which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to provide for certain rules for housing or transportation based on gender and to provide for a limitation on gender-related medical treatment.</official-title></form><legis-body id="H95AD5A79C01C4620B65E49D8C3FD51F7" style="OLC"><section id="H7502CE99450542FEB8E7978C21C35761" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prison Rape Prevention Act of 2024</short-title></quote>.</text></section><section id="H033B31C262B8478ABE847CDA71CDB5BE"><enum>2.</enum><header>Rules for housing or transportation based on gender; limitation on gender-affirming care</header><text display-inline="no-display-inline">Section 3621 of title 18, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="HD4478F4217824956A1EB53FEC68F06E5" display-inline="no-display-inline"><subsection id="HDB7F461122E34934919A8BD920DBBACE"><enum>(j)</enum><header>Rules for housing or transportation based on gender; limitation on gender-Affirming care</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Bureau of Prisons—</text><paragraph id="H6083FD450EE7496D9852915A374250D7"><enum>(1)</enum><text>shall ensure that a prisoner is placed, during that prisoner’s term of imprisonment, only among prisoners of the same biological sex as the prisoner;</text></paragraph><paragraph id="HD6C8F5C748A74AA2955543A0A460709F"><enum>(2)</enum><text>shall ensure that a prisoner, when transported in the company of other prisoners, is only transported among prisoners of the same biological sex as the prisoner; and</text></paragraph><paragraph id="HF10CA3603C6E4863BB98837482983346"><enum>(3)</enum><text display-inline="yes-display-inline">may not furnish or pay for any gender-related medical treatment. </text></paragraph></subsection><subsection id="H738A2DD0789E4E75BC0B9AA030FEC887"><enum>(k)</enum><header>Definitions</header><text>For purposes of subsection (j):</text><paragraph id="H1917B5430A2946C98DD510A696352A52"><enum>(1)</enum><header>Biological sex</header><text display-inline="yes-display-inline">The term <term>biological sex</term> means the biological determination as to whether an individual is male or female.</text></paragraph><paragraph id="HE2AE4A5388DA4544A7BC99097B0290D2"><enum>(2)</enum><header>Female</header><text>The term <term>female</term> means an individual who naturally has, had, will have, or would have, but for a developmental or genetic anomaly or historical accident, the reproductive system that at some point produces, transports, and utilizes eggs for fertilization. </text></paragraph><paragraph id="HB9A9DCCF94E3414587C3F2642CE40E28"><enum>(3)</enum><header>Male</header><text>The term <term>male</term> means an individual who naturally has, had, will have, or would have, but for a developmental or genetic anomaly or historical accident, the reproductive system that at some point produces, transports, and utilizes sperm for fertilization.</text></paragraph><paragraph id="HD5B36EC8D71446D9B434D7376313323A"><enum>(4)</enum><header>Gender</header><text>The term <term>gender</term>—</text><subparagraph id="H9895ED5C1694430290E2184653D75813"><enum>(A)</enum><text>means—</text><clause id="HBFE75A44B5E64C8F99A6EF541D501811"><enum>(i)</enum><text>males, females, or the natural differences between males and females, unless such term is otherwise specified or used alone (rather than with or as an adjective modifying other words); and</text></clause><clause id="H8D33A6127E6146159A00228C1EBA94AB"><enum>(ii)</enum><text>a synonym for sex; and</text></clause></subparagraph><subparagraph id="H0818A3B71E12441C96AE3C2B38D29218"><enum>(B)</enum><text>does not mean a synonym for terms or ideas such as gender identity, experienced gender, gender expression, or gender roles</text></subparagraph></paragraph><paragraph id="HC6AE3CE4B01C45E5BCE2CA993AC3E920"><enum>(5)</enum><header>Gender-related medical treatment</header><text>The term <term>gender-related medical treatment</term>—</text><subparagraph id="HB20E97BE892048AAB8DCF1906541E266"><enum>(A)</enum><text>means—</text><clause id="H2AEA44CDB8ED40C4A1CB91341443342D"><enum>(i)</enum><text>with respect to a female individual, medical treatments provided for purposes of addressing the perception of such individual that the gender or sex of such individual is not female, including—</text><subclause id="HB08AC5F8B94D49F2A621460B23B5B5C5"><enum>(I)</enum><text>surgical procedures, including—</text><item id="HCB2A807A044E4680ACE6FF859F999547"><enum>(aa)</enum><text>vaginectomy;</text></item><item id="H61A568D97A5347A4A28E8FCEBF2EDF25"><enum>(bb)</enum><text>hysterectomy;</text></item><item id="H500BF977574848CE9E7AF638056765BA"><enum>(cc)</enum><text>oophorectomy;</text></item><item id="H06D5FEA7C8AB459FB5E361A2F79AEDD0"><enum>(dd)</enum><text>reconstruction of the urethra;</text></item><item id="H8F085889258D49C084B1041C8D117A3A"><enum>(ee)</enum><text>metoidioplasty;</text></item><item id="H781719D7C21949D9ACBBE8E9A0613AA4"><enum>(ff)</enum><text>phalloplasty;</text></item><item id="H5F2EA25E9FD44BC4B664A29BD5333039"><enum>(gg)</enum><text>salpingo-oophorectomy;</text></item><item id="H20B4AA7DF196424AB1353EC4F16C3154"><enum>(hh)</enum><text>scrotoplasty;</text></item><item id="H605B773471DE43548D5B59847009A80C"><enum>(ii)</enum><text>implantation of erection or testicular protheses;</text></item><item id="HFF0EDD7164184930871719B2B7ADC929"><enum>(jj)</enum><text>subcutaneous mastectomy;</text></item><item id="HFE7DD4D122D24A5DB079C792581B6EE0"><enum>(kk)</enum><text>vocal cord surgery;</text></item><item id="H512A7F3A55334BA4A4C5366B3054E6C4"><enum>(ll)</enum><text>pectoral implants; and</text></item><item id="HFF69DB2368E34D199C0ACEA3F11B6E1B"><enum>(mm)</enum><text>penile transplantation;</text></item></subclause><subclause id="H7E6D2D3BF51342FA9B2F915242A00067"><enum>(II)</enum><text>exogenous doses of testosterone or other androgens;</text></subclause><subclause id="H282BE337195644F28BEE00BAEEF7D812"><enum>(III)</enum><text>puberty blockers, including—</text><item id="HEE3BFBEC901A44D994E0CBD2CBFC05D9"><enum>(aa)</enum><text>GnRH agonists; and</text></item><item id="H39CBABEE117D4B7383A697DB17BC43EC"><enum>(bb)</enum><text>synthetic drugs that suppress the production of estrogen and progesterone or delay or suppress pubertal development in female individuals; and</text></item></subclause><subclause id="HA520F2B880104F56865A22158E34FD29"><enum>(IV)</enum><text display-inline="yes-display-inline">such other medical treatment, identified by the Director of the Federal Bureau of Prisons, that may be provided for purposes of addressing the perception of such individual that the gender or sex of such individual is not female; and</text></subclause></clause><clause id="H9A332ABB6CD74BB686CD2C3B6762BE3C"><enum>(ii)</enum><text>with respect to a male individual, medical treatments provided for purposes of addressing the perception of such individual that the gender or sex of such individual is not male, including—</text><subclause id="H9615AE39FF1B497CB9758849AA69B260"><enum>(I)</enum><text>surgical procedures, including—</text><item id="H766771FDAECB4A4BAFFFB3931746D970"><enum>(aa)</enum><text>penectomy;</text></item><item id="HEE1043B87FEB43AAA8A811E3FC6C21AE"><enum>(bb)</enum><text>orchiectomy;</text></item><item id="HE259CDFA1ACE4A0C8C5C8E535594650B"><enum>(cc)</enum><text>vaginoplasty;</text></item><item id="HC0EDC055C76C4211BB52545FAE8B6649"><enum>(dd)</enum><text>clitoroplasty;</text></item><item id="H9036197EC0BD42849D2E33E92DEE9835"><enum>(ee)</enum><text>vulvoplasty;</text></item><item id="H1BA8550352B8423F8F3EEE23D3CD595F"><enum>(ff)</enum><text>augmentation mammoplasty;</text></item><item id="H2CD18E2932624D46AF9C57F7458430EE"><enum>(gg)</enum><text>facial feminization surgery;</text></item><item id="H7B935525C3174920971B1BE575FA35CF"><enum>(hh)</enum><text>vocal cord surgery;</text></item><item id="HC512E63F832B426DA33F94E6A6869198"><enum>(ii)</enum><text>chondrolaryngoplasty;</text></item><item id="HFD8E228D351141C8AD8D5B63102B6786"><enum>(jj)</enum><text>gluteal augmentation; and</text></item><item id="H6A489C4849E24FE48F25D73BE4DDD61B"><enum>(kk)</enum><text>uterine transplantation;</text></item></subclause><subclause id="H622C3B0B8FD244A1B9928CABB6645606"><enum>(II)</enum><text>exogenous doses of estrogen;</text></subclause><subclause id="H44B0E59B9A26498486619AA12609C83E"><enum>(III)</enum><text>puberty blockers, including—</text><item id="HD7365751DCDF4B7DA8707B19A2AA31A2"><enum>(aa)</enum><text>GnRH agonists; and</text></item><item id="H49E6E9FC84904679B64BBC4477F7C4B0"><enum>(bb)</enum><text>synthetic drugs that suppress the production of testosterone or delay or suppress pubertal development in male individuals; and</text></item></subclause><subclause id="HA225545C14BA460EAA845F9ACB13A79F"><enum>(IV)</enum><text display-inline="yes-display-inline">such other medical treatment, identified by the Director of the Federal Bureau of Prisons, that may be provided for purposes of addressing the perception of such individual that the gender or sex of such individual is not male; and</text></subclause></clause></subparagraph><subparagraph id="HF80CBF07608C46CA9FDD9D141ABFC7CB"><enum>(B)</enum><text display-inline="yes-display-inline">does not include any medical treament performed on an individual for the purposes of treating—</text><clause id="H9DDC7591FA65423B91996612ECAE49C2"><enum>(i)</enum><text>a disorder of sex development, diagnosed by a physician after such physician has determined through genetic or biochemical testing that such individual does not have normal sex chromosome structure, sex steroid hormone production, or sex steroid hormone action;</text></clause><clause id="HF23E0CFC2C4A4B7C864AD8DCB457BBFB"><enum>(ii)</enum><text>irresolvably ambiguous biological sex characteristics of such individual, including the presence of— </text><subclause id="HB143CC544B274D4FA96796CFD4A2B06E"><enum>(I)</enum><text>46 XX chromosomes with virilization; </text></subclause><subclause id="H2E170B00B7B34A4A912E4271108CAC67"><enum>(II)</enum><text>46 XY chromosomes with undervirilization; or </text></subclause><subclause id="H124DF6D54D1345E5879DA4533A7814E9"><enum>(III)</enum><text>both ovarian and testicular tissue; or</text></subclause></clause><clause id="H785466176D4D4B1A9A50D79A47F31BF5"><enum>(iii)</enum><text>an infection, injury, disease, or disorder caused or exacerbated by gender-related medical treatment that was furnished to an individual.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
