<section id="H5CF2C55E4B3347679E124778806F9F9D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Can’t Cancel Your Own Debt Act of 2023</short-title></quote>.</text></section> <section id="H11400D27047240ED85775DAF8E40447D"><enum>2.</enum><header>No student loan cancellation for Members of Congress</header> <subsection id="HDE92A9C840FE4E968CDBB2B8CF908987"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, an individual who serves as a Member of Congress shall not be eligible, during or after such service—</text>
<paragraph id="H0A66276FF5AF4DF88A221652CBBC45E4"><enum>(1)</enum><text>for any service- or employment-based student loan cancellation for any time served as a Member of Congress; or</text></paragraph> <paragraph id="H5A27BA34830B436AAFC4E9A70405277C"><enum>(2)</enum><text>for student loan cancellation from any Federal program that is established or amended by an Act of Congress, or established or set forth by an Executive order or agency action, during the period in which the individual is serving as a Member.</text></paragraph></subsection>
<subsection id="H3BFF2FD3CA8D424EA6C4EB3137B6B266"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">For the purposes of this Act—</text> <paragraph id="H78BD5A8F21E848D9AFDCCDE290F69071"><enum>(1)</enum><header>Agency action</header><text display-inline="yes-display-inline">The term <term>agency action</term> has the meaning given such term in section 551 of title 5, United States Code.</text></paragraph>
<paragraph id="HE5857B7375884A00AB5B5FA52A885F8E"><enum>(2)</enum><header>Cancellation</header><text>The term <term>cancellation</term> means cancellation, forgiveness, or assumption of the obligation to repay the student loan debt of an individual by the Federal Government.</text></paragraph> <paragraph id="HA73343352C0C41AF8AD87D9BA2E2600B"><enum>(3)</enum><header>Student loan</header><text>The term <term>student loan</term> means any loan made to an individual (including a loan made to a parent on behalf of a dependent student) for expenses related to attendance or enrollment at an institution of higher education.</text></paragraph></subsection>
<subsection id="HE33DC0A47419433A912174FB2CF3F013"><enum>(c)</enum><header>Application</header><text>This Act shall apply to any individual who serves as a Member of Congress on or after the date of enactment of this Act.</text></subsection></section> </legis-body></bill>
