which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name>, and in addition to the Committees on <committee-name committee-id="HGO00">Oversight and Accountability</committee-name>, and <committee-name committee-id="HHA00">House Administration</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Family and Medical Leave Act of 1993 to provide leave because of the death of a son or daughter, and for other purposes.</official-title></form><legis-body id="HBDC91AB7936043D7A5919ED46EDD830B" style="OLC"><section id="H594AB357175743AFBC49D5ED4A11C1FD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Parental Bereavement Act of 2024</short-title></quote> or the <quote><short-title>Sarah Grace-Farley-Kluger Act</short-title></quote>.</text></section><section id="HEA19C8A2379A41D5BED697F196CA7B42"><enum>2.</enum><header>Family leave because of the death of a son or daughter</header><subsection id="H3288F79BA56441DDBED8DFD73B9D339A"><enum>(a)</enum><header>Son or daughter</header><text display-inline="yes-display-inline">Section 101(12) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611(12)</external-xref>) is amended by—</text><paragraph id="H4821EDF2212B4ED8AB76084BA2146A6A"><enum>(1)</enum><text>redesignating subparagraphs (A) and (B) as clauses (i) and (ii), resepctively;</text></paragraph><paragraph id="H093F257C37614230AC891DBF4BDD0B3E"><enum>(2)</enum><text>by striking <quote>, who is—</quote> and inserting the following: </text><quoted-block style="OLC" id="HDA5E0F38918848F881A94E138DF3A887" display-inline="no-display-inline"><subparagraph id="H38E4C404AAA14999AE97111FE60815F9"><enum>(A)</enum><text display-inline="yes-display-inline">who is—</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H0D702F7E0A76471FB8DE18D80174023D"><enum>(3)</enum><text>in clause (ii), as so redesignated, by striking the period at the end and inserting </text><quoted-block style="OLC" id="H9C4D749F7D434B4FBF91AD2305991358" display-inline="yes-display-inline"><text>; or</text><subparagraph id="HE2BF947FBFF441AEBF0A5EB5B071FD79"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to leave taken under section 102(a)(1)(G), who is any years of age.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HFEF8313287D64F1EB8721E8789FE0924"><enum>(b)</enum><header>Family leave</header><paragraph id="H407C9D6448B840B9A541D7C60D566911"><enum>(1)</enum><header>Entitlement to leave</header><text>Section 102(a)(1) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H99FE083A16504CAFAB9B28792FE711D4" style="OLC"><subparagraph id="H31762647895F4CBBA35E3255D598B2BB"><enum>(G)</enum><text>Because of the death of a son or daughter.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H1CA73483BE89499AB86EA846493A6C55"><enum>(2)</enum><header>Expiration of entitlement</header><text>Section 102(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(2)</external-xref>) is amended—</text><subparagraph id="H73E93FAB1A04427F8FD05AEE744A49E4"><enum>(A)</enum><text>by striking <quote>under subparagraphs</quote> and inserting </text><quoted-block style="OLC" id="H323D41F736404890932F1C7E545D28B4" display-inline="yes-display-inline"><text>under—</text><subparagraph id="H852F57A5AEC54297AC611176C3BAD521"><enum>(A)</enum><text display-inline="yes-display-inline">subparagraphs</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HED61207C041240BDB012E39AC3F123F1"><enum>(B)</enum><text>in subparagraph (A), as so redesignated, by striking the period at the end and inserting</text><quoted-block style="OLC" id="H9170F0E6AA104D298EE81134184E3D87" display-inline="yes-display-inline"><text>; and</text><subparagraph id="H462F543DE743471E9F638E2B5CF531D1"><enum>(B)</enum><text display-inline="yes-display-inline">subparagraph (G) of paragraph (1) for a death of a son or daughter shall expire at the end of the 12-month period beginning on the date of such death.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H08830802D961427B9451D4F5CBC0BB0E"><enum>(3)</enum><header>Requirements relating to leave</header><subparagraph id="HE50D0BE8BD974DDBB1D74A5BF41F3633"><enum>(A)</enum><header>Schedule</header><text>Section 102(b)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(b)(1)</external-xref>) is amended by inserting after the third sentence the following new sentence: <quote>Leave under subsection (a)(1)(G) shall not be taken by an employee intermittently or on a reduced leave schedule unless the employee and the employer of the employee agree otherwise.</quote>.</text></subparagraph><subparagraph id="H18FF1DE9D601460B90B6015562B34E29"><enum>(B)</enum><header>Substitution of paid leave</header><text>Section 102(d)(2)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(d)(2)(B)</external-xref>) is amended, in the first sentence, by striking <quote>(C) or (D)</quote> and inserting <quote>(C), (D), or (G)</quote>.</text></subparagraph><subparagraph id="H53FB15FE33F147F282C19879C9CEC7E1"><enum>(C)</enum><header>Notice</header><text>Section 102(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(e)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HD61E634BD5A24D6F8376E6E27895E79C" style="OLC"><paragraph id="H23B46E83B6FD47008D2D5F7C27C0C40D"><enum>(4)</enum><header>Notice for leave due to death of a son or daughter</header><text>In any case in which the necessity for leave under subsection (a)(1)(G) is foreseeable, the employee shall provide such notice to the employer as is reasonable and practicable.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="H9937A9707DF243D59796F09655A18E67"><enum>(D)</enum><header>Spouses employed by same employer</header><text>Section 102(f)(1)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(f)(1)(A)</external-xref>) is amended by striking <quote>subparagraph (A) or (B)</quote> and inserting <quote>subparagraph (A), (B), or (G)</quote>.</text></subparagraph><subparagraph id="H1889EB7B5BE141BFA3DC6CDD05A22821"><enum>(E)</enum><header>Certification requirements</header><text>Section 103 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2613">29 U.S.C. 2613</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H3D24F18D6AAE4BAFB4F99705F08E530E" style="OLC"><subsection id="H7BEE8BB8ED6340E6AAD564CFE45A4E6D"><enum>(g)</enum><header>Certification related to the death of a son or daughter</header><text>An employer may require that a request for leave under section 102(a)(1)(G) be supported by a certification issued at such time and in such manner as the Secretary may by regulation prescribe. If the Secretary issues a regulation requiring such certification, the employee shall provide, in a timely manner, a copy of such certification to the employer.</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block></subparagraph><subparagraph id="H7E48E7D3381A4197ABB1AD455925AC3E"><enum>(F)</enum><header>Failure to return from leave</header><text>Section 104(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2614">29 U.S.C. 2614(c)</external-xref>) is amended—</text><clause id="HEBA85CA067F74A2193AB646F441227E0"><enum>(i)</enum><text>in paragraph (2)(B)(i), by inserting before the semicolon the following: <quote>, or a death that entitles the employee to leave under section 102(a)(1)(G)</quote>; and</text></clause><clause id="HF430C6C85AC844C58C8BC85577165136"><enum>(ii)</enum><text>in paragraph (3)(A)—</text><subclause id="HD8A60EAC6C2247648D7758BDF963787C"><enum>(I)</enum><text>in the matter preceding clause (i), by inserting <quote>, or the death,</quote> before <quote>described</quote>;</text></subclause><subclause id="H492FDD4A28404C60B4F4A27E651D949A"><enum>(II)</enum><text>in clause (ii), by striking <quote>or</quote> at the end;</text></subclause><subclause id="H734295CCB815495FBD0FD53FE579E46B"><enum>(III)</enum><text>by redesignating clause (iii) as clause (iv); and</text></subclause><subclause id="HFE3D8B0BB40740F69BA48E3FA409080A"><enum>(IV)</enum><text>by inserting after clause (ii) the following:</text><quoted-block display-inline="no-display-inline" id="HFDCA9BE915DF42B8AA00914B05160EA7" style="OLC"><clause id="H02E8C217062E4537BE9D425B31F15199"><enum>(iii)</enum><text>a certification that meets such requirements as the Secretary may by regulation prescribe, in the case of an employee unable to return to work because of a death specified in section 102(a)(1)(G); or</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subclause></clause></subparagraph><subparagraph id="H2B973D28121547B3ABF0A0FF4CB3FC40"><enum>(G)</enum><header>Employees of local educational agencies</header><text>Section 108 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2618">29 U.S.C. 2618</external-xref>) is amended—</text><clause id="H04A3F57030AB431CBD27B12D29A5AA08"><enum>(i)</enum><text>in subsection (c)(1)—</text><subclause id="H31BC9136403A4309BEBD8D0D4B094956"><enum>(I)</enum><text>in the matter preceding subparagraph (A), by inserting after <quote>medical treatment</quote> the following: <quote>, or under section 102(a)(1)(G) that is foreseeable,</quote>; and</text></subclause><subclause id="H4BCAFD1AF2AA4CA6855FF5E2F7A58211"><enum>(II)</enum><text>in subparagraph (A), by inserting after <quote>to exceed</quote> the following: <quote>(except in the case of leave under section 102(a)(1)(G))</quote>;</text></subclause></clause><clause id="H793976E9969A48809020B199FDF9AD97"><enum>(ii)</enum><text>in subsection (c)(2), by striking <quote>section 102(e)(2)</quote> and inserting <quote>paragraphs (2) and (4) of section 102(e), as applicable</quote>; and</text></clause><clause id="H71F507C43C354900B6D018FE6D0049C6"><enum>(iii)</enum><text>in subsection (d), in paragraph (2) and (3), by striking <quote>or (C)</quote> each place it appears and inserting <quote>(C), or (G)</quote>.</text></clause></subparagraph></paragraph></subsection><subsection id="H52B258F16BF548C3A1C3DB0665AA81D4"><enum>(c)</enum><header>Family leave for civil service employees</header><paragraph id="H07FF7338BB5640CFADBBE04C8E6AC54D"><enum>(1)</enum><header>Son or daughter</header><text>Section 6381(6) of title 5, United States Code, is amended—</text><subparagraph id="H1D903254890F44F094BE830B02942A9A"><enum>(A)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively;</text></subparagraph><subparagraph id="HDEFC6294E3F04486ADBAADAE5613E38D"><enum>(B)</enum><text>by striking <quote>, who is—</quote> and inserting the following:</text><quoted-block style="USC" id="H373553AB5BD3431981D7A27220591557" display-inline="no-display-inline"><subparagraph id="H9465DE3700304ECDA1B83D739A0D7310"><enum>(A)</enum><text display-inline="yes-display-inline">who is—</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H9EB64A4E149B4C198782789390805D13" commented="no"><enum>(C)</enum><text>in clause (ii), as so redesignated, by striking <quote>disability;</quote> and inserting </text><quoted-block style="USC" id="HC322D8A5CE19435A9A3D29C9B4A38C4A" display-inline="yes-display-inline"><text>disability; or</text><subparagraph id="H4FC44A4F53894475B5B129E609495A61"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to leave taken under section 6382(a)(1)(F), who is any years of age;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H74A9F3CC988341178D02A58E31758CFD"><enum>(2)</enum><header>Entitlement to leave</header><text>Section 6382(a)(1) of such title is amended by adding at the end the following:</text><quoted-block style="USC" id="HBA8A6B706FAA4B1DA1CE100DF395EE10" display-inline="no-display-inline"><subparagraph id="HF545BE2A84DC46BAAC5F03D873812E87"><enum>(F)</enum><text display-inline="yes-display-inline">Because of the death of a son or daughter.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H68981C82D5574DB4A6212E9CA319B285"><enum>(3)</enum><header>Expiration of leave</header><text display-inline="yes-display-inline">Section 6382(a)(2) of such title is amended by—</text><subparagraph id="HEF8CB27758414B56A86496B8143BD466"><enum>(A)</enum><text>striking <quote>under subparagraph</quote> and inserting </text><quoted-block style="USC" id="H580C6E8A740645AD84045758682137F9" display-inline="yes-display-inline"><text>under—</text><subparagraph id="H73BE7D7BDB744B7FBDCD1E553407844C"><enum>(A)</enum><text display-inline="yes-display-inline">subparagraph</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H3BC5B27BE37C42A4BA0E5DF31A65E2BF"><enum>(B)</enum><text>in subparagraph (A), as so redesignated, by striking the period at the end and inserting </text><quoted-block style="USC" id="H3896D2475F2D4C088455BFCDB79AA34D" display-inline="yes-display-inline"><text>; or</text><subparagraph id="HFD075B2851584B6D97F37F4A3CBBAD8B"><enum>(B)</enum><text display-inline="yes-display-inline">subparagraph (F) of paragraph (1) for a death of a son or daughter shall expire at the end of the 12-month period beginning on the date of such death.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HE9F1F1F230A04FA2A7B148F2C900F7A8"><enum>(4)</enum><header>Requirements relating to leave</header><subparagraph id="HC6D40A6D81EE47B481E38DC2AB9BAA88"><enum>(A)</enum><header>Schedule</header><text>Section 6382(b)(1) of such title is amended by inserting after the third sentence the following new sentence: <quote>Leave under subsection (a)(1)(F) shall not be taken by an employee intermittently or on a reduced leave schedule unless the employee and the employing agency of the employee agree otherwise.</quote>.</text></subparagraph><subparagraph id="HBA9F5C3D5BF74FCF8FDFCEA0559B3E67"><enum>(B)</enum><header>Substitution of paid leave</header><text>Section 6382(d) of such title is amended, in the first sentence, by striking <quote>or (E)</quote> and inserting <quote>(E), or (F)</quote>.</text></subparagraph><subparagraph id="H06A2EEFC095947D7A78437830E9CDAE1"><enum>(C)</enum><header>Notice</header><text>Section 6382(e) of such title is amended by adding at the end the following new paragraph:</text><quoted-block style="USC" id="H2966EC4D41B84D3FB440C75109E17234" display-inline="no-display-inline"><paragraph id="HBEF1A39590494BF68344E52B1992032C"><enum>(4)</enum><text display-inline="yes-display-inline">In any case in which the necessity for leave under subsection (a)(1)(F) is foreseeable, the employee shall provide such notice to the employing agency as is reasonable and practicable.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="H23649A5E927446819769B495D9BA77D4"><enum>(D)</enum><header>Certification requirements</header><text>Section 6383 of such title is amended by adding at the end the following:</text><quoted-block style="USC" id="H5401A006C5A346B9AF046E2FF7097C3E" display-inline="no-display-inline"><subsection id="HF0AD49645378457FBE4BBB1FF2741422"><enum>(g)</enum><text display-inline="yes-display-inline">An employing agency may require that a request for leave under section 6382(a)(1)(F) be supported by a certification issued at such time and in such manner as the Office of Personnel Management may by regulation prescribe. If the Office issues a regulation requiring such certification, the employee shall provide, in a timely manner, a copy of such certification to the employer.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section></legis-body></bill>
