R. 1242</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230228">February 28, 2023</action-date><action-desc><sponsor name-id="G000559">Mr. Garamendi</sponsor> (for himself, <cosponsor name-id="P000613">Mr. Panetta</cosponsor>, <cosponsor name-id="S001205">Ms. Scanlon</cosponsor>, <cosponsor name-id="S001150">Mr. Schiff</cosponsor>, <cosponsor name-id="J000305">Ms. Jacobs</cosponsor>, and <cosponsor name-id="C001112">Mr. Carbajal</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name>, and in addition to the Committees on <committee-name committee-id="HAG00">Agriculture</committee-name>, <committee-name committee-id="HIG00">Intelligence (Permanent Select)</committee-name>, <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, and <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To make improvements to the role of the Department of Defense in responding to domestic emergencies, including wildfires.</official-title></form><legis-body id="H826E9646AF684D91BCFC4DBDA1787751" style="OLC"><section id="HC017C6D170F8421CBD65D9750AFF5F05" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Support for Fighting Wildfires Act of 2023</short-title></quote>.</text></section><section id="H3254E92080814F21BFB60F8BA7D4B1DD"><enum>2.</enum><header>Requirement of Secretary of Defense to reimburse State costs of fighting certain wildland fires</header><text display-inline="no-display-inline">Section 2691(d) of title 10, United States Code, is amended by striking <quote>may</quote> and inserting <quote>shall</quote>.</text></section><section id="H3DEB7AA4254940909C9E6409097637E7"><enum>3.</enum><header>Authorization for FireGuard Program</header><subsection id="H8A7B080C87CC4B198F1769C356060F5C"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/32/5">Chapter 5</external-xref> of title 32, United States Code, is amended by adding at the end the following new section:</text><quoted-block id="H6AD7B75625DC4D45A217FB083377B69B" style="USC"><section id="HC2FB6A6E01B949569F4E0CEE59895AB4"><enum>510.</enum><header>Authorization for FireGuard Program</header><subsection id="H140BDF1504274CEE99D3AC0161EB9979"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">The Secretary of Defense may use members of the National Guard to carry out a program to aggregate, analyze, and assess multi-source remote sensing information for interagency partnerships in the detection and monitoring of wildfires, and to support any emergency response to such wildfires. Such a program shall be known as the <quote>FireGuard Program</quote>.</text></subsection><subsection id="H474DA540AD0F4821A6B7EA9FEF0A4245"><enum>(b)</enum><header>Resources; limitation</header><text display-inline="yes-display-inline">If the Secretary carries out a program under this section, the Secretary—</text><paragraph id="H4348D88C224E4E918EA4A1DDE9254DD1"><enum>(1)</enum><text display-inline="yes-display-inline">shall transfer the functions, personnel, assets, and capabilities of the FireGuard Program, in existence on the day before the date of enactment of the <short-title>Military Support for Fighting Wildfires Act of 2023</short-title>, to the FireGuard Program authorized under this section;</text></paragraph><paragraph id="H201F44DB15D34A86A7CFB95C3CCFB295"><enum>(2)</enum><text>may direct the Director of the National Geospatial-Intelligence Agency to provide such assistance as the Secretary determines necessary to carry out the FireGuard Program; and</text></paragraph><paragraph id="HCAF2E34657474B41A7D8BAEDA5E095E7"><enum>(3)</enum><text display-inline="yes-display-inline">may not reduce support, or transfer responsibility for support to an interagency partner, for the FireGuard Program authorized under this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H96745B50BC314A269FD743B38E64B551"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text><quoted-block style="USC" id="H34B8FA86DC9046E6B6E7A9550971D66D" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">510. Authorization for FireGuard Program.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1D816F4C184841BAA66BD4B37887048F" commented="no"><enum>(c)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">The National Defense Authorization Act for Fiscal Year 2022 (<external-xref legal-doc="public-law" parsable-cite="pl/117/81">Public Law 117–81</external-xref>) is amended by striking section 515.</text></subsection></section><section id="HDFFD93BE0A834C16A4DCE98EF57302CD" display-inline="no-display-inline"><enum>4.</enum><header>Transfer of aircraft to other departments for wildfire suppression and other purposes</header><text display-inline="no-display-inline">Section 1098 of the National Defense Authorization Act for Fiscal Year 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/66">Public Law 113–66</external-xref>) is amended—</text><paragraph id="HD94B0E57EAD44CE2AF505D01421B9146"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)(A)(i) by striking <quote>the seven demilitarized HC–130H aircraft specified in subparagraph (C)</quote> and inserting <quote>not fewer than seven demilitarized HC–130H aircraft</quote>;</text></paragraph><paragraph id="H952FB56157964AEFAA5BA5A429DEC09E" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subparagraph (C) of subsection (a)(1);</text></paragraph><paragraph id="H10A2AFAB581D4B81916A75820C9D88F7"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (b)(1)(A) by striking <quote>not more</quote> and insert <quote>not fewer</quote>; and</text></paragraph><paragraph id="H8069644F576B44FABDB342F70A6015D7"><enum>(4)</enum><text>in subsection (c)—</text><subparagraph id="H8F074DBE05DC4732B4593E107EF0656C"><enum>(A)</enum><text>in paragraph (1), by striking <quote>purposes;</quote> and inserting <quote>purposes, search and rescue, or emergency operations pertaining to wildfires; and</quote>;</text></subparagraph><subparagraph id="HD1A90D3F97A240248F984D4888F1C189"><enum>(B)</enum><text>in paragraph (2), by striking <quote>; and </quote> and inserting a period; and</text></subparagraph><subparagraph id="HD2DB68422AB24B63AFD7F01B0868952C"><enum>(C)</enum><text>by striking paragraph (3).</text></subparagraph></paragraph></section><section id="H4A73466342BB48D5A2E98EC94DDE86B3" section-type="subsequent-section"><enum>5.</enum><header>No reimbursement for use of National Geospatial-Intelligence Agency resources during a major disaster</header><text display-inline="no-display-inline">The Director of the National Geospatial-Intelligence Agency may not require the Federal Emergency Management Agency or a Federal land management agency to reimburse the National Geospatial-Intelligence Agency for use of resources for any request approved by the Director pertaining to—</text><paragraph id="H25B954E4B83143A3A44741B37D0A9DAE"><enum>(1)</enum><text>a request made by such a Federal agency through the National Interagency Fire Center; or</text></paragraph><paragraph id="H59499E9CF5CD4D6BAA5F3A16CC9FD4C1"><enum>(2)</enum><text display-inline="yes-display-inline">an area of Federal land affected by extreme weather, as that term is defined in section 328(c) of the National Defense Authorization Act for Fiscal Year 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/92">Public Law 116–92</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/221">10 U.S.C. 221</external-xref> note).</text></paragraph></section><section id="H50E475AB9F4F4B5086683B0C5936BFB4"><enum>6.</enum><header>Exemption from Economy Act for certain requests made through the National Interagency Fire Center</header><text display-inline="no-display-inline">Section 1535(b) of title 31, United States Code (commonly known as the <quote>Economy Act</quote>), shall not apply to any assistance provided by the Department of Defense to the Federal Emergency Management Agency or a Federal land management agency under a request—</text><paragraph id="H07F4142615B0476FAEC9612763214255"><enum>(1)</enum><text>made through the National Interagency Fire Center; and</text></paragraph><paragraph id="H0272099969954A32B27628814E1FB1AF"><enum>(2)</enum><text display-inline="yes-display-inline">pertaining to an area covered by a declaration of a major disaster or emergency under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>).</text></paragraph></section><section id="H1961C5D456204725B08F3A2FC8363BCD"><enum>7.</enum><header>Guidance for use of unmanned aircraft systems by the National Guard</header><subsection id="HA10AE81F12EC4A70BA764452B15A3576"><enum>(a)</enum><header>New guidance</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of Defense shall issue new guidance that treats the use of unmanned aircraft systems by the National Guard for covered activities in a manner no more restrictive than the use of other aircraft for covered activities.</text></subsection><subsection id="HAFDE71A3EE1948AA8063CC71203A32D1"><enum>(b)</enum><header>Covered activities defined</header><text>In this section, <quote>covered activities</quote> means the following:</text><paragraph id="HD54A6C5CB65B48B78D2D59EF0FA8FD54"><enum>(1)</enum><text>Emergency operations.</text></paragraph><paragraph id="H1E9561F494B843FFBC36D2A67B5AE94E"><enum>(2)</enum><text>Search and rescue operations.</text></paragraph><paragraph id="H2619B2D74A4048E89F7440B4C273DBEA"><enum>(3)</enum><text>Defense support to civil authorities.</text></paragraph><paragraph id="HD34B659318C64A20BE9BE30D922D60A4"><enum>(4)</enum><text>Support under section 502(f) of title 32, United States Code.</text></paragraph></subsection></section><section id="H7E73D819A02D49EBB4D3725ABC1DD6AB" display-inline="no-display-inline" section-type="subsequent-section"><enum>8.</enum><header>Study on use of CH–47 Chinooks to respond to wildfires</header><text display-inline="no-display-inline">Not later one year after the date of the enactment of this Act, the Secretary of Agriculture, the Secretary of the Interior, and the Secretary of Homeland Security shall jointly submit to Congress a report—</text><paragraph id="H692D358D5DF84082BA282BBA5F8A2277"><enum>(1)</enum><text>on the feasibility and effectiveness of using CH–47 Chinooks with firefighting modifications to—</text><subparagraph id="H0449DD44428E4DF198D5E9F4F96167D8"><enum>(A)</enum><text>respond to wildfires; and</text></subparagraph><subparagraph id="H0DB61C2262644BF2B50D3912F09A2B78"><enum>(B)</enum><text>perform search and rescue activities; and</text></subparagraph></paragraph><paragraph id="H06B2213040DA4DC98830E1CDC90FE9D3"><enum>(2)</enum><text>that identifies the governmental organizations (including Federal, State, and local government organizations) that would be most effective with respect to using the aircraft described in paragraph (1) to carry out the activities specified in that paragraph.</text></paragraph></section></legis-body></bill>
