R. 200</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230109">January 9, 2023</action-date><action-desc><sponsor name-id="R000103">Mr. Rosendale</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Forest and Rangeland Renewable Resources Planning Act of 1974 and the Federal Land Policy and Management Act of 1976 to provide that the Secretary of Agriculture and the Secretary of the Interior are not required to reinitiate consultation on a land management plan or land use plan under certain circumstances, and for other purposes.</official-title></form><legis-body id="H5C14398F53CD484794282C530F0DFCE1" style="OLC"><section id="H940AEE092E624D0386525085B0F3DA33" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Forest Information Reform Act</short-title></quote> or the <quote><short-title>FIR Act</short-title></quote>. </text></section><section id="H6C1C83F8237B410E984E3920E6F5C68B"><enum>2.</enum><header>No additional consultation required</header><subsection id="H41DEF6736A394F63AF5942AB10CEC4A5"><enum>(a)</enum><header>Forest Service plans</header><text>Section 6(d)(2) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604(d)(2)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA940407FF7F747BFA55D17051B6A242B"><paragraph id="H69E7B98F0E644826BD5B90F07831C552"><enum>(2)</enum><header>No additional consultation required under certain circumstances</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary shall not be required to reinitiate consultation under section 7(a)(2) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536(a)(2)</external-xref>) or section 402.16 of title 50, Code of Federal Regulations (or a successor regulation), on a land management plan approved, amended, or revised under this section when a species is listed, critical habitat is designated, or new information concerning a listed species or critical habitat becomes available.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1F2DA1C7A5CA4AD5A41B54C142E18F81"><enum>(b)</enum><header>Bureau of Land Management plans</header><text>Section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA1839040AB51437B812346D730737570"><subsection id="HA437C46288D442A2A97169D69462E7C2"><enum>(g)</enum><header>No additional consultation required under certain circumstances</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary shall not be required to reinitiate consultation under section 7(a)(2) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536(a)(2)</external-xref>) or section 402.16 of title 50, Code of Federal Regulations (or a successor regulation), on a land use plan approved, amended, or revised under this section when a species is listed, critical habitat is designated, or new information concerning a listed species or critical habitat becomes available.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
