R. 10265</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20241129">November 29, 2024</action-date><action-desc><sponsor name-id="S001201">Mr. Suozzi</sponsor> (for himself and <cosponsor name-id="P000614">Mr. Pappas</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HHM00">Committee on Homeland Security</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the Department of Homeland Security Northern Border Mission Center, and for other purposes.</official-title></form><legis-body id="H5C391650F3514736B731A63DAA60BBCC" style="OLC"><section id="HFE40A9D0010E4442B4DE7FCF287234F0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing our Northern Border Act</short-title></quote>.</text></section><section id="H5CC56F2C529249D39AED6176E7390340"><enum>2.</enum><header>Department of homeland security northern border mission center</header><subsection id="H78A99E1AE8044624ADA7AC5E15587A7A"><enum>(a)</enum><header>Establishment</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary shall establish the Department of Homeland Security Northern Border Mission Center.</text></subsection><subsection id="H34FBA5AEBD9A48D78445F3FDC3FC1F48"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Center shall be to serve as the Department’s forward deployed centralized operations support center for domain awareness, information sharing, intelligence, training, and stakeholder engagement with Federal, State, tribal, local, and international government partners along the northern border of the United States.</text></subsection><subsection id="HE58D72EBFE4C481A93A8ADD3EC016920"><enum>(c)</enum><header>Location</header><text>The Center shall be placed along the northern border at a location that is collocated with an existing U.S. Border Patrol sector headquarters, an Air and Marine Operations branch, and a United States Coast Guard air station, and other existing Department activities.</text></subsection><subsection id="H3FAFC4E1C2084C8D9808A6437AF99593"><enum>(d)</enum><header>Components</header><paragraph id="H344D56218935428C85D6943578F563F7"><enum>(1)</enum><header>In general</header><text>The Center shall collocate personnel and activities of—</text><subparagraph id="H97CB069DA0C142B8A740CA587EE77167"><enum>(A)</enum><text>U.S. Customs and Border Protection;</text></subparagraph><subparagraph id="H75A37F187181434D801C9225F478A17B"><enum>(B)</enum><text>the United States Coast Guard;</text></subparagraph><subparagraph id="H0CF3F95A01E840C78D0537F2771FE33B"><enum>(C)</enum><text>U.S. Immigration and Customs Enforcement’s Homeland Security Investigations; and</text></subparagraph><subparagraph id="HC299866F340E434EA74A9E4DEE9FA53E"><enum>(D)</enum><text>other components and offices of the Department that the Secretary determines to be necessary, including to support the training, technology testing, and development described in subsection (e).</text></subparagraph></paragraph><paragraph id="H38730790D3B6463F8C738C8BEE1A2EB3"><enum>(2)</enum><header>Additional personnel</header><text>Additional Federal, State, tribal, local, and international government partners may be collocated as the Secretary determines to be necessary and appropriate to support the operations described in this section.</text></paragraph></subsection><subsection id="H3FBD25DDBE944A699DF9742C71DE3CBD"><enum>(e)</enum><header>Functions</header><paragraph id="HB0547B0F46B54788847F7073C0199984"><enum>(1)</enum><header>In general</header><text>The Center shall perform the functions described in this subsection in addition to any other functions assigned by the Secretary. In carrying out these functions, the Center shall support the Department’s northern border security operations.</text></paragraph><paragraph id="HF46B6A896F404D33B71A385E617345E1"><enum>(2)</enum><header>Northern border strategy</header><text>The Center, in collaboration with relevant offices and components of the Department, shall—</text><subparagraph id="H94A8B78E6C8E4E25ACF20E5576398CCF"><enum>(A)</enum><text>serve as a coordination mechanism for operational components for the implementation of the Department of Homeland Security Northern Border Strategy and any successor strategy and support appropriate offices of the Department in the evaluation and updating of the Department of Homeland Security Northern Border Strategy and any successor strategy; and</text></subparagraph><subparagraph id="HDE52D503B3B042D6B0A9300BE1A8C937"><enum>(B)</enum><text>support the development of best practices and policies for personnel at the northern border to support such implementation.</text></subparagraph></paragraph><paragraph id="H4BC7010039354846BFAE477CFC84BB18"><enum>(3)</enum><header>Training</header><text>The Center shall serve as a training location to support the delivery of training or exercises for Department personnel and Federal, State, tribal, local, and international government partners.</text></paragraph><paragraph id="HECD91727F04E4283A678FA2BDFAC76EC"><enum>(4)</enum><header>Resource and technological needs and challenges</header><text>The Center, in collaboration with relevant offices and components of the Department, shall—</text><subparagraph id="H7A91CA48B1914290AC1E54E6C24C314B"><enum>(A)</enum><text>identify resource and technological needs or challenges affecting security along the northern border; and</text></subparagraph><subparagraph id="H5B9F659C2FFD4376A3E36AA6BE039D0A"><enum>(B)</enum><text>serve as a testing ground and demonstration location for the testing of border security technology, including determining such technology’s suitability and performance in the northern border and maritime environments.</text></subparagraph></paragraph><paragraph id="H78D216E6FEF645A58258DBF37DB59588"><enum>(5)</enum><header>Air and marine operations</header><subparagraph id="HD89E27CA32664911B7135EE2543C8582"><enum>(A)</enum><header>Quick reaction capabilities</header><text>In support of the Center, U.S. Customs and Border Protection’s Air and Marine Operations shall establish and maintain capability that is collocated with the Center and available for quick deployment in support of the northern border missions, U.S. Customs and Border Protection, and the Department, including missions in the Great Lakes region.</text></subparagraph><subparagraph id="H6B316905031A4283867C49B08B37FD14"><enum>(B)</enum><header>Northern border domain awareness</header><text>In order to coordinate with the Center and support its operations, the Air and Marine Operations Center shall collocate personnel and resources with the Center to enhance the Department’s capabilities to—</text><clause id="HEA686120B1C4449DA08B212BBECA66FE"><enum>(i)</enum><text>support air and maritime domain awareness and information sharing efforts along the northern border;</text></clause><clause id="HBFB769B548D94A9CAABF7C4D29FFD6B1"><enum>(ii)</enum><text>provide dedicated monitoring of northern border systems; and</text></clause><clause id="HA65C1C5F633840DF96036E5E52E5DA23"><enum>(iii)</enum><text>lead, in coordination with other U.S. Customs and Border Protection components, Federal, State, tribal, local, and international governments, and private sector partners, the Center’s efforts to track and monitor legitimate cross-border traffic involving unmanned aircraft and unmanned aircraft systems.</text></clause></subparagraph></paragraph><paragraph id="H14F15F6DD71942CD87072F06CC5A3C4C"><enum>(6)</enum><header>Counter-unmanned aircraft systems</header><subparagraph id="H94396B25BE7E4CA1B3C9E2F0F0860E04"><enum>(A)</enum><header>In general</header><text>Pursuant to policies established by the Secretary, consistent with section 210G of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/124n">6 U.S.C. 124n</external-xref>), the Center shall support counter-unmanned aircraft systems operations along the northern border to respond to the increased use of unmanned aircraft systems.</text></subparagraph><subparagraph id="H803EA44E90CF4F74B9C5609255738412"><enum>(B)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to provide additional authority related to detection, mitigation, research, development, or testing of unmanned aircraft systems or counter-unmanned aircraft systems.</text></subparagraph></paragraph><paragraph id="HBF059CC160F8438794819EF4D91A7724"><enum>(7)</enum><header>Privacy and civil rights</header><text>The Center, in collaboration with the Chief Privacy Officer and the Office for Civil Rights and Civil Liberties of the Department, shall ensure that operations and practices of the Center comply with the privacy and civil rights policies of the Department and its components, and as necessary, ensure there are resources or personnel available to support the Center’s mission onsite.</text></paragraph><paragraph id="H232035C1E31347E5BD56D5BC3C63EABA"><enum>(8)</enum><header>Noncontiguous northern border</header><text>The Center, in collaboration with relevant offices and components of the Department, shall identify the specific challenges that exist along the noncontiguous international land border with Canada and the maritime border with Russia, including resource, technological challenges, and domain awareness.</text></paragraph></subsection><subsection id="H0C633787402B4878B2CBA564350E84D2"><enum>(f)</enum><header>Annual reporting</header><text>Not later than 180 days after the establishment of the Center, and annually thereafter, the Secretary shall submit a report, that may include a classified annex or a sensitive but unclassified annex, to the Committee on Homeland Security and Governmental Affairs of the Senate, the Committee on Foreign Relations of the Senate, the Committee on Commerce, Science, and Transportation of the Senate, the Committee on Homeland Security of the House of Representatives, the Committee on Foreign Affairs of the House of Representatives, and the Committee on Transportation and Infrastructure of the House of Representatives that describes the activities of the Center during the most recently concluded fiscal year, including—</text><paragraph id="H86336A02BDC5421D9B9B3332D0C05171"><enum>(1)</enum><text>personnel levels;</text></paragraph><paragraph id="H01C4B1B07A754B2BA25DCE3074555BA2"><enum>(2)</enum><text>additional resources that are needed to support the operations of the Center and northern border operations of the Department; and</text></paragraph><paragraph id="HAF217EDCBD3E4740B74606C76AF3F86A"><enum>(3)</enum><text>any additional assets or authorities that are needed to increase security and domain awareness along the northern border.</text></paragraph></subsection><subsection id="H05002129B4F2482682C3951D13EEDD2E"><enum>(g)</enum><header>Temporary duty assignments</header><text>The Secretary shall submit a quarterly report to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives regarding temporary duty assignments of U.S. Border Patrol agents during the reporting period, including—</text><paragraph id="H4F2E2D25F23F42498C715C2969BE5221"><enum>(1)</enum><text>the number of agents on temporary duty assignment;</text></paragraph><paragraph id="H8204FE71EA07432B848EF6C974436EFF"><enum>(2)</enum><text>the duration of the temporary duty assignment;</text></paragraph><paragraph id="HE7E5E911E682472EB9537C9D6C58C1D3"><enum>(3)</enum><text>the sectors from which the agents were assigned; and</text></paragraph><paragraph id="H50517824B7E44E249961869914157CB5"><enum>(4)</enum><text>the sectors to which the agents were assigned.</text></paragraph></subsection><subsection id="H51B5323C5A17498FA98DB28F5FAF7879"><enum>(h)</enum><header>Report on large unmanned aircraft systems operations</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary of Homeland Security shall submit a report to the Committee on Homeland Security and Governmental Affairs of the Senate, the Committee on Commerce, Science, and Transportation of the Senate, the Committee on Homeland Security of the House of Representatives, and the Committee on Transportation and Infrastructure of the House of Representatives on the Department’s operation of large unmanned aircraft systems. The report shall include information on existing large unmanned aircraft systems, as well as recommendations on how to enable the operations of large unmanned aircraft systems based at the Center established pursuant to subsection (a) of this section.</text></subsection><subsection id="H41F39EB43CFE4198BC9F875D3DD13335"><enum>(i)</enum><header>Rules of construction</header><paragraph id="H17451D5CE186402E9BC2C0AF2482A8B3"><enum>(1)</enum><header>Authority to establish center</header><text>The Center established pursuant to subsection (a) shall be established separate and distinct from the Secretary’s authorities under section 708 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/348">6 U.S.C. 348</external-xref>).</text></paragraph><paragraph id="H934DDBCE8086482183D70C1E9125C2A9"><enum>(2)</enum><header>Commandant authority</header><text>Nothing in this section shall be construed to affect, impinge, or alter any authority of the Commandant of the Coast Guard under title 14 or title 46, United States Code, or limit the Commandant’s discretion and ability to deploy Coast Guard assets and personnel.</text></paragraph></subsection><subsection id="H8270DB3698A04561AA451A30EC01D0A7"><enum>(j)</enum><header>Sunset</header><text>This section shall cease to be effective beginning on October 1, 2027.</text></subsection><subsection id="HE3D0C1D2419348188DE433ECF1366DA9"><enum>(k)</enum><header>No additional funds</header><text>No additional funds are authorized to be appropriated for the purpose of carrying out this section.</text></subsection><subsection id="HA741E9D233B04144BC6D19FB42F84A30"><enum>(l)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H6441F28802474972A8D375B0B68D5CED"><enum>(1)</enum><header>Center</header><text>The term <quote>Center</quote> means the Department of Homeland Security Northern Border Mission Center established pursuant to subsection (a).</text></paragraph><paragraph id="H565DC8E7739543B6A29E65EDE574E4EB"><enum>(2)</enum><header>Department</header><text>The term <quote>Department</quote> means the Department of Homeland Security.</text></paragraph><paragraph id="H154743BC955841A9838DE3E83901717C"><enum>(3)</enum><header>Northern border</header><text>The term <quote>northern border</quote> means—</text><subparagraph id="H11CE72D182774D3EA17F25E7C6ADADC3"><enum>(A)</enum><text>the international border between the United States and Canada; and</text></subparagraph><subparagraph id="H760D815BFDB94889A0437E779D23C547"><enum>(B)</enum><text>the maritime border between Alaska and the Russian Federation.</text></subparagraph></paragraph><paragraph id="HD18EC39372AF41ADB0984CDBDB3CFF99"><enum>(4)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Homeland Security.</text></paragraph></subsection></section></legis-body></bill>
