<section id="H6EF3CAAD48C9406685AD5250E2095916" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Financial Freedom Act of 2023</short-title></quote>.</text></section> <section id="HB6267D90D9294B69B0E70FCA8609F3E0"><enum>2.</enum><header>Fiduciary duties with respect to pension plan investments</header><text display-inline="no-display-inline">Section 404(a) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1104">29 U.S.C. 1104(a)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H56C5DEF904554F9EA249DCEE82B52A3F"><enum>(3)</enum>
<subparagraph id="H17D3E88DD32841129EA6EE5BD6C548D8" display-inline="yes-display-inline"><enum>(A)</enum><text>In the case of a pension plan that provides for individual accounts and permits a participant or beneficiary to exercise control over the assets in the participant’s or beneficiary’s account, nothing in paragraph (1)—</text> <clause id="H7D4C3A77CC194756B1D095463A000AE6" indent="up1"><enum>(i)</enum><text>requires a fiduciary to select, or prohibits a fiduciary from selecting, any particular type of investment alternative, provided that a fiduciary provides the participant or beneficiary an opportunity to choose, from a broad range of investment alternatives, the manner in which some or all of the assets of the participant’s or beneficiary’s account are invested, according to regulations prescribed by the Secretary; or</text></clause>
<clause id="HC5411695587D43D0858E69A210F8D19F" indent="up1"><enum>(ii)</enum><text>requires that any particular type of investment be either favored or disfavored, other than on the basis of the investment’s risk-return characteristics, in the context of the plan fiduciary’s objective of providing investment alternatives suitable for providing benefits for participants and beneficiaries.</text></clause></subparagraph> <subparagraph id="HAF6509987C584E7B869F75889E631F5F" indent="up1"><enum>(B)</enum><text>In the event that a fiduciary selects a self-directed brokerage window as an investment alternative for a plan described in subparagraph (A)—</text>
<clause id="H44F7C5B6008F43B59685730BBCED6607"><enum>(i)</enum><text>the Secretary shall not issue any regulations or subregulatory guidance constraining or prohibiting the range or type of investments that may be offered through such brokerage window;</text></clause> <clause id="HACC4191A82A04484A958BF86DC328B1F"><enum>(ii)</enum><text>subsection (c) shall apply to such self-directed brokerage window; and</text></clause>
<clause id="HCCA632E5E2BB4A50B2B16F21F51CBD00"><enum>(iii)</enum><text>the diversification requirement of paragraph (1)(C) and the prudence requirement of paragraph (1)(B) are not violated by the fiduciary’s selection of a self-directed brokerage window as an investment alternative or as a result of the exercise of a participant or beneficiary’s control over the assets in such self-directed brokerage window.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
