which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Department of Energy Organization Act to secure the supply of critical energy resources, including critical minerals and other materials, and for other purposes.</official-title></form><legis-body id="H5827B439040A4BD09A862F3FE2A06ECE" style="OLC"><section id="HEF1B81F9F73549C4B0FB322B23FB1F07" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing America’s Critical Minerals Supply Act</short-title></quote>.</text></section><section id="HAB0C81191C5E47B895C33A7540D9E3F1"><enum>2.</enum><header>Amendment to the Department of Energy Organization Act</header><text display-inline="no-display-inline">The Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7101">42 U.S.C. 7101 et seq.</external-xref>) is amended—</text><paragraph id="H73F66372FD0246ABB39F49ED62B75B53"><enum>(1)</enum><text display-inline="yes-display-inline">in section 2, by adding at the end the following:</text><quoted-block style="OLC" id="H1F477EDE71DB4D6C8CAC49777259F8D9" display-inline="no-display-inline"><subsection id="HFC9114C3597E4CFD8BA70ED428A2A53A"><enum>(d)</enum><text display-inline="yes-display-inline">As used in sections 102(20) and 203(a)(12), the term <term>critical energy resource</term> means any energy resource that—</text><paragraph id="H440F8866F7194E19A45DACB3EB202BC1"><enum>(1)</enum><text display-inline="yes-display-inline">is essential to the energy sector and energy systems of the United States; and</text></paragraph><paragraph id="HCA2439EAFA6E4BA69FD35A8473232D4E"><enum>(2)</enum><text>the supply chain of which is vulnerable to disruption.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H7AF4471BF8F94047A2B67DAC5DC4010F"><enum>(2)</enum><text>in section 102, by adding at the end the following:</text><quoted-block style="OLC" id="HE3A1C27E3E2B4874B376207650CCCD32" display-inline="no-display-inline"><paragraph id="H28435C198C9142289B349350F11FC398"><enum>(20)</enum><text display-inline="yes-display-inline">To ensure there is an adequate and reliable supply of critical energy resources that are essential to the energy security of the United States.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H6D755800003A462095A46E8CBA6E0FF6"><enum>(3)</enum><text>in section 203(a), by adding at the end the following:</text><quoted-block style="OLC" id="H1CCF43CFC5F6444690AC97CAECDC26AC" display-inline="no-display-inline"><paragraph id="H7BCD96EDA3BD4C39AAF36891D49D6208"><enum>(12)</enum><text display-inline="yes-display-inline">Functions that relate to securing the supply of critical energy resources, including identifying and mitigating the effects of a disruption of such supply on—</text><subparagraph id="H66FB79C34F6B4771872AF57E16B757E2"><enum>(A)</enum><text>the development and use of energy technologies; and</text></subparagraph><subparagraph id="H34D1B7ECC8A4444EB2EDD18EBA4BE8D5"><enum>(B)</enum><text>the operation of energy systems.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HEB68C348E8644540A1CA4E04B55E72ED"><enum>3.</enum><header>Securing critical energy resource supply chains</header><subsection id="H6F386205B7C447A6B4EDC8E258AC271E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out the requirements of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7101">42 U.S.C. 7101 et seq.</external-xref>), the Secretary of Energy, in consultation with the appropriate Federal agencies, representatives of the energy sector, States, and other stakeholders, shall—</text><paragraph id="H55651AA76F5943048596A151B171F065"><enum>(1)</enum><text>conduct ongoing assessments of—</text><subparagraph id="HC38BF38E3BB2454FAC2EA58791EE1927"><enum>(A)</enum><text display-inline="yes-display-inline">energy resource criticality based on the importance of critical energy resources to the development of energy technologies and the supply of energy;</text></subparagraph><subparagraph id="H31A2A4337FA748CA8EE8B784D91C7FAB"><enum>(B)</enum><text display-inline="yes-display-inline">the critical energy resource supply chain of the United States; and</text></subparagraph><subparagraph id="H862927F1B39248459557ADD9C7806162"><enum>(C)</enum><text>the vulnerability of such supply chain;</text></subparagraph></paragraph><paragraph id="HBE4CCD525952487E92988FFBA7F36B1B"><enum>(2)</enum><text display-inline="yes-display-inline">strengthen critical energy resource supply chains in the United States, including by—</text><subparagraph id="H81ABDDB54D5444A48CFEC381A945CE9E"><enum>(A)</enum><text display-inline="yes-display-inline">diversifying the sources of the supply of critical energy resources; and</text></subparagraph><subparagraph id="H99AF9D28059E4DDC847D5E17A2A40403"><enum>(B)</enum><text display-inline="yes-display-inline">increasing domestic production, separation, and processing of critical energy resources;</text></subparagraph></paragraph><paragraph id="H2623A33CC896464B82066343599AFC11"><enum>(3)</enum><text display-inline="yes-display-inline">develop substitutes and alternatives to critical energy resources;</text></paragraph><paragraph id="H6F40C3780FE04AB0A849A3B385A21C4D"><enum>(4)</enum><text display-inline="yes-display-inline">improve technology that reuses and recycles critical energy resources; and</text></paragraph><paragraph id="H7E17BC02BB194ADF86756A392929A3EE"><enum>(5)</enum><text display-inline="yes-display-inline">evaluate how the energy security of the United States is affected by the reliance of the United States on importing critical energy resources.</text></paragraph></subsection><subsection id="H8FD4E5638B8F4FD1AEEAB5429FEE4B5C"><enum>(b)</enum><header>Critical energy resource defined</header><text display-inline="yes-display-inline">In this section, the term <term>critical energy resource</term> has the meaning given such term in section 2 of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7101">42 U.S.C. 7101</external-xref>).</text></subsection></section></legis-body></bill>
