R. 1057</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230217">February 17, 2023</action-date><action-desc><sponsor name-id="H001077">Mr. Higgins of Louisiana</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Food, Drug, and Cosmetic Act to ensure the safety of imported seafood.</official-title></form><legis-body id="H0FA99505B422466BB6CB17532C8FA018" style="OLC"><section commented="no" display-inline="no-display-inline" id="H2B4F15B06F324DC4943A9F3B241CC91A" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Imported Seafood Safety Standards Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H30EDF00C86594E9AB051E6A9C3BB072A" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Ensuring the safety of imported seafood</header><subsection commented="no" display-inline="no-display-inline" id="HFBFDF646E12449C185D7DF1C81D0986F"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Chapter VIII of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/381">21 U.S.C. 381 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HDE0E204F4A1C42CCBA83655511939341" style="OLC"><section commented="no" display-inline="no-display-inline" id="H231004DCDA8A4769AC17009601CCDF7F" section-type="subsequent-section"><enum>810.</enum><header display-inline="yes-display-inline">Safety of imported seafood</header><subsection commented="no" display-inline="no-display-inline" id="H8847CD9AF0194AC19EDE09842B1A3E57"><enum>(a)</enum><header display-inline="yes-display-inline">Requirement of equivalence</header><paragraph commented="no" display-inline="no-display-inline" id="H8851E0CB9FB7457B85212A535A4BFA4F"><enum>(1)</enum><header display-inline="yes-display-inline">Standards for exporting country</header><text display-inline="yes-display-inline">No seafood may be imported into the United States from a foreign country unless the Secretary certifies that the seafood imported from such country is maintained through a program using reliable analytical methods to ensure compliance with the United States standards for seafood manufacturing, processing, and holding.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8A61561484734C2EA8E7F83C8014D947"><enum>(2)</enum><header display-inline="yes-display-inline">Inspection of exporting facilities</header><text display-inline="yes-display-inline">In accordance with the procedures described under section 704, officers and employees duly designated by the Secretary shall conduct not less than 1 inspection on an annual basis of each foreign facility that exports seafood to the United States to ensure that each such foreign facility maintains a program using reliable analytical methods to ensure compliance with the United States standards for seafood manufacturing, processing, and holding. In addition to such annual inspection, such officers and employees shall conduct periodic follow-up inspections of such foreign facilities as determined necessary by the Secretary.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD19D9709FCD947719C9055ACD8679670"><enum>(b)</enum><header display-inline="yes-display-inline">Mandatory testing</header><paragraph commented="no" display-inline="no-display-inline" id="H6068452F2EF34A78A85AE682013AB7FB"><enum>(1)</enum><header display-inline="yes-display-inline">Minimum testing</header><text display-inline="yes-display-inline">The Secretary shall inspect and test not less than 20 percent of all seafood imported or offered for import into the United States each year.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4A16A8430D8E4869B14C8CFEAE698EF8"><enum>(2)</enum><header display-inline="yes-display-inline">New exporters</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, the first 15 shipments of seafood imported or offered for import into the United States from an exporter shall be inspected and tested by the Secretary.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6A92153542394C96B866692B24AF223A"><enum>(3)</enum><header display-inline="yes-display-inline">Failure to pass inspection</header><subparagraph commented="no" display-inline="no-display-inline" id="HD28EFAF60DA24E55B8A2B66399FE065F"><enum>(A)</enum><header display-inline="yes-display-inline">One failure</header><text display-inline="yes-display-inline">If a shipment of seafood imported or offered for import into the United States by an exporter fails to meet an inspection or test requirement under this Act, each subsequent shipment of seafood from such exporter shall be inspected and tested by the Secretary, until 15 consecutive shipments by such exporter pass that inspection and testing.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H53D737F62E1D4D0E9EF8AA8B3F2F280B"><enum>(B)</enum><header display-inline="yes-display-inline">Multiple failures</header><clause commented="no" display-inline="no-display-inline" id="H6AE92605A194485898D0EC41864771FF"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If more than 3 shipments of seafood imported or offered for import into the United States by an exporter fail to meet inspection or test requirements under this Act during any 1-year period, no shipments from such exporter may be imported or offered for import into the United States for the following 1-year period. Following such 1-year period when no shipments may be so imported or offered, such exporter shall not be permitted to offer imports to the United States unless the Secretary certifies that such exporter is maintaining a program using reliable analytical methods to ensure compliance with the United States standards for seafood manufacturing, processing, and holding.</text></clause><clause commented="no" display-inline="no-display-inline" id="H3AAE968B52E24FCDA3D93C5B77E24ED2"><enum>(ii)</enum><header display-inline="yes-display-inline">Determination by Secretary</header><text display-inline="yes-display-inline">Shipments of seafood imported or offered for import into the United States by an exporter that has been subject to a 1-year suspension period and a certification under clause (i) shall be inspected at a rate determined appropriate by the Secretary for a period of time as determined appropriate by the Secretary.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H609E358A53184FA7B7AFD3A34C513C90"><enum>(C)</enum><header display-inline="yes-display-inline">Pattern of failures</header><text display-inline="yes-display-inline">If the Secretary determines that shipments of seafood imported or offered for import into the United States from a particular country repeatedly fail to meet inspection or testing requirements under this Act, all shipments of seafood from such country shall be refused entry into the United States until the Secretary makes a certification described under subsection (a).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5C50A6708BB744E5B4953E7C540A02CB"><enum>(D)</enum><header display-inline="yes-display-inline">Procedures</header><text display-inline="yes-display-inline">The testing and inspections procedures used under this paragraph shall be carried out in accordance with section 801.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H19F03B808C1C48D88B153257EC9B526B"><enum>(4)</enum><header display-inline="yes-display-inline">Fees</header><text display-inline="yes-display-inline">The Secretary shall by regulation impose such fees on exporters in such amounts as may be necessary to provide, equip, and maintain an adequate and efficient inspection service to carry out this subsection. Receipts from such fees shall be covered into the Treasury and shall be available to the Secretary for expenditures incurred in carrying out the purposes of this subsection, including expenditures for salaries of additional inspectors when necessary to supplement the number of inspectors for whose salaries Congress has appropriated.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3B4516F74C094460A8B65AEB4EF41765"><enum>(c)</enum><header display-inline="yes-display-inline">Effect of shipments that fail To meet requirements</header><paragraph commented="no" display-inline="no-display-inline" id="HCAA203FA5B1047C7893692B3BEF0AA60"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding section 801, if a shipment of seafood imported or offered for import into the United States fails to meet safety standards established by the Secretary, such shipment shall be detained or destroyed unless the imported shipment meets criteria for re-export, as determined by the Secretary.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H820C7EBD6D454FDE86A7B8D4D44E6D6C"><enum>(2)</enum><header display-inline="yes-display-inline">Labeling</header><text display-inline="yes-display-inline">If a shipment of seafood has been refused admission under paragraph (1), other than such a shipment that is required to be destroyed, the Secretary shall require the owner or consignee of the shipment to affix to the container of the seafood a label that clearly and conspicuously bears the statement: <quote>UNITED STATES: REFUSED ENTRY</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H56BE5C29895B4D5389D5FA44D815AF9E"><enum>(3)</enum><header display-inline="yes-display-inline">Exporting to foreign country</header><text display-inline="yes-display-inline">If the appropriate authority of a foreign country notifies the Secretary, not later than 45 days after the shipment is rejected under paragraph (1), that the shipment will be accepted in that country, such shipment may be released to the importer for exportation to such foreign country.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDF69CA5D964F4BCE8214A911C3CC25C0"><enum>(4)</enum><header display-inline="yes-display-inline">Destruction of shipment</header><text display-inline="yes-display-inline">If the Secretary deems that a shipment rejected under paragraph (1), if it had been allowed entry, could have caused significant health risks if consumed by humans, the shipment shall be destroyed notwithstanding the receipt of a notification under paragraph (3).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB383A1684BDC4136826E6E12EC7A0479"><enum>(5)</enum><header display-inline="yes-display-inline">Notification to ports of entry</header><text display-inline="yes-display-inline">The Secretary shall notify ports of entry not later than 5 days after a shipment described in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H45C288B28D3A4BCBB2D3DDB660EE5595"><enum>(A)</enum><text display-inline="yes-display-inline">was determined to fail to meet safety standards established by the Secretary under such paragraph; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1D78F1D895314891AF70576DFEDCF579"><enum>(B)</enum><text display-inline="yes-display-inline">was detained or destroyed.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H39A208DE05234A5282AFB1DB4C85BE1D"><enum>(d)</enum><header display-inline="yes-display-inline">Ports of entry</header><paragraph commented="no" display-inline="no-display-inline" id="H799DF99D72AD41879E2644087CD2418B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this chapter, seafood may be imported or offered for import only at those ports of entry into the United States that have the personnel trained to conduct the applicable testing and inspection of seafood, as certified by the Secretary under paragraph (2).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5D744C3C10844F17BE02C3539C43EDBF"><enum>(2)</enum><header display-inline="yes-display-inline">Certification</header><text display-inline="yes-display-inline">The Secretary shall certify which ports of entry into the United States have the personnel trained to conduct the applicable testing and inspection of seafood.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2D81B7031F6345E7AF37B75824B90C5A"><enum>(3)</enum><header display-inline="yes-display-inline">Effect of certification requirement</header><text display-inline="yes-display-inline">If a port of entry—</text><subparagraph commented="no" display-inline="no-display-inline" id="H4D509658A0DE4FAF8630B40ADACB4A39"><enum>(A)</enum><text display-inline="yes-display-inline">was, on the day before the date of enactment of this section, a port of entry that accepted seafood imported or offered for import into the United States; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H54E741BD563949A9801C90C0B3E88CEC"><enum>(B)</enum><text display-inline="yes-display-inline">does not meet the requirements for certification under paragraph (2),</text></subparagraph><continuation-text commented="no" continuation-text-level="paragraph">the Secretary shall, as soon as practicable after the date of enactment of this section, provide proper personnel levels and training to enable such port to be certified under paragraph (2).</continuation-text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H40E8190B16B74E19A26C2C0A241FFA38"><enum>(e)</enum><header display-inline="yes-display-inline">Annual report</header><text display-inline="yes-display-inline">On an annual basis, the Secretary shall submit to Congress a report that describes the implementation of this section, including—</text><paragraph commented="no" display-inline="no-display-inline" id="H7E34BC9BEE0E46EB8CD246ABB19761A0"><enum>(1)</enum><text display-inline="yes-display-inline">summary data relating to inspections and testing under this section, and any noncompliance with the applicable provisions of this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H794619AD15E945E6AEB6139EC15D77D8"><enum>(2)</enum><text display-inline="yes-display-inline">recommendations of any improvements or other modifications to this section determined necessary by the Secretary.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="HFF275E82244B4665B5EC553678EBFF66"><enum>(b)</enum><header display-inline="yes-display-inline">Prohibited act; penalties</header><text display-inline="yes-display-inline">Chapter III of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331 et seq.</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H5D3D30E15A4740C194D7353F08E35F64"><enum>(1)</enum><text display-inline="yes-display-inline">in section 301, by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H4C679929723D4BF6827235CF19307A41" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="HC2ED22485AF4432DAAE09E9E14954DB3"><enum>(ggg)</enum><text display-inline="yes-display-inline">Knowingly making a false statement with respect to a test or inspection carried out under section 810, or knowingly misbranding any seafood imported under such section.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA7FC6A5ED1DF42F8B1A1F87B85469263"><enum>(2)</enum><text display-inline="yes-display-inline">in section 303, by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H12745190500344FB9D30F2BFF56F3E74" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="H8735850F027B4A0A97D39A93876A4AD9"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H84291ACC2CB2428194E88BA988E56EB0"><enum>(1)</enum><text display-inline="yes-display-inline">Any person who violates section 301(ggg) shall be subject to a civil penalty in an amount not to exceed $250,000 for each such violation, and not to exceed $1,100,000 for all such violations after the second conviction in any 3-year period.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD8E3B71F2439421B85856A38AE4B8395" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Paragraphs (5), (6), and (7) of subsection (f) shall apply to a civil penalty assessment under this subsection in the same manner as such paragraphs apply to a civil penalty assessment under subsection (f)(1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H2261F7DE5A874C54BB1BF403480F8FA0" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Cooperation with States to conduct inspections</header><text display-inline="no-display-inline">Chapter VIII of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/381">21 U.S.C. 381 et seq.</external-xref>), as amended by section 2, is further amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HE0A5F4C78FE04F35A2D6B7DC80C4BFCC" style="OLC"><section commented="no" display-inline="no-display-inline" id="HD1AA5BF0C06D4D70B82838148426AAC4" section-type="subsequent-section"><enum>810A.</enum><header display-inline="yes-display-inline">Cooperation with States to conduct seafood inspections</header><subsection commented="no" display-inline="no-display-inline" id="H883145D922C74D8BBF0BDAC43A4B2BE4"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment of cooperative inspection program</header><text display-inline="yes-display-inline">The Secretary may establish a program under which a State may conduct inspection, testing, and certification of seafood imported or offered for import into the United States.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H22292358EC8E40C283C250302B51DFF8"><enum>(b)</enum><header display-inline="yes-display-inline">Components of program</header><text display-inline="yes-display-inline">Under the program established under subsection (a)—</text><paragraph commented="no" display-inline="no-display-inline" id="HFAED9D6F6BC64700AB771354685CC1E4"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="H8D1808BEE078400A9E6DB49B5652D4B4"><enum>(A)</enum><text display-inline="yes-display-inline">provide training to State officials to enable such officials to carry out inspection, testing, and certification, in accordance with Federal requirements and safety standards, of seafood imported or offered for import into the United States; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H479A14C27F93416A8EB982D58844A31A"><enum>(B)</enum><text display-inline="yes-display-inline">certify such State officials as authorized agents of the Federal Government to carry out such inspections, testing, and certification; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB0557CAE92284CA59E123F881D64516A"><enum>(2)</enum><text display-inline="yes-display-inline">a State that receives a grant under subsection (c) shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="HC2FF8593AA974038BE0F6C9816FF84E7"><enum>(A)</enum><text display-inline="yes-display-inline">comply with all requirements of the Secretary with respect to the training and certification of State officials described under paragraph (1);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE171A7DD684E4873B6F9C87BD0D9D3E7"><enum>(B)</enum><text display-inline="yes-display-inline">inspect, test, and certify, in accordance with Federal requirements and safety standards, seafood imported or offered for import into the United States; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCAA3EDDEA3C744A5993FEC6DA24A33B3"><enum>(C)</enum><text display-inline="yes-display-inline">carry out any other activities as determined necessary by the Secretary to ensure the safety of seafood imported or offered for import into the United States.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFD3633F5C8FC41BDA4019C1D6C38F6B6"><enum>(c)</enum><header display-inline="yes-display-inline">Grants</header><paragraph commented="no" display-inline="no-display-inline" id="H81C9D53B4BF84BDBBDEE1D89DED0EB05"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall award grants to States to carry out the cooperative seafood inspection program established under subsection (a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8645B329E05B4928908F4BC17875B033"><enum>(2)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under paragraph (1), a State shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
