<official-title display="yes">To amend the Controlled Substances Act to provide for punishment for the knowing distribution of fentanyl, if death results, and for other purposes.</official-title>

<section id="H1539292123494E9EB8D3583DE8036C3B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Death Penalty for Dealing Fentanyl Act of 2023</short-title></quote>.</text></section> <section id="H0DA4266B27794D4AB89829C1B177416C"><enum>2.</enum><header>Knowing distribution of fentanyl where death results</header><text display-inline="no-display-inline">Part D of the Controlled Substances Act is amended by adding at the end the following: </text> 
<quoted-block style="OLC" id="H11482B7BD63B4871950DA430FDF26DE0" display-inline="no-display-inline"> 
<section id="HF69ECA2BCCAD49CDA9BD5EB709781BB6"><enum>424.</enum><header>Knowing distribution of fentanyl where death results</header><text display-inline="no-display-inline">Any person who knowingly violates section 401(a)(1) or section 416 by distributing, possessing with intent to distribute, or manufacturing fentanyl shall, if death results, be punished—</text> <paragraph id="HE19AF7F066A144D4A5C9403766DFDC03"><enum>(1)</enum><text>by death or imprisonment for any term of years or for life; and</text></paragraph> 
<paragraph id="HD6795D4C458E41D78AC149A3845938A5"><enum>(2)</enum><text>by a fine under title 18, United States Code.</text></paragraph> </section><after-quoted-block>.</after-quoted-block></quoted-block> </section> </legis-body> </bill>
