Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Water Pollution Control Act to establish an Ohio River Basin Restoration Program, and for other purposes.</official-title></form><legis-body id="H1162B752B80C4155AF550475952BC321" style="OLC"><section id="H5C8B68D5DB354AFF8303C820977A448C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ohio River Basin Restoration Program Act</short-title></quote>.</text></section><section id="HEE52EF39927044F0A880EFB4AE6C8634"><enum>2.</enum><header>Ohio River Basin Restoration Program</header><text display-inline="no-display-inline">Title I of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HA5E00C80D53E4073B93F9264E49F3642" display-inline="no-display-inline"><section id="HFEA816826B2D4C60A161DDADE7DB3182"><enum>127.</enum><header>Ohio River</header><subsection id="H9C75283D18D64BEDB810AE0F60B46CE4"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H28DF1A9E5EA34C15ABEBADCDA7D27311"><enum>(1)</enum><header>Agency</header><text>The term <term>Agency</term> means the Environmental Protection Agency.</text></paragraph><paragraph id="H6B2B45CB99CA41DBAC07DE137EF9A6ED" commented="no"><enum>(2)</enum><header>Ohio River Basin</header><text>The term <term>Ohio River Basin</term> means the portions of each Ohio River State that contain the watershed of the Ohio River.</text></paragraph><paragraph id="H93953280835A4E8597E86BA8D1DAEB3E" commented="no"><enum>(3)</enum><header>Ohio River Basin Restoration Program</header><text display-inline="yes-display-inline">The term <term>Ohio River Basin Restoration Program</term> means the Ohio River Basin Restoration Program established by this section.</text></paragraph><paragraph id="H9F49437F175E4140BC3F74BC9C26A8AF"><enum>(4)</enum><header>Ohio River State</header><text>The term <term>Ohio River State</term> means Ohio, Kentucky, West Virginia, Pennsylvania, Indiana, Illinois, New York, Virginia, Maryland, North Carolina, Georgia, Alabama, Tennessee, or Mississippi.</text></paragraph><paragraph id="H245A4D4268F843E1A84649BAE93C1CB7"><enum>(5)</enum><header>Program Office</header><text>The term <term>Program Office</term> means the Ohio River National Program Office established under this section.</text></paragraph><paragraph id="HBC49F3C8B0A54AD2B2055DD18FFFAA8E"><enum>(6)</enum><header>Program Director</header><text>The term <term>Program Director</term> means the Director of the Program Office.</text></paragraph><paragraph id="H15E8632ED46C4A91AB6DE6E83FED9704"><enum>(7)</enum><header>Tribal Government</header><text>The term <term>Tribal Government</term> means the recognized governing body of any Indian tribe individually identified (including parenthetically) in the list published under section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph></subsection><subsection id="H0D15C30369D445D094F246091D18B449"><enum>(b)</enum><header>Ohio river national program office</header><paragraph id="H56615BA4BFA74081898ECC26540ABDDB"><enum>(1)</enum><header>In general</header><text>The Administrator shall establish an Ohio River National Program Office within the Agency to carry out the Ohio River Basin Restoration Program.</text></paragraph><paragraph id="HE8A3FFEA19A3496F8F0037372F4761FC"><enum>(2)</enum><header>Program Director</header><text>The Program Office shall be headed by a Program Director, appointed by the Administrator, who, by reason of management experience and technical expertise relating to the Ohio River, is highly qualified to direct the development of programs and plans on a variety of issues related to restoration of the Ohio River Basin.</text></paragraph><paragraph id="H353CA90AE57A4A7DB20316F8E713B5B0"><enum>(3)</enum><header>Functions</header><text>The Program Director shall—</text><subparagraph id="H2BD3CFD76FE14E2A9D5E9DEC1D8BADAA"><enum>(A)</enum><text>coordinate actions of the Agency that seek to protect and restore the Ohio River Basin;</text></subparagraph><subparagraph id="H5EB4B508A0394C659D886E3E4EA9F20C"><enum>(B)</enum><text>develop, implement, and update the Ohio River Basin Restoration Program and action plan required by this section, in coordination with relevant Federal agencies and non-Federal entities;</text></subparagraph><subparagraph id="H639387C5F0344EF3A09CF2A9D51BD56B"><enum>(C)</enum><text display-inline="yes-display-inline">document information and updates related to the development and implementation of the Ohio River Basin Restoration Program and action plan required by this section, and make such information and updates available to the public, including on a public website;</text></subparagraph><subparagraph id="H4C415E7943994130B6FCF74FB9BC49D1"><enum>(D)</enum><text>facilitate, in cooperation with the Bureau of Indian Affairs, engagement and consultation with Tribal Governments and Tribal organizations to ensure Tribal needs and priorities are solicited early and throughout the development of the actionable goals and action plan required by this section; and</text></subparagraph><subparagraph id="H1990E1908A8E4C7B81B2FB8E6C0155AB"><enum>(E)</enum><text>submit to Congress, and make available on a public website, the action plan and updates required by this section, and an annual report describing—</text><clause id="H5248966B1662410BACEE67881AAECA0A"><enum>(i)</enum><text>progress made in implementing the Ohio River Basin Restoration Program;</text></clause><clause id="H2AF811CF66DF4086B42EBC6506E2F3EB"><enum>(ii)</enum><text>coordination of the Ohio River Basin Restoration Program with other Federal, State, Tribal, and local programs;</text></clause><clause id="H75729DD4EB784099BF861E61CF769577"><enum>(iii)</enum><text>any funds transferred to relevant Federal agencies under this section;</text></clause><clause id="H200B24CB17D14BED853EE75A0B32F28F"><enum>(iv)</enum><text>any grants awarded under this section;</text></clause><clause id="H7C45AAD875B44A8CB424C2BFFF509CA4"><enum>(v)</enum><text>specific projects and activities carried out pursuant to this section; and</text></clause><clause id="HB7905E2BDBF44EF289D79C85BCF0979E"><enum>(vi)</enum><text>agreements with relevant Federal agencies and non-Federal entities.</text></clause></subparagraph></paragraph><paragraph id="H101700A76D6A46369DC5CCE0522A7534"><enum>(4)</enum><header>Agreements</header><text>In carrying out paragraph (3), the Program Director may enter into agreements, as applicable, with relevant Federal agencies and non-Federal entities.</text></paragraph></subsection><subsection id="HEABF4DD5E3704E6F83CF0DDCCB4BCAD0"><enum>(c)</enum><header>Ohio river basin restoration program</header><paragraph id="HFBA2891C5BFE4C38851A7C5F8C2F242A"><enum>(1)</enum><header>Establishment</header><text>There is established within the Agency the Ohio River Basin Restoration Program to advance systemic, large-scale restoration of the Ohio River Basin.</text></paragraph><paragraph id="HA77AA5D1A4774A50AB7521034738437E"><enum>(2)</enum><header>Activities</header><text>Any project or activity carried out pursuant to the Ohio River Basin Restoration Program shall be designed to address at least 1 of the following:</text><subparagraph id="H160FEF03839B48A88B9A1A11855BD28A"><enum>(A)</enum><text display-inline="yes-display-inline">Improvement of water quality in the Ohio River Basin and drinking water in the Ohio River States through—</text><clause id="H8BB8C4EABC5B40F782268ECC98B9871A"><enum>(i)</enum><text>reductions in the amount of polluted runoff, excess agricultural nutrients, and sediment reaching the Ohio River; and</text></clause><clause id="HBC05C3D0426B4A3B8AF48EDE85FD30C5"><enum>(ii)</enum><text>improvements in water source protections.</text></clause></subparagraph><subparagraph id="H42CC3F79EDF44C939ED94E728D582619"><enum>(B)</enum><text display-inline="yes-display-inline">Improvement of community resilience through restoration of natural systems in the Ohio River Basin to minimize and ameliorate flood and storm risks.</text></subparagraph><subparagraph id="H95212521456B47D7BA52E40868A6BEF2"><enum>(C)</enum><text display-inline="yes-display-inline">Protection and restoration of fish and wildlife habitat in the Ohio River Basin.</text></subparagraph><subparagraph id="H2E3B40EE4B5A49B18AB75FA20106338D"><enum>(D)</enum><text display-inline="yes-display-inline">Prevention and control of the spread of aquatic invasive species in the Ohio River Basin.</text></subparagraph><subparagraph id="HD5315C0F98E441CD85E444DE0E4100DB"><enum>(E)</enum><text>Remediation of toxic substances and mine-related pollution.</text></subparagraph><subparagraph id="H10F8AF82CE5248DDBFDEA5B790603F38"><enum>(F)</enum><text display-inline="yes-display-inline">Improvement of opportunities for public access and recreation in the Ohio River Basin consistent with the ecological needs of fish and wildlife habitat.</text></subparagraph><subparagraph id="HF8E052901812491DA13F3ED98C52A546"><enum>(G)</enum><text>Improvement of water management to enhance outcomes for fish and wildlife and reduce flood risks.</text></subparagraph><subparagraph id="HB879D4FE91FB4F3B9CA3E53C050B39B5"><enum>(H)</enum><text>Collection, monitoring, and evaluation of data needed to plan, implement, and assess the effectiveness of projects or activities carried out under this section.</text></subparagraph><subparagraph id="HBF4EB488F91B43FF9EB6300894EA8E88"><enum>(I)</enum><text display-inline="yes-display-inline">Improvement of public outreach, education, and citizen involvement in the development and implementation of projects and activities carried out under this section.</text></subparagraph></paragraph><paragraph id="HBE84B71EBC7C48B5B673C5A43CCE948C"><enum>(3)</enum><header>Approaches</header><text>Projects and activities carried out under this section shall prioritize use of natural, nature-based, and non-structural solutions to the maximum extent practicable, including—</text><subparagraph id="H51A9E4909A9C414B9674E9850B235593"><enum>(A)</enum><text>protecting or restoring naturally occurring hydrologic, geomorphic, and ecological functions and processes; and</text></subparagraph><subparagraph id="H81E2A59DFEFB4EA297028E8BF756E9F0"><enum>(B)</enum><text>removing or modifying structures such as culverts, levees, and dams to restore ecological functions and processes.</text></subparagraph></paragraph><paragraph id="HBD9F70DAE48040A5BB458E300F0B1111"><enum>(4)</enum><header>Project implementation</header><subparagraph id="HC20C09F6C7994878885819EBB41EF6FA"><enum>(A)</enum><header>In general</header><text>Funds made available to carry out the Ohio River Basin Restoration Program may be used to implement projects and activities described in paragraph (2) that are carried out by a relevant Federal agency or by a non-Federal entity.</text></subparagraph><subparagraph id="HD7FFA2968E6A48DCA325F4C39907AB88"><enum>(B)</enum><header>Grant authority</header><text>The Program Director, or the head of any other Federal agency receiving funds to carry out the Ohio River Basin Restoration Program, may make a grant to, or otherwise enter into an agreement with, any non-Federal entity (including any State, local, or Tribal governmental entity, nonprofit organization, institution of higher education, or individual) that the Program Director or agency head determines is qualified to carry out a project or activity described in paragraph (2).</text></subparagraph></paragraph><paragraph id="HE534E23817B44CFD84E66273C3D4B3E0"><enum>(5)</enum><header>Project selection</header><subparagraph id="H75D03DA2DBA44DF3A385FC6427D1AB1B"><enum>(A)</enum><header>In general</header><text>In carrying out the Ohio River Basin Restoration Program, the Program Director shall collaborate with relevant Federal agencies to select projects and activities to be implemented pursuant to this section using appropriate principles and criteria, including—</text><clause id="H1B2A29C8A60B49FCA2657A11EDE49678"><enum>(i)</enum><text>the selection of projects and activities that are equitably distributed throughout the Ohio River Basin;</text></clause><clause id="HDA1E1C2EDFDF4DA989658B7508D2D3B6"><enum>(ii)</enum><text>the ability of a project or activity to achieve strategic and measurable environmental outcomes;</text></clause><clause id="HF6D95D26C6374428BA56EBA48372F359"><enum>(iii)</enum><text display-inline="yes-display-inline">the recognition that projects and activities may provide benefits to local or regional communities, or to the entire Ohio River Basin;</text></clause><clause id="H09EF4A0DC6DA4B6591D86A3EA19F8F95"><enum>(iv)</enum><text>the feasibility of prompt implementation, timely achievement of measurable results, and resource leveraging; and</text></clause><clause id="HA958F467F04B44ACB80ED5557682F7DA"><enum>(v)</enum><text>the opportunity to improve interagency, intergovernmental, and interorganizational coordination and collaboration to reduce duplication and improve measurable environmental outcomes.</text></clause></subparagraph><subparagraph id="H812B7DB76E7D4EC0BE162BB878FFBD26"><enum>(B)</enum><header>Compatibility</header><text>The Program Director shall ensure that projects and activities carried out under this section are compatible with—</text><clause id="HDA61A3F93FF44253B84898C0EC462590"><enum>(i)</enum><text>the ability of the Corps of Engineers to maintain navigation in the Ohio River; and</text></clause><clause id="H26C8AC28FC98480399E1C65A44D5A879"><enum>(ii)</enum><text>the structural integrity or effectiveness of Federal, State, local, or Tribal disaster risk reduction infrastructure.</text></clause></subparagraph></paragraph></subsection><subsection id="H3E3B58CDD3674D89BF407D0292D529C5"><enum>(d)</enum><header>Actionable goals and action plan</header><paragraph id="HCC2C7115EFEC440987DE9A793323A665"><enum>(1)</enum><header>Actionable goals</header><text>Not later than 1 year after the date of enactment of this section, the Program Director shall develop actionable goals for the Ohio River Basin Restoration Program, which shall be measurable and shall include criteria for measuring their success in making progress toward restoring the ecological health and resilience of the Ohio River Basin.</text></paragraph><paragraph id="HE605BAAB66BA448C92BFE621C9A46F1B"><enum>(2)</enum><header>Action plan</header><text>Not later than 2 years after the date of enactment of this section, the Program Director shall develop an action plan for advancing the actionable goals developed under paragraph (1).</text></paragraph><paragraph id="H0E44466FB418445295A5018E9BBF8DFF"><enum>(3)</enum><header>Contents</header><text>The Program Director shall include in the action plan developed under paragraph (2)—</text><subparagraph id="H87FA676CDC4549819BD2B6AB8DDC6231"><enum>(A)</enum><text display-inline="yes-display-inline">a description of existing Federal, State, Tribal, and regional commissions, and regional plans, programs, and activities affecting the Ohio River Basin, that may be used to advance the Ohio River Basin Restoration Program;</text></subparagraph><subparagraph id="HD7A92725DBED45558BE0187935E545F1"><enum>(B)</enum><text display-inline="yes-display-inline">recommendations for a comprehensive approach to advancing systemic, large-scale restoration of the Ohio River Basin that, where appropriate, leverages existing Federal and State programs;</text></subparagraph><subparagraph id="H30382160CF464F31BA4E23DB5330D4E8"><enum>(C)</enum><text>a multi-year plan that identifies specific objectives with corresponding commitments for activities, research, and measures for progress; and</text></subparagraph><subparagraph id="H2B033194E45A48838DCC3C5AAD59EA3F"><enum>(D)</enum><text>a plan to monitor the implementation of any specific projects or activities identified in the action plan.</text></subparagraph></paragraph><paragraph id="H0A36BC4A1161432E85D8F1994597AEFC"><enum>(4)</enum><header>Project recommendations</header><text>The action plan may include recommendations for specific projects or activities that advance the action plan objectives, including timelines, anticipated costs, and the identification of entities responsible for the implementation of such projects or activities.</text></paragraph><paragraph id="H299BE3A8F8F04672B5493165AFA2D132"><enum>(5)</enum><header>Updates</header><text>Not less often than once every 5 years, the Program Director shall review and update the actionable goals and action plan developed under this subsection.</text></paragraph><paragraph id="H4938263028D44034891625E9267F9284"><enum>(6)</enum><header>Coordination and consultation</header><text display-inline="yes-display-inline">In developing and updating the actionable goals and action plan under this subsection, the Program Director shall—</text><subparagraph id="HEB0D1F5B98D04C699BC81FE81A210077"><enum>(A)</enum><text>consult with Ohio River States, Tribal Governments within those States, the Secretary of the Interior, the Chief of Engineers, and the Secretary of Agriculture;</text></subparagraph><subparagraph id="H1F99930BCFC14299901D1CD4CE834E41"><enum>(B)</enum><text>engage with relevant Federal agencies, local governments, nongovernmental organizations, institutions of higher education, interstate compact agencies, and members of the public;</text></subparagraph><subparagraph id="H7EC0E463945942BEB073754103CC9AD5"><enum>(C)</enum><text>provide public notice and an opportunity for comment; and</text></subparagraph><subparagraph id="HA31C08C2C23640C298EEB7D19B712246"><enum>(D)</enum><text>engage an independent, scientific panel to review the scientific credibility of the action plan to optimize the likelihood of successful restoration at appropriate scales.</text></subparagraph></paragraph></subsection><subsection id="HDA26D8845A7D4D83A829EFEAA63DE673"><enum>(e)</enum><header>Funding</header><paragraph id="HF1821603736E49758C30C4399228E6E5" commented="no"><enum>(1)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary to carry out this section.</text></paragraph><paragraph id="HE6A6E7AEF14C48558C3D563B644CDB58"><enum>(2)</enum><header>Transfer of funds to Federal entities</header><text>With funds made available to carry out this section for each fiscal year, the Administrator may—</text><subparagraph id="HFFBE6BA3543746A390E779154EF3B062"><enum>(A)</enum><text>transfer funds to the head of any relevant Federal agency, with the concurrence of the head of such agency, to carry out activities in accordance with this section; and</text></subparagraph><subparagraph id="HB2E28B5DB00145D08FBEE1CFDD5A5DFE"><enum>(B)</enum><text>enter into an interagency agreement with the head of any relevant Federal agency to carry out activities in accordance with this section.</text></subparagraph></paragraph><paragraph id="H2A5CFE2B6D59473D905143994A892E28"><enum>(3)</enum><header>Limitations</header><text>No funds made available to carry out this section may be used for any water infrastructure activity for which financial assistance is received—</text><subparagraph id="H9484116D8670429E90CF79A0CE456B44"><enum>(A)</enum><text>from a State water pollution control revolving fund established under section 603;</text></subparagraph><subparagraph id="H2F2A44EEDFE14CA09A1FAAF5BEF9C887"><enum>(B)</enum><text>from a State drinking water revolving loan fund established under section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>); or</text></subparagraph><subparagraph id="H1431B6D7DF2F425ABDC549F16AE1A3EB"><enum>(C)</enum><text>pursuant to the Water Infrastructure Finance and Innovation Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/3901">33 U.S.C. 3901 et seq.</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="H1F78A20D11CD42BF8EBA9C176176E26D"><enum>(f)</enum><header>Budget item</header><text>The Administrator shall, in the Agency’s annual budget submission to Congress, include a funding request for the Ohio River Basin Restoration Program as a separate budget line item.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
