which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name>, and in addition to the Committee on <committee-name committee-id="HGO00">Oversight and Accountability</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To reduce the pay of Members of the House of Representatives if a Speaker is not elected on the first day of a Congress.</official-title></form><legis-body id="H3823B43B5DB14CDEB2ED3B6C6D64B5DD" style="OLC"><section id="H03CA7A23C1C1418A97E302053470E4B7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Pay for Disarray Act</short-title></quote>.</text></section><section id="H76D745E5C44E41E8BA157DCE7907EAB8" section-type="subsequent-section"><enum>2.</enum><header>Reduction of pay of Members of House if Speaker is not elected</header><subsection id="HB246DBBFF3D646A096014B0E052F497F"><enum>(a)</enum><header>Reduction of pay</header><paragraph id="HFE34A286D89A4895BFFF03023568FE64"><enum>(1)</enum><header>Reduction</header><text>If, by the end of the first day of a Congress, the House of Representatives has not elected a Speaker, the annual rate of pay applicable under section 601(a) of the Legislative Reorganization Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/2/4501">2 U.S.C. 4501</external-xref>) with respect to each Member of the House of Representatives for the year shall be reduced by an amount equal to the product of—</text><subparagraph id="H03797F7F65DF49E88A8CE946B594AD82"><enum>(A)</enum><text>an amount equal to one day’s worth of pay under such annual rate; and</text></subparagraph><subparagraph id="HC8BC8BE917D74E08878DCA400A34DF27"><enum>(B)</enum><text>the number of 24-hour periods occurring during the Congress during which no Speaker has been elected for the Congress.</text></subparagraph></paragraph><paragraph id="H692AB143E1234D39B71C2D58D1EDE67F"><enum>(2)</enum><header>Effective date</header><text>This subsection shall apply with respect to the One Hundred Nineteenth Congress and each succeeding Congress.</text></paragraph></subsection><subsection id="H77D996E694D6495B9A83C6C93AECEC1C"><enum>(b)</enum><header>Rule for One Hundred Eighteenth Congress</header><paragraph id="HC0D0F20F118541C49C030E82C4D8EF82"><enum>(1)</enum><header>Holding salaries in escrow</header><text display-inline="yes-display-inline">If, by the end of the first day of the One Hundred Eighteenth Congress, the House of Representatives has not elected a Speaker, the Chief Administrative Officer of the House of Representatives, or an employee of the Office of the Chief Administrative Officer who is designated by the Chief Administrative Officer to carry out this Act, shall—</text><subparagraph id="HB9F28FEF3CE24448BF4F68B496FF70F6"><enum>(A)</enum><text display-inline="yes-display-inline">deposit in an escrow account and exclude from the payments otherwise required to be made for the compensation of each Member of the House of Representatives with respect to a pay period during which the House has not elected a Speaker an amount equal to the product of—</text><clause id="HAD6C47A410FA4875BBA3F11F415CA4D8"><enum>(i)</enum><text>the daily rate of pay of the Member under section 601(a) of the Legislative Reorganization Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/2/4501">2 U.S.C. 4501</external-xref>); and</text></clause><clause commented="no" display-inline="no-display-inline" id="HC0336917DF6B4E9D9B0C3D535C473016"><enum>(ii)</enum><text>the number of 24-hour periods during which no Speaker has been elected for the One Hundred Eighteenth Congress; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H157F10DA24184CE78BCBAA43B76511E2"><enum>(B)</enum><text>release amounts deposited in an escrow account under subparagraph (A) to such Member of the House of Representatives only upon the expiration of the period described in paragraph (2).</text></subparagraph></paragraph><paragraph id="H4398B50BE98F4FB5B4577E7A10618579"><enum>(2)</enum><header>Period described</header><text>The period described in this paragraph is the period that—</text><subparagraph id="H12A89C60679544FDBFFB9876B9D3097E"><enum>(A)</enum><text>begins on the first day of the One Hundred Eighteenth Congress; and</text></subparagraph><subparagraph id="HFFF259FBF64745F69E2EBF2B774F31D4"><enum>(B)</enum><text>ends on the earlier of—</text><clause id="HEC46C8455D484FA7B3B9D5480D45815D"><enum>(i)</enum><text>the date on the House elects a Speaker for the One Hundred Eighteenth Congress; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H10D717D26272489FA025C5C9BBB49F7F"><enum>(ii)</enum><text>the last day of the One Hundred Eighteenth Congress.</text></clause></subparagraph></paragraph><paragraph id="H88B7F3E41CAA4BDC89DFB7F6BC03D0E4"><enum>(3)</enum><header>Withholding and remittance of amounts from payments held in escrow</header><text display-inline="yes-display-inline">The Chief Administrative Officer of the House of Representatives, or an employee of the Office of the Chief Administrative Officer who is designated by the Chief Administrative Officer to carry out this Act, shall provide for the same withholding and remittance with respect to a payment deposited in an escrow account under paragraph (1) that would apply to the payment if the payment were not subject to paragraph (1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H85B6ED7AB14A40458E42CD740D4E7956"><enum>(4)</enum><header>Release of amounts at end of the congress</header><text display-inline="yes-display-inline">In order to ensure that this subsection is carried out in a manner that shall not vary the compensation of Representatives in violation of the twenty-seventh amendment to the Constitution of the United States, the Chief Administrative Officer of the House of Representatives, or an employee of the Office of the Chief Administrative Officer who is designated by the Chief Administrative Officer to carry out this Act, shall release for payment to Members of the House of Representatives any amounts remaining in any escrow account under this section on the last day of the One Hundred Eighteenth Congress.</text></paragraph></subsection><subsection id="H3580FA347C1946E58AB0CBF29BB8EA51"><enum>(c)</enum><header>Member defined</header><text display-inline="yes-display-inline">In this section, the term <term>Member of the House of Representatives</term> means an individual serving in a position in the House of Representatives which is covered under subparagraph (A), (B), or (C) of section 601(a)(1) of the Legislative Reorganization Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/2/4501">2 U.S.C. 4501(1)</external-xref>).</text></subsection></section></legis-body></bill>
