organization;</text></paragraph><paragraph id="H26ADA9A4D6B24787B54C3291DE47CD47"><enum>(7)</enum><text>the Program Management Organization;</text></paragraph><paragraph id="HB92AB12323104D7093FE12F78949798B"><enum>(8)</enum><text display-inline="yes-display-inline">Technical Operations Services for the Air Traffic Organization;</text></paragraph><paragraph id="H2EA1990EBA2F426CA7DE04FDEF83652E" commented="no"><enum>(9)</enum><text>the Office of Airports; </text></paragraph><paragraph id="H107924CDC627468CB2221AD14CC32AA5"><enum>(10)</enum><text>the Office of the Chief Counsel;</text></paragraph><paragraph id="HB487BC392E40443B89F5A16FD95B1F2F"><enum>(11)</enum><text>the Office of Commercial Space Transportation; </text></paragraph><paragraph id="H71AA56F734AB4BE2B90D45CA5C6F438B"><enum>(12)</enum><text>the Office of Environment and Energy; </text></paragraph><paragraph id="H4093D69447C245E8AFD5B98F87985BF1"><enum>(13)</enum><text>the office headed by the Chief Technology Officer; and</text></paragraph><paragraph id="HD6B82E7AED3449E4B01BF8A4DBBB281B"><enum>(14)</enum><text>the Office of Finance and Management.</text></paragraph></subsection><subsection id="H24819878A4BF4D128D996C8B5CB013ED"><enum>(c)</enum><header>Chair</header><paragraph id="H3BA68BC1B80447F4AE4F56525C281A6A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of Advanced Integration shall serve as the Chair of the Advanced Aviation Coordination Unit, at the discretion of the Associate Administrator for Advanced Aviation.</text></paragraph><paragraph id="HB2DEAFC93C204B86B12648BC75D75482"><enum>(2)</enum><header>Authority</header><text>The Chair may—</text><subparagraph id="H55789D3F250544BAB13FF60AAD37F3FF"><enum>(A)</enum><text>schedule meetings of the members of the Advanced Aviation Coordination Unit;</text></subparagraph><subparagraph id="H62A4CD530C7B4C50B5F459B2AA2CC2E0"><enum>(B)</enum><text>identify items for the members of the Advanced Aviation Coordination Unit to act on in fulfillment of the responsibilities described in subsection (d); and</text></subparagraph><subparagraph id="HFD96D13D56AC42EBA16D36A1B76D7E65"><enum>(C)</enum><text>submit to the Administrator, the Secretary, and Congress a notice of noncompliance indicating that a member of the Advanced Aviation Coordination Unit failed to participate in the Coordination Unit to the extent necessary to fulfill such responsibilities.</text></subparagraph></paragraph><paragraph id="HDA37A80EE50948808DBEF6E075A8B0B5"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Chair shall consult with the Director of the William J. Hughes Technical Center for Advanced Aviation to identify new aviation-related technologies through the aviation innovation program established under section 5(c).</text></paragraph></subsection><subsection id="H2A5BE434B74A4EB6862EBAE58ED639CC"><enum>(d)</enum><header>Responsibilities</header><text>The members of the Advanced Aviation Coordination Unit shall collaborate to—</text><paragraph id="H3F4AC66F72E848B1B314C26C0EA2E3E5"><enum>(1)</enum><text display-inline="yes-display-inline">promote the safe and responsible integration of advanced aviation systems into the national airspace system;</text></paragraph><paragraph id="H9EF9B590E60245CEB4A47B5010CE7EDA"><enum>(2)</enum><text>establish or improve processes related to such integration;</text></paragraph><paragraph id="H108B8065294541CCB5AB2907D4A1FB0F"><enum>(3)</enum><text>establish or improve processes related to the certification of advanced aviation systems;</text></paragraph><paragraph id="H3B57F188432945178EDE3C30F36C3CC0"><enum>(4)</enum><text>develop clear and consistent standards related to advanced aviation systems;</text></paragraph><paragraph id="H70A92E6A7F2F431BB50B05B8024BCF1F"><enum>(5)</enum><text>ensure that determinations of the Administration related to advanced aviation systems are made in a timely manner;</text></paragraph><paragraph id="HB7CF7BEC23014214A4681996DAC26C5B"><enum>(6)</enum><text>proactively identify, discuss, and act on challenges related to the application and impact of radio frequency spectrum use in the national airspace system; and</text></paragraph><paragraph id="HBC2C297CC1EF43E78AD27704967DD295"><enum>(7)</enum><text>identify innovative aviation technologies that may be integrated into the national airspace system.</text></paragraph></subsection><subsection id="H43868839CE7E4D1BBC678EEABC28F876"><enum>(e)</enum><header>Interagency coordination</header><text>The Secretary may facilitate coordination between interagency partners and the members of the Advanced Aviation Coordination Unit to fulfill the responsibilities described in subsection (d).</text></subsection></section><section id="HDA8D63E86BA84C7E82BDFB8B650B51F8" commented="no"><enum>5.</enum><header>William J. Hughes Technical Center for Advanced Aviation</header><subsection id="H482A938BCCEF4CE595E0A5FE80CAE7A4" commented="no"><enum>(a)</enum><header>Establishment</header><paragraph id="HD95C898FA58F43CBBD0193E74DD220D4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after date of enactment of this Act, the Secretary shall redesignate the William J. Hughes Technical Center as the William J. Hughes Technical Center for Advanced Aviation.</text></paragraph><paragraph id="H0748F614AB414CFDA001405570E76D53"><enum>(2)</enum><header>Director</header><text display-inline="yes-display-inline">The Director of the William J. Hughes Technical Center shall be known as Director of the William J. Hughes Technical Center for Advanced Aviation.</text></paragraph></subsection><subsection id="HB375F0DB8CBF448BABBCE7E489ADBAF8" commented="no"><enum>(b)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">The Director of the William J. Hughes Technical Center for Advanced Aviation shall be responsible for—</text><paragraph id="H27CAB44641D04414B55FB7E8E1959E3F" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">assuming all roles and responsibilities previously held by the Director of William J. Hughes Technical Center, including—</text><subparagraph id="H0A0482914CC846D3AF853CABAA5E3BFF" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">managing the research and development portfolio of the Administration and the Research and Development Advisory Committee;</text></subparagraph><subparagraph id="HAC8D68672600466CB2F5F663C346D3EA" commented="no"><enum>(B)</enum><text>preparing congressional reports relevant to such research, including the National Aviation Research Plan and Annual Review;</text></subparagraph><subparagraph id="H4D9C8B14772749F582D4D141E6B2F6FA" commented="no"><enum>(C)</enum><text>developing formal research partnerships with industry, academia, and other government agencies, and promoting the dissemination of federally funded research;</text></subparagraph><subparagraph id="H0F7DBDA0EAAB4C9DA866B2B01D157B71" commented="no"><enum>(D)</enum><text>managing research grants and Centers of Excellence;</text></subparagraph><subparagraph id="HAD5CE408D8F84E1697F5160F9A943914" commented="no"><enum>(E)</enum><text>conducting aviation research, development, testing, evaluation activities, and sustainment activities, including field support, for new and existing national airspace system applications and technologies related to—</text><clause id="H05F8B106998A4A5F8F5E9087403BAADE" commented="no"><enum>(i)</enum><text>aerospace performance and planning, including reducing aviation hazards and aircraft safety assurance;</text></clause><clause id="HB74078D97FA548B09D12D9EAE04BF92B" commented="no"><enum>(ii)</enum><text>airports;</text></clause><clause id="H323E948C102C43739918CF5F6007D829" commented="no"><enum>(iii)</enum><text>digital systems and technologies, including spectrum management and evolving aerospace operations;</text></clause><clause id="HB75C2067D725422495D86F845112177B" commented="no"><enum>(iv)</enum><text>safety and health;</text></clause><clause id="H2EF359D88BEC4A7AB357B186BFA7F31D" commented="no"><enum>(v)</enum><text>aircraft, weather, or human factors; </text></clause><clause id="H198544FA6D4049C898E8BBBB0B2320E2" commented="no"><enum>(vi)</enum><text>pre-implementation air traffic management, including NextGen; </text></clause><clause id="H10960819CE164EBF97FB78E4DEDEFEED" commented="no"><enum>(vii)</enum><text>testing during the development of air traffic control systems to verify performance; and</text></clause><clause id="HC73F07997C2D4A1EB7C09EFBA32381EE" commented="no"><enum>(viii)</enum><text>flight testing;</text></clause></subparagraph><subparagraph id="H255D091C146642A5BBEF2B3F8BC0DFB2" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">maintaining and upholding test methods, standards, and policies of the Administration and providing independent test and evaluation to confirm products are operationally suitable and effective for use in the national airspace system;</text></subparagraph><subparagraph id="HB022DD529B134E2F9DD01BEDB367A39A" commented="no"><enum>(G)</enum><text display-inline="yes-display-inline">developing performance-based standards with industry and domestic or international partners for advanced aviation systems and other global aviation harmonization activities; and</text></subparagraph><subparagraph id="H6B4B96D8E57F448FA456569E30A9C75C" commented="no"><enum>(H)</enum><text>facilitating interagency engagement through the research team process;</text></subparagraph></paragraph><paragraph id="HDB679569A1274EAA8A2EC7D85C0A32C1"><enum>(2)</enum><text>assisting the Associate Administrator for Advanced Aviation in fulfilling the responsibilities described in paragraphs (7) and (8) of section 2(c);</text></paragraph><paragraph id="H40C12089682D42648E58C186938BAD22" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">managing the campus of the William J. Hughes Technical Center for Advanced Aviation, including— </text><subparagraph id="HFC589543B0574A5DBC2E240392D9C8CD" commented="no"><enum>(A)</enum><text>conducting operations and maintenance, engineering design and construction, and operational support services for campus facilities owned by the Administration and Administration personnel residing on properties that are owned by the Administration and located on the campus;</text></subparagraph><subparagraph id="H42540BDD2B1048EEB84B1122FC3C20FC" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">operating, maintaining, and enhancing the support infrastructure of the campus, including buildings, roads, utilities, and land;</text></subparagraph><subparagraph id="HCC3EEE1ABAA6466FB4FCE67563F0FEE4" commented="no"><enum>(C)</enum><text>ensuring compliance with environmental laws, policies, directives, and initiatives;</text></subparagraph><subparagraph id="H888EC7C39BBD49CFAF615020B9FF49AB" commented="no"><enum>(D)</enum><text>managing lease agreements and land permits that support the missions of all Federal, State, and local agencies on the campus;</text></subparagraph><subparagraph id="H893B9E4228844428995C0931BB4C8AB2" commented="no"><enum>(E)</enum><text>managing, modernizing, and enhancing the activities of the national airspace system laboratories and supporting the physical and virtual laboratories through configuration management, test bed maintenance and enhancement, laboratory scheduling, computer operations, documentation library services, and systems engineering; and</text></subparagraph><subparagraph id="HE53FBDE86F3B4D93AB7DA7D1EDEAD66E" commented="no"><enum>(F)</enum><text>providing technical and engineering services for customers of such laboratories in support of research and development system installations and proof-of-concept testing;</text></subparagraph></paragraph><paragraph id="HAE4DBC7498CA4886801FF4807D250657" commented="no"><enum>(4)</enum><text>overseeing all research, development, testing, evaluation, and sustainment activities related to advanced aviation systems; and</text></paragraph><paragraph id="H41D6A0DF8CEA4D19A189A573538AB466" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">hosting domestic and international symposia, conferences, or technical interchange meetings with industry, academia, and other government agencies.</text></paragraph></subsection><subsection id="HF47C0D8D99CA4F7A9434B3A08B34FAEB"><enum>(c)</enum><header>Aviation Innovation Program</header><paragraph id="H7AF03F30646748CD8BA958DDB814FD0A" commented="no"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Director of the William J. Hughes Technical Center for Advanced Aviation shall establish and manage a program to evaluate new aviation-related technologies proposed to be used in the national airspace system and facilitate the integration of such technologies into the national airspace system.</text></paragraph><paragraph id="HDF1EC67E3B8A4CD388D4766F7AE3E1C5"><enum>(2)</enum><header>Components</header><subparagraph id="H317BFAAAB30C4214A9DE4D291C265D65"><enum>(A)</enum><header>In general</header><text>In carrying out the program established under paragraph (1), the Director shall— </text><clause id="H42362DC752594261A4706A7ABB3AB707" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">encourage aviation industry stakeholders, innovators, and entrepreneurs to present to the Director aviation-related technologies for proposed use in the national airspace system;</text></clause><clause id="H0D6BFE7D2058467D8A6EE628CBAE9235"><enum>(ii)</enum><text>examine the effects of each such technology proposed under the program on the national airspace system and the potential benefits and risks of such technology, including the potential safety, social, economic, and workforce effects, and methods to safely integrate such technology into the national airspace system; and</text></clause><clause id="H0690D40E93B94DF8A862BEB55E6B1511" commented="no"><enum>(iii)</enum><text>determine whether such technology could feasibly be integrated into the national airspace system.</text></clause></subparagraph><subparagraph id="H4E338845D3924109B44B4E9E5768E65D"><enum>(B)</enum><header>Recommendations</header><text>After examining a technology and making the determination required under subparagraph (A), the Director shall submit to the Associate Administrator for Advanced Aviation recommendations on—</text><clause id="H499BE7BB32C046719F34FFFCAA7619D3" commented="no"><enum>(i)</enum><text>whether such technology could feasibly and safely be integrated into the national airspace system;</text></clause><clause id="HD73D1215970D463B8DCE9F2E6EDA074C" commented="no"><enum>(ii)</enum><text>which office or offices should be responsible for designing and implementing policies, processes, and procedures related to such technology; and</text></clause><clause id="HF5240005E83F4804B09BF6EB8F80D5AF" commented="no"><enum>(iii)</enum><text>whether such technology may be considered an advanced aviation system.</text></clause></subparagraph><subparagraph id="H5C0AA34345114D9880303C281BDD733E" commented="no"><enum>(C)</enum><header>Referral</header><text display-inline="yes-display-inline">Upon receipt of a recommendation related to an aviation-related technology under subparagraph (B), the Associate Administrator for Advanced Aviation shall—</text><clause id="HFC9A7D0CD76B4C179293E066F2FBDCAA" commented="no"><enum>(i)</enum><text>submit a summary of such recommendation to the Administrator and the Secretary;</text></clause><clause id="H9D7DCCCB23704838BD298E62CEFDD870" commented="no"><enum>(ii)</enum><text>refer such technology to the relevant office of the Administration; and</text></clause><clause id="H3DE9567CAA25433CAE26382845440C79" commented="no"><enum>(iii)</enum><text>in the case of a recommendation by the Director that a technology be considered an advanced aviation system, refer such technology to the Advanced Aviation Coordination Unit established under section 4.</text></clause></subparagraph></paragraph><paragraph id="H1FD34F5F2E1745C589F2507A2D5FA257" commented="no"><enum>(3)</enum><header>Collaboration</header><text display-inline="yes-display-inline">In examining each technology proposed under the program established under this subsection, the Director shall collaborate with subject matter experts from relevant offices of the Administration in an expeditious and thorough manner to provide an effective pathway for the development, demonstration, and adoption of such technology.</text></paragraph><paragraph id="H668846CCF8C34D0B81D16B8DCE30EA0C" commented="no"><enum>(4)</enum><header>Partnerships</header><text display-inline="yes-display-inline">The Director may enter into partnerships with stakeholders to participate in the program established under this subsection. </text></paragraph></subsection><subsection id="H5E7D988DABCF43B2BEFA3FACE3F40298" commented="no"><enum>(d)</enum><header>Authority</header><text display-inline="yes-display-inline">The Director may establish cooperative research and development agreements and make grants to carry out this section.</text></subsection><subsection id="H1A38C5A3366E484A812D12DC82868C4C" commented="no"><enum>(e)</enum><header>Preservation</header><text display-inline="yes-display-inline">The redesignation of the William J. Hughes Technical Center under this section shall not affect any agreement between the William J. Hughes Technical Center and another entity that was in effect on the day before such redesignation occurs. </text></subsection><subsection id="HCBEA1B40A59C40A0842576BEC06D41B5" commented="no"><enum>(f)</enum><header>Conforming amendment</header><text>Section 44507 of title 49, United States Code, is amended—</text><paragraph id="H6ED790172B8C462E8B064B7CE3167017" commented="no"><enum>(1)</enum><text>by striking <quote><header-in-text level="subsection" style="USC"><enum-in-header>(a)</enum-in-header> Civil aeromedical institute</header-in-text></quote> and all that follows through <quote>The Civil Aeromedical Institute established</quote> and inserting <quote>The Civil Aeromedical Institute established</quote>; and</text></paragraph><paragraph id="H9DA6B0A839084366BEA51397C4D33146" commented="no"><enum>(2)</enum><text>by striking subsection (b).</text></paragraph></subsection></section><section id="HD881343F257B4D0C8996CD0703777A94"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HD1007FB9CBAD4B9E8CDCCD261AB902CE"><enum>(1)</enum><header>Administrator</header><text>The term <quote>Administrator</quote> means the Administrator of the Federal Aviation Administration.</text></paragraph><paragraph id="H0A29C0F4BEEF4CFEAACCA51EDB3E58B6"><enum>(2)</enum><header>Administration</header><text>The term <quote>Administration</quote> means the Federal Aviation Administration.</text></paragraph><paragraph id="H383D7CDDAFB94450BE3CA4C39F910AD7"><enum>(3)</enum><header>Advanced aviation system</header><text>The term <quote>advanced aviation system</quote> means—</text><subparagraph id="HBC68C6AD4E6A43BDB711EC7803A8CFBC"><enum>(A)</enum><text>an unmanned aircraft system;</text></subparagraph><subparagraph id="H475C8C22C4A949AC843D0668E63F1B87"><enum>(B)</enum><text>a counter-UAS system;</text></subparagraph><subparagraph id="HAA606F8E82C74F19A7219977C001FD82"><enum>(C)</enum><text>a powered lift aircraft;</text></subparagraph><subparagraph id="H72685FD808D1405FBA348B36B35D548F"><enum>(D)</enum><text>a technology related to—</text><clause id="H188B54EB608F43B393D75D27794B0359"><enum>(i)</enum><text>advanced air mobility; </text></clause><clause id="H86DCA4B99D144C1BA580C320341A9430"><enum>(ii)</enum><text>the ability of an aircraft to detect surroundings and avoid impacts;</text></clause><clause id="H3C7647C6316443CD8E75FC388894AED8"><enum>(iii)</enum><text display-inline="yes-display-inline">autonomous functioning of aircraft;</text></clause><clause id="H016806DE89A94FE69AB8818243240442"><enum>(iv)</enum><text>supersonic aircraft capabilities;</text></clause><clause id="H5E8F21DD37114505B6C1FEF0217912E8"><enum>(v)</enum><text>electric or hydrogen based aircraft propulsion; or</text></clause><clause id="H8167D80AA40B4C32B4D6BCD169B097BD"><enum>(vi)</enum><text>evolving aerospace operations including new aircraft, airport, weather, or digital systems;</text></clause></subparagraph><subparagraph id="HB7EF899CEEE544A3905F7F7516F608AC"><enum>(E)</enum><text>a technology that—</text><clause id="H5E86A95FEE9045E3BEF40157769BD6E0"><enum>(i)</enum><text>relates to the telecommunication capabilities of aircraft; or</text></clause><clause id="H1FCFBCB323854F6A972B67D26E627876"><enum>(ii)</enum><text display-inline="yes-display-inline">functions in the 5G band, 6G band, or other high-frequency spectrum bands as designated by the National Telecommunications and Information Administration for use as aeronautical radio frequency spectrum; or</text></clause></subparagraph><subparagraph id="H61C9846069F04CC9980225FAF1414209"><enum>(F)</enum><text>any other aviation-related technology that the Associate Administrator for Advanced Aviation determines qualifies as an advanced aviation system that could feasibly be integrated into the national airspace system.</text></subparagraph></paragraph><paragraph id="H7D0ED1BB6A5E40F485F9848F2F881039"><enum>(4)</enum><header>Counter-uas system; unmanned aircraft system</header><text>The terms <quote>counter-UAS system</quote> and <quote>unmanned aircraft system</quote> have the meanings given such terms in section 44801 of title 49, United States Code.</text></paragraph><paragraph id="H5DDC8B4CABC44397B2B40606AF916F9C"><enum>(5)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Transportation.</text></paragraph></section></legis-body></bill>
