<section id="HCF4B6A38DFD241D2A1BB2B37C2AC0F3A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Healthy Technology Act of 2023</short-title></quote>.</text></section> <section id="H76633E1A9A11427897FFC9C3AE4BA3B3"><enum>2.</enum><header>Prescription of drugs by artificial intelligence or machine learning technologies</header><text display-inline="no-display-inline">Section 503(b) of Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/353">21 U.S.C. 353(b)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H4FB413F879074CA7929A25132280F81A" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">In this subsection, the term <term>practitioner licensed by law to administer such drug</term> includes artificial intelligence and machine learning technology that are—</text> <subparagraph id="HDF2D15478E264616B25552F7CBC663DF"><enum>(A)</enum><text display-inline="yes-display-inline">authorized pursuant to a statute of the State involved to prescribe the drug involved; and</text></subparagraph>
<subparagraph id="H338EFF48A1724EE699DA73CFBAD2A6BD"><enum>(B)</enum><text display-inline="yes-display-inline">approved, cleared, or authorized under section 510(k), 513, 515, or 564.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
