R. 10535</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20241219">December 19, 2024</action-date><action-desc><sponsor name-id="L000602">Ms. Lee of Pennsylvania</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide grants to State and local governments that enact right to counsel legislation for low-income tenants facing eviction, and for other purposes.</official-title></form><legis-body id="H3F26B6AFC8F94B8CB44325CE5422BE04" style="OLC"><section id="H974D0AE70D6F46B19EA2188384047382" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Eviction Right to Counsel Act of 2024</short-title></quote>.</text></section><section id="H857B976DB0FF47EBB586C2CFB312541D"><enum>2.</enum><header>Eviction right to counsel fund</header><subsection commented="no" display-inline="no-display-inline" id="H99B9B0C7C1AF48B59991D67B95EE5BD9"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="HC7F0DE369585402EBF70816C5A735DC9"><enum>(1)</enum><header>Covered individual</header><text>The term <term>covered individual</term> means a tenant with an income that is equal to or less than 200 percent of the Federal poverty line.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8474806746ED4B80A9C590EFB549119F"><enum>(2)</enum><header display-inline="yes-display-inline">Covered proceeding</header><text>The term <term>covered proceeding</term> means a civil action in a court or administrative forum for—</text><subparagraph commented="no" display-inline="no-display-inline" id="HA8C0C9066A19453D94902BDF88B4FF56"><enum>(A)</enum><text display-inline="yes-display-inline">eviction, or an equivalent ejectment, from the primary residence of the tenant; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD12558656AC745CEB8238D5D2C0768E6"><enum>(B)</enum><text>the termination of a housing subsidy.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H99FFD433336945F0808FE22EE28A406C"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a State government, a local government, or an Indian Tribal government. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7B242E82A3AF431C8FCBCCEC055609E2"><enum>(4)</enum><header display-inline="yes-display-inline">Fund</header><text>The term <term>Fund</term> means the Eviction Right to Counsel Fund established under subsection (b).</text></paragraph><paragraph id="HC6391CD5A1E24230915DAC796E2C5C0C"><enum>(5)</enum><header>Indian Tribal government</header><text>The term <term>Indian Tribal government</term> has the meaning given the term <term>Indian tribal government</term> in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8D390A977D404F638F6BA695B6B4481A"><enum>(6)</enum><header>Right to counsel legislation</header><text>The term <term>right to counsel legislation</term> means legislation that specifies that full legal representation shall be provided at no cost to all covered individuals in a covered proceeding. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4917E597B08B4C92AC211B38719EDAA4"><enum>(7)</enum><header display-inline="yes-display-inline">Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6A8EBA045F36422B8A66F6E8DF18356D"><enum>(8)</enum><header>State</header><text>The term <term>State</term> means each of the 50 States, the District of Columbia, and any territory or possession of the United States.</text></paragraph></subsection><subsection id="H3F88F7B93A6B4683A0555F49AA805E0F"><enum>(b)</enum><header>Establishment of fund</header><paragraph id="HB89E7420756042DF8949EC516BB31C6B"><enum>(1)</enum><header>In general</header><text>There is established in the Treasury of the United States a fund to be known as the <quote>Eviction Right to Counsel Fund</quote> consisting of the amounts authorized to be appropriated under paragraph (2).</text></paragraph><paragraph id="H826EB47804574A86967679B3B3D0756F"><enum>(2)</enum><header>Deposits to the fund</header><text>There are authorized to be appropriated to the Fund $100,000,000 for each of fiscal years 2025 through 2029 for the cost of making grants under subsection (c).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H62237B6F878F46D5A1906FB7B0566FDD"><enum>(c)</enum><header>Grants</header><paragraph commented="no" display-inline="no-display-inline" id="H90113F84F23F460CA9A2ECEF1BEE2FB8"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a program to provide grants to eligible entities that enact right to counsel legislation.</text></paragraph><paragraph id="HAE227BF33540491A944A91FD6FB79568"><enum>(2)</enum><header>Application</header><subparagraph id="HE1EC1510F367411981A5638392DA31FC"><enum>(A)</enum><header>In general</header><text>An eligible entity that desires a grant from the Secretary under this subsection shall submit to the Secretary an application at such time, in such manner, and accompanied by such information as the Secretary may reasonably require.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF2237F28B6EE4E2C80A0802522AD6607"><enum>(B)</enum><header>Requirement</header><text>An application submitted under subparagraph (A) shall include a certification that the eligible entity has enacted right to counsel legislation.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H532EB08C629443388CCAD80A8AA8953C"><enum>(3)</enum><header>Priority</header><text display-inline="yes-display-inline">In selecting applicants under this section, the Secretary shall prioritize funding for eligible entities that—</text><subparagraph commented="no" display-inline="no-display-inline" id="H3A3F73A8B07F4890B9F8AB29AFDBA5C0"><enum>(A)</enum><text display-inline="yes-display-inline">have enacted laws that—</text><clause commented="no" display-inline="no-display-inline" id="H0431E359809D4E34B04AB440A3DCC46A"><enum>(i)</enum><text display-inline="yes-display-inline">limit the causes for which a landlord can evict a tenant or refuse to renew the lease of a tenant when the tenant is not at fault or in violation of any law; </text></clause><clause commented="no" display-inline="no-display-inline" id="H91D76211B44B437B849D76168ABF81E4"><enum>(ii)</enum><text>require adequate written notice periods of not less than 30 days for tenants facing eviction; </text></clause><clause commented="no" display-inline="no-display-inline" id="H3FE007869698402EBB6A42EE686113F8"><enum>(iii)</enum><text display-inline="yes-display-inline">establish eviction diversion programs; or</text></clause><clause commented="no" display-inline="no-display-inline" id="HF9CEF233F6FA4343835F8C3CD3B8F18D"><enum>(iv)</enum><text>provide emergency rental assistance to tenants; or</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H19B54F4F59884BE48BA9D473858105B7"><enum>(B)</enum><text>will prioritize using grant funds for the training and recruitment of attorneys to provide representation for covered individuals in a covered proceeding.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF9D99607126A46AB83313D30461AEA24"><enum>(4)</enum><header>Use of funds</header><text>A recipient of a grant under this section may use the grant funds for the costs incurred by right to counsel legislation, including providing training resources for attorneys representing covered individuals in covered proceedings.</text></paragraph></subsection></section></legis-body></bill>
