which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the Secretary of Defense from entering into information technology contracts with entities that provide certain services to China, and for other purposes.</official-title></form><legis-body id="HA37F8E3C166342A9BF56400D2E46E8D4" style="OLC"><section id="HDEFF7FC9DAB94EC6B57AD6E82A0CAE09" section-type="section-one"><enum>1.</enum><header>Prohibition on information technology contracts with entities that provide certain services to China</header><subsection id="HF406AD4D3DF64B779DAF6FDE6191D97B"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The Secretary of Defense may not enter into, renew, or extend an information technology contract with an entity, including a parent, subsidiary, affiliate, or subcontractor (at any tier) of such an entity, that—</text><paragraph id="H56054133F8E84CD9AFCDBDC856C4DC44"><enum>(1)</enum><text display-inline="yes-display-inline">owns, operates, substantially funds, or has a material interest in a facility or research organization located on the mainland of the People’s Republic of China if such facility or research organization has a primary purpose, as determined by the Secretary, of researching or developing artificial intelligence;</text></paragraph><paragraph id="H16441CFB6F314ED689B33FC0D0510F6C"><enum>(2)</enum><text display-inline="yes-display-inline">has enabled a covered Chinese entity to access a source code of software to be used by or on behalf of the United States Government, if such contract is for such software;</text></paragraph><paragraph id="H76F283B9821B4E2FAD471B0AAF579846"><enum>(3)</enum><text>provides software with a military or law enforcement application or a dual-use application to a covered Chinese entity; or</text></paragraph><paragraph id="HEC59A608124949EF8C5CF5B8564009D1"><enum>(4)</enum><text display-inline="yes-display-inline">operates a data center (as such term is defined in section 453 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17112">42 U.S.C. 17112</external-xref>)) in the mainland of China, including a data center operated—</text><subparagraph id="H5F192974295C402CB9786A9802076DB3"><enum>(A)</enum><text display-inline="yes-display-inline">by a parent, subsidiary, or affiliate of an entity seeking to enter into, renew, or extend a contract with the Secretary; or</text></subparagraph><subparagraph id="H05C09EAF89C54045B1710F75AD3BF471"><enum>(B)</enum><text display-inline="yes-display-inline">on behalf of such an entity by a covered Chinese entity.</text></subparagraph></paragraph></subsection><subsection id="H6C253737A7EC486D826F1521583FAD5F"><enum>(b)</enum><header>Waiver authority</header><text>The Secretary may waive the prohibition under this section for a contract if the Secretary determines such a waiver is necessary to advance the national security interests of the United States.</text></subsection><subsection id="H411D589354C74DF8B228CCBDDAFDAC62"><enum>(c)</enum><header>Applicability</header><text>This section shall apply only with respect to contracts entered into, renewed, or extended within three years after the date of the enactment of this Act.</text></subsection><subsection id="H1D885C16FAD346AA8A019C6A0A8A8418"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H1A10669678114F5EA3E0B469B147C24B"><enum>(1)</enum><text>The term <term>covered Chinese entity</term> means an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, determines to be—</text><subparagraph id="HBC62AB5BD6F24F49A2B4481A9060145B"><enum>(A)</enum><text>owned, controlled, directed, or subcontracted by, affiliated with, or otherwise connected to, the government of China, or a parent, subsidiary, or affiliate of such an entity; or</text></subparagraph><subparagraph id="HC33CDEC14B0E40F2B58AE5806A82AE1A"><enum>(B)</enum><text display-inline="yes-display-inline">a subcontractor (at any tier) of the government of China.</text></subparagraph></paragraph><paragraph id="H0666081848954881BCB3D4B0EC60D205"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>material interest</term> means a financial or other interest that the Secretary determines is significant enough to influence a decision or action of an individual.</text></paragraph></subsection></section></legis-body></bill>
