<section id="H46578FD9BBA9472BB14D19C3F3987630" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Conservation Reinvestment Act</short-title></quote>.</text></section> <section id="HE8AE69BCAD2E42CCB1940D377E147D37"><enum>2.</enum><header>Additional assistance for producers</header> <subsection id="H73A15B8B4C4E4DD2AD0A4ABBA4BA5BC7"><enum>(a)</enum><header>Economic assistance payments</header><text display-inline="yes-display-inline">In addition to amounts otherwise available (including amounts made available on or after the date of the enactment of this Act during calendar year 2024 for the same purpose), of the funds of the Commodity Credit Corporation, the Secretary of Agriculture shall use $1,450,000,000 for fiscal year 2025 to increase the percentage of economic loss covered under the assistance prescribed in section 2102 of title I of Division B of the Further Continuing Appropriations and Disaster Relief Supplemental Appropriations Act, 2025.</text></subsection> 
<subsection id="HD92EE4EC3D6D4260A648C97F84921021" commented="no"><enum>(b)</enum><header>Additional assistance for producers of sales-Based crops and flat-Rate crops</header><text display-inline="yes-display-inline"></text> <paragraph id="H4E6A29B1BB7E41B0A2245216140AB4E5" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to amounts otherwise available, including under the Marketing Assistance for Specialty Crops program, of the funds of the Commodity Credit Corporation, the Secretary of Agriculture shall use—</text> 
<subparagraph id="H3C40D7E24BD7413C947C2A49B09C9DC2"><enum>(A)</enum><text>$1,000,000,000 for fiscal year 2025 to assist producers of sales-based crops that are not eligible for assistance with respect to such crops under subsection (a) or the assistance described in such subsection; and</text></subparagraph> <subparagraph id="H9FB4C0020CB54A45B60AC8C94CFF9B62"><enum>(B)</enum><text display-inline="yes-display-inline">$450,000,000 for fiscal year 2025 to provide $30-per-acre payments to producers of flat-rate crops that are not eligible for assistance with respect to such crops under subsection (a) or the assistance described in such subsection.</text></subparagraph></paragraph> 
<paragraph id="H7B245C1E18C34AF38912A42BA749FB1E" commented="no"><enum>(2)</enum><header>Terms and conditions</header> 
<subparagraph id="H432A50CCC80746A9A1EB9E8E7EEE4508" commented="no"><enum>(A)</enum><header>In general</header><text>Assistance provided under paragraph (1)—</text> <clause id="H9917E610BA3B473EBC564F94D3BA65D1"><enum>(i)</enum><text>in the case of sales-based crops, shall be subject to the same terms and conditions as any assistance provided under the Marketing Assistance for Specialty Crops program, except that such assistance shall be subject to the payment limitations specified in section 9.7(e) of title 7, Code of Federal Regulations (as in effect on the date of enactment of this Act); and</text></clause> 
<clause id="H04B0DBBCA2914B11BFF7320046A5D80F"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of flat-rate crops, shall be provided in a similar manner, as determined by the Secretary of Agriculture, as assistance with respect to such crops is provided under the Coronavirus Food Assistance Program under section 9.203 of title 7, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text></clause></subparagraph> <subparagraph id="HC5CDACD111DC4574BD2D62809BFA27EF" commented="no"><enum>(B)</enum><header>Expediting provision of assistance</header><text>The Secretary of Agriculture may use eligibility criteria for any existing program of the Department of Agriculture under which assistance is provided to producers of sales-based crops or flat-rate crops to expedite the provision of assistance under this subsection.</text></subparagraph></paragraph> 
<paragraph id="HCE5A426DC13A46879106D42D1DB906DC" commented="no"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text> <subparagraph id="H1ED7A5FFF3EE494BBB030D91B855B110"><enum>(A)</enum><text>The term <term>Marketing Assistance for Specialty Crops program</term> refers to the program established by the Secretary of Agriculture for which a notice of funds availability was published in the Federal Register on December 10, 2024 (89 Fed. Reg. 99212).</text></subparagraph> 
<subparagraph id="HB6521E8D9BEA454AAF824BC591692CB6"><enum>(B)</enum><text display-inline="yes-display-inline">The terms <term>sales-based crops</term> and <term>flat-rate</term> crops have the meanings given such terms in section 9.201 of title 7, Code of Federal Regulations (as in effect on the date of enactment of this Act). </text></subparagraph></paragraph></subsection></section> <section id="HC1C9EAE857DC4354B86A83FE1533BB4C"><enum>3.</enum><header>Conservation funding</header> <subsection id="HE1F89D522DFF4A5380858FA1AD505217"><enum>(a)</enum><header>Annual funding</header><text>Section 1241(a) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3841">16 U.S.C. 3841(a)</external-xref>) is amended—</text>

<clause id="H6CEA6B8580CE4E0FA48FF2F594920E2A"><enum>(vii)</enum><text>$1,375,000,000 for fiscal year 2031.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> </subsection> <subsection id="HCD35F7B874964EE8B20F811F9BDCDF71"><enum>(b)</enum><header>Mitigation agricultural conservation practices</header><text>Section 1241 of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3841">16 U.S.C. 3841</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H9EB8741E72BF4F84AF9839FA20ED7369"><enum>(k)</enum><header>Mitigation agricultural conservation practices</header> 
<paragraph id="H37CD4DC1D7A04220818C34FC63B7D024"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>mitigation agricultural conservation practice</term> means a practice or enhancement that directly improves soil carbon, reduces nitrogen losses, or reduces, captures, avoids, or sequesters carbon dioxide, methane, or nitrous oxide emissions, associated with agricultural production.</text></paragraph> <paragraph id="H570960DBE197428CB4E94046A22622EE"><enum>(2)</enum><header>Use of funds</header><text>Of the funds made available under subsection (a)(3)(A) for fiscal year 2025 and each fiscal year thereafter, the Secretary shall use not less than 30 percent of such funds to carry out mitigation agricultural conservation practices.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE0DFAAA5F1114665A1AA9E70BDC5D695"><enum>(c)</enum><header>Rcpp funding</header><text>Section 1271D(a) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3871d">16 U.S.C. 3871d(a)</external-xref>) is amended to read as follows:</text> <quoted-block style="OLC" id="H5A4198F8BB6344BC9C93686EF5F1DD4F"> <subsection id="H9FBF4BE47FE24CE3929CC36D7015A37A"><enum>(a)</enum><header>Availability of funding</header><text>Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out the program, to the maximum extent practicable—</text>

<paragraph id="HCA5792998E7F4E06A830455D29357EE9"><enum>(3)</enum><text>$450,000,000 for fiscal year 2027;</text></paragraph> <paragraph id="H70A7705AB3B544EFBEFC1EA48E44E7EF"><enum>(4)</enum><text>$450,000,000 for fiscal year 2028;</text></paragraph> 
<paragraph id="H59B550E0D16045A7AD3729A732ED4B1C"><enum>(5)</enum><text>$450,000,000 for fiscal year 2029;</text></paragraph> <paragraph id="H935DB63322B4452284A1CEE004015EC7"><enum>(6)</enum><text>$450,000,000 for fiscal year 2030; and</text></paragraph> 
<paragraph id="HA7C5BF22440A4EFC9F445CC96217561E"><enum>(7)</enum><text>$450,000,000 for fiscal year 2031.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HE9A2682BE1CB489DB8FB9AA13D033CC1"><enum>(d)</enum><header>Watershed Protection and Flood Prevention Act</header><text>Section 15 of the Watershed Protection and Flood Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1012a">16 U.S.C. 1012a</external-xref>) is amended—</text> 
<paragraph id="H64CEBA9FB7AB4A7CB20354BBDC26E1DD"><enum>(1)</enum><text>by striking <quote>$50,000,000 for fiscal year 2019</quote> and inserting <quote>$150,000,000 for fiscal year 2025</quote>; and</text></paragraph> <paragraph id="H3FB1B5E7A86244938E58C41E1B0962CC"><enum>(2)</enum><text>by inserting before the period at the end <quote>, to remain available until expended</quote>.</text></paragraph></subsection> 
<subsection id="H68E18B102ECE458BBD2D70EAE51605C7"><enum>(e)</enum><header>Conservation rescissions</header><text>The unobligated balances of amounts appropriated by section 21001(a) of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> are rescinded.</text> </subsection></section> <section id="HE8EB63F0FB0F4A0897279A91DFEE91B3" commented="no"><enum>4.</enum><header>Mandatory reporting of dairy product processing costs</header><text display-inline="no-display-inline">Section 273 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1637b">7 U.S.C. 1637b</external-xref>) is amended—</text> 
<paragraph id="H97EDDAA503D948ECBA3CDC1B80110BD9" commented="no"><enum>(1)</enum><text>in subsection (b)—</text> <subparagraph id="HCF82A512E79B417CAEB5132E65655E54" commented="no"><enum>(A)</enum><text>in paragraph (1)—</text> 
<clause id="H9DCD6BC5F42F4BE7BBED81B86BB44926" commented="no"><enum>(i)</enum><text>in subparagraph (A)(ii), by striking <quote>and</quote> at the end;</text></clause> <clause id="HF264BAD6151144A3B85C76D2A080DDDA" commented="no"><enum>(ii)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause>

<subparagraph id="H1B91837320A74E52A7A8863F6BEA192E" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this paragraph, and every 2 years thereafter, the Secretary shall publish a report containing the information obtained under subparagraph (C) of subsection (b)(1).</text></subparagraph> <subparagraph id="H1869BA0F33064AFF9717FD62FF9272CB" commented="no"><enum>(B)</enum><header>Funding</header><text display-inline="yes-display-inline">For fiscal year 2025, of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this paragraph $10,000,000, to remain available until expended.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section> 
<section id="H1A4CA21F621E48BB8AFDC7B4AC874972"><enum>5.</enum><header>Contingency fund for American producers</header> 
<subsection id="H595075B505434F07BE79B82E22539A32"><enum>(a)</enum><header>Relief provided</header><text>During fiscal year 2028, the Secretary of Agriculture shall make payments to producers in order to provide financial assistance, as determined by the Secretary of Agriculture, using terms and conditions the Secretary of Agriculture determines appropriate.</text></subsection> <subsection id="HD46A2F1D89F74DD081297EF911FCFB27"><enum>(b)</enum><header>Funding</header><text>For fiscal year 2028, of the funds of the Commodity Credit Corporation, the Secretary of Agriculture shall use to carry out this section $7,000,000,000, to remain available until expended.</text></subsection></section> 
<section id="HB7873DCA02E8417B8F3A49D81D6039BA"><enum>6.</enum><header>Organic or non-organic whole milk permissible</header><text display-inline="no-display-inline">Section 9(a)(2) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(a)(2)</external-xref>) is amended—</text> <paragraph id="HB57AEFC8BCD24E099C0594E1E31DE649"><enum>(1)</enum><text>by amending subparagraph (A) to read as follows:</text> 
<quoted-block style="OLC" id="H36D8E8D1B397452ABBA2471A3BDE303A"> 
<subparagraph id="HC3A91BDEE00F42D3AA53067BC5CB7C81"><enum>(A)</enum><header>In general</header><text>Lunches served by schools participating in the school lunch program under this Act—</text> <clause id="HECA680D93F5F4E56A6A5A9D9F9DA5C33"><enum>(i)</enum><text>shall offer students a variety of fluid milk;</text></clause> 
<clause id="H4902665A95064919BDE14F8899F7D9A7"><enum>(ii)</enum><text>may offer students flavored and unflavored organic or non-organic whole, reduced-fat, low-fat and fat-free fluid milk and lactose-free fluid milk; and</text></clause> <clause id="H2B823622927646ECBDB8E4B3903056A3"><enum>(iii)</enum><text>shall provide a substitute for fluid milk for students whose disability restricts their diet, on receipt of a written statement from a licensed physician that identifies the disability that restricts the student’s diet and that specifies the substitute for fluid milk.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H4441B54448B64AEC9061B9C02C7A5365"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H811351ED645A4D8592F96F994D9E09E5"> <subparagraph id="HCB995222583C4B5CA9A789B35C6597FB"><enum>(D)</enum><header>Saturated fat</header><text>Milk fat included in any fluid milk provided under subparagraph (A) shall not be considered saturated fat for purposes of measuring compliance with the allowable average saturated fat content of a meal under section 210.10 of title 7, Code of Federal Regulations (or successor regulations).</text></subparagraph> 
<subparagraph id="H6E546B00F750433E86F5D55D31646ABD"><enum>(E)</enum><header>Prohibition on certain purchases</header><text>The Secretary shall prohibit schools participating in the school lunch program under this Act from purchasing or offering milk produced by China state-owned enterprises.</text></subparagraph> <subparagraph id="H3DA4D580EA314F1EAE48CD76E8CA07BB"><enum>(F)</enum><header>Limitation on authority</header><text>The Secretary may not prohibit any school participating in the school lunch program under this Act from offering students the milk described in subparagraph (A)(ii).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HA5B8075A79E14D7A89B0582B3FAD9E89"><enum>7.</enum><header>Energy funding</header> 
<subsection id="H34FACA31ADF341D3A4CEFBB4BE8EC7EA"><enum>(a)</enum><header>Annual funding</header><text>Section 9007(f) of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8107">7 U.S.C. 8107(f)</external-xref>) is amended—</text> <paragraph id="HFD851DB371C24B08BAC3F4075B208D89"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="H68CECDC5893B4639985FFACE2A9C0F1C"><enum>(A)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="H16CADA20E21A423FA42F70320A484B69"><enum>(B)</enum><text>in subparagraph (E), by striking <quote>fiscal year 2014 and each fiscal year thereafter.</quote> and inserting <quote>each of fiscal years 2014 through 2024;</quote>; and</text></subparagraph> 
<subparagraph id="H79190AA749C04485821E1ED12033AE8B"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block id="H00AA416F307D4840ABC09704035B5DC0" style="OLC"> <subparagraph id="HF8880C7D08254379B7F3EBA44DD96B84"><enum>(F)</enum><text>$100,000,000 for each of fiscal years 2025 through 2028;</text></subparagraph> 
<subparagraph id="HDE9EE063BB924F70B7B7C52D5196A03A"><enum>(G)</enum><text>$105,000,000 for each of fiscal years 2029 and 2030; and</text></subparagraph> <subparagraph id="HA1231EFBDF3C4EEFB5F593C9A436E791"><enum>(H)</enum><text>$110,000,000 for fiscal year 2031.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H1E4A637D886D4B0F8999B625F4D5EBCB"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block id="H328514BF1F8048B0855DF64A1723971A" style="OLC"> <paragraph id="HA87855D0C6934183BF9E512722850E45"><enum>(4)</enum><header>Reservation of funds</header><text>Of the funds made available to carry out this section for a fiscal year, the Secretary may reserve—</text> 
<subparagraph id="H3F0E3D33FD7940E4B895DCA584FFEEA2"><enum>(A)</enum><text>not more than 10 percent for awarding grants under subsection (c) that support the adoption of underutilized but proven commercial technologies; and</text></subparagraph> <subparagraph id="H041460F9B0314553B3190EEEBC635105"><enum>(B)</enum><text>not more than 5 percent for administrative costs.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HFEC20351295D45849B05941145D260F3"><enum>(b)</enum><header>Rescission</header> 
<paragraph id="H540C0ED148314AC199ED9E3B22159103"><enum>(1)</enum><header>In general</header><text>Of the unobligated balances of amounts made available by section 22002 of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (136 Stat. 2019), $489,447,000 is rescinded.</text></paragraph> <paragraph id="H1B717B44EBB046859AA6F265E0759885"><enum>(2)</enum><header>Fiscal years 2026 and 2027</header><text>Section 22002 of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (136 Stat. 2019) is amended in each of subsections (a)(2) and (b)(2) by striking <quote>2027</quote> and inserting <quote>2025</quote>.</text></paragraph></subsection></section>
