R. 1212 IN THE HOUSE OF REPRESENTATIVES February 27, 2023 Mr. Gosar introduced the following bill; which was referred to the Committee on the Judiciary, and in addition to the Committee on Energy and Commerce, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned A BILL To amend the Controlled Substances Act to provide for punishment for the knowing distribution of fentanyl, if death results, and for other purposes.

Short title

This Act may be cited as the Death Penalty for Dealing Fentanyl Act of 2023.

Knowing distribution of fentanyl where death results

Part D of the Controlled Substances Act is amended by adding at the end the following:

Knowing distribution of fentanyl where death results

Any person who knowingly violates section 401(a)(1) or section 416 by distributing, possessing with intent to distribute, or manufacturing fentanyl shall, if death results, be punished— (1)by death or imprisonment for any term of years or for life; and (2)by a fine under title 18, United States Code.
