which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit sanctuary jurisdictions from receiving community development block grants.</official-title></form><legis-body id="H23DB6D6868284661A840AD7FA6DC0A3F" style="OLC"><section id="H5631C53299E748918EB0DD22885302EB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Community Development Block Grants for Sanctuary Cities Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="HA41CA4B2EF094A72A8CBE0C2CC032C42"><enum>2.</enum><header>Ineligibility of sanctuary jurisdictions for community development block grants</header><text display-inline="no-display-inline">Title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>) is amended—</text><paragraph id="H78AC2559507C45FE8B3C8A64A920979B"><enum>(1)</enum><text>in section 102(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/5302">42 U.S.C. 5302(a)</external-xref>), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7EDAEA021143476DB454149A21313DDC"><paragraph id="H07E429A5CFE947F3A924CDEB5C9F618B"><enum>(25)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H66E5ECF82ADE4B91B2C01A46DF72259C"><enum>(A)</enum><text>Except as provided in subparagraph (B), the term <term>sanctuary jurisdiction</term> means any State or political subdivision of a State that has in effect a statute, ordinance, policy, or practice that prohibits or restricts any government entity or official from—</text><clause commented="no" display-inline="no-display-inline" id="H66BBC969721D434DA78A1461C9920936" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">sending, receiving, maintaining, or exchanging with any Federal, State, or local government entity information regarding the citizenship or immigration status (lawful or unlawful) of any individual; or</text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="H0C1EF4A769494C939102DB73D4BE7854"><enum>(ii)</enum><text display-inline="yes-display-inline">complying with a request lawfully made by the Department of Homeland Security under section 236 or 287 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226</external-xref>, 1357) to comply with a detainer for, or notify about the release of, an individual.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="H00214DB637CC48D4B2FE630660786CB9"><enum>(B)</enum><text display-inline="yes-display-inline">A State or political subdivision of a State shall not be deemed a sanctuary jurisdiction based solely on its having a policy whereby its officials will not share information regarding, or comply with a request made by the Department of Homeland Security under section 236 or 287 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226</external-xref>, 1357) to comply with a detainer regarding, an individual who comes forward as a victim or a witness to a criminal offense.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H644F5272BC7348E1AD1DB11C85B6660F"><enum>(2)</enum><text>in section 104(b) (<external-xref legal-doc="usc" parsable-cite="usc/42/5304">42 U.S.C. 5304(b)</external-xref>)—</text><subparagraph id="H4C9B07B0460B4924B956BE4A394C8BF8"><enum>(A)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H8FED8BF81B3C4DDE92F5EA5FD088BA5A"><enum>(B)</enum><text>by redesignating paragraph (6) as paragraph (7); and</text></subparagraph><subparagraph id="HD05686F49F9E48E1BC404DAB7FE71B1F"><enum>(C)</enum><text>by inserting after paragraph (5) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBD1B9A068552449097D52C42B11058D5"><paragraph id="HDA756BBF17564A91BCE272E5C73C121C"><enum>(6)</enum><text>the grantee is not a sanctuary jurisdiction and will not become a sanctuary jurisdiction during the period for which the grantee receives a grant under this title; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
