<section id="H3643C11AE8454D0CA0C9E1F64340D8D4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>CBD Product Safety and Standardization Act of 2023</short-title></quote>.</text></section> <section id="H46F1C2D83793484287B92908E2B543F8"><enum>2.</enum><header>Regulation of interstate commerce with respect to food containing cannabidiol derived from hemp</header> <subsection id="H65C65D5BD5F64D7CA5E75E31CED0BBB2"><enum>(a)</enum><header>Standards and regulations</header><text display-inline="yes-display-inline">Chapter IV of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/342">21 U.S.C. 342 et seq.</external-xref>) is amended by inserting after section 409 the following:</text>

<section id="H590BB2AF06D54F78922108D4E70C73DF"><enum>409A.</enum><header>Food containing cannabidiol derived from hemp</header>
<subsection id="HB534BB0284EA43F391B853F993B50AED"><enum>(a)</enum><header>Standards</header><text display-inline="yes-display-inline">The standards specified in this section for a food (other than a dietary supplement) containing cannabidiol derived from hemp (as defined in section 297A of the Agricultural Marketing Act of 1946) are that the food—</text> <paragraph id="H2CCD4AF75E1A47CD96EFEAB8EB38C25D"><enum>(1)</enum><text>is—</text>
<subparagraph id="HE8AF42B06BF945F993AB69928146D566"><enum>(A)</enum><text>in conformity with a regulation issued pursuant to section 409(c)(1)(A);</text></subparagraph> <subparagraph id="HEC1BAA63B5F44082BD32E01072336E98"><enum>(B)</enum><text>the subject of a notice submitted to the Secretary under subpart E of part 170 of title 21, Code of Federal Regulations (or any successor regulations); or</text></subparagraph>
<subparagraph id="HC5E1DC632454417BACA6A1318F220A5C"><enum>(C)</enum><text display-inline="yes-display-inline">generally recognized, among experts qualified by scientific training and experience to evaluate its safety, as having been adequately shown through scientific procedures to be safe under the conditions of its intended use, within the meaning of section 201(s); and</text></subparagraph></paragraph> <paragraph id="H9137F65435DC46A9A22374B272A9A2CE"><enum>(2)</enum><text display-inline="yes-display-inline">complies with all other applicable requirements under, or pursuant to, this Act and the Fair Packaging and Labeling Act.</text></paragraph></subsection>
<subsection id="HE77C12EC25524287AA4328F6A02760CC"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary shall issue, through notice and comment rulemaking pursuant to section 553 of title 5, United States Code, regulations specifying, with respect to a food containing cannabidiol derived from hemp—</text> <paragraph id="H21C78179E6FD4F88AEAE1E52E6111521"><enum>(1)</enum><text> a maximum amount of cannabidiol derived from hemp per serving;</text></paragraph>
<paragraph id="HEC634805ECE544AEB8A7B71DE1767243"><enum>(2)</enum><text>labeling and packaging requirements; and</text></paragraph> <paragraph id="H0690DA611A9A48B49CB9F67B9EB48AED"><enum>(3)</enum><text display-inline="yes-display-inline">conditions of intended use, including any conditions specific to a food category described under subpart A of part 170 of title 21, Code of Federal Regulations (or any successor regulations).</text></paragraph></subsection>
<subsection id="HBBED631C0D2A4EF0AC26257029DBE3CE"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The standards under this section shall apply beginning on the date of enactment of the <short-title>CBD Product Safety and Standardization Act of 2023</short-title>, regardless of whether regulations have been issued under subsection (b).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H76E3BF231E794D6BBCD86E67A50AF4D7"><enum>(b)</enum><header>Prohibited acts</header><text display-inline="yes-display-inline">Section 301(ll) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331(ll)</external-xref>) is amended, in the matter preceding paragraph (1), by inserting <quote>(other than a food containing cannabidiol that meets the requirements specified in section 409A)</quote> after <quote>made public</quote>.</text></subsection>
<subsection id="HFCD1BCBA0221426FB0BE1D911EF91A50"><enum>(c)</enum><header>Conforming amendments</header>
<paragraph id="HB6BE0F280DBC4E02AC24BC1766A01919"><enum>(1)</enum><header>Adulteration</header><text>Section 402 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/342">21 U.S.C. 342</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H290E2099277C4FC9A3D7AC3AB0C55E2C"> <subsection id="H4E5E2FE1882E496BA4043196CB5CC902"><enum>(j)</enum><text display-inline="yes-display-inline">If it is a food (other than a dietary supplement) that contains cannabidiol derived from hemp (as defined in section 297A of the Agricultural Marketing Act of 1946), unless such food meets the requirements specified in section 409A. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="H635A535BD33E403984C9E5EAB3FC3D7D"><enum>(2)</enum><header>Misbranding</header><text display-inline="yes-display-inline">Section 403 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="HEECF823D0A8C46C1B096A45B6F5FF848" display-inline="no-display-inline"> <subsection id="HC3DD88162133489388ACC3E578F1D7D0"><enum>(z)</enum><text display-inline="yes-display-inline">If it is a food (other than a dietary supplement) that contains cannabidiol derived from hemp (as defined in section 297A of the Agricultural Marketing Act of 1946), unless the labeling of such food meets the requirements specified in or pursuant to section 409A.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
