which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fair Labor Standards Act of 1938 to prohibit certain practices by employers relating to restrictions on discussion of employees' and prospective employees' salary and benefit history, and for other purposes.</official-title></form><legis-body id="H18D6F220350345869C28A67A5E0856CE" style="OLC"><section id="H79CBBD8F46C5414E8281659976052B7B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pay Equity for All Act of 2023</short-title></quote>.</text></section><section id="H28973CAA5FB241EFA1798A4FAC2939B7"><enum>2.</enum><header>Prohibitions relating to prospective employees’ salary and benefit history</header><subsection id="H89E2ECE9CD7C4545AAD97AFC7FD22501"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) is amended by inserting after section 7 the following new section:</text><quoted-block display-inline="no-display-inline" id="H5D1FBA7B75094ABEBC54EB8F7295BB68" style="OLC"><section id="H8546C2E7A787411D8D6F3D1388DB5587"><enum>8.</enum><header>Requirements and prohibitions relating to wage, salary, and benefit history</header><subsection id="HD997AB106F214A6F9D030B7A842A46F6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">It shall be an unlawful practice for an employer to—</text><paragraph id="HFD0FACBBFF62484A8FD8E229E7D20CD2"><enum>(1)</enum><text display-inline="yes-display-inline">rely on the wage history of a prospective employee in considering the prospective employee for employment, including requiring that a prospective employee’s prior wages satisfy minimum or maximum criteria as a condition of being considered for employment;</text></paragraph><paragraph id="HF834F43930384F36974161FC669574D2"><enum>(2)</enum><text display-inline="yes-display-inline">rely on the wage history of a prospective employee in determining the wages for such prospective employee, except that an employer may rely on wage history if it is voluntarily provided by a prospective employee, after the employer makes an offer of employment with an offer of compensation to the prospective employee, to support a wage higher than the wage offered by the employer;</text></paragraph><paragraph id="H34F38720E6D946F18123E71D1B84FB70"><enum>(3)</enum><text display-inline="yes-display-inline">seek from a prospective employee or any current or former employer the wage history of the prospective employee, except that an employer may seek to confirm prior wage information only after an offer of employment with compensation has been made to the prospective employee and the prospective employee responds to the offer by providing prior wage information to support a wage higher than that offered by the employer; or</text></paragraph><paragraph id="H9B31363FF44542ECA668DA2441848CC5"><enum>(4)</enum><text display-inline="yes-display-inline">discharge or in any other manner retaliate against any employee or prospective employee because the employee or prospective employee—</text><subparagraph id="H886950F3494E453EB07D1190899C7265"><enum>(A)</enum><text display-inline="yes-display-inline">opposed any act or practice made unlawful by this section; or</text></subparagraph><subparagraph id="HE27FFB6E36CD476CAAC290A85C9CBF34"><enum>(B)</enum><text display-inline="yes-display-inline">took an action for which discrimination is forbidden under section 15(a)(3).</text></subparagraph></paragraph></subsection><subsection id="H85E0E07134E94CE0AF0A37F12D18F3CD"><enum>(b)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>wage history</term> means the wages paid to the prospective employee by the prospective employee’s current employer or previous employer.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2D97DA0CE01F4DC9A390CF331C95146B"><enum>(b)</enum><header>Penalties</header><text display-inline="yes-display-inline">Section 16 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/216">29 U.S.C. 216</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="HC923A4D6CD2E45A0B3C86ADA74556AF2" style="OLC"><subsection id="HFA9F32529C7340FBB75B1E3A262C5AB1"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H710ECA9F587F4881BDA8188A11760B6A"><enum>(1)</enum><text display-inline="yes-display-inline">Any person who violates the provisions of section 8 shall—</text><subparagraph id="HEC2354FA0DE94F8D8C3BDE0E8F432EB3" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">be subject to a civil penalty of $5,000 for a first offense, increased by an additional $1,000 for each subsequent offense, not to exceed $10,000; and</text></subparagraph><subparagraph id="H14D43A460DB8499DA54CFE7F331A361C" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">be liable to each employee or prospective employee who was the subject of the violation for special damages not to exceed $10,000 plus attorneys' fees, and shall be subject to such injunctive relief as may be appropriate.</text></subparagraph></paragraph><paragraph id="HE5963087A0E1490CA6C1BECB0B532D5C" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">An action to recover the liability described in paragraph (1)(B) may be maintained against any employer (including a public agency) in any Federal or State court of competent jurisdiction by any one or more employees or prospective employees for and on behalf of—</text><subparagraph id="H1A27B068BEF94146988C091BDB1BB93A"><enum>(A)</enum><text display-inline="yes-display-inline">the employees or prospective employees; and</text></subparagraph><subparagraph id="HA956495C2B094D248550CF123E920653"><enum>(B)</enum><text display-inline="yes-display-inline">other employees or prospective employees similarly situated.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
