and</text></subparagraph><subparagraph id="H795FAF4C3FA3438CA13E6518EF476377"><enum>(B)</enum><text>in clause (ii)(II), by striking <quote>September 30, 2025</quote> and inserting <quote>September 30, 2037</quote>.</text></subparagraph></paragraph><paragraph id="H1E8EBFDE145F43ADB98A3EDFE9C2B7B7"><enum>(3)</enum><header>Extension of third-country fabric program</header><text>Section 112(c)(1) of the African Growth and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3721">19 U.S.C. 3721(c)(1)</external-xref>) is amended—</text><subparagraph id="HD9D1D6F8063849868796309A51176649"><enum>(A)</enum><text>in the paragraph heading, by striking <quote><header-in-text style="OLC" level="paragraph">September 30, 2025</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">September 30, 2037</header-in-text></quote>;</text></subparagraph><subparagraph id="H4158983A1B604F559A51F6556061005D"><enum>(B)</enum><text>in subparagraph (A), by striking <quote>September 30, 2025</quote> and inserting <quote>September 30, 2037</quote>; and</text></subparagraph><subparagraph id="H50951BC52C5C43679FE1EBFEE9D1FC32"><enum>(C)</enum><text>in subparagraph (B)(ii), by striking <quote>September 30, 2025</quote> and inserting <quote>September 30, 2037</quote>.</text></subparagraph></paragraph></subsection><subsection id="H89B08EF85B5442BA81A2720E644F9375" commented="no"><enum>(c)</enum><header>Reporting requirement</header><text display-inline="yes-display-inline">Section 110(c) of the Trade Preferences Extension Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/19/3705">19 U.S.C. 3705</external-xref> note) is amended by striking “September 30, 2025” and inserting “September 30, 2037”.</text></subsection></section><section id="HEF65751F5D9141088E1C679A84A0D8D8"><enum>3.</enum><header>Review, enforcement, and reporting requirements</header><subsection commented="no" display-inline="no-display-inline" id="H6603F2D3FCB142B9917232DFD1C64E5D"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 506A(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2466a">19 U.S.C. 2466a(a)</external-xref>) is amended by striking paragraphs (2) and (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H55D07FCE1E3F408686AC41B92B619275"><paragraph commented="no" display-inline="no-display-inline" id="HA09A93CE01E54A2BA447E8C3718207C3"><enum>(2)</enum><header>Monitoring and review of certain countries</header><subparagraph commented="no" display-inline="no-display-inline" id="H44E3604A32E049B3BAA338DE50CC3E5F"><enum>(A)</enum><header display-inline="yes-display-inline">Biennial review</header><clause id="H2A766E11D314473F87FA7FF59D80C94B"><enum>(i)</enum><header>In general</header><text>Not less frequently than once every 2 years, the President shall monitor, review, and report to Congress on the progress of each country listed in section 107 of the African Growth and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3706">19 U.S.C. 3706</external-xref>) in meeting the requirements described in paragraph (1) in order to determine the current or potential eligibility of the country to be designated as a beneficiary sub-Saharan African country for purposes of this section.</text></clause><clause id="HBEB1B3BB35044D828ACAC87A13609CCB"><enum>(ii)</enum><header>Reporting</header><text>The President’s determinations, and explanations of such determinations, with specific analysis of the eligibility requirements described in paragraph (1)(A), shall be included in the biennial report required by section 106(a)(1).</text></clause><clause id="H9AA3C92A273B4F789733F0A0E279DDC1" commented="no"><enum>(iii)</enum><header>Frequency</header><text display-inline="yes-display-inline">The President shall conduct full reviews pursuant to subsection (i) with respect to a subset of countries listed in section 107 of the African Growth and Opportunity Act chosen in a manner that ensures that on an annual basis full reviews are conducted for at least one half of the countries listed in section 107 of the African Growth and Opportunity Act and to ensure that every country listed in such section 107 is reviewed at least once every 2 years.</text></clause></subparagraph><subparagraph id="H57BB6C035E2F4EF7A7A2809E7F4A3898"><enum>(B)</enum><header>Out of cycle review</header><clause id="H015F6BA2577E4BF19C0F9F70D05C22BE"><enum>(i)</enum><header>In general</header><text>The President may, at any time, initiate an out-of-cycle review of whether a beneficiary sub-Saharan African country is making continual progress in meeting the requirements described in paragraph (1). The President shall give due consideration to petitions received under subsection (d)(3) in determining whether to initiate an out-of-cycle review under this subparagraph.</text></clause><clause id="HC36FCE4B704A4FC3B8C78ABC8F11BEC6"><enum>(ii)</enum><header>Public notice</header><text>The President shall also publicly announce the commencement of each out-of-cycle review conducted pursuant to this subparagraph unless, upon prior consultation with the appropriate congressional committees, the President determines that such an announcement would not be in the national security or foreign policy interest of the United States. For each review so publicly announced, the President shall also publicly announce the results of the review when concluded.</text></clause></subparagraph><subparagraph id="H29F8A33C3F7F44D2AA98FF5D69FDA8CB"><enum>(C)</enum><header>Initiation of out-of-cycle reviews by Congress</header><text>If the chairperson and ranking member of one of the appropriate congressional committees jointly submit a request for an out-of-cycle review of a beneficiary sub-Saharan African country based on the assertion that the country is not making continual progress in meeting the requirements described in paragraph (1), the President shall—</text><clause id="H08D55B9DD8CF445689362CA5821C0F34"><enum>(i)</enum><text>not later than 15 days after receiving the request, initiate an out-of-cycle review of whether the country is making continual progress in meeting those requirements; and</text></clause><clause id="H5EDA0C917A8345FF8623E099FDD42CCB"><enum>(ii)</enum><text>not later than 45 days after receiving the request, submit a classified or unclassified report to the appropriate congressional committees on the review that includes—</text><subclause commented="no" display-inline="no-display-inline" id="H346586F7E64A41AEB180D6491F1D5E94"><enum>(I)</enum><text display-inline="yes-display-inline">the determination of the President, pursuant to the review, of whether or not the country is making continual progress in meeting the requirements described in paragraph (1);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HB90211E81E8D481383A2B8682B800CAC"><enum>(II)</enum><text display-inline="yes-display-inline">a description of the considerations entering into that determination, including a specific analysis of the requirements described in paragraph (1); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H08B43CCFBAAD44459A341FD64B4E43E2"><enum>(III)</enum><text>if the President determines that the country is not making continual progress in meeting those requirements, the matters described in clauses (ii) through (iv) of paragraph (4)(B).</text></subclause></clause></subparagraph><subparagraph id="HD3F1461C0B25433EA1C5A2D58AA92ECA"><enum>(D)</enum><header>Delegation</header><text>If the President delegates responsibility for conducting reviews under subparagraphs (A), (B), and (C), the President shall delegate that responsibility jointly to—</text><clause commented="no" display-inline="no-display-inline" id="H8F0561BC70314740889CBB3650152596"><enum>(i)</enum><text display-inline="yes-display-inline">the United States Trade Representative or a designee of the Trade Representative serving in a position to which the designee was appointed by the President by and with the advice and consent of the Senate; and </text></clause><clause commented="no" display-inline="no-display-inline" id="HD3E49FD49162416C921E547D90CC6BAC"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary of State or a designee of the Secretary serving in a position to which the designee was appointed by the President by and with the advice and consent of the Senate.</text></clause></subparagraph></paragraph><paragraph id="HCE3788D559F84E2198B43E33821BAA33" commented="no"><enum>(3)</enum><header>Continuing compliance</header><subparagraph commented="no" display-inline="no-display-inline" id="H5BD736D53A9145679E400ACEF8AD4740"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>If, pursuant to a review conducted under paragraph (2), the President determines that a beneficiary sub-Saharan African country is not making continual progress in meeting the requirements described in paragraph (1), the President shall, subject to paragraph (4)—</text><clause commented="no" display-inline="no-display-inline" id="HEAB50716093F4BD0AE3877CA1B7E3C3C"><enum>(i)</enum><text display-inline="yes-display-inline">terminate the designation of that country as a beneficiary sub-Saharan African country for purposes of this section;</text></clause><clause commented="no" display-inline="no-display-inline" id="H512E41C68EC5438C8D7744936D33ABC6"><enum>(ii)</enum><text display-inline="yes-display-inline">withdraw, suspend, or limit the application of duty-free treatment to any article of the country that is described in subsection (b)(1) or section 112 of the African Growth and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3721">19 U.S.C. 3721</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="H16CDBC5B5D924DE8B2E540FE55D37673"><enum>(iii)</enum><text display-inline="yes-display-inline">issue a warning letter to the country detailing concerns with the lack of progress of the country in meeting the requirements described in paragraph (1) and providing notice that, if corrective action is not taken before the next review of the country under paragraph (2), the President may take action under clause (i) or (ii) based on the results of that review; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H452A08EFA43F4E07991E2F57134CDD52"><enum>(iv)</enum><text display-inline="yes-display-inline">take no action under clause (i), (ii), or (iii) if the President determines that—</text><subclause commented="no" display-inline="no-display-inline" id="H0FA98B99FABE40B58B551A07ACB55CA3"><enum>(I)</enum><text display-inline="yes-display-inline">the compliance of the country with the requirements described in paragraph (1) will be most effectively promoted by other means; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H630807473C2443CDBD6458E6244F20E4"><enum>(II)</enum><text display-inline="yes-display-inline">the economic and foreign policy interests of the United States will be most effectively advanced by taking no action.</text></subclause></clause></subparagraph><subparagraph id="H3D9FE4C234FD46FF97C8708095C3BD33" commented="no"><enum>(B)</enum><header>Effective date</header><text>An action taken under subparagraph (A) shall be effective with respect to a country—</text><clause commented="no" display-inline="no-display-inline" id="H2397EEBF60F44C4EB2B8030570BEB88D"><enum>(i)</enum><text display-inline="yes-display-inline">for biennial reviews conducted under paragraph (2)(A), on January 1 of the year following the year in which the determination that the country is not making continual progress in meeting the requirements described in paragraph (1) is made;</text></clause><clause commented="no" display-inline="no-display-inline" id="H27A8204DA682400EB523E8ABFD22AA43"><enum>(ii)</enum><text display-inline="yes-display-inline">for out-of-cycle reviews conducted under subparagraph (B) or (C) of paragraph (2), not later than 90 days after such a determination is made. </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF47C6F180B384C4B91E58029B7EF7B45"><enum>(4)</enum><header>Notification, reporting, and briefing</header><subparagraph id="H3DFE6837810C47FE8DA50C3B45ADE9B0" commented="no"><enum>(A)</enum><header>Notification</header><text>If, pursuant to a review conducted under paragraph (2), the President determines that a beneficiary sub-Saharan African country is not making continual progress in meeting the requirements described in paragraph (1), the President shall notify the appropriate congressional committees and the government of the country of the President’s determination and any action the President is considering taking not less than 60 days before taking any action with respect to the country under paragraph (3)(A) or determining to take no action as described in clause (iv) of that paragraph.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H073E359D34B649AB9E8C570D2B4D42F0"><enum>(B)</enum><header>Report required</header><text>Not later than 15 days after providing notification under subparagraph (A) with respect to a country, the President shall submit to the appropriate congressional committees a classified or unclassified report, informed by the United States Trade Representative and the Secretary of State, that includes—</text><clause commented="no" display-inline="no-display-inline" id="H8D828B09A68D4C9E8E60822DA0571403"><enum>(i)</enum><text display-inline="yes-display-inline">a description of the considerations entering into the determination that the country is not making continual progress in meeting the requirements described in paragraph (1), including a specific analysis of those requirements;</text></clause><clause commented="no" display-inline="no-display-inline" id="H76C6D4E863A94070AAE141E8481F4869"><enum>(ii)</enum><text display-inline="yes-display-inline">an analysis of the expected economic and political effects of—</text><subclause commented="no" display-inline="no-display-inline" id="HCABEE173FEC44F048D03A804EE20FA53"><enum>(I)</enum><text display-inline="yes-display-inline">the action the President intends to take under paragraph (3)(A) with respect to the country; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H1340BAA3FCA641CC98CA29D750553AD6"><enum>(II)</enum><text>taking no action, if the President determines to take no action as described in clause (iv) of that paragraph;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HFE0A2D93A9BF451E9EF8B591826B37C5"><enum>(iii)</enum><text>an explanation of the role of the action or determination to take no action in the overall strategy of the United States toward the country; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HD38080142EAE4B62B258EA3EF1195CC2"><enum>(iv)</enum><text>an explanation of what actions by the country would result in the restoration of, as applicable—</text><subclause commented="no" display-inline="no-display-inline" id="H39822DF8D84B41798AC15EFC909A74F9"><enum>(I)</enum><text display-inline="yes-display-inline">the designation of the country as a beneficiary sub-Saharan African country for purposes of this section; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H27EF087EFB8048B3A201DC50907C658E"><enum>(II)</enum><text display-inline="yes-display-inline">the application of duty-free treatment to articles of the country. </text></subclause></clause></subparagraph><subparagraph id="HE0478C1CF2034296B5480755A828A76A" commented="no"><enum>(C)</enum><header>Briefing required</header><text>Not later than 30 days after providing notification under subparagraph (A), the United States Trade Representative and the Secretary of State shall provide briefings to the appropriate congressional committees addressing—</text><clause commented="no" display-inline="no-display-inline" id="H11CDE4EFDDD746E6B60721DAA070C10C"><enum>(i)</enum><text display-inline="yes-display-inline">the findings of the review conducted under paragraph (2); and </text></clause><clause commented="no" display-inline="no-display-inline" id="H82E4855FFFCC41678AFA8EA09BED0BBC"><enum>(ii)</enum><text display-inline="yes-display-inline">the contents of the report required by subparagraph (B).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1D7A957B87F74E3CB6FFECBB8A916DDE"><enum>(b)</enum><header>Conforming amendments</header><text>Title V of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2461">19 U.S.C. 2461 et seq.</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="HCBAAE539F8434CE8AE459811C3288B7D"><enum>(1)</enum><text display-inline="yes-display-inline">in section 506A (<external-xref legal-doc="usc" parsable-cite="usc/19/2466a">19 U.S.C. 2466a</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="HED4C0BFD0D074A268F568B59BD1DB020"><enum>(A)</enum><text>by striking subsection (c);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA0A0D2C759B54ACFAB83FA43E9457C54"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (d), by striking paragraph (4); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H22A03F5E68B8472EA9C618E587A01020"><enum>(C)</enum><text>in subsection (e)—</text><clause commented="no" display-inline="no-display-inline" id="H68058DAE9A864CB7B8F789050C9093A2"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text style="OLC" level="subsection">Beneficiary Sub-Saharan African Countries, Etc</header-in-text>.—For purposes of this title—</quote> and inserting <quote><header-in-text style="OLC" level="subsection">Definitions</header-in-text>.—In this title:</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="HC95A403D38C64316A109BA01026D745F"><enum>(ii)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) and (2) as paragraphs (2) and (3), respectively; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HA794B2D775FC4D8588395EA4B7236713"><enum>(iii)</enum><text>by inserting before paragraph (2), as so redesignated, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0D550FC1B207440F84C9BED12A36ADDD"><paragraph id="HEDF50D49F77844E28AB2952E6065DCCC"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="H212CEBA96BCB4B7D84C41C29B6410B9C"><enum>(A)</enum><text>the Committee on Ways and Means and the Committee on Foreign Affairs of the House of Representatives; and</text></subparagraph><subparagraph id="H3DF5F2A6B42E4025B7ADA4B9E4ECC948"><enum>(B)</enum><text>the Committee on Finance and the Committee on Foreign Relations of the Senate.</text></subparagraph></paragraph><after-quoted-block>; and</text></subparagraph><subparagraph id="H1B7FCB37CF9B4AFCA1FAF4FAF050EBE2"><enum>(B)</enum><text display-inline="yes-display-inline">apply with respect to a country that is a beneficiary sub-Saharan African country as of such date of enactment and that has not published a national utilization strategy as required by section 118 of the African Growth and Opportunity Act (as added by subsection (b)) by the date that is not later than 1 year after such date of enactment.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H58D67F331458444693B23633C0086ECA"><enum>(b)</enum><header display-inline="yes-display-inline">Biennial utilization strategies</header><text display-inline="yes-display-inline">Subtitle B of the African Growth and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3721">19 U.S.C. 3721 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H107F436D0D854E729917E2FABC6BB78C"><section commented="no" display-inline="no-display-inline" id="HEF056CDF289C4A69B4929CDA8FF94ABA" section-type="subsequent-section"><enum>118.</enum><header display-inline="yes-display-inline">Biennial utilization strategies</header><subsection commented="no" display-inline="no-display-inline" id="HA0410CCCDDB14A2C87AD4F6AF52AE76C"><enum>(a)</enum><header display-inline="yes-display-inline">Sense of Congress</header><paragraph commented="no" display-inline="no-display-inline" id="H7D65104D9AB8409EA9C25E91F616D6A0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text><subparagraph commented="no" display-inline="no-display-inline" id="H6CB5B58B5D3F449E8EC1AF3A7DD81006"><enum>(A)</enum><text display-inline="yes-display-inline">beneficiary sub-Saharan African countries should develop utilization strategies on a biennial basis in order to more effectively and strategically utilize benefits available under this Act and section 506A of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2466a">19 U.S.C. 2466a</external-xref>) (in this section referred to as <quote>AGOA utilization strategies</quote>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H57F73E039F284AA78C6BBF0B430D3649"><enum>(B)</enum><text display-inline="yes-display-inline">United States trade capacity building agencies should work with, and provide appropriate resources to, such sub-Saharan African countries to assist in developing and implementing biennial AGOA utilization strategies; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H37F4E046F1BB406D96831D9629BE5031"><enum>(C)</enum><text display-inline="yes-display-inline">as appropriate, and to encourage greater regional integration, the United States Trade Representative should consider requesting the Regional Economic Communities to prepare biennial AGOA utilization strategies.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H57AB549857D743A58E737F42D01577AE"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">It is further the sense of Congress that biennial AGOA utilization strategies should identify strategic needs and priorities to bolster utilization of benefits available under this Act. To that end, biennial AGOA utilization strategies should—</text><subparagraph commented="no" display-inline="no-display-inline" id="HF32A7FD7A9264FA1B50DFD1BA1EC7EB4"><enum>(A)</enum><text display-inline="yes-display-inline">review potential exports under this Act and section 506A of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2466a">19 U.S.C. 2466a</external-xref>) and identify opportunities and obstacles to increased trade and investment and enhanced poverty reduction efforts;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H019315102E0049B8AA597997053E74A6"><enum>(B)</enum><text display-inline="yes-display-inline">identify obstacles to regional integration that inhibit utilization of benefits under this Act and section 506A of the Trade Act of 1974;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2170910D59464F5F8040828259E5138C"><enum>(C)</enum><text display-inline="yes-display-inline">set out a plan to take advantage of opportunities and address obstacles identified in subparagraphs (A) and (B), improve awareness of this Act as a program that enhances exports to the United States, and utilize United States Agency for International Development regional trade hubs;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1DD9834BB7D04F32919CB8261CAA6EB2"><enum>(D)</enum><text display-inline="yes-display-inline">set out a strategy to promote small business and entrepreneurship; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H29B55A40B75A4D71AB3BD8B1B1FB6671"><enum>(E)</enum><text display-inline="yes-display-inline">eliminate obstacles to regional trade and promote greater utilization of benefits under this Act and section 506A of the Trade Act of 1974 and establish a plan to promote full regional implementation of the Agreement on Trade Facilitation of the World Trade Organization.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H032AF79168D241ED9570A2D9B360E521"><enum>(3)</enum><header display-inline="yes-display-inline">Publication</header><text display-inline="yes-display-inline">It is further the sense of Congress that—</text><subparagraph commented="no" display-inline="no-display-inline" id="H28422EB3395B460C831B7FACAE23882A"><enum>(A)</enum><text display-inline="yes-display-inline">each beneficiary sub-Saharan African country should publish on an appropriate internet website of such country public versions of its AGOA utilization strategy; and</text></subparagraph><subparagraph id="HB1F0F313C96E4F29BBF00F80AA81F919" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the United States Trade Representative should publish on the internet website of the Office of the United States Trade Representative public versions of all AGOA utilization strategies described in subparagraph (A).</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAE8622F167A149C2AB9D850F2884F076"><enum>(b)</enum><header>Assistance To implement utilization strategies</header><paragraph id="H8A704AD184384BC9888692685F491127"><enum>(1)</enum><header>Eligibility</header><text>Each beneficiary sub-Saharan African country that has published an AGOA utilization strategy as described in paragraph (3) of subsection (a) that meets the criteria described in paragraph (2) of that subsection is eligible for the assistance described in paragraph (2).</text></paragraph><paragraph id="H1D9C9D37B82E443EB648C433EDF4ACB8"><enum>(2)</enum><header>Trade capacity building assistance</header><text>The Administrator of the United States Agency for International Development should assist each country that is eligible under paragraph (1) in the implementation of the AGOA utilization strategy of the country, including assistance in—</text><subparagraph id="H545613D23D8445C0B13C9686FCBBDFEB"><enum>(A)</enum><text>developing a business environment conducive to international trade and investment;</text></subparagraph><subparagraph id="HAC0B0F2505E34B2F8DDCB99E5EB78261"><enum>(B)</enum><text>establishing trade-related infrastructure and industrial zones;</text></subparagraph><subparagraph id="H900EA6B4583F43679B0517C12CF1CB95"><enum>(C)</enum><text>conducting export promotion activities;</text></subparagraph><subparagraph id="HEB849FEE4FF94EB79CAD42B073B79CEF"><enum>(D)</enum><text>modernizing and improving customs operations and procedures;</text></subparagraph><subparagraph id="H70F52FF4810E4239AE9707FF08D16454"><enum>(E)</enum><text>meeting sanitary and phytosanitary standards;</text></subparagraph><subparagraph id="H56B04156B6544CDB82C2BCE5FAF17B77"><enum>(F)</enum><text>minimizing technical barriers to trade;</text></subparagraph><subparagraph id="HC1029C77610241B78F4A9C77A7585467"><enum>(G)</enum><text>protecting intellectual property rights;</text></subparagraph><subparagraph id="HD6C2C2304D344FA491E78BE6B2133A8B"><enum>(H)</enum><text>implementing the Agreement on Trade Facilitation of the World Trade Organization;</text></subparagraph><subparagraph id="H34AE26045ABD4FA1BFE0901ED462F3D0"><enum>(I)</enum><text>furthering labor and environmental standards; and</text></subparagraph><subparagraph id="H0DC142E907B34683871FF85B2CC27AF6"><enum>(J)</enum><text>other trade capacity building activities.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD9EFB6A040074D718C9C89F8A590A5FB"><enum>(c)</enum><header display-inline="yes-display-inline">Beneficiary sub-Saharan african country defined</header><text>In this section, the term <term>beneficiary sub-Saharan African country</term> has the meaning given that term in section 506A(e) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2466a">19 U.S.C. 2466a(f)</external-xref>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD169280E25B14F7BA62F95FF6CE38CBF"><enum>(c)</enum><header>Clerical amendment</header><text>The table of contents for the African Growth and Opportunity Act is amended by inserting after the item relating to section 117 the following:</text><quoted-block style="OLC" id="H1A6606B21511492DB6EDA8D411A071DC"><toc><toc-entry level="section" idref="HEF056CDF289C4A69B4929CDA8FF94ABA">Sec. 118. 2466a</external-xref>) is amended by inserting after subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8A7866C6ACF3422690B87C5ADAE8BD9B"><subsection commented="no" display-inline="no-display-inline" id="HEDFCC2ECBF0D4038BBE11BDFA24FA644"><enum>(c)</enum><header display-inline="yes-display-inline">Mandatory graduation of high income countries</header><paragraph commented="no" display-inline="no-display-inline" id="H454D8FCCFBA547999D85028CE0BFC4E2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided by paragraph (2), if the President determines that a beneficiary sub-Saharan African country has been classified, under the official statistics of the International Bank for Reconstruction and Development, as a <quote>high income</quote> country for a period of 5 consecutive years, the President shall terminate the designation of the country as a beneficiary sub-Saharan African country for purposes of this section and as a beneficiary developing country for purposes of this title, effective on January 1 of the second year following the year in which that determination is made.</text></paragraph><paragraph id="HC2ACC93F351C4937832A7E8D2F324A7E"><enum>(2)</enum><header>Exception</header><text>After a country has been designated as <quote>high income</quote> for a period of 5 consecutive years as described in paragraph (1), the President may elect to maintain the designation of the country as a beneficiary sub-Saharan African country for purposes of this section and as a beneficiary developing country for purposes of this title for not more than an additional 5 years to allow for the negotiation of a free trade agreement with that country, in accordance with the policy described in section 116(a) of the African Growth and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3723">19 U.S.C. 3723(a)</external-xref>). </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" country of particular concern for religious freedom under section 402(b)(1)(A)(ii) of the International Religious Freedom Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/22/6442">22 U.S.C. 6442(b)(1)(A)(ii)</external-xref>);</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAFEDA4352AD441B988ABA754A4210AD7"><enum>(4)</enum><text> does not provide support for acts of international terrorism and cooperates in international efforts to eliminate terrorist activities, including by not having been determined by the Secretary of State to have repeatedly provided support for acts of international terrorism for purposes of—</text><subparagraph id="H60BAF06C14B24ABD9DF787DC46C4F7DE"><enum>(A)</enum><text>section 1754(c)(1)(A)(i) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4813">50 U.S.C. 4813(c)(1)(A)(i)</external-xref>);</text></subparagraph><subparagraph id="HA573483157DE43C78AFBE4DB0EC5F1A9"><enum>(B)</enum><text>section 620A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>);</text></subparagraph><subparagraph id="H0364E789063245BC9E5213671ED11DC0"><enum>(C)</enum><text>section 40(d) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780(d)</external-xref>); or</text></subparagraph><subparagraph id="H6D37ACBE06134E519B201CD3C509BC5E"><enum>(D)</enum><text>any other provision of law; not subject to restrictions on the provision of assistance to a country the duly elected head of government of which is deposed by a coup d’état or decree under an Act making appropriations for the Department of State, foreign operations, and related programs.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H93A9DB1C6C9E42478A21D2EA4BD88B0A"><enum>7.</enum><header display-inline="yes-display-inline">Report on enforcement of prohibition on importation of goods made with forced labor</header><text display-inline="no-display-inline">Section 112 of the African Growth and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3721">19 U.S.C. 3721</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" report on procedures in place to ensure that any country the textile and apparel articles of which are receiving preferential treatment under this section is not exporting those articles to the United States in violation of—</text><subparagraph commented="no" display-inline="no-display-inline" id="H68C98625A74D466EAED708521F85C0BB"><enum>(A)</enum><text display-inline="yes-display-inline">section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>); or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA366DAD30C324226A7DD1B2182CB8E37"><enum>(B)</enum><text display-inline="yes-display-inline">section 3 of the Act entitled <quote>An Act to ensure that goods made with forced labor in the Xinjiang Autonomous Region of the People’s Republic of China do not enter the United States market, and for other purposes</quote>, approved December 23, 2021 display-inline="yes-display-inline">A description of the status of trade and investment between the United States and sub-Saharan Africa, including information on leading exports to the United States from sub-Saharan African countries.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H77D05A89588C47028C67AC4699FBACFA"><enum>(B)</enum><text display-inline="yes-display-inline">Any changes in eligibility of sub-Saharan African countries during the period covered by the report.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF0C98EE28EDE4B8299E30C89F0EC6F07"><enum>(C)</enum><text display-inline="yes-display-inline">A detailed analysis of whether each beneficiary sub-Saharan African country is continuing to meet the eligibility requirements set forth in section 104 and the eligibility criteria set forth in section 502 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2462">19 U.S.C. 2462</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H37446296DD404920AF803E6629A4B8D1"><enum>(D)</enum><text display-inline="yes-display-inline">A description of the status of regional integration efforts in sub-Saharan Africa.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB3FAEE2EB9464550875AD8562BAF96CA"><enum>(E)</enum><text display-inline="yes-display-inline">A summary of United States trade capacity building efforts.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCF5A84AEECC9418D98DB806603AA33C5"><enum>(F)</enum><text display-inline="yes-display-inline">Any other initiatives related to enhancing the trade and investment relationship between the United States and sub-Saharan African countries.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8B392FF620D440C281383A1F1323E16E"><enum>(b)</enum><header display-inline="yes-display-inline">Potential trade agreements report</header><text display-inline="yes-display-inline">Not later than December 31, 2024, and every 4 years thereafter, the United States Trade Representative shall submit to Congress a report that—</text><paragraph commented="no" display-inline="no-display-inline" id="HF1BFAF04B3F345BD8580BCD28F2FB940"><enum>(1)</enum><text display-inline="yes-display-inline">identifies sub-Saharan African countries that have a expressed an interest in entering into a free trade agreement with the United States;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H497B147A5FF34E029BC0927EE6DBD035"><enum>(2)</enum><text display-inline="yes-display-inline">evaluates the viability and progress of such sub-Saharan African countries and other sub-Saharan African countries toward entering into a free trade agreement with the United States; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H045B616E0A5742A7A5D7E67E34E8E8B1"><enum>(3)</enum><text display-inline="yes-display-inline">describes a plan for negotiating and concluding such agreements, which includes the elements described in subparagraphs (A) through (E) of section 116(b)(2).</text></paragraph></subsection><subsection id="H5482D06BD6394447B5331909F2C96A8E" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Termination</header><text display-inline="yes-display-inline">The reporting requirements of this section shall cease to have any force or effect after September 30, 2041. </text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" <external-xref legal-doc="usc" parsable-cite="usc/19/3705">19 U.S.C. 3705</external-xref> note) is repealed. </text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HDFA2EBA7E14D40E6BFB2DCFCA5E67F3C"><enum>9.</enum><header display-inline="yes-display-inline">United States International Trade Commission report on expanding articles covered by African Growth and Opportunity Act</header><subsection id="H3D3F1DD34F2544D880025D498DA6DCFB"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, the United States International Trade Commission shall submit to the appropriate congressional committees a report evaluating options for expanding the range of articles eligible for duty-free treatment under the African Growth and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3701">19 U.S.C. 3701 et seq.</external-xref>) and section 506A of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2466a">19 U.S.C. 2466a</external-xref>).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H7CC4A9C337A9406392716E3C3D32BF0B"><enum>(b)</enum><header>Hearing</header><text>The Commission shall hold a hearing to solicit public input on what articles described in subsection (a) should be considered in the report required by that subsection.</text></subsection><subsection id="H4A45468889DC4D39BE1628E66192D141"><enum>(c)</enum><header>Elements</header><text>In preparing the report required by subsection (a), the Commission shall consider—</text><paragraph id="H3A6A7B759D8342CD9A4858501A845DBB"><enum>(1)</enum><text>the extent to which duty-free treatment of articles described in that subsection could expand exportation of those articles to the United States;</text></paragraph><paragraph id="HE85E620A3ACC400094DE98C54D096E0E"><enum>(2)</enum><text>the economic effects of expanded exportation of those articles on the economy of the country exporting the articles; and</text></paragraph><paragraph id="HF50080BABC1849A8BE3B0187ECFE8DAE"><enum>(3)</enum><text>the economic effects of expanded imports of those articles on the economy of the United States.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD1BB44CB31B64A0EBE5055DDCA44D3BF"><enum>(d)</enum><header display-inline="yes-display-inline">Appropriate congressional committees defined</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text><paragraph id="H00108C78D40F408D99B2174E5D6A2743"><enum>(1)</enum><text>the Committee on Ways and Means and the Committee on Foreign Affairs of the House of Representatives;
