R. 1437</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230308">March 8, 2023</action-date><action-desc><sponsor name-id="R000612">Mr. Rose</sponsor> (for himself and <cosponsor name-id="S001200">Mr. Soto</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize livestock producers and their employees to take black vultures in order to prevent death, injury, or destruction to livestock, and for other purposes.</official-title></form><legis-body id="H0BB5800B51C74F6DB2F056333179F957" style="OLC"><section id="H0ABB0B9805254E13A573048102E5683A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Black Vulture Relief Act of 2023</short-title></quote>. </text></section><section id="H333D920B19234539A09FCB23E10D6D7C"><enum>2.</enum><header>Authorization for livestock producers and their employees to take certain black vultures</header><subsection id="H2022F79C8BD0461FA42D7CAF92B9E1A3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any provision of the Migratory Bird Treaty Act (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703 et seq.</external-xref>), a covered person may—</text><paragraph id="H64385051B61B4663AB1BDE1C838EFD05"><enum>(1)</enum><text>take or attempt to take a black vulture that is causing, or that the covered person has a reasonable belief will cause, death, injury, or destruction to livestock; or</text></paragraph><paragraph id="HDD4E32BFE8FA4E10A3D0D5FAA525B493"><enum>(2)</enum><text>in the course of taking or attempting to take a black vulture described in paragraph (1), cause injury to such black vulture.</text></paragraph></subsection><subsection id="H8ECFC0F32200471C9C3FA5FD127CA1A5"><enum>(b)</enum><header>Reporting requirements</header><text>Not later than January 31 of each year, a covered person that takes a black vulture pursuant to subsection (a) in the preceding 12-month period shall complete and submit to the appropriate United States Fish and Wildlife Service Regional Office (as determined by the geographic jurisdictions described in section 2.2 of title 50, Code of Federal Regulations) an annual report using the form developed under subsection (c).</text></subsection><subsection id="H5702F5549D6A46D9B82BDE553F9A0510"><enum>(c)</enum><header>Issuance of form</header><text display-inline="yes-display-inline">The Director of the United States Fish and Wildlife Service shall, not later than 180 days after the date of enactment of this Act, make available on the agency website such reporting form as the Director determines appropriate for the purposes of taking reports under subsection (b). Such form may not be more onerous to complete than similar forms for permitted take under the Migratory Bird Treaty Act (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703 et seq.</external-xref>) required as of the date of the enactment of this section.</text></subsection><subsection id="H1F37AFFC20DE4391B5C50FC1E2FA4E69"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H3C89F00A17004A3BA7EA77850FB78F4A"><enum>(1)</enum><header>Black vulture</header><text display-inline="yes-display-inline">The term <term>black vulture</term> means a bird of the species Coragyps atratus. </text></paragraph><paragraph id="HFDC032BE396745B791420C58CF676117"><enum>(2)</enum><header>Covered person</header><text>The term <term>covered person</term> means—</text><subparagraph id="HAEDFAA28615342298F9136DA9C8D71F1"><enum>(A)</enum><text display-inline="yes-display-inline">a livestock producer; or</text></subparagraph><subparagraph id="H824EAE3B7548441A8789F2008FDFCD78"><enum>(B)</enum><text>an employee of a livestock producer when such employee is actively engaged in livestock production. </text></subparagraph></paragraph><paragraph id="H2DAC3730A96C4AF9B450C4D9214F8AF5"><enum>(3)</enum><header>Livestock</header><text display-inline="yes-display-inline">The term <term>livestock</term> has the meaning given such term in section 602 of the Emergency Livestock Feed Assistance Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/7/1471">7 U.S.C. 1471</external-xref>).</text></paragraph><paragraph id="HCD5B41E8ED5E4D1281FD5B770425B2CC"><enum>(4)</enum><header>Livestock producer</header><text display-inline="yes-display-inline">The term <term>livestock producer</term> has the meaning given such term in section 602 of the Emergency Livestock Feed Assistance Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/7/1471">7 U.S.C. 1471</external-xref>).</text></paragraph><paragraph id="H5C98F41DADAF4FECB314AB6B1817B379"><enum>(5)</enum><header>Take</header><text display-inline="yes-display-inline">The term <term>take</term> means to capture, kill, disperse, or transport.</text></paragraph></subsection></section></legis-body></bill>
