<official-title display="yes">To amend the Controlled Substances Act with respect to a penalty for illicit fentanyl and fentanyl-related substances.</official-title>

<section id="H460C8294BDED4D7BA51E93565838B888" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>William and James Wonacott Act of 2023</short-title></quote>.</text></section> <section id="HA610AB70C1AE41A5B646846A636981F0"><enum>2.</enum><header>Enhanced penalty for illicit fentanyl and fentanyl-related substances</header><text display-inline="no-display-inline">Part D of title II of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841</external-xref>) is amended by adding after section 404 the following new section:</text>

<section id="H2820B7FAF2824308A62DCAA18F61FB72"><enum>404A.</enum><header>Penalty with respect to illicit fentanyl and fentanyl-related substances</header>
<subsection id="HE2910941030B4C6E881007ECF494EC5A"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">It shall be unlawful for any person to sell, give, or distribute any substance that contains two milligrams or more of—</text> <paragraph id="HE95ECF06938D4B8FBF598C45EC8F8600"><enum>(1)</enum><text>illicit fentanyl; or</text></paragraph>
<paragraph id="H00773A070494466991B37B0C28A64832"><enum>(2)</enum><text>a fentanyl-related substance, </text></paragraph><continuation-text continuation-text-level="subsection">to another person without such person’s knowledge that the substance sold, given, or distributed contains illicit fentanyl or fentanyl-related substance.</continuation-text></subsection> <subsection id="HD3512FCDA1EB4707AB11B768FCBDF91B"><enum>(b)</enum><header>Penalty</header><text>Notwithstanding any other provision of law, and subject to subsection (c), any person who violates subsection (a) and such violation—</text>
<paragraph id="H4C6841D839564D459B0D5EA72D8CCB20"><enum>(1)</enum><text display-inline="yes-display-inline">does not result in death, shall be imprisoned not less than 20 years and may be imprisoned for life; or</text></paragraph> <paragraph id="HC38E0425018C4792814F277E2CEDB44D"><enum>(2)</enum><text display-inline="yes-display-inline">results in death, shall be imprisoned not less than 25 years and may be imprisoned for life.</text></paragraph></subsection>
<subsection id="H916F655A117247F3BC84DAFA5E57BE4B"><enum>(c)</enum><header>Exception</header><text>Notwithstanding any other provision of law, this section shall not apply if—</text> <paragraph id="HA7AA28A721FB46B28030C752E3AD2631"><enum>(1)</enum><text display-inline="yes-display-inline">the individual for which fentanyl or fentanyl-related substance was sold, given, or distributed received such fentanyl knowingly;</text></paragraph>
<paragraph id="HB88CDF416C674A708A5C486B2A440A2A"><enum>(2)</enum><text display-inline="yes-display-inline">the individual for which fentanyl or fentanyl-related substance was sold, given, or distributed received such fentanyl for a medicinal purpose; or</text></paragraph> <paragraph id="HF7BA1AEB48524941B586D26F0F1CEFF8"><enum>(3)</enum><text display-inline="yes-display-inline">the individual obtained such fentanyl or fentanyl-related substance pursuant to a valid prescription from a licensed medical practitioner or licensed pharmacist, while they were acting in the course of their professional capacity or as otherwise authorized by this title or title III.</text></paragraph></subsection>
<subsection id="H53050DF3EE8C4C2BB54D2B435804388A"><enum>(d)</enum><header>Illicit fentanyl defined</header><text>In this section, the term <term>illicit fentanyl</term> means fentanyl and any analogue or precursor thereof that is sold, given, distributed, manufactured, or possessed, in violation of section 401, 406, or 416 of this Act.</text></subsection> <subsection id="HEE90C8E4FDAF43A0A38E2413D7FDD3E3"><enum>(e)</enum><header>Fentanyl-Related substance defined</header><text display-inline="yes-display-inline">In this section, the term <term>fentanyl-related substance</term> shall have the meaning given such term in section 1308.11(h)(30)(i) of title 21, Code of Federal Regulations and shall include any substance not otherwise listed under another Administration Controlled Substance Code Number, and for which no exemption or approval is in effect under section 505 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>), that is structurally related to fentanyl and its analogues, isomers, esters, ethers, salts, and salts of isomers, including—</text>
<paragraph id="H57686149B1BF4EDB8D6BE80EE686DA50"><enum>(1)</enum><text>replacement of the phenyl portion of the phenethyl group by any monocycle, whether or not further substituted in or on the monocycle;</text></paragraph> <paragraph id="H493ED01A0F6E448D8B1C20F6D1DC20D0"><enum>(2)</enum><text>substitution in or on the phenethyl group with alkyl, alkenyl, alkoxyl, hydroxyl, halo, haloalkyl, amino, or nitro groups;</text></paragraph>
<paragraph id="H46C23DA70A07418295F314954FF192C5"><enum>(3)</enum><text>substitution in or on the piperidine ring with alkyl, alkenyl, alkoxyl, ester, ether, hydroxyl, halo, haloalkyl, amino, or nitro groups;</text></paragraph> <paragraph id="HE84AC0E2B55D4E6A9CA242B6902D05F7"><enum>(4)</enum><text>replacement of the aniline ring with any aromatic monocycle whether or not further substituted in or on the aromatic monocycle; or</text></paragraph>
<paragraph id="H510271387C264A7998247EAB951EBEC3"><enum>(5)</enum><text>replacement of the N-propionyl group by another acyl group.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body> </bill>
